This book engages with what are widely recognized as the two core
dimensions of emotion. When we are afraid, glad or disappointed, we
feel a certain way; moreover, our emotion is intentional or
directed at something: we are afraid of something, glad or
disappointed about something. Connecting with a vital strand of
recent philosophical thinking, Muller conceives of these two
aspects of emotion as unified. Examining different possible ways of
developing the view that the feeling dimension of emotion is itself
intentional, he argues against the currently popular view that it
is a form of perception-like receptivity to value. Muller instead
proposes that emotional feeling is a specific type of response to
value, an affective 'position-taking'. This alternative conceives
of emotional feeling as intimately related to our cares and
concerns. While situating itself within the analytic-philosophical
debate on emotion, the discussion crucially draws on ideas from the
early phenomenological tradition and thinks past the theoretical
strictures of many contemporary approaches to this subject. The
result is an innovative view of emotional feeling as a thoroughly
personal form of engagement with value.
Der Autor nimmt die in letzter Zeit gestiegene Beliebtheit der
Societas Europaea (SE) zum Anlass, die Innenhaftung des
Verwaltungsrats einer SE fur die Falle zu untersuchen, in denen man
sich in Abkehr zu dem in Deutschland vorherrschenden dualistischen
Organisationsmodell (Vorstand/Aufsichtsrat) fur eine monistische
Ausgestaltung durch Einsetzung eines einheitlichen Verwaltungsrats
entschlossen hat. Dabei geht er durch einen rechtsvergleichenden
Blick auf das U.S.-amerikanische Recht der Frage nach, ob und in
welchem Ausmass das System der deutschen, dualistisch gepragten
Organhaftung auf die Mitglieder des Verwaltungsrats in der
monistisch verfassten SE ubertragen werden kann.

set-up of the music industry. By analyzing studies and data, the
paper illustrates several challenges that influenced record sales.
Considering the different type of players in the music industry -
record labels, online and physical retailers, and artists - this
paper will only discuss the challenges and effects of the
digitalization on the major record labels. The challenges of
digitalization for artists will not be covered in this paper;
digital music actually enhances the chance of being discovered and
for reaching a larger audience (Ankeny 2012). In this sense, the
digitalization is an opportunity, rather than a challenge for
artists. This also applies for online retailers such as iTunes and
Amazon. Since digital music does not require physical storage,
online retailers can offer music at almost zero costs. Thus, online
retailers benefit from the digitalization of music. Physical
retailers presumably lose revenue because of the digitalization of
music. However, their situation will not be discussed further, in
this paper. The major record labels are highly vertically
integrated (Neff and Blomer 2003, p. 104). Besides managing
artists, the recording companies are also in charge of the
publishing and copyrights of music. Additionally, they have
enormous production resources and strong distribution networks.
This gives the major record labels a significant competitive
advantage. However, this advantage was partly ruined by the
