Die Medienrezeption von kontroversen Gerichtsurteilen zeigt eine Mischung aus Missverstandnissen und polemischen Zuspitzungen, berechtigter Kritik und uberzogener Richterschelte. Diese Arbeit analysiert Art, Ausmass, mogliche Grunde und politische bzw. demokratietheoretische Bedeutung dieser "Verstandnisschwierigkeiten." Im theoretischen Teil werden Modelle der gesellschaftlichen Rechtskommunikation aus Diskurs- und Systemtheorie, Pluralismus- und Verfassungstheorie entwickelt und ihre derzeitige Basis im deutschen Gerichtsverfahrensrecht uberpruft. Im zweiten, empirischen Teil untersucht der Autor anhand von 15 Fallen (darunter der "Memminger Abtreibungsprozess") Art und Ausmass der Verstandigungsprobleme. Im dritten und letzten Teil wird aus den vorliegenden Ergebnissen eine neue Theorie der Rechtskommunikation entwickelt."
