The Least Dangerous Branch? - Consequences of Judicial Activism (Hardcover): Stephen P. Powers, Stanley Rothman The Least Dangerous Branch? - Consequences of Judicial Activism (Hardcover)
Stephen P. Powers, Stanley Rothman
R2,822 Discovery Miles 28 220 Ships in 10 - 15 working days

Is the American judiciary still the least dangerous branch, as Alexander Hamilton and legal scholar Alexander Bickel characterized it? Unlike legislatures or administrative agencies, courts do not make policy so much as direct and redirect policy as it is implemented. The judicial contribution to policymaking involves the infusion of constitutional rights into the realm of public policy, and as the government has grown, the courts have become more powerful from doing more and more of this. Powers and Rothman explore the impact of the federal courts, providing a brief account of the development of constitutional law and an overview of the judiciary's impact in six controversial areas of public policy.

Busing

Affirmative action

Prison reform

Mental health reform

Procedural reforms in law enforcement

Electoral redistricting

In each of these areas, the authors review significant cases that bear on the particular policy, exploring the social science evidence to assess the impact of the courts on policies--and the consequences of that intervention. Powers and Rothman conclude that judicial intervention in public policy has often brought about undesirable consequences, sometimes even for the intended beneficiaries of government intervention.

The Apocalypse in Ireland - Prophecy and Politics in the 1820s (Hardcover, New edition): Thomas P. Power The Apocalypse in Ireland - Prophecy and Politics in the 1820s (Hardcover, New edition)
Thomas P. Power
R1,762 Discovery Miles 17 620 Ships in 12 - 17 working days

"Power reconstructs the extraordinary popular agitation that took hold in the Irish countryside in the decade after Waterloo when "Pastorini's prophecies" foretold the imminent collapse of Protestantism. The electrifying effects of this agitation affected both the drive for Catholic Emancipation and the local strength of Protestantism in much of the country. Power takes command of this extraordinary story, which challenges assumptions about the modernization of nineteenth-century Ireland." (David Dickson, Professor Emeritus of Modern History, Trinity College Dublin, Ireland) "The Apocalypse in Ireland: Prophecy and Politics in the 1820s is a tough-minded, archivally-rich, and admirably original examination of a phenomenon rarely discussed in Irish studies: the biblically-based prophetics that ran rampant in the Catholic population in the two generations between the early 1770s and the late1820s. These are associated with the figure of "Signior Pastorini" (Bishop Charles Walmesley) who read the Apocalypse of St. John in a distinctly anti-Protestant fashion. Dr Thomas Power convincingly documents the immediate depth of these sectarian etchings upon the Irish Catholic polity and suggests the possible long-term impact of their underlying sanguinary agenda." (Professor Donald Akenson, Queen's University, Canada) A commentary on the Book of Revelation entitled A General History of the Christian Church (1771), written by an English Catholic bishop contained a prophecy that predicted the destruction of Protestantism in 1825. Summarized in a broadsheet and widely disseminated in Ireland, the prophecy drew on a receptivity in Irish popular culture to apocalyptic change. Reinforced by folk religion, poetry and ballad, the prophecy generated high expectations among Irish Catholics that a complete overthrow of the social and political order was imminent. The prophecy was appropriated by the Rockite agrarian movement of the early 1820s to give potency and legitimation to traditional grievances. The vacuum created by the demise of the agrarian movement was filled by the Catholic Association and Daniel O'Connell who utilized the prophecy for the attainment of Catholic emancipation in 1829. Dissemination of the prophecy resulted in a rise in sectarianism and contributed to an exodus from Ireland of large numbers of Protestants thereby creating an Irish spiritual diaspora particularly in British North America. This book reveals how a misinterpretation of the passages from Revelation heightened sectarian fervour that left a lasting legacy.

Over the last decade our view of chemistry has evolved substantially. Whereas individual researchers previously focused on specific areas of chemistry, such as inorganic, organic, etc. we now take a more holistic approach. Effective and efficient research projects now incorporate whatever aspects of the chemistry subdisciplines that are needed to complete the intended work. The main group elements have always been used in this manner. Depending on the use of the elements, the resulting work can be described under any heading of chemistry. The group 13 elements have been special in this regard due to the very unique characters of the constituent elements. Thus, there is a dramatic change in the properties of the elements when proceeding through the series, B, A1, Ga, In, T1. This difference is one of the main reasons why these elements have seen, and continue to see, such widespread usage in such disparate applications as organic synthesis, electronic and structural materials, and catalysis, to name but a few.

American motion pictures still dominate the world market with an impact that is difficult to measure. Their role in American culture has been a powerful one since the 1930s and is a hallmark of our culture today. Though much has been written about the film industry, there has been very little systematic attention paid to the ideology of its creative elite. How does the outlook of that elite impact on the portrayals of America that appear on the screen? How do their views interact with the demands of the market and the structure of the industry to determine the product that is seen by mass audiences?"Hollywood's America" is a marvelously rich and careful discussion of these questions. It combines a meticulous systematic content analysis of fifty years of top-grossing films with a history of the changing structure of the industry. To that mixture it adds an in-depth survey of Hollywood's creative elite, comparing them to other leadership groups. The result is a balanced discussion of unique breadth and depth on a subject of national importance.Placing the film industry in the context of American society as a whole, the authors point out that Hollywood's creative leadership impacts the larger society even as it is influenced by that society. The creators of films cannot remove themselves too far from the values of the audiences that they serve. However, the fact that films are made by a relatively small number of people, who, as the authors demonstrate, tend to share a common outlook, means that, over time, motion pictures have had an undeniable impact on the beliefs, lifestyles, and action of Americans. This study contributes to the debate over the role and influence of those who create and distribute the products of mass culture in the United States. The book also contains a devastating critique of the poststructuralist theories that currently dominate academic film criticism, demonstrating how they fail in their attempt to explain the political significance of motion pictures.

This is a scholarly new study of Ireland during the eighteenth century. It is the first full-scale examination of an entire Irish county for the period, and is based on extensive and meticulous research. In it, Thomas P. Power sets out to reconstruct in detail the economic, social, and political history of Tipperary, Ireland's largest inland county. The examines the growing commercialization of the local economy, the changing composition of landed society, the dynamics of land tenure, sectarian tension, and the emergence of long-term rural unrest. In addition, he devotes a chapter to the revolutionary decade of the 1790s. By testing at local level the relevance of generalizations made for Ireland as a whole, the book makes a valuable contribution to current debates on the nature of Irish social and economic development in this period.

Forcibly Without Her Consent - Abductions in Ireland, 1700-1850 (Paperback): Thomas P. Power Forcibly Without Her Consent - Abductions in Ireland, 1700-1850 (Paperback)

Why do men abduct women? Are their motives sexual, economic, or social? How crucial is the use of violence? How important is the participation of others? What are the societal consequences of abduction?

Answers to these questions can usefully be found in a historical case study of abductions as they occurred in Ireland between 1700 and 1850.

"Forcibly Without Her Consent" describes in detail how abduction was a largely communally-sanctioned exercise in male violence against women, how it depended for success on a well established ritual, how it eluded suppression by the forces of law and order, and how it impacted class structure, marriage, and patterns of rural unrest.

In fascinating detail, Thomas Power uncovers the causes and implications of abduction. Reading this book will give you a deep insight into the social origins of abduction.

Few visitors to the stunning Frijoles Canyon at Bandelier National Monument realize that its depths embrace but a small part of the archaeological richness of the vast Pajarito Plateau west of Santa Fe, New Mexico. In this beautifully illustrated book, archaeologists, historians, ecologists, and Pueblo contributors tell a deep and sweeping story of the region. Beginning with its first Paleo-Indian residents, through its Ancestral Pueblo florescence in the 14th and 15th centuries, to its role in the birth of American archaeology and the nuclear age, and concluding with its enduring centrality in the lives of Keresan and Tewa Indian peoples today, the plateau remains a place where the mysterious interplay of human culture and magnificent landscapes is written in its mesas and canyons. A must read for anyone interested in Southwestern archaeology and Native peoples.
