Research Handbook on Feminist Jurisprudence (Hardcover): Robin West, Cynthia G. Bowman Research Handbook on Feminist Jurisprudence (Hardcover)
Robin West, Cynthia G. Bowman
R6,567 Discovery Miles 65 670 Ships in 10 - 15 working days

The Research Handbook on Feminist Jurisprudence surveys feminist theoretical understandings of law, including liberal and radical feminism, as well as socialist, relational, intersectional, post-modern, and pro-sex and queer feminist legal theories. Featuring contributions from a diverse team of prominent scholars, this Research Handbook illuminates the ways in which feminist scholarship has enriched understandings of law's sometimes subordinating structures and the ways in which law can be interpreted or changed so as to promote the equality, liberty, wellbeing, and interests of women. The expert contributors offer a vast range of feminist perspectives on law, including liberal, radical, and post-modern feminism, and explore the implications of these theoretical stances for understandings of the nature of law, legal change, and the relationship between law and politics. Chapters analyse the influence of feminist legal theories on doctrinal areas of law including US constitutional and civil rights law, international law, and various areas of private law. This insightful book will be of interest to law students, legal scholars, and scholars of political and moral philosophy seeking to understand the entire body of feminist legal scholarship from the early 1970s to the present, as well as its variants, and relationships among different theoretical perspectives. Contributors include: S.F. Appleton, K.K. Baker, I. Caglar, M. Chamallas, C.-j. Chen, M.A. Fineman, M.A. Franks, C. Grant Bowman, B.A. Gur, N.D. Hunter, L.C. Ikemoto, O. Kamir, H. Keren, S.A. Law, N. Menon, N. Naffine, J.A. Nice, V.F. Nourse, N. Rimalt, D.E. Roberts, L.A. Rosenbury, J.C. Suk, D. Tuerkheimer, R. West, A.K. Wing, K.A. Yuracko

Caring for Justice (Paperback, New Ed): Robin West Caring for Justice (Paperback, New Ed)
Robin West
R755 Discovery Miles 7 550 Ships in 10 - 15 working days

"Starkly essentialist reasoning sounds almost quaint by today's standards of gender equality. So it is with some surprise that general readers will encounter an intense and carefully reasoned defense of essentialism from the pen of one of America's best-known feminist legal theorists."
--"Women's Review of Books"

"By critiquing traditional ideas about 'justice, ' including economic theories about value, this provocative feminist jurisprudential scholar advances what she calls an 'ethic of care' and argues that 'if adjudication is to be just, then the goal of good judging must be both justice and care.'"
--"Georgia Bar Journal"

Over the past decade, mainstream feminist theory has repeatedly and urgently cautioned against arguments which assert the existence of fundamental--or essential--differences between men and women. Any biological or natural differences between the sexes are often flatly denied, on the grounds that such an acknowledgment will impede women's claims to equal treatment.

In "Caring for Justice," Robin West turns her sensitive, measured eye to the consequences of this widespread refusal to consider how women's lived experiences and perspectives may differ from those of men. Her work calls attention to two critical areas in which an inadequate recognition of women's distinctive experiences has failed jurisprudence. We are in desperate need, she contends, both of a theory of justice which incorporates women's distinctive moral voice on the meaning of justice into our discourse, and of a theory of harm which better acknowledges, compensates, and seeks to prevent the various harms which women, disproportionately and distinctively, suffer.

Providing afresh feminist perspective on traditional jurisprudence, West examines such issues as the nature of justice, the concept of harm, economic theories of value, and the utility of constitutional discourse. She illuminates the adverse repercussions of the anti-essentialist position for jurisprudence, and offers strategies for correcting them. Far from espousing a return to essentialism, West argues an anti- anti-essentialism, which greatly refines our understanding of the similarities and differences between women and men.

In Search of Common Ground on Abortion - From Culture War to Reproductive Justice (Hardcover, New Ed): Robin West, Justin... In Search of Common Ground on Abortion - From Culture War to Reproductive Justice (Hardcover, New Ed)
Robin West, Justin Murray, Meredith Esser
R4,352 Discovery Miles 43 520 Ships in 10 - 15 working days

This book brings together academics, legal practitioners and activists with a wide range of pro-choice, pro-life and other views to explore the possibilities for cultural, philosophical, moral and political common ground on the subjects of abortion and reproductive justice more generally. It aims to rethink polarized positions on sexuality, morality, religion and law, in relation to abortion, as a way of laying the groundwork for productive and collaborative dialogue. Edited by a leading figure on gender issues and emerging voices in the quest for reproductive justice - a broad concept that encompasses the interests of men, women and children alike - the contributions both search for 'common ground' between opposing positions in our struggles around abortion, and seek to bring balance to these contentious debates. The book will be valuable to anyone interested in law and society, gender and religious studies and philosophy and theory of law.

Marriage, Sexuality, and Gender (Paperback): Robin West Marriage, Sexuality, and Gender (Paperback)
Robin West
R1,588 Discovery Miles 15 880 Ships in 10 - 15 working days

"Marriage, Sexuality, and Gender" examines contemporary debates about the meaning and value of civil marriage. The book analyzes arguments for traditional marriage, including those of neonaturalists, utilitarians, and communitarians or virtue theorists. The volume also considers a range of feminist, welfarist, and liberationist arguments for ending the institution altogether. It evaluates two major reform movements: one focused on expanding marriage to include same-sex couples and the other focused on the use of law to render marriage more internally just. The book concludes with a plea to activists to redirect marriage equality movements toward the creation of an entirely secular civil union law that would respect a broader range of private life-long commitments, including but not limited to same- and opposite-sex couples, without threatening the role of religious marriage in the lives of those who embrace it and without penalizing nonparticipants.

Nussbaum and Law (Hardcover, New Ed): Robin West Nussbaum and Law (Hardcover, New Ed)
Robin West
R9,346 Discovery Miles 93 460 Ships in 10 - 15 working days

The essays collected in this volume reflect the profound impact of Martha Nussbaum's philosophical writings on law and legal scholarship. The capabilities approach that she has largely authored has influenced the approach scholars take to the law of disabilities, both in the United States and in Canada, as well as to international human rights and to domestic private law's protections of vulnerable populations. Her analyses of the relationship between our emotions and our thought and action has triggered a re-assessment of the legal regulation and recognition of emotion in a range of fields, most particularly in the field of criminal law; and her writing on the nature of dignity has informed an understanding of the emerging civil rights of gay and lesbian citizens worldwide. Our appreciation of the role of narrative in legal thought and discourse and the contributions of literature to law and legal culture, have also been broadened and deepened by her contributions. Taken together, and including the introduction by the editor, the essays collected in this volume demonstrate the far-reaching impact of Nussbaum's philosophical oeuvre.

Rights (Hardcover, Rev Ed): Robin West Rights (Hardcover, Rev Ed)
Robin West
R9,355 Discovery Miles 93 550 Ships in 10 - 15 working days

Rights brings together the most influential essays of the last thirty years critiquing and defending the liberal rights tradition. Modern 'rights critics' have focused on the perceived conflict between liberal rights and progressive or egalitarian political objectives, the preference of liberal states for negative over positive rights and also the dangers to community of the overly atomistic conception of human nature, which is arguably at the heart of the liberal rights tradition.

Normative Jurisprudence - An Introduction (Paperback): Robin West Normative Jurisprudence - An Introduction (Paperback)
Robin West
R875 Discovery Miles 8 750 Ships in 10 - 15 working days

Normative Jurisprudence aims to reinvigorate normative legal scholarship that both criticizes positive law and suggests reforms for it, on the basis of stated moral values and legalistic ideals. It looks sequentially and in detail at the three major traditions in jurisprudence - natural law, legal positivism and critical legal studies - that have in the past provided philosophical foundations for just such normative scholarship. Over the last fifty years or so, all of these traditions, although for different reasons, have taken a number of different turns - toward empirical analysis, conceptual analysis or Foucaultian critique - and away from straightforward normative criticism. As a result, normative legal scholarship - scholarship that is aimed at criticism and reform - is now lacking a foundation in jurisprudential thought. The book criticizes those developments and suggests a return, albeit with different and in many ways larger challenges, to this traditional understanding of the purpose of legal scholarship.
