Gemeint sind hiermit, grob beschrieben, Leistungen wie die Wasserversorgung oder der offentliche Personennahverkehr (OPNV), welche in Deutschland traditionell die Kommunen den Burgern bereitstellen und so einen immensen Beitrag zum Allgemeinwohl leisten. Uberwiegend werden diese Leistungen durch kommunale Unternehmen, sei es in offentlich-rechtlicher Form, in Privatrechtsform oder in gemischtwirtschaftlicher Form, erbracht. Daseinsvorsorgeleistungen gelten allgemein als der substanziellen Kernbestand der kommunalen Selbstverwaltung, welche den deutschen Kommunen durch Art. 28 Abs. 2 GG ausdrucklich zugesichert wird. Der fortschreitende Prozess der europaischen Integration wirkt jedoch in vielfaltiger Weise immer starker auf die kommunale Selbstverwaltung und die kommunale Daseinsvorsor-ge einschliesslich ihrer Wahrnehmung durch kommunale Unternehmen rechtlich und tat-sachlich ein.
