In the midst of the realist-leaning artistic climate of the Late
Gothic and Early Renaissance, Netherlandish painter Hieronymus
Bosch (c. 1450-1516) was more than an anomaly. Bosch's paintings
are populated with grotesque scenes of fantastical creatures
succumbing to all manner of human desire, fantasy, and angst. One
of his greatest inventions was to take the figural and scenic
representations known as drolleries, which use the monstrous and
the grotesque to illustrate sin and evil, and to transfer them from
the marginalia of illuminated manuscripts into large-format panel
paintings. Alongside traditional hybrids of man and beast, such as
centaurs, and mythological creatures such as unicorns, devils,
dragons, and griffins, we also encounter countless mixed creatures
freely invented by the artist. Many subsidiary scenes illustrate
proverbs and figures of speech in common use in Bosch's day. In his
Temptation of St Anthony triptych, for example, the artist shows a
messenger devil wearing ice skates, evoking the popular expression
that the world was "skating on ice"-meaning it had gone astray. In
his pictorial translation of proverbs, in particular, Bosch was
very much an innovator. Bosch-whose real name was Jheronimus van
Aken-was widely copied and imitated: the number of surviving works
by Bosch's followers exceeds the master's own production by more

How come we ought to do things? Current metanormative debates often
suffer from the fact that authors implicitly use adequacy
conditions not shared by their opponents. This leads to an
unsatisfying dialectical gridlock (Chang): One author accuses her
opponents of not being able to account for stuff she judges
essential, but the opponents do not think this to be a major flaw.
In an attempt to meet the problem of gridlock head-on, the current
investigation approaches oughtness differently. I start with the
introduction of a grounding framework for thinking about oughtness
that allows a lucid presentation of the views on the market. It
soon becomes clear that one necessary part of any plausible
assessment of accounts of oughtness is a discussion of their
adequacy conditions. I continue with a detailed evaluation of four
different accounts, as presented by Halbig (2007), Schroeder
(2007), Stemmer (2006), and Scanlon (2014). My main result is that
desire-based or Humean theories of oughtness are more plausible
because desire-independent accounts fail to explain something
crucial: the for-me character of oughtness. Based on the insights
gathered thus far, I then develop a new Humean theory - metaethical
conativism - and defend it against some historically influential
objections.

Es ist zum Allgemeinplatz geworden in einer Untersuchung des
sogenannten Gartens der Luste von Hieronymus Bosch (ca.1450-1516)
zu betonen, dass dieses Triptychon das grosste und beruhmteste, das
bedeutendste und schwierigste Werk im etwa 23 Gemalde umfassenden
Oeuvre dieses Malers sei. Der Garten der Luste nimmt als Hauptwerk
Boschs und als die umstrittenste Innovation in seinem Oeuvre eine
Schlusselrolle ein. Weil es das haufigste Ziel von Untersuchungen
und Interpretationsversuchen geworden ist, liefert es das
geeignetste Material um die Ansatze und Methoden der
kunsthistorischen Forschung auch auf dem Hintergrund des Phanomens
Bosch' darzustellen und daraus Erkenntnisse fur den Umgang mit
anderen Werken Boschs zu erhalten. Die Arbeit gibt einen Uberblick

"Luhmanns Theorie ist Magie. Sie jongliert mit einem kleinen, genau
bestimmten Satz von Grundbegriffen - wie Sinn, System, Umwelt,
Kommunikation - und bietet eine scharfe und eiskalte Sicht der
modernen Gesellschaft." Ein Zitat aus einem Nachruf zum im November
1998 verstorbenen Soziologen Niklas Luhmann, das kurz und pragnant
seine Betrachtungsweise darstellt. Ebenso nuchtern betrachtete
Luhmann in seinem 1981 erschienenen 'Politische Theorie im
Wohlfahrtsstaat' den Wohlfahrtsstaat, wobei er sich auch nicht mit
Kritik zuruckhalt. Dabei ist Luhmanns Kritik selbst nicht frei von
Kritik. So sagt Lutz Leisering, Professor der Sozialpolitik an der
Universitat Bielefeld: "Luhmanns Wohlfahrtsstaatskritik ist
dezidiert immanent." Und Leisering ist nicht der einzige Soziologe,
der Luhmanns Kritik als ein Produkt seiner Systemtheorie
bezeichnet. Doch ist Luhmanns Kritik nur mit Hilfe der
Systemtheorie zu erklaren? Daraus ergibt sich die Kernfrage dieser
Arbeit: ist Luhmanns Kritik am Wohlfahrtsstaat gerechtfertigt? Der
Begriff des Wohlfahrtsstaates zieht sich wie ein roter Faden durch
diese Arbeit, deshalb muss an dieser Steller gesagt sein, dass sich
dieser Begriff im weiteren Verlauf der Arbeit an der
Klassifizierung nach Gosta Esping-Andersen orientiert.
Esping-Andersen unterscheidet drei Grundtypen, den liberalen, den
konservativen und den sozialdemokratischen Wohlfahrtsstaat. Der
liberale Wohlfahrtsstaat ist durch relativ geringe soziale
Sicherheit durch die Politik, aber Rechtssicherheit am Markt
gekennzeichnet. Der konservative Wohlfahrtsstaat dagegen bietet
mehr soziale Sicherheit durch Pflichtversicherungen, und der
sozialdemokratische Wohlfahrtsstaat bindet eine starkere soziale
Sicherheit an das Burgerre

Abstract: Nahezu alle Verfassungsgerichte der liberalen Demokratien
sind in diesen zentrale Akteure. Sie sollen die demokratischen
Strukturen und Institutionen, auch gegen den Parlamentswillen,
schutzen. Demzufolge sind die Richter an den obersten Gerichten
liberaler Demokratien auch Huter der Verfassung. Doch sind die
Verfassungsgerichte wirklich so unabhangig wie sei sein sollten
oder gibt es eine Politisierung festzustellen? Die vorliegende
Arbeit untersucht die richterlichen Berufungsverfahren der
Verfassungsgerichte hinsichtlich einer moglichen Politisierung und
daraus resultierenden Gefahrdung der Unabhangigkeit. Der
Schwerpunkt liegt dabei auf den verfassungsmassigen und rechtlich
gegebenen Regelungen. Dazu werden die Berufungsverfahren der beiden
Staaten USA und BRD genauer betrachtet. Die USA, da diese eine der
machtigsten und politisch einflussreichsten Demokratien der Welt
ist. Die BRD, da diese eine neue, nicht ausschliesslich auf den
finanziellen Sektor beschrankte, europaische Zivilmacht darstellt.
Ein weiteres Argument fur diese Fallauswahl ergibt sich aus den
beiden unterschiedlichen Typen der Verfassungsgerichtsbarkeit. Der
amerikanische Supreme Court kann der diffusen
Verfassungsgerichtsbarkeit zugeordnet werden, dieser diente sogar
als Vorbild dieses Typus. Das deutsche Bundesverfassungsgericht
hingegen kann dem Typus der spezialisierten
Verfassungsgerichtsbarkeit zugeordnet werden. Der pragnantesten
Unterschied dieser beiden Typen ist die institutionelle
Selbststandigkeit des Bundesverfassungsgerichts gegenuber dem
Supreme Court. Ein weiteres wichtiges Unterscheidungsmerkmal stellt
die Normenkontrolle dar, in der diffusen Verfassungsgerichtsbarkeit
ist lediglich eine diffuse Normenkontrolle
Diese Festschrift ehrt den Alttestamentler James Alfred Loader,
der, von der Universität von Pretoria und der UNISA herkommend,
seit 1997 an der Universität Wien lehrt. Weisheit und Schöpfung
