Steinberger ist der Thematik nicht nur durch seine friihere Tiitigkeit als Bundesverfassungsrichter verbunden, sondern er hat sich urn die Verfassungsrechtsentwicklung in Mittel- und Osteuropa in den letztenJahren besonders im Rahmen der Arbeiten der Venedig-Kom- mission des Europarats verdient gemacht. An dem KoUoquium nahmen fuhrende Verfassungsrechtler aus Deutschland und den mittel- und ost- europiiischen Staat en teil, darunter die Priisidenten einiger mittel- und osteuropaischer Verfassungsgerichte sowie mehrere Mitglieder des Bun- desverfassungsgerichts. Vor dem Hintergrund des rasanten politischen und wirtschaftlichen Wandels seit dem groBen Umbruch der Jahre 1989/1990 war es Ziel des KoUoquiums, eine erste Zwischenbilanz des verfassungsrechtlichen Transformationsprozesses in Mittel-und Osteuropa zu ziehen. Gleichzei- tig soUte untersucht werden, in welch em AusmaB die verfassungsgericht- liche Praxis in den neuen Demokratien durch die Rechtsprechung des Bundesverfassungsgerichts beeinfluBt worden ist und wo sie eigene Wege gegangen ist. In diesem Rahmen wurden mehrere Schwerpunktthemen be- handelt (Rechtsstaatsprinzip, Grundrechte, verfassungsprozessuale Fra- gen sowie Staatsrecht und internationale Beziehungen), die jeweils Gegen- stand einfuhrender Referate von Mitarbeitern des Instituts sowie des Lehrstuhls von Herrn Professor Steinberger und kommentierender Stel- lungnahmen der osteuropiiischen Experten mit anschlieBender Diskus- stOn waren. Den AbschluB bildete eine Podiumsdiskussion, auf der die Bedeutung der westeuropiiischen Verfassungsrechtsprechung fur die Entwicklung verfassungsgerichtlicher Kontrollstandards in Mittel- und Osteuropa, aber auch die moglichen Ruckwirkungen der dortigen Verfassungsrecht- sprechung auf Westeuropa diskutiert wurden.

The protection of religious freedom has resurfaced as an issue of fundamental importance throughout much of the world during the last decade. The re-emergence of religion, including religious extremism, as a potent social and political force in increasingly multi-religious societies has started to undermine many of the established assumptions on the proper relationship between the state, the church and religious minority groups. The present volume analyses in a comparative and international perspective the question if and to what extent these principles and rules have to be reformulated in order to meet the challenges of religious pluralism at the dawn of the twenty-first century.

There is an increasing focus on the need for national implementation of treaties. International law has traditionally left enforcement to the individual parties, but more and more treaties contain arrangements to induce States to comply with their commitments. Experts in this 2007 book examine three forms of such mechanisms: dispute settlement procedures in the form of international courts, non-compliance procedures of an administrative character, and enforcement of obligation by coercive means. Three fields are examined, namely human rights, international environmental law, and arms control and disarmament. At present these relations are primarily governed by market forces, with little regulatory interference at the international level. In the light of numerous financial crises, this abstinence must be seriously questioned. Starting with an analysis of the regulatory problems at the international level, with only minimal powers entrusted to international organisations, this book develops various possibilities for reform. On the basis of an historical analysis, the book first adopts a comparative approach to national attempts to regulate international financial markets, then outlines the potential of relevant institutions and finally develops a policy perspective. It seeks to provide a framework for analysing options for the regulation of international financial markets from a public international law and comparative law perspective.

International Environmental Law is a new textbook written for students, practitioners, and anyone interested in the subject. The overall aim of the book is to provide a fresh understanding of international environmental law as a whole, seen in the light of climate change, biodiversity loss, and the other serious environmental challenges facing the world. The book has also been kept deliberately manageable in size by careful selection of topics and by adopting a cross-cutting synthesis of regulatory interaction in the field. This enables the reader to place international environmental law in the broader context of public international law in general, revealing at the same time that international environmental law is experimental ground for developing new legal approaches towards global governance. To this end, the authors have combined theory and practice. Apart from discussing concepts, rule-making and compliance, the book looks at options for improved coordination, harmonisation and even integration of existing multilateral environmental agreements, analysing how conflicts between various environmental regimes can be avoided or, at least, adequately managed. The authors argue that an appropriate management of international environmental relations must address the North-South divide, which continues to be a major obstacle to global environmental cooperation. Furthermore, the authors emphasise the growing human rights dimension of international environmental law. This book is an ideal 'door opener' for the further study of international environmental law. Focusing on 'international environmental governance' in a comprehensive way, it serves to explain that each institution, each actor, and each instrument is part of a multi-dimensional process in international environmental law and relations.

Die dritte Auflage des Konkordanzkommentars EMRK/GG erörtert in bewährter Form die Wechselwirkungen zwischen deutschem und europäischem Grundrechtsschutz. Auf der Grundlage der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte und des Bundesverfassungsgerichts werden die dogmatischen Grundfragen, die Einzelgewährleistungen und die Durchsetzungsmechanismen des europäischen und deutschen Grundrechtsschutzes einer vergleichenden Analyse unterzogen. Die seit der Vorauflage ergangene Rechtsprechung ist umfassend in die Darstellung eingearbeitet. Dabei werden auch aktuelle Entwicklungen wie die praktischen Auswirkungen der neu entfachten Debatte über das Subsidiaritätsprinzip und den mitgliedstaatlichen Beurteilungsspielraum bei der Bewertung von Grundrechtseingriffen gebührend berücksichtigt.
