Ausgehend von der Entstehung der Strafprozesswissenschaft im spatmittelalterlichen Oberitalien verfolgt es die Entwicklung bis an die Schwelle zum Kodifikationszeitalter. Aus einer Vorlesung hervorgegangen, bietet es eine anschauliche Darstellung des allmahlichen Vordringens inquisitorischer Strukturen vor allem in Italien, Frankreich und Deutschland im Zusammenspiel der Wissenschaft mit Gerichtspraxis und Gesetzgebung der erstarkenden absolutistischen Territorialstaaten. Gegen diese Strukturen und ihre Missstande (vor allem die gerichtliche Folter und generell die ohnmachtige Position des Beschuldigten) richtet sich die Kritik der Humanisten, der Vertreter des Natur- und Vernunftrechts und der Aufklarer. Die Textsammlung enthalt 18 strafrechtstheoretische Texte vom ausgehenden 18. Jahrhundert bis zur Gegenwart. Die italienische Strafrechtswissenschaft rezipiert schon seit einigen Jahrzehnten intensiv die deutsche Strafrechtswissenschaft; abgesehen von einer kurzen Phase zu Beginn des 20. Jahrhunderts handelt es sich hierbei jedoch uberwiegend um eine Einbahnstrasse. Die Textsammlung soll dazu beitragen, diesen Zustand zu andern, denn die italienische Strafrechtswissenschaft verdient auch die Beachtung der deutschen Seite. Da die Wahrnehmung haufig an Sprachbarrieren scheitert, werden die Texte in deutscher UEbersetzung prasentiert. Die Herausgeber hoffen daher ein in Deutschland noch wenig erschlossenes Feld aufzuhellen und einen ersten strafrechtshistorischen und -dogmatischen Vergleich der Entwicklungen zu ermoeglichen. Bei diesem Vergleich kann die Heranziehung der bereits im selben Verlag erschienenen Textsammlung 'Moderne deutsche Strafrechtsdenker' sowie die 'Einfuhrung in die moderne Strafrechtsgeschichte' hilfreich sein."
