In 2007, the International Max Planck Research School for Maritime
Affairs together with the International Tribunal for the Law of the
Sea (ITLOS), both based in Hamburg, decided to establish an annual
lecture series, the "Hamburg Lectures on Maritime Affairs" - giving
distinguished scholars and practitioners the opportunity to present
and discuss recent developments in this field. The present volume -
the third in the series - collects the lectures held between 2011
and 2013 inter alia by Andrew Dickinson, Yvonne Marie Dutton, Bevan
Marten, Andreas Maurer, Irini Papanicolopulu, aslav Pejovic, Juan
L. Pulido, Andres Recalde Castells, Thomas J. Schoenbaum and
Rudiger Wolfrum."

The International Max Planck Research School for Maritime
Affairs hosted a global conference addressing marine pollution. At
this meeting, academics and practitioners came together to discuss
their findings and debate recent developments from an
interdisciplinary perspective. This volume reflects those
discussions, examining a broad range of topics concerning the
ecological, economic, political, and legal aspects of the pollution
of the sea.

the choice-of-venue and arbitration agreements that are important
for daily practice. In addition, particular consideration is
devoted to the latest revisions regarding consumer protection for
special areas and compulsory insurance contracts in the
Introductory Law to the German Civil Code (EGBGB, Articles 46b and
c).

The foundations of tort law in various European legal systems
differ considerably. Until now, there has not been an attempt to
harmonise the entire field of tort law in a consistent manner. To
rectify this, a group of tort lawyers has proposed to address the
fundamental questions underlying every tort law system. The result
is this important series of books, which searches for a common law
of Europe without the necessity yet to lay these principles down in
formal legal texts, such as a European civil code. Identifying the
most relevant factors in establishing liability as wrongfulness,
causation, damage, fault, and the area of strict liability, the
authors concentrate on the tort liability factor under discussion
in each volume, combining theoretical abstract analysis with the
discussion of concrete cases. Each author gives an overview of the
particular tort liability factor under his or her national legal
system - primarily by working out the concept and its importance in
establishing liability - and then applies the analysis to actual
cases. The subsequent conclusions aim at the coordination of the
results and other important factors. In summary, each volume tries
to make clear what common ground pertaining to each tort liability
factor underlies all the legal systems concerned with respect to
the law of tort. Each volume also provides the academic and
practitioner with the fundamental issues relating to that factor
underlying the law of tort in the countries covered.
This work represents a systematic and practical analysis of the
relevant rules, matter and terminology of international sales law.
Written for practitioners as well as researchers and students the
manual offers a comprehensive and in-depth overview of the relevant
legal international and national regulations, taking into account
the practice-relevant topics and the relevant soft law regulations.
The international and comparative law character of the work is
reflected in the consideration of such international regulations
such as the CISG, the Principles of European Private Law (PECL),
the Principles of International Commercial Contracts (UNIDROIT
principles) and the proposal to create a common European Sales law

Dieses Buch setzt sich kritisch mit der Umsetzung der
Verbrauchsguterkaufrichtlinie 99/44/EG vom 25. Mai 1999 ins
polnische Recht auseinander. Dabei untersucht es die
Richtlinienkonformitat des entsprechenden Umsetzungsgesetzes vom
27. Juli 2002. Ausgang der Argumentation ist der Beitritt Polens in
die Europaische Union 2004. Eine der schwierigsten und
herausforderndsten Aufgaben im Rahmen des Beitrittsprozesses war
fur Polen die Anpassung der innerstaatlichen Rechtsvorschriften an
die Richtlinienvorgaben der EU. Die Umsetzung der unterschiedlichen
EU-Richtlinien zwecks Schaffung eines Mindestsockels an gemeinsamen
Vorschriften fuhrte zu einer umfangreichen Umgestaltung des
polnischen Zivilrechts mit teilweise weitreichenden Folgen fur den
Rechtsanwender.
Das "Ob" und "Wie" der europaischen Vertragsrechtsharmonisierung
wird in der rechtswissenschaftlichen Literatur kontrovers
diskutiert. Auf Ebene der europaischen Gesetzgebung gibt es seit
langerer Zeit Bestrebungen, im Wege gesetzlicher Vorgaben eine
Vereinheitlichung zu erreichen. Dieser Beitrag richtet den Blick
auf das nicht normative Instrument des Modellgesetzes als
flexibleren Ansatz zur Harmonisierung. Durch Modellgesetze wurde in
den unterschiedlichsten nationalen und internationalen Kontexten
eine Vereinheitlichung erreicht. Das Ergebnis der Untersuchung
fallt differenziert aus: Das Modellgesetz ist im genannten
Zusammenhang als Instrument zur weiteren Vereinheitlichung des
momentanen Rechtszustands empfehlenswert. Es stellt jedoch nur eine
Zwischenloesung auf dem Weg einer zukunftigen legislativen
Vereinheitlichung dar.
Im ersten Teil des Buches wird die Frage untersucht, ob und
gegebenenfalls in welchem Umfang das UN-Kaufrecht die Aufrechnung
regelt. Der Autor kommt zu dem Ergebnis, dass das UN-Kaufrecht die
Aufrechnung von wechselseitigen Geldanspruchen aus einem dem
Kaufrechtsubereinkommen entstammenden Vertragsverhaltnis regelt. Im
zweiten Teil wird der praktisch wichtigen Frage nachgegangen, ob
bei Geltung des deutschen Aufrechnungsstatuts wahrungsverschiedene
Forderungen aufgerechnet werden koennen. Unter Berucksichtigung
auch des schweizerischen, oesterreichischen, englischen und
franzoesischen Aufrechnungsrechts gelangt der Autor zu dem
Ergebnis, dass wahrungsverschiedene Forderungen dann aufrechenbar
sind, wenn die beteiligten Wahrungen frei konvertibel sind.
Die Arbeit befasst sich mit der Frage, wie tatsachliche
Gleichberechtigung zwischen Frauen und Mannern im Arbeitsleben
bezogen auf den Bereich der Lohngleichheit erreicht werden kann.
Bisher wurden vor allem materiell-rechtliche Ansatze zur
Herstellung tatsachlicher Gleichberechtigung der Frauen diskutiert.
Mit dieser Arbeit soll nach verfahrensrechtlichen Moeglichkeiten
gesucht werden. Auf der Grundlage bestehender Gesetze wird
untersucht, ob dem kollektiven Anliegen der Gruppe benachteiligter
Arbeitnehmerinnen durch Ausschoepfung der gegebenen rechtlichen
Mittel zu effektiverem Schutz verholfen werden kann. Bei der Suche
nach geeigneten Instrumentarien werden auslandische Loesungsansatze
dargestellt, vor deren Hintergrund effektivere
Rechtsschutzmoeglichkeiten fur Deutschland ausfindig gemacht
werden.
Der Autor untersucht, wie das franzoesische Recht die Frage nach
den schuldnerischen Aufklarungspflichten im
Unternehmensinsolvenzverfahren beantwortet. Er stellt zunachst die
"procedure de sauvegarde ", den "redressement " und die
"liquidation judiciaire " vor. Der Autor benennt die dem Schuldner
auferlegten Aufklarungshandlungen und zeigt auf, welche Instrumente
zur Sanktionierung von Pflichtverletzungen bereitstehen. Fur das
bessere Verstandnis geht er auf die historische Entwicklung seit
dem Code de commerce von 1807 ein. Im Falle des Sanierungs- und des
Liquidationsverfahrens kommt er zu dem Ergebnis, dass der
rechtlichen Missbilligung mangelhafter Sachverhaltsaufklarung nicht
mit der Zuruckweisung des Eigenantrags Ausdruck verliehen werden
kann.
Die Autorin unternimmt einen Rechtsvergleich der Haftung fur Tiere
im deutschen und US-amerikanischen Recht. Die Tierhalterhaftung
nach 833 BGB schutzt grundsatzlich auch denjenigen, der sich
freiwillig der Tiergefahr aussetzt. Diese weite Haftung wird
insbesondere im Pferdesport den Interessen der Beteiligten oft
nicht gerecht. Die Untersuchung des US-Rechts zeigt Moeglichkeiten
der Haftungsbegrenzung anhand der in den USA weit verbreiteten
"Equine Activity Statutes". Die Autorin untersucht diese
Vorschriften und analysiert Moeglichkeiten, sie in das deutsche
Recht zu ubertragen. Sie zeigt zudem, dass die Privilegierung des
Nutztierhalters ( 833 Satz 2 BGB) uberholt ist und schlagt eine
Reform des 833 BGB vor.
Dieses Buch geht der Frage nach, ob das englische oder das deutsche
Insolvenzverfahren aus Sicht des Rechtssubjekts zu bevorzugen ist.
Diese Frage und die Wahl des Bezugspunktes beruhen auf den haufig
festzustellenden Abhangigkeiten zwischen der Schuldnerin, ihren
Glaubigern und den sonstigen am Verfahren beteiligten Personen und
der hieraus folgenden UEberlegung, dass ein gutes
Insolvenzverfahren die Interessen des Rechtssubjekts hinreichend
berucksichtigen muss. Der Autor gelangt u. a. zu dem Ergebnis, dass
das englische Restschuldbefreiungsverfahren gegenuber der deutschen
Regelung zu bevorzugen ist und dass das deutsche Verfahren uber die
starkeren insolvenzrechtlichen Werkzeuge verfugt und weniger
Risiken fur die Schuldnerin birgt.
Deutsche Unternehmen importieren in erheblichem Umfang Waren aus
Entwicklungs- und Schwellenlandern. Teilweise werden diese Waren
unter menschenrechtsbeeintrachtigenden Arbeitsbedingungen
hergestellt. Sofern deutsche Unternehmen durch ihr Geschaftsgebaren
zu den Missstanden beitragen, stellt sich neben der ethischen
Dimension auch die Frage nach ihrer rechtlichen Verantwortung. Kann
(und sollte) ein deutsches Unternehmen fur
Menschenrechtsbeeintrachtigungen seines Zulieferers haften? Welche
Chancen sind einer zivilrechtlichen Klage vor einem deutschen
Gericht und nach deutschem Recht einzuraumen? Trotz aller
rechtlichen und tatsachlichen Hindernisse sieht die Autorin im
Ergebnis aufgrund der mittelbaren Drittwirkung der Menschenrechte
im Zivilrecht durchaus Raum fur Anspruche.
Das Werk befasst sich mit dem geschlechtsspezifischen iranischen
Familienrecht. Ob bei der Eheschliessung, den Ehewirkungen, der
Scheidung oder den Scheidungsfolgen, stets spielt das Geschlecht
der Beteiligten eine entscheidende Rolle, da eine Fulle der
iranischen Rechtsvorschriften geschlechtsspezifisch formuliert ist.
Die Kenntnis dieser iranischen Rechtsvorschriften fur den deutschen
Rechtsanwender - ob nun Richter oder Rechtsanwalt - ist angesichts
der Anzahl der iranischen Staatsangehoerigen in Deutschland von
besonderer Relevanz, da die Gerichte im Falle eines Auslandsbezuges
stets die Anwendung auslandischer Rechtsvorschriften prufen mussen.
