Recognition lies at the heart of multiple contests around citizenship rights, identity politics, claims for material re-distribution, and demands for past harms to be acknowledged. This book seeks to consider where various contemporary contests over recognition are taking us. By looking at disputes around disability, race and ethnicity, nationalism, class, sexuality and ownership of the past, it explores the contemporary significance of recognition claims. In reflection of the global contexts of such disputes, the book draws on accounts from Europe, the USA, Latin America, the Middle East and Australasia. In doing so the book explores the following questions: Do we live in a moment where recognition is opening up to allow for greater space for varied or hybrid forms of living and mutual valuation, provided with rights and protection? Or is recognition paradoxically a means to narrow down options to more restrictive categories of acceptable ways of living and legitimate access to rights?

This work deals with the integration of thousands of survivors of the Holocaust into Israeli society in the early years of the new State's existence. Among the issues discussed are: the ways in which the survivors were recruited into the defence forces and the role they played in the War of Independence, the settlement of the immigrants in towns and villages abandoned by Arabs during the war and the immigrant youth.

"The New India" looks critically at various constructions of the Indian citizen from 1991 to 2007, the period when economic liberalization became established government policy. Liberalization generated complex social and economic tensions, and Chowdhury reveals howthese tensions shaped images of the citizen in cultural narratives of the time--in films, literary texts, corporate advertisements, political documents, and citizens' responses to the privatization of public space. This thesis provides a new approach to the Ethiopian Land Law debate. The basic argument made in this thesis is that even if the Ethiopian Constitution provides and guarantees common ownership of land (together with the state) to the people, this right has not been fully realized whether in terms of land accessibility, enjoyability, and payment of fair compensation in the event of expropriation. Expropriation is an inherent power of the state to acquire land for public purpose activities. It is an important development tool in a country such as Ethiopia where expropriation remains the only method to acquire land. Furthermore, the two preconditions of payment of fair compensation and existence of public purpose justifications are not strictly followed in Ethiopia. The state remains the sole beneficiary of the process by capturing the full profit of land value, while paying inadequate compensation to those who cede their land by expropriation. Secondly, the broader public purpose power of the state in expropriating the land for unlimited activities puts the property owners under imminent risk of expropriation.

This book discusses how human wellbeing is constructed and transferred intergenerationally in the context of international migration. Research on intergenerational transmission (IGT) has tended to focus on material asset transfers prompting calls to balance material asset analysis with that of psychosocial assets - including norms, values attitudes and behaviors. Drawing on empirical research undertaken with Latin American migrants in London, Katie Wright sets out to redress the balance by examining how far psychosocial transfers may be used as a buffer to mediate the material deprivations that migrants face via adoption of a gender, life course and human wellbeing perspective.

This book examines the contentious subject of human rights in China. However, in contrast to the majority of the literature which focuses on alleged Chinese abuses of human rights, the author examines the emergence and evolution of a Chinese conception of rights, paying attention to the impact of Confucianism, Republicanism, and Marxism on this conception. It is suggested that the joint influence of these doctrines helps to explain, among other things, the contemporary emphasis attached to socio-economic and collective rights in China, and the importance accorded to citizens duties in relation to the exercise of their rights.

This book considers the effectiveness and fairness of using international cooperation to obtain confession evidence or evidence of a suspect or accused person's silence across borders. This is a question of balance in limiting and protecting the right to silence. The functioning of the applicable law in Denmark, England and Wales and Australia is analysed in relation to investigative and trial measures such as police questioning, administrative questioning powers, covert surveillance and the use of silence as evidence of guilt.On the national level, this work examines the way in which domestic rules balance the right to silence in national criminal proceedings, and whether investigative and trial rules produce continuity throughout the criminal proceedings as a whole. From the transnational perspective, comparative legal analysis is used to determine whether the national continuity may be disrupted to such an extent that cooperation in the gathering of confession evidence causes unfairness. From the international perspective, this research compares the right to silence under the ICCPR and the ECHR to identify the overall effect of cooperating under particular human rights frameworks on the question of balance.

This book contributes to an increasingly important branch of critical security studies that combines insights from critical geopolitics and postcolonial critique by making an argument about the geographies of violence and their differential impact in contemporary security practices, including but not limited to military intervention. The book explores military intervention in Libya through the categories of space and time, to provide a robust ethico-political critique of the intervention. Much of the mainstream international relations scholarship on humanitarian intervention frames the ethical, moral and legal debate over intervention in terms of a binary, between human rights and state sovereignty. In response, O'Sullivan questions the ways in which military violence was produced as a rational and reasonable response to the crisis in Libya, outlining and destabilising this false binary between the human and the state. The book offers methodological tools for questioning the violent institutions at the heart of humanitarian intervention and asking how intervention has been produced as a rational response to crisis. Contributing to the ongoing academic conversation in the critical literature on spatiality, militarism and resistance, the book draws upon postcolonial and poststructural approaches to critical security studies, and will be of great interest to scholars and graduates of critical security studies and international relations.

This book evaluates the protection of traditional cultural expressions in Africa using South Africa, Kenya, Nigeria and Ghana as case study examples in the light of regional and international approaches in this respect. Such protection is considered in the context of a combination of positive protection models such as the protection offered by intellectual property rights and negative protection such as tangible heritage protection and authorisations by national competent authorities. These models are in turn assessed taking into consideration human and peoples' rights frameworks, which recognise and affirm group entitlement to, among others, traditional cultural expressions. These frameworks ensure that such traditional cultural expressions are available for further innovation and creativity.

This book is devoted to the study of the interplay between religious rules and State law. It explores how State recognition of religious rules can affect the degree of legal diversity that is available to citizens and why such recognition sometime results in more individual and collective freedom and sometime in a threat to equality of citizens before the law. The first part of the book contains a few contributions that place this discussion within the wider debate on legal pluralism. While State law and religious rules are two normative systems among many others, the specific characteristics of the latter are at the heart of tensions that emerge with increasing frequency in many countries. During the transition to democracy, states have used various mechanisms to address previous human rights abuses including domestic trials, truth and reconciliation commissions and internationalized tribunals.
