Discussion of trade barriers has come round - inevitably it seems - to national regimes of regulatory protection. Indeed, state regulation has the potential to undermine the very legitimacy of the global trading system. A compelling reconciliation between these two paramount values is essential. This text has a twofold purpose: to consider what has so far been accomplished in this mission in the field of international economic law, and to prescribe some solutions to continuing problems. This latter endeavour amounts to a coherent and integrated plan that will enhance the acceptability of free markets to governments, traders, and other stakeholders alike. The challenges analysed in depth here include: the development in the global trade regime of non-trade policy objectives, which still tend to be treated as mere exceptions to general obligations; the built-in emphasis on products rather than measures; the novel risks associated with the development of modern technology; the case-by-case approach of WTO jurisprudence, which generally fails to investigate whether the substance of any given domestic regulation is necessary to the policy goals of the state in question; and the "technical and economic feasibility" of complying with international trade obligations. The author conducts his analysis in a broad context encompassing the WTO system, the European Union, and the North American Free Trade Agreement. He finds that the clash, despite the particular institutional characteristics of these various organizations, is a major concern of them all. The jus gentium of international trade, he offers, is an imperative combining the good faith principle with the communitarian duty to cooperate. This year, the "Yearbook Commercial Arbitration" has reached the milestone of thirty years of documenting the law and practice of international commercial arbitration. Modern investment treaties give private arbitrators power to determine whether governments should pay compensation to foreign investors for a wide range of sovereign acts. In recent years, particularly developing countries have incurred significant liabilities from investment treaty arbitration, which begs the question why they signed the treaties in the first place. Through a comprehensive and timely analysis, this book shows that governments in developing countries typically overestimated the economic benefits of investment treaties and practically ignored their risks. Rooted in insights on bounded rationality from behavioural psychology and economics, the analysis highlights how policy-makers often relied on inferential shortcuts when assessing the implications of the treaties, which resulted in systematic deviations from fully rational behaviour. This not only sheds new light on one of the most controversial legal regimes underwriting economic globalization but also provides a novel theoretical account of the often irrational, yet predictable, nature of economic diplomacy.

The Caspian Sea region is rich in oil and natural gas and can potentially become a major energy supplier. Despite the interest of the three Caspian countries of Azerbaijan, Kazakhstan, and Turkmenistan, their energy resources have remained mainly undeveloped a decade after their independence. The main factor that has prevented the full development of the Caspian energy resources has been the difficulty of selecting long-term safe, reliable, and economically viable export routes. The three landlocked Caspian countries have no choice but to depend on their neighbors to access international waters for their exports. For many reasons, including internal stability and extensive oil facilities and pipelines, Iran offers the most suitable routes to all three Caspian countries. However, despite the interest of the Caspian energy-exporters, in using this route, the U.S. policy of containment of Iran has prevented them from doing so. For political, economic, and security reasons, the existing in-use Georgian and Russian routes cannot and will not be a long-term solution for energy exports. The insistence of the American government on imposing the expensive and unreliable Turkish route on the reluctant Caspian energy-exporters and its categorical rejection of the Iranian route have created a major obstacle to the development of the Caspian energy industries. As Peimani suggests, if this policy continues, many oil and gas exporters will opt for the Iranian route without regard to existing U.S. punitive legislation. The results could well be the isolation of the U.S. in the Caspian region and a gradual exclusion of American oil companies from the region. This overview will be of interest to scholars, researchers, and policymakers involved with economic and political issues of the region.

McGee takes the position that the only proper trade policy is one of total, immediate, and unilateral free trade, since such a policy is the only one that is consistent with individual rights. He also explodes the myth that trade deficits are bad and advocates the repeal of the antidumping laws, incorporating rights theory as well as utilitarian arguments. This book is unique in that it (1) does not limit itself to utilitarian arguments, (2) explains why trade deficits are irrelevant, and (3) calls for immediate repeal of the antidumping laws. Part I discusses the philosophy of protectionism and reviews nearly two dozen arguments that projectionists have used to restrict trade. Chinese President Xi Jinping launched the Silk Road Economic Belt component of the One Belt One Road (OBOR) initiative at Kazakhstan in 2013. OBOR is a development strategy and framework that focuses on connectivity and cooperation among countries primarily in Eurasia. It consists of two main components, the land-based 'Silk Road Economic Belt' (SREB) and ocean-going 'Maritime Silk Road' (MSR). This book studies the equilibrium or balance between overland and maritime trade routes of OBOR.This book has two major sections. The interpretive section examines contemporary media narratives related to the OBOR initiative and how contemporary commentators appropriate narratives about historical events related to the maritime Silk Road to interpret current policy agendas and legitimize diplomatic or economic exchanges. In terms of institutional studies, the chapters related to Asian Infrastructure Investment Bank (AIIB) will look at the issues facing the Bank in its quest in forming a new world platform for multilateral development financing.The other section, the empirical case study of the publication highlights the fact that Euro-China High Speed Rail (HSR) and Central Asia-China HSR are not viable at the moment as passenger volume is not sufficient to justify the HSR line. This section examines the overland route of the OBOR and looks at recent Chinese HSR history and conventional sub-high speed rail technology development, and identifies technical & economic criteria determining the appropriate technology for a certain line. The chapter in this section will use the developed criteria to analyze the various rail linkage projects currently under study in the OBOR framework, highlight the economic, bureaucratic and geo-political challenges that these projects likely face and lay down conditions that will determine the outcome of these projects.
Developing countries comprise a two-thirds majority of the membership of the World Trade Organization, with nearly 30 of these classed by the UN as being among the 48 least-developed countries in the world. In order to ensure the equitable participation of these countries in the benefits of the global trading system, the GATT Uruguay Round Agreements that created the WTO accorded special and differential treatment to developing countries.
