European Energy Studies Volume III: The Geoeconomics of Sovereign Wealth Funds and Renewable Energy - Towards a New Energy Paradigm in the Euro-Mediterranean Region (Hardcover)
Simone Tagliapietra
R2,123 Discovery Miles 21 230 Ships in 12 - 17 working days

This book was originally published by Claeys and Casteels, now formally part of Edward Elgar Publishing. The purpose of this book is to propose an innovative vision on the development process of the enlarged Mediterranean region. Triangulating the Gulf Cooperation Council, North Africa and the European Union into a unique cooperation scheme, the book highlights the strong complementarity that exists between these regions in the field of renewable energy. The wide availability of Sovereign Wealth Funds' capital in the Gulf Cooperation Council, the great renewable energy potential of North Africa and the institutional support of the European Union are the three main pillars of this cooperation scheme. This triangulation would enhance not only the energy outlook of the overall Mediterranean region, but also its socio-economic development, ultimately promoting an enlarged area of cooperation, stability and peace.

Steven J Haberfeld
R1,842 Discovery Miles 18 420 Ships in 12 - 17 working days

Negotiation, understood simply as "working things out by talking things through," is often anything but simple for Native nations engaged with federal, state, and local governments to solve complex issues, promote economic and community development, and protect and advance their legal and historical rights. Power Balance builds on traditional Native values and peacemaking practices to equip tribes today with additional tools for increasing their negotiating leverage. As cofounder and executive director of the Indian Dispute Resolution Service, author Steven J. Haberfeld has worked with Native tribes for more than forty years to help resolve internal differences and negotiate complex transactions with governmental, political, and private-sector interests. Drawing on that experience, he combines Native ideas and principles with the strategies of "interest-based negotiation" to develop a framework for overcoming the unique structural challenges of dealing with multilevel government agencies. His book offers detailed instructions for mastering six fundamental steps in the negotiating process, ranging from initial planning and preparation to hammering out a comprehensive, written win-win agreement. With real-life examples throughout, Power Balance outlines measures tribes can take to maximize their negotiating power-by leveraging their special legal rights and historical status and by employing political organizing strategies to level the playing field in obtaining their rightful benefits. Haberfeld includes a case study of the precedent-setting negotiation between the Timbisha Shoshone Tribe and four federal agencies that resolved disputes over land, water, and other natural resource in Death Valley National Park in California. Bringing together firsthand experience, traditional Native values, and the most up-to-date legal principles and practices, this how-to book will be an invaluable resource for tribal leaders and lawyers seeking to develop and refine their negotiating skills and strategies.

A Short Introduction to Judging and to Legal Reasoning (Paperback): Geoffrey Samuel A Short Introduction to Judging and to Legal Reasoning (Paperback)
Geoffrey Samuel
R955 Discovery Miles 9 550 Ships in 12 - 17 working days

This Short Introduction looks at judging and reasoning from three perspectives: what legal reasoning has been; what legal reasoning is from the view of judges and jurists; and what legal reasoning is from the view of a social scientist epistemologist or humanities specialist. Geoffrey Samuel begins by identifying the main institutional focal points of legal reasoning (ius, regulae iuris, Interpretatio, utilitas and actiones). While examining legal reasoning from both an internal and external viewpoint, the book simultaneously incorporates theory and scholarship from a range of other disciplines including social science and film studies. The author also includes a discussion of fiction theory, schemes of intelligibility, and other epistemological issues as well as standard reasoning devices such as induction, deduction and analogy. Combining cases and materials with original text, this unique, concise format is designed to be accessible for students who are starting out on their law programs, as well as providing insights for students and researchers who would like to examine judging and legal reasoning in more depth.

The Future of Asian Trade Deals and IP (Hardcover): Kung-Chung Liu, Julien Chaisse The Future of Asian Trade Deals and IP (Hardcover)
Kung-Chung Liu, Julien Chaisse
R3,150 Discovery Miles 31 500 Ships in 12 - 17 working days

The first part of this open access book sets out to re-examine some basic principles of trade negotiation, such as choosing the right representatives to negotiate and enhancing transparency as a cure to the public's distrust against trade talks. Moreover, it analyses how the Comprehensive and Progressive Agreement for the Trans-Pacific Partnership (CPTPP) might impact on the Regional Comprehensive Economic Partnership's (RCEP) IP chapter and examines the possible norm setters of Asian IP. It then focuses on the People's Republic of China's (PRC) trade and IP strategy against the backdrop of the power games between the PRC, India and the US. The second part of the book reflects on issues related to investor-state dispute settlement and its relationship with IP, such as how to re-calibrate the balance in international investment arbitration, and whether compulsory license of IP constitutes expropriation in India, the PRC and select ASEAN countries. The third part of the book questions and strives to improve some of the proposed IP provisions of CPTPP and RCEP and to redefine some aspects of international IP norms, such as: pre-grant patent opposition and experimental use exception; patent term extension; patent linkage and data exclusivity for the pharmaceutical sector; plant variety protection; pre-established damages for copyright infringement; and the restructuring of copyright limitations in the public interest. The open access edition of this book is available under a CC BY-NC-ND 3.0 licence on www.bloomsburycollections.com. Open access was funded by the Applied Research Centre for Intellectual Assets and the Law in Asia, School of Law, Singapore Management University.

Atiyah and Adams' Sale of Goods, 14th Edition, by Twigg-Flesner and Canavan is a highly readable and comprehensive account of the law governing the sale of goods. This book addresses the increasing split of the law on the sale of goods between commercial and consumer contracts, which is reflected in the separate treatment of consumer law aspects.

Information Environmentalism - A Governance Framework for Intellectual Property Rights (Hardcover): Robert Cunningham Information Environmentalism - A Governance Framework for Intellectual Property Rights (Hardcover)
Robert Cunningham
R3,153 Discovery Miles 31 530 Ships in 12 - 17 working days

The regulation and flow of information continues to have a critical impact upon how people live their lives and the way society functions. In recent times, disinformation and privacy violation have become the 'information pollution' of the 21st century. This book explores ways and means of protecting the 'information environment' by drawing upon four theories of contemporary environmentalism: welfare economics, the commons, ecology, and public choice theory. Welfare economics highlights the need to focus on costs (as well as benefits) when evaluating regulatory structures. The commons encourages queries about the validity of propertisation. Ecology speaks to the importance of diversity and resilience. And public choice theory hazards against the regulatory effect of concentrated interests. The lessons from each inspire the proposed information environmental governance framework. By neatly capturing the metaphorical relationship between the physical environment and the information environment, Robert Cunningham explores progressive regulatory pathways for the digital age. This book will be a thought-provoking read for scholars and students with an interest in intellectual property or the regulation of information.
