Shipping Law & Admiralty Jurisdiction In South Africa (Hardcover, 2nd ed): John Hare Shipping Law & Admiralty Jurisdiction In South Africa (Hardcover, 2nd ed)
John Hare
R2,766 R2,273 Discovery Miles 22 730 Save R493 (18%) Ships in 4 - 8 working days

South African shipping law is a rich amalgam of English common law and Roman-Dutch civilian principles. Its provenance was profoundly influenced first by Dutch dominance over the seas and world trade during the 17th and 18th centuries, and then by the might of the English commercial empire of the 19th and 20th centuries.

Today's South African shipping lawyer continues to draw on both systems, supplemented by innovative developments, especially in admiralty practice.

The second edition of Shipping Law & Admiralty Jurisdiction in South Africa follows ten years after its first publication. The book aims to cover all aspects of admiralty jurisdiction and practice, and general shipping law, in one volume.

Equality In The Workplace - Reflections From South Africa And Beyond (Paperback): Ockert Dupper, Christoph Garbers Equality In The Workplace - Reflections From South Africa And Beyond (Paperback)

R923 R799 Discovery Miles 7 990 Save R124 (13%) Ships in 4 - 8 working days

South Africa’s history of colonialism and apartheid has created deep patterns of inequality and poverty. One of the ways in which the government has tried to address the high levels of inequality that characterise the South African labour market, is through an extensive process of legislative reform, which includes the Employment Equity Act (EEA) of 1998.

The EEA was enacted to achieve equity in the workplace by prohibiting unfair discrimination and by requiring the implementation of affirmative action measures to ensure the equitable representation of designated groups (blacks, women and disabled persons) in all occupational categories and levels in the workforce. The Act gives effect to the constitutional imperative for substantive equality in respect of the workplace.

One decade after the enactment of the EEA, this collection of essays evaluates its efficacy in achieving its stated goals. This is done against the background of comparative experiences elsewhere, in particular India, Canada, the United Kingdom, Germany and the European Union.

A proper understanding of the law of contract requires far more than the mere rote learning of principles extracted from cases. Contract law is a practical subject and students will understand it best by applying contractual principles to practical, life-like scenarios. Student's guide to the law of contract fosters such an approach. It is filled with examples, exercises and problem-setting questions that increase gradually in level of complexity. This will facilitate discussion in study groups and during lectures. Spaces for the completion of exercises and summaries of prescribed cases enable students to engage actively with the learning material in one basic source. Student's guide to the law of contract can be used by lecturers as a primary teaching tool for undergraduate students to improve their students' knowledge and understanding of basic contractual principles, develop their ability to reason and stimulate their interest in the subject. Likewise, students will find it useful as an aid additional to lectures and more advanced contract law textbooks.

Jurisprudence in an African Context explores the unique contribution of African jurisprudence, and that of Western jurisprudence, to engage with the context and issues of contemporary Southern African societies. The text's unique pedagogy invites the reader to explore African perspectives of law through excerpts of primary texts, and supports understanding, engagement and debate through accessible and stimulating commentary.

Organised thematically, the text engages with many urgent and important issues, related to law and justice, which concern African societies: these topics include land reform, the distribution of wealth and opportunity, who counts as a member of a political community, the rights of gay people, the interests of traditional societies, and approaches to dealing with crime.

The text provides a rich perspective of the proper role of law and justice in contemporary society, through the lens of African history, context and values.

Psychology and law are disciplines and professions that seem to be, at first glance, quite distinct and separate - but in reality their congruences are many and varied - psychologists frequently appear in court as expert witnesses; and they often actively research topics that are directly related to law and legal practice. Similarly, lawyers and other legal professional often face questions in their professional practice that are inherently psychological in nature. This text introduces the reader to some of the intersections of psychology and law. Each chapter includes learning objectives, exercises and a detailed reference section. Topics addressed in psychology and law include: psychological assessment in forensic settings; crime and policing; child custody assessment; the detection of deception and truthfulness; eyewitness testimony and identification; the role and treatment of child witnesses in legal proceedings; assessing dangerousness and the risk of violence; the psychologist as expert witness; investigative psychology and psychological profiling; psychology and human rights; insanity and diminished capacity defences.

Decisions up to June 2002 have been considered for inclusion. Die titel bevat 'n opsomming van die feite van elke saak, 'n uittreksel uit die uitspraak asook 'n aantekening waarin die beginsels wat in die saak ter sprake gekom het, ontleed word.

The amendments to the law of wills brought about by the Law of Succession Amendment Act of 1992 have created fundamental changes in South African testamentary law. This book analyzes the Wills Act as now amended. It deals with such topics as language usage generally, taking instruction from would-be testators, the structure of wills, estate duty, the limits to freedom of testation, the interpretation of wills, donation of human tissues, the so-called living will, traps to avoid in drafting, testamentary trusts, and other problems which practitioners commonly have to handle. It discusses important cases which have shaped testamentary law and gives examples of wills and testamentary trusts.

Domestic Violence and International Law (Hardcover): Bonita Meyersfeld Domestic Violence and International Law (Hardcover)
Bonita Meyersfeld
R3,521 Discovery Miles 35 210 Ships in 10 - 15 working days

Domestic Violence and International Law argues that certain forms of domestic violence are a violation of international human rights law. The argument is based on the international law principle that, where a state fails to protect a vulnerable group of people from harm, whether perpetrated by the state or private actors, it has breached its obligations to protect against human rights violation. This book provides a comprehensive legal analysis for why a state should be accountable in international law for allowing women to suffer extreme forms of domestic violence and how this can help individual victims. It is irrelevant that the violence is perpetrated by individuals and not state actors such as soldiers or the police. The state's breach of its responsibility is in its failure to act effectively in domestic violence cases; and in its silent endorsement of the violence, it becomes complicit. The book seeks to reformulate academic and political debate on domestic violence and the responsibility of states under international law. It is based on empirical data combined with an honest assessment of whether or not domestic violence is recognised by the international community as a human rights violation. 'Domestic Violence in International Law [...] provides an original, provocative, and much needed legal framework for the coherent development of a norm against domestic violence in international human rights law...Dr. Meyersfeld has developed a thoroughgoing analysis that asks and answers the most difficult questions often neglected by academics, lawyers and activists who dismiss the possibility that systemic violence against women could violate international law...Most fundamentally, this book is memorable for the hope and optimism it expresses about the transformative possibilities of international law. For without compromising such intensely human values as privacy, autonomy and cultural identity, Dr. Meyersfeld moves her reader with an abiding conviction: that international law, fueled with the power of transnational actors, can propel public actors to protect abused and vulnerable people in their most private worlds.' From the Foreword by Harold Koh, The Legal Adviser, United States Department of State (2009-).

Methodologies of Legal Research - Which Kind of Method for What Kind of Discipline? (Hardcover, New): Mark van Hoecke Methodologies of Legal Research - Which Kind of Method for What Kind of Discipline? (Hardcover, New)
Mark van Hoecke
R2,959 Discovery Miles 29 590 Ships in 10 - 15 working days

Until quite recently questions about methodology in legal research have been largely confined to understanding the role of doctrinal research as a scholarly discipline. In turn this has involved asking questions not only about coverage but, fundamentally, questions about the identity of the discipline. Is it (mainly) descriptive, hermeneutical, or normative? Should it also be explanatory? Legal scholarship has been torn between, on the one hand, grasping the expanding reality of law and its context, and, on the other, reducing this complex whole to manageable proportions. The purely internal analysis of a legal system, isolated from any societal context, remains an option, and is still seen in the approach of the French academy, but as law aims at ordering society and influencing human behaviour, this approach is felt by many scholars to be insufficient. Consequently many attempts have been made to conceive legal research differently. Social scientific and comparative approaches have proven fruitful. However, does the introduction of other approaches leave merely a residue of 'legal doctrine', to which pockets of social sciences can be added, or should legal doctrine be merged with the social sciences? What would such a broad interdisciplinary field look like and what would its methods be? This book is an attempt to answer some of these questions.
