The leading case of The Mayor, Alderman and Burgesses of the Borough of Bradford v Pickles was the first to establish that it is not unlawful for a property owner to exercise his or her property rights maliciously and to the detriment of others, or the public interest. Though controversial at the time, today it is often invisible and taken for granted. This book explores why the common law, in contrast to civil law systems, developed in this way.
This book shows how governance regimes before the 1970s suppressed rural prospects of housing improvement and created conditions for middle-class capture. Using original archival sources to reveal the intricacies of local and national policy processes, weak rural housing performances are shown to owe more to national governance regimes than local under-performance. Looking `behind the scenes' at policy processes highlights neglected principles in national governance, and shows how investigating rural housing is fundamental to understanding the national scene. With original insights and a new analytical perspective, this volume offers evidence and conclusions that challenge mainstream assumptions in public policy, housing, rural studies and planning.
This book gives a brief account of the background to the dual land tenure system in force in Sierra Leone and explains the reasons why the dualism derived from the different colonial experience of the former Colony and Protectorate of Sierra Leone still persists almost fifty years after the two entities were merged to form a unitary State of Sierra Leone. The book gives an account, for the benefit of both law students and legal practitioners, of the main features of the English derived land law in the Western Area and of the forms of land holding in the Provinces which are governed predominately by customary law. The book also highlights the practical problems that legal practitioners may be confronted with in advising clients wanting to enter into transactions involving land in Sierra Leone and in drafting legal documents for the creation or transfer of interests in land in different parts of the country. By giving an account of developments relating to policy initiatives and by laying bare the achievements and shortcomings of land tenure reform to date, the book aims to stimulate debate on current proposals for reform not only among law students and practitioners of the law but also among policy makers and members of the wider non-legal community It offers a brief but constructive criticism of the dual land tenure system and offers some proposals for reform of the system changes in the light of stated policies.
Landmark Cases in Land Law is the sixth volume in the Landmark Cases series of collected essays on leading cases (previous volumes in the series having covered Restitution, Contract, Tort, Equity and Family Law). The eleven cases in this volume cover the period 1834 to 2011, although, interestingly, no fewer than six of the cases were decided or reported in the 1980s. The names of the selected cases will be familiar to property lawyers. However, individually, the essays provide a reappraisal of the cases from a wide range of perspectives - focusing on their historical, social or theoretical context, highlighting previously neglected aspects and even questioning their perceived importance. This volume has been prepared for the Environmental and Health & Safety Manager. This book advocates a new way of thinking about mortgage contracts. This claim is based on the assumption that we currently live in a political economy in which consumer debt fulfils a social function. In the field of housing this is evidenced by the expansion of mortgage credit through which consumers are to purchase residential property as a means of social inclusion and personal welfare. It is suggested that contract law needs to adjust to this new social function in order to avoid welfare losses in terms of default, over-indebtedness, and possibly eviction. To this end, this book analyses theoretical contract law frameworks and makes concrete proposals for contract law in the EU legal order.
A human right to housing represents the law's most direct and overt protection of housing and home. Unlike other human rights, through which the home incidentally receives protection and attention, the right to housing raises housing itself to the position of primary importance. However, the meaning, content, scope and even existence of a right to housing raise vexed questions. Drawing on insights from disciplines including law, anthropology, political theory, philosophy and geography, this book is both a contribution to the state of knowledge on the right to housing, and an entry into the broader human rights debate. This book presents a critical reassessment of theories of property rights, in response to conflicts and competition between different groups, and the state. It does so by taking an institutional political perspective to analyse the structures of property rights, with a focus on a series of case studies from Bangladesh. In doing so, the book highlights the importance of property rights for economic growth, why developing countries often fail to design property rights conducive for economic development, and the strategies required for designing an efficient structure of rights. This book is a statement of the current law of compulsory purchase of land and compensation for that purchase. It covers all major aspects of the procedure for the compulsory acquisition of land and deals in full detail with all aspects of the law of compensation for such an acquisition. The many and diverse statutory provisions are organised into a series of chapters containing all principles and rules and there is a full analysis and explanation of the leading authorities on the subject and the principles derived from those authorities without which the subject cannot be understood. The aim of the book is, not only to explain the statutory provisions and to organise the various possible claims for compensation into different heads, but also to explain and analyse the substantial body of case law which has built up, particularly in recent years, and the relationship between that body of law and the underlying statutory provisions. The National Environmental Policy Act (NEPA), enacted in 1970, requires federal agencies to analyze the environmental effects of all proposed major Federal actions significantly affecting the quality of the human environment. Property Law and Social Morality develops a theory of property that highlights the social construction of obligations that individuals owe each other. By viewing property law through the lens of obligations rather than through the lens of rights, the author affirms the existence of important property rights (when no obligation to another exists) and defines the scope of those rights (when an obligation to another does exist). Examining a series of court decisions made during the 1980s regarding the legal claims of several Native American tribes who attempted to protect ancestrally revered lands from development schemes by the federal government, this book looks at important questions raised about the religious status of land. The tribes used the First Amendment right of free exercise of religion as the basis of their claim, since governmental action threatened to alter the land which served as the primordial sacred reality without which their derivative religious practices would be meaningless. Brown argues that a constricted notion of religion on the part of the courts, combined with a pervasive cultural predisposition towards land as private property, marred the Constitutional analysis of the courts to deprive the Native American plaintiffs of religious liberty. Brown looks at four cases, which raised the issue at the federal district and appellate court levels, centered on lands in Tennessee, Utah, South Dakota, and Arizona; then it considers a fifth case regarding land in northwestern California, which ultimately went to the U.S. Supreme Court. In all cases, the author identifies serious deficiencies in the judicial evaluations. The lower courts applied a conception of religion as a set of beliefs and practices that are discrete and essentially separate from land, thus distorting and devaluing the fundamental basis of the tribal claims. It was this reductive fixation of land as property, implicit in the rulings of the first four cases, that became explicitly sanctioned and codified in the Supreme Court's decision in "Lyng v. Northwest Indian Cemetery Protective Association" of 1988. In reaching such a position, the Supreme Court injudiciously engaged in a policy determination to protect government land holdings, and did so through a shocking repudiation of its own long established jurisprudential procedure in cases concerning the free exercise of religion.
