Principles of International Trade and Investment Law (Hardcover): Andrew D. Mitchell, Elizabeth Sheargold Principles of International Trade and Investment Law (Hardcover)
Andrew D. Mitchell, Elizabeth Sheargold
R2,868 Discovery Miles 28 680 Ships in 12 - 17 working days

This carefully crafted book discusses a wide range of important legal principles such as procedural fairness and reasonableness in the context of international trade and investment law. Using comparative methodology, the authors examine how those principles are reflected in treaties and how they are employed by adjudicators resolving disputes. Contributing to a growing and important body of scholarship,Principles of International Trade and Investment Law provides critical analysis of important topics in international economic law, including cross-border data transfers and prudential regulation. By identifying commonalities and divergences in how the two regimes treat key legal concepts, such as necessity testing and non-discrimination, the book provides insight into international trade and investment law while also furthering our understanding of the broader fields of international economic law and public international law. Examining how these key principles are interpreted and used in international economic law, this book will be welcomed by academics and practitioners interested in international investment and trade law as well as researchers in the international public law field.

Regulatory Autonomy in International Economic Law - The Evolution of Australian Policy on Trade and Investment (Hardcover):... Regulatory Autonomy in International Economic Law - The Evolution of Australian Policy on Trade and Investment (Hardcover)
Andrew D. Mitchell, Elizabeth Sheargold, Tania Voon
R3,153 Discovery Miles 31 530 Ships in 12 - 17 working days

Regulatory Autonomy in International Economic Law provides the first extensive legal analysis of Australia's trade and investment treaties in the context of their impact on national regulatory autonomy. This thought-provoking study offers compelling lessons for not only Australia but also countries around the globe in relation to pressing current problems, including the uncertain future of the World Trade Organization and widespread concerns about the legitimacy of investor-State dispute settlement. Through a critical exploration of evolving patterns of treaty practice, the authors address the complex relationship between international economic law and a State's regulatory autonomy in the key areas of intellectual property, services, and investment. This insightful investigation highlights problems of inconsistency across treaties, limited transparency and consultation in the negotiation of treaties, and increasing restrictions on policy space in intellectual property protection. These factors are all crucial in preserving a country's ability to pursue policy objectives such as protecting public health and the environment while capturing the benefits of international trade and foreign investment. This discerning book will prove instrumental to scholars and practitioners in the fields of international trade law, international investment law, public international law, and intellectual property. It will also appeal to government agencies and international organisations working in these areas or in matters of public health or the environment.

Public Health and Plain Packaging of Cigarettes - Legal Issues (Hardcover): Tania Voon, Andrew D. Mitchell, Jonathan Liberman,... Public Health and Plain Packaging of Cigarettes - Legal Issues (Hardcover)
Tania Voon, Andrew D. Mitchell, Jonathan Liberman, Glyn Ayres
R3,154 Discovery Miles 31 540 Ships in 12 - 17 working days

Tobacco use represents a critical global health challenge. The World Health Organization estimates that tobacco kills nearly 6 million people a year, with the toll expected to rise to 8 million annually over the next two decades. This detailed book, written by health and legal experts from institutions around the globe, examines legal issues arising from Australia's world-first introduction of mandatory plain packaging of tobacco products. The book offers an in-depth exploration of relevant domestic and international legal questions in fields such as intellectual property, constitutional law, health, trade and investment. The authors' analysis sheds light on broader questions relating to the capacity of governments to regulate tobacco products and the tobacco industry, and to regulate in the interests of public health more generally. The answers to these questions are of vital interest not only to Australia but also to the international community, with states' regulatory sovereignty increasingly being challenged in local and international courts and tribunals. This timely study is designed to assist international organizations, NGOs, policymakers, and scholars in law, medicine and health-related areas. Health professionals and advisors will also find much of interest here. Contributors: A. Alemanno, G. Ayres, E. Bonadio, J. Bosland, S. Chapman, M. Davison, S. Evans, T.A. Faunce, B. Freeman, K. Dymaneke D. Mitchell
R2,532 Discovery Miles 25 320 Ships in 10 - 15 working days

Although there has been an increase in literature regarding children of color with disabilities, it mainly focuses on their experiences in one social context. Crises of Identifying: Negotiating and Mediating Race, Gender, and Disability within Family and Schools includes narratives on the familial and educational experiences in public, private, and institutional educational settings of five African American adults who have disabilities associated with blindness, cerebral palsy, and speech impairment. As a deaf African American female, the author and researcher also highlights her familial and educational experiences throughout the book as a frame of analysis. This book can serve as a literary resource to academics and educational programs and/or institutions as well as an informational guide to parents, teachers, administrators, and paraprofessionals/ caregivers of children with disabilities regarding the significance of leadership, advocacy, activism, and identification development within familial and educational contexts on the experiences of children including the impact of complex dynamics that exist within and between families and schools. Hopefully, this book will provide parents, teachers, administrators, and paraprofessionals with an understanding and comprehension of complexities concerning disability, gender, and race within family and schools including their association with crises of identifying, essentialist discourses, as well as power and privilege dynamics. This book consists of nine chapters which are organized into three parts. Part I focuses on background, rationale, theoretical and methodological underpinnings of the research this book is based on. Part II introduces the reader to the narratives of five African Americans with disabilities. Each narrative provides insights into the lived experiences and leadership qualities of two males and three females. Part III presents the concluding chapters of the book and highlights the significance of this research for the educational field including disability studies, teacher education programs, and special education.

Non-Discrimination and the Role of Regulatory Purpose in International Trade and Investment Law (Hardcover): Andrew D.... Non-Discrimination and the Role of Regulatory Purpose in International Trade and Investment Law (Hardcover)
Andrew D. Mitchell, David Heaton, Caroline Henckels
R2,719 Discovery Miles 27 190 Ships in 12 - 17 working days

Non-discrimination requirements, such as most-favored nation and national treatment obligations, are central to both international trade law and international investment law. Significant inconsistencies between the fields are evident, however, in the way adjudicators have treated key elements of the test for discrimination. This book surveys and criticizes the manner in which tribunals have employed the concept of regulatory purpose in determining whether discrimination has occurred. The authors of this book propose a new definition of regulatory purpose that assists in framing the test for unlawful discrimination in both fields of law. It provides a systematic and structured analysis of how regulatory purpose should - and should not - be used in applying non-discrimination norms. Throughout, the book compares and contrasts trade and investment law, drawing out several parallels and suggesting areas in which one legal system might answer or shed light on questions arising in the other. With its comprehensive and up-to-date analysis of trade and investment jurisprudence, this book will appeal to practitioners and academics in the fields of trade and investment law. Lawyers and adjudicators will find it a useful source of ideas and proposals to inform their arguments and decisions. For government officials, it will be informative when considering the optimal way to structure measures that may affect the interests of foreign traders or investors. It will also provide a useful survey of the literature for academics, as well as a springboard for further comparison of international trade and investment law.

Medicine in the Crusades - Warfare, Wounds and the Medieval Surgeon (Hardcover): Piers D. Mitchell Medicine in the Crusades - Warfare, Wounds and the Medieval Surgeon (Hardcover)
Piers D. Mitchell
R2,413 Discovery Miles 24 130 Ships in 12 - 17 working days

This is the first book to be published on any aspect of medicine in the crusades. It will be of interest not only to scholars of the crusades specifically, but also to scholars of medieval Europe, the Byzantine world and the Islamic world. Focusing on injuries and their surgical treatment, Piers D. Mitchell considers medical practitioners, hospitals on battlefields and in towns, torture and mutilation, emergency and planned surgical procedures, bloodletting, analgesia and anesthesia. He provides an assessment of the exchange of medical knowledge that took place between East and West in the crusades, and of the medical negligence legislation for which the kingdom of Jerusalem was famous. The book presents a radical reassessment of many outdated misconceptions concerning medicine in the crusades and the Frankish states of the Latin East.

J. Brewer, D Mitchell, G. Leavey
R3,219 Discovery Miles 32 190 Ships in 12 - 17 working days

Much has been written about the influence of religion on the Northern Ireland conflict and the part played by ex-combatants in the peace process. Yet we know very little about the religious outlook of ex-combatants themselves. Are they personally devout? Is religion important to their political identity? Did faith play a role in their decision to take up arms, or lay them down? And now that their war is over, does religion help them cope with the past?

Based on original interviews with ex-combatants from across the political and religious divide, this book addresses these questions, shedding new light on the interplay of religion, identity and violence in Ireland. It also shows how the case of Northern Ireland illuminates the current international debate around religion and peacemaking. Arguing that advocates of religious interventions in transitional justice often naively exaggerate its influence, a theoretical model for understanding the role of religion in transitional justice is proposed.

Legal Principles in WTO Disputes (Hardcover): Andrew D. Mitchell Legal Principles in WTO Disputes (Hardcover)
Andrew D. Mitchell
R2,740 Discovery Miles 27 400 Ships in 12 - 17 working days

Principles play a crucial role in any dispute settlement system, and the World Trade Organization (WTO) is no exception. However, WTO Panels and the Appellate Body have been too timid in using principles, sometimes avoiding their use when appropriate and at other times using them without fully acknowledging that they are doing so. Perhaps more worryingly, these bodies often fail to delve deeply enough into principles. They tend to overlook key questions such as the legal basis for using a given principle, whether the principle is being used in an interpretative manner or as applicable law, and the meaning of the principle in public international law. This book establishes a framework for addressing these questions. The use of such a framework should allay fears and misconceptions about the use of principles and ensure that they are used in a justifiable manner, improving the quality of dispute settlement in the WTO.

2008 Catholic Press Association Award Winner

The 2002 "Institutio Generalis Missalis Romani(IGMR) "comes at an important moment in the history of Roman Catholicism. The Church has come through the dramatic reforms of Vatican II and more than a generation has engaged in the contemporary liturgical practices. New churches have been built and texts and songs written that reflect the post 'Vatican II approach to liturgy. In view of these many changes there are yet concerns about what norms best articulate the liturgical Vision embedded in the documents of Vatican II and what directives are most appropriate for shaping the full, active, and conscious participation of the faithful.

This commentary by members of the Catholic Academy of Liturgy is attentive to these concerns. While maintaining a balanced view of the reVisions, the authors provide thoughtful analysis of the theological, pastoral, and ecclesial implications of the 2002 "IGMR." Several prefatory chapters reflecting on the overall significance of the current Instruction are followed by a concise and meaningful chapter-by-chapter commentary.

In addition to the full text of the Instruction in Latin and English, readers will find a varied and rich commentary by top liturgical scholars. No single author's viewpoint dominates, and yet the authors offer a consistent, readable text for everyone interested in the current state of liturgy in the Catholic Church.

The Mystery of the Rosary - Marian Devotion and the Reinvention of Catholicism (Paperback): Nathan D. Mitchell The Mystery of the Rosary - Marian Devotion and the Reinvention of Catholicism (Paperback)
Nathan D. Mitchell
R660 Discovery Miles 6 600 Ships in 12 - 17 working days

Ever since its appearance in Europe five centuries ago, the rosary has been a widespread, highly visible devotion among Roman Catholics. Its popularity has persisted despite centuries of often seismic social upheaval, cultural change, and institutional reform. In form, the rosary consists of a ritually repeated sequence of prayers accompanied by meditations on episodes in the lives of Christ and Mary. As a devotional object of round beads strung on cord or wire, the rosary has changed very little since its introduction centuries ago. Today, the rosary can be found on virtually every continent, and in the hands of hard-line traditionalists as well as progressive Catholics. It is beloved by popes, professors, protesters, commuters on their way to work, children learning their "first prayers," and homeless persons seeking shelter and safety. Why has this particular devotional object been so ubiquitous and resilient, especially in the face of Catholicism's reinvention in the Early Modern, or "Counter-Reformation," Era? Nathan D. Mitchell argues in lyric prose that to understand the rosary's adaptability, it is essential to consider the changes Catholicism itself began to experience in the aftermath of the Reformation. Unlike many other scholars of this period, Mitchell argues that after the Reformation Catholicism actually became more innovative and diversified rather than retrenched and monolithic. This innovation was especially evident in the sometimes "subversive"; visual representations of sacred subjects, such as in the paintings of Caravaggio, and in new ways of perceiving the relation between Catholic devotion and the liturgy's ritual symbols. The rosary was thus involved not only in how Catholics gave flesh to their faith, but in new ways of constructing their personal and collective identity. Ultimately, Mitchell employs the history of the rosary, and the concomitant devotion to the Virgin Mary with which it is associated, as a lens through which to better understand early modern Catholic history.

Zora Neale Hurston - An Annotated Bibliography of Works and Criticism (Hardcover): Cynthia Davis, Verner D. Mitchell Zora Neale Hurston - An Annotated Bibliography of Works and Criticism (Hardcover)
Cynthia Davis, Verner D. Mitchell
R2,855 Discovery Miles 28 550 Ships in 12 - 17 working days

Zora Neale Hurston (1891-1960), the most prominent of the Harlem Renaissance women writers, was unique because her social and professional connections were not limited to literature but encompassed theatre, dance, film, anthropology, folklore, music, politics, high society, academia, and artistic bohemia. Hurston published four novels, three books of nonfiction, and dozens of short stories, plays, and essays. In addition, she won a long list of fellowships and prizes, including a Guggenheim and a Rosenwald. Yet by the 1950s, Hurston, like most of her Harlem Renaissance peers, had faded into oblivion. An essay by Alice Walker in the 1970s, however, spurred the revival of Hurston's literary reputation, and her works, including her 1937 novel Their Eyes Were Watching God, have enjoyed an enduring popularity. Zora Neale Hurston: An Annotated Bibliography of Works and Criticism consists of reviews of critical interpretations of Hurston's work. In addition to publication information, each selection is carefully crafted to capture the author's thesis in a short, pithy, analytical framework. Also included are original essays by eminent Hurston scholars that contextualize the bibliographic entries. Meticulously researched but accessible, these essays focus on gaps in Hurston criticism and outline new directions for Hurston scholarship in the twenty-first century. Comprehensive and up-to-date, this volume contains analytical summaries of the most important critical writings on Zora Neale Hurston from the 1970s to the present. In addition, entries from difficult-to-locate sources, such as small academic presses or international journals, can be found here. Although intended as a bibliographic resource for graduate and undergraduate students, this volume is also aimed toward general readers interested in women's literature, African American literature, American history, and popular culture. The book will also appeal to scholars and teachers studying twentieth-century American literature, as well as those specializing in anthropology, modernism, and African American studies, with a special focus on the women of the Harlem Renaissance.

Human By Nature - Between Biology and the Social Sciences (Paperback): Peter Weingart, Sandra D. Mitchell, Peter J. Richerson,... Human By Nature - Between Biology and the Social Sciences (Paperback)
Peter Weingart, Sandra D. Mitchell, Peter J. Richerson, Sabine Maasen
R1,384 Discovery Miles 13 840 Ships in 12 - 17 working days

Representing a wide range of disciplines -- biology, sociology, anthropology, economics, human ethology, psychology, primatology, history, and philosophy of science -- the contributors to this book recently spent a complete academic year at the Center for Interdisciplinary Research (ZiF) discussing a plethora of new insights in reference to human cultural evolution. These scholars acted as a living experiment of "interdisciplinarity in vivo." The assumption of this experiment was that the scholars -- while working and residing at the ZiF -- would be united intellectually as well as socially, a connection that might eventually enhance future interdisciplinary communication even after the research group had dispersed. An important consensus emerged: The issue of human culture poses a challenge to the division of the world into the realms of the "natural" and the "cultural" and hence, to the disciplinary division of scientific labor. The appropriate place for the study of human culture, in this group's view, is located between biology and the social sciences. Explicitly avoiding biological and sociological reductionisms, the group adopted a pluralistic perspective -- "integrative pluralism" -- that took into account both today's highly specialized and effective (sub-)disciplinary research and the possibility of integrating the respective findings on a case-by-case basis. Each sub-group discovered its own way of interdisciplinary collaboration and submitted a contribution to the present volume reflecting one of several types of fruitful cooperation, such as a fully integrated chapter, a multidisciplinary overview, or a discussion between different approaches. A promising first step on the long road to an interdisciplinarily informed understanding of human culture, this book will be of interest to social scientists and biologists alike.

Tobacco use represents a critical global health challenge. The World Health Organization estimates that tobacco kills nearly 6 million people a year, with the toll expected to rise to 8 million annually over the next two decades. Written by health and legal experts from institutions around the globe, The Global Tobacco Epidemic and the Law examines the key areas of domestic and international law affecting the regulation of tobacco. The book offers a wide-ranging and in-depth exploration of relevant legal questions, including a focus on the activities of the World Health Organization and the WHO Framework Convention on Tobacco Control, as well as an extensive evaluation of relevant developments in international trade law and international investment law. The authors' expert analysis also sheds light on broader questions relating to the capacity of governments to regulate tobacco products and the tobacco industry, as reflected in detailed case studies of tobacco control in various countries and regions around the world. The answers to these questions are of vital interest to the international community, with states' regulatory sovereignty regarding tobacco increasingly being challenged in local and international courts and tribunals. Combining unique insight with rigorous analysis, this book will facilitate a more sophisticated understanding of the legal issues concerning tobacco control and will be of interest to lawyers, diplomats, policymakers and NGOs, as well being a valuable resource for scholars of law, public policy and health.
