While scholars have rightly focused on the importance of the
landmark opinions of the United States Supreme Court and its Chief
Justice, John Marshall, in the rise in influence of the Court in
the Early Republic, the crucial role of the circuit courts in the
development of a uniform system of federal law across the nation
has largely been ignored. This book highlights the contribution of
four Associate Justices (Washington, Livingston, Story and
Thompson) as presiding judges of their respective circuit courts
during the Marshall era, in order to establish that in those early
years federal law grew from the 'inferior courts' upwards rather
than down from the Supreme Court. It does so after a reading of
over 1800 mainly circuit opinions and over 2000 original letters,
which reveal the sources of law upon which the justices drew and
their efforts through correspondence to achieve consistency across
the circuits. The documents examined present insights into
momentous social, political and economic issues facing the Union
and demonstrate how these justices dealt with them on circuit.
Particular attention is paid to the different ways in which each
justice contributed to the shaping of United States law on circuit
and on the Court and in the case of Justices Livingston and
Thompson also during their time on the New York State Supreme
Court.

THE NEW YORK TIMES BESTSELLER David Lynch - co-creator of Twin
Peaks and writer and director of groundbreaking films such as
Eraserhead, The Elephant Man, Blue Velvet and Mulholland Drive -
opens up about a lifetime of extraordinary creativity, the
friendships he has made along the way and the struggles he has
faced to bring his projects to fruition. Room to Dream is both an
astonishing memoir told in Lynch's own words and a landmark
biography based on hundreds of interviews, that offers unique
insights into the life and mind of one of the world's most
enigmatic and original artists.
Musical verse accompanies a milkman and his cranky kitty as they
make their morning rounds. The milkman knows his hometown; he knows
who needs ice cream for a birthday party, who just broke a leg, and
who has a new baby. He even helps return a lost dog that's hiding
along his route. This pitch-perfect, retro read-aloud's gentle
sensibility is ideally matched with beautiful art that powerfully
evokes an era of classic illustration.
From a renowned Vedic scholar, leader of the Maharishi Foundations, and
Harvard-trained neuroscientist: a radical new paradigm for
understanding Consciousness and finding enlightenment, peace, and
fulfillment.
Dr. Tony Nader, a renowned Vedic scholar and neuroscientist, offers a
direct path to peace for ourselves and our world that anyone can
obtain—simply by delving into our own Consciousness. Dr. Nader provides
the methods, tools, and guidance for connecting with our authentic
inner nature and understanding how Consciousness is the essence of all
existence, including addressing such fundamental questions as:
- What is the key to a well-lived, flourishing life in which we can
all coexist in peace?
- Can freedom be compatible with law and order?
- How can we meet all our challenges as individuals and a society,
including the environment, genetic engineering, and the rapid
development of artificial intelligence?
True wellness is a state of profound clarity, peace, and contentment,
resulting from connection with our pure Consciousness. By enlivening
our coherence between our Consciousness and the external world, we can
find our happiest and highest states of ourselves.
Now fully updated, Lynch on Lynch describes the career of a
cinematic genius who has continued to astonish filmgoers with the
lovely and life-affirming The Straight Story and the luxurious
dread of the Academy Award-nominated Mulholland Drive. David Lynch
erupted onto the cinema landscape with Eraserhead, establishing
himself as one of the most original, imaginative, and truly
personal directors at work in contemporary film. He is a
surrealist, in the tradition of the great Spanish director Luis
Bunuel. Over the course of a career that includes such films as The
Elephant Man, Blue Velvet, Wild at Heart, Lost Highway, and the
seminal TV series Twin Peaks, Lynch has remained true to an
artistic vision of innocence lost or adrift in the direst states of
darkness and confusion. Nobody else sees the world quite as David
Lynch does. Once seen, his films are never forgotten, nor does the
world about us seem quite as it did before. In this definitive
career-length interview book, Lynch speaks openly about the full
breadth of his creative work, which encompasses not only movies but
also a lifelong commitment to painting, a continuing exploration of
photography, extensive work in television, and musical
collaborations with composer Angelo Badalamenti and singer Julee
Cruise.
Financial models are an inescapable feature of modern financial
markets. Yet it was over reliance on these models and the failure
to test them properly that is now widely recognized as one of the
main causes of the financial crisis of 2007-2011. Since this
crisis, there has been an increase in the amount of scrutiny and
testing applied to such models, and validation has become an
essential part of model risk management at financial institutions.
The book covers all of the major risk areas that a financial
institution is exposed to and uses models for, including market
risk, interest rate risk, retail credit risk, wholesale credit
risk, compliance risk, and investment management. The book
discusses current practices and pitfalls that model risk users need
to be aware of and identifies areas where validation can be
advanced in the future. This provides the first unified framework
for validating risk management models.
Improving Schools with Blended Learning is specifically designed to address the important issues needed to successfully modernise education within the context of technological change. It does this by first providing a clear roadmap for designing Blended Learning environments able to respond to the technological imperatives challenging schools at present, and then illustrating this roadmap via specific, original research that details the 'how to' aspects of a successful technology-based design process. School leaders, teachers, teacher education students and researchers will all find highly relevant information about how to manage for disruption in the new and informative approach to Blended Learning (BL) they will discover in this book.
This book arose from two different research projects the authors have been pursuing over the last 3–5 years, including school improvement research and Blended Learning research designed to investigate the role of technology in effective teaching and learning. By combining the insights gained from these two different research areas, this book is able to present a novel understanding of BL that is both insightful and clearly evidence-based.
Improving Schools with Blended Learning also provides several original contributions to specific knowledge in the areas of BL and school improvement that most educators will find highly useful, including the use of BL schemas, a clear and extended BL continuum, how to measure and evaluate the success of BL, how to scaffold teacher ICT knowledge and skills, and a specific process for contextualising applied BL in relation to the ‘disruption’ imperatives of the Knowledge Economy.

The roots of Hallowe'en lie in the ancient pre-Christian Celtic
festival of Samhain, a feast to mark the death of the old year and
the birth of the new. It was believed that on this night the veil
separating the worlds of the living and the dead grew thin and
ruptured, allowing spirits to pass through and walk unseen but not
unheard amongst men. The advent of Christianity saw the pagan
festival subsumed in All Souls' Day, when across Europe the dead
were mourned and venerated. Children and the poor, often masked or
in outlandish costume, wandered the night begging 'soul cakes' in
exchange for prayers, and fires burned to keep malevolent phantoms
at bay. From Europe, the haunted tradition would quickly take root
and flourish in the fertile soil of the New World. Feeding hungrily
on fresh lore, consuming half-remembered tales of its own shadowy
origins and rituals, Hallowe'en was reborn in America. The pumpkin
supplanted the carved turnip; costumes grew ever stranger, and
celebrants both rural and urban seized gleefully on the festival's
intoxicating, lawless spirit. For one wild night, the dead stared
into the faces of the living and the living, ghoulishly masked and
clad in tattered backwoods baroque, stared back. The photographs in
Haunted Air provide an extraordinary glimpse into the traditions of
this macabre festival from ages past, and form an important
document of photographic history. These are the pictures of the
dead: family portraits, mementos of the treasured, now
unrecognisable, other. Torn from album pages, sold piecemeal for
pennies and scattered, abandoned to melancholy chance and the hands
of strangers.

David Lynch directs this cult 1980s classic starring Dennis Hopper
and Kyle MacLachlan. When college student Jeffrey Beaumont
(MacLachlan) returns home to look after his dad's store while he's
in hospital, a short stroll through a seemingly peaceful field sees
him stumbling upon a severed ear. As Jeffrey reports the crime to
the police he finds himself being sucked into a world of murder,
voyeurism and sado-masochism.
At one time, Italian wines conjured images of cheap Chianti in
straw-wrapped bottles. More recently, expensive "Super Tuscans"
have been the rage. But between these extremes lay a bounty of
delicious, moderately priced wines that belong in every wine
drinker's repertoire.
Vino Italiano is the only comprehensive and authoritative American
guide to the wines of Italy. It surveys the country's
wine-producing regions; identifies key wine styles, producers, and
vintages; and offers delicious regional recipes. Extensive
reference materials--on Italy's 300 growing zones, 361 authorized
grape varieties, and 200 of the top producers-- provide essential
information for restaurateurs and wine merchants, as well as for
wine enthusiasts.
Beautifully illustrated as well as informative, Vino Italiano is
the perfect invitation to the Italian wine experience.

Three films from legendary American director David Lynch. In 'The
Elephant Man' (1980), John Merrick (John Hurt) is a brutalised man,
treated as a freak since childhood because of his appalling
physical deformities, until he is discovered by London doctor
Frederick Treves (Anthony Hopkins), who treats him with the
kindness and intelligence he deserves. Unfortunately, by awakening
his true character the problems continue, for he can never lead a
'normal' life. In 'Mulholland Drive' (2001), having narrowly
survived a murder attempt and a car crash, a shocked and wounded
woman (Laura Elena Harring) takes refuge in a nearby apartment.
When she is discovered the next morning by the apartment's official
resident, aspiring actress Betty Elms (Naomi Watts), she confesses
that she neither knows who she is nor what happened to her. The two
women then begin to investigate, and it gradually becomes clear
that they have known each other in the past. Meanwhile, a young
film director (Justin Theroux) finds that the mob are taking an
unusual interest in the casting of his latest film. Finally, in
'Inland Empire' (2006), Laura Dern plays Nikki Grace, an ingenue
actress whose latest role in a Tennessee Williams-esque fright of a
film tests her to her limits. A parallel storyline shows an earlier
attempt to make this film in Poland which ended in tragedy when the
two lead players were offed.
This book is about designing the effective classroom curriculum.
The authors argue that an effective classroom curriculum should be
the goal of every teacher in every classroom around the world:
effective that is for every student, not just those who find school
easy! But how does one go about designing a classroom curriculum
that is effective? What are the essential ingredients and how
should these ingredients be organised for teaching effect? What
role does Technology play in such classroom plans? In this book
Lynch, Smith and Howarth provide an insight into these questions by
providing a text that focuses on classroom teaching diagnostic and
design strategies. Their intent in writing such a book is to enable
the classroom teacher to develop, teach and assess a classroom
curriculum where learning success for all students is the central
goal. This text is compulsive reading for the teacher who wants to
make a difference in their classrooms.
Ken Sell, David Lynch and Tina Doe, three accomplished and
published experts in the field of education, bring together leading
education researchers and school leaders to create a collection of
chapters which focus on key aspects of effective school leadership.
The book explores a model for whole of school improvement and
examines key concepts such as; readiness for change, approaches to
leadership, how to use data, parental engagement, as well as
providing insights into aspects of schooling and teaching into the
future
How does the effective teacher assess and report their classroom
curriculum program? Building on the success of their previous
book--- Designing the Classroom Curriculum in the Knowledge Age ---
David Lynch and Richard Smith seek to answer this question by
focusing their "teaching design" idea on classroom assessment and
reporting. At the heart of their teaching design idea is the
formulation of teaching strategies that enable all students to make
the required learning gains. At its core, the book encourages the
teacher to work towards becoming a different kind of teacher, a
teacher who has a mindset attuned to the Knowledge Age and who
embraces new knowledge sets that reflect research into effective
teaching. More specifically, the book explores the theory and
practice of "teaching design" from the perspective of assessment
and reporting. The book examines these premises as context when
assessing and reporting the classroom curriculum. A real how to
assess and report book.
This book case studies schools and universities, in Australia and
elsewhere, as they respond to changes in society and the economy
that are generated by the Knowledge Economy. Chapters by academics,
scholars and community leaders unravel the circumstances of
education and provide an analysis of an education system struggling
to find its way in a period of rapid social movement. To illustrate
their ideas, chapter authors offer examples of innovations and the
logistics necessary to change the current system of educationin
school, community and university levels.
It appears that teachers and teacher educators have fossilized in
their resolve to continue doing what they've always done, despite
calls for fundamental change. So, what does "a changed world"
actually mean for teachers and teacher educators? How might society
prepare teachers for this changed world and what are the new
capabilities that such a program should focus on? What does
fundamental change in teaching and teacher education actually look
like? This book is about teacher education reform and seeks to
answer these and other questions. More specifically the book aims
to showcase a disruptive model in teacher education and answer some
of the ponderings around what teacher education could be and how it
could be organized differently for the different world in which
teachers now have to operate.
How do I plan my classroom curriculum so that all my students
benefit? Where should I start? What are the important
considerations? What should I be aiming for? How do I ensure that
my teaching is effective? These are some of the questions teachers
invariably ask? In the complex and challenging environment, that is
the classroom in the Knowledge Age, having the personal capacity to
design the classroom curriculum so that all students make the
required learning gains is the today's benchmark for teaching
success. The authors provide an insight into how to design the
classroom curriculum so that all students make the required
learning gains. The book provides a detailed understanding of the
theory and practice of curriculum and programming and step by step
instructions and design resources to enable an easy understanding
of the classroom curriculum design process. The book is supported by
the publisher's Book Resources Section.
