EVIDENCE AND BURDEN OF PROOF UNDER THE FOREIGN SOVEREIGN IMMUNITIES
ACT, 1976 is practical guide for assessing the quality of the
evidence and the burden of proof in sovereign immunity trials under
the FSIA 1976. The study concludes in demonstrating two distinct
rules of the burden of proof, for each kind of immunity; the rules
are widely uniform, and were corroborated by most US District
Courts, Courts of Appeals and the United States Supreme Court.
Pierre F. Walter shows in this study that solid knowledge of
procedural rules and the law of evidence in sovereign immunity
litigation is often the basis of winning a case. While this is
generally so, it is of even more importance in the highly complex
trials that involve foreign sovereign immunity. The law firm stands
out that can anticipate the judge's assessment of the burden of
proof situation in every phase of the trial, thereby reducing cost
for the client and substantially shifting probability up for
winning the case. DR. PIERRE F. WALTER, ESQ. is an international
lawyer holding degrees in German and European law, and a 'Docteur
en droit' in international law from the law faculty of the
University of Geneva (1987). Before expanding his career into
corporate training and business consultancy, he has worked as a
research assistant with Freshfields, Bruckhaus, Deringer in
Cologne, Germany, with Lalive Lawyers in Geneva and with Professor
Louis B. Sohn, UGA Law School, Department of International Law.
VIBRANT LIFE is the final conclusion of more than twenty years of
research on the vibrational nature of life and our universe.
Instead of presenting a dry scientific treatise, the author
organizes the material as a guide for a richer, and healthier life.
It consists of six main parts: 'The Vibrant Nature of
Consciousness', 'The Vibrant Nature of the Cosmos', 'The Vibrant
Nature of Pleasure, Emotions, and Sexuality', 'The Vibrant Nature
of Life Cycles', 'The Vibrant Nature of Health' and 'The Vibrant
Nature of the Human Psyche'. The book shows that while the split
between science and religion, at the time of Newton and Descartes,
created a science that was myopic and hostile to nature, the author
advocates a holistic understanding of the field nature of life, and
a systemic view of living systems that is coherent and sustainable.
It is here, at this intersection between science and a lifestyle
that fosters vibrancy that the author situates the present book. It
is neither a simple review of more than one hundred books nor is it
a selfhelp guide without scientific backup. The intention of the
author was to bring science and selfhelp together in a unique plot
that makes science fruitful as a direct guidance for a richer,
healthier and fuller life, and a point of departure for
self-discovery. The result is a true life guide that gives
scientifically proven answers to all our fundamental questions,
from birth to death, over sexuality, the handling of emotions,
coping with violence, and other conditions for truly intelligent
living.

CREATIVE PRAYER is a selfhelp essay representing a witness report
of a prayer method the author is working with since 1990 and that
was originally created by Ernest Holmes in 1927 as "The Science of
Mind," also called Religious Science, as it was founded by Ernest
Holmes in 1927, and expanded and commercialized in the 1960s, by
Dr. Joseph Murphy and Catherine Ponder. The author came across this
uncanny praying technique for the first time in Joseph Murphy's
book "The Power of Your Subconscious Mind" and has quoted many
prayer examples in his review of Murphy's other book, 'Think
Yourself Rich', which is one of his best. - Pierre F. Walter, 110
Book Reviews (2010). - The New Paradigm in Consciousness and
Psychology (2011). When the author started out with the prayer
healing technique, he was doing a psychotherapy, but his
psychiatrist fully welcomed his idea of doing the prayers as an
add-on to the therapy. And in fact, the combination proved to be
very powerful. In the present selfhelp essay the author explains
the technique that Dr. Joseph Murphy called "scientific prayer,"
explicates what the science is about, and teach with examples how
to practice it and what it does. It can be used namely not only for
healing self and others, but also for building self-esteem,
self-confidence and high self-worth, and also for creating inner
peace. And there is more. There is one aspect of the technique that
Joseph Murphy did not mention in his books, and which is why the
author came to call the technique 'creative prayer'. The technique
namely also enhances creativity, and very powerfully so.

EMOTIONAL FLOW is a science production that presents a
non-moralistic, functional and bioenergetic regard on emotions,
sexuality, sexual paraphilias and sexual crime that asserts the

POWER OR DEPRESSION is an essay that was inspired by the author's
selfhelp guide 'Macht oder Ohnmacht', originally written in German
language. The essay points out the historical roots of abuse and
patriarchal society's systematic breeding of depression as
something like a cultural disease. However, the author does not
stay with the analysis what depression is and how it is
systematically bred by our culture, but he shows practical ways to
get free from the cultural trap so as to find a way to personal
liberation and creative realization. His approach to healing the
abuse pattern is mainly focused upon establishing a strong
identity, built on soul values, and realizing a high level of
personal autonomy....
THE NEW PARADIGM IN BUSINESS, MARKETING AND CAREER is a sampler
with ten bestselling books reviewed. Among the reviewed authors are
training gurus such as Edward de Bono, career consultants such as
Laurence G. Boldt or marketing gurus such as Sergio Zyman. The
books of Edward de Bono were a precious resource for me, and I
studied them in minute detail, both for the concise in-depth
research the great corporate trainer did on the human mind and our
infinite human potential, and his specific and for the most part
cutting-edge training techniques. Then I reviewed the books of
Laurence G. Boldt, and was fascinated from the first to the last
page. I found this man was more than even an excellent career
coach, but a real sage, steeped in the Zen tradition and with a
talent for wistful speech and talk. Finally I found Tom
Butler-Bowden's volume "50 Success Classics" that I virtually
devoured. I can only express my great admiration for this author's
research and literary talent. Sergio Zyman's amazing and insightful
book captivated me to a point I never put it down until I finished
it. This book is a must-read for everyone who wants to know more
about marketing or, rather, the end of marketing as we know it. An
amazing career, an amazing man, not very much the type of
individuals I am having social intercourse with, one of the
toughest vintage, so to speak, but an admirable and extravagant
person all in all, and a genius in his kind.
THE IDIOT GUIDE TO EMOTIONS sets out to elucidate the nature and
functions of our emotions and provides clear instructions and
examples how to handle emotions and keep them in a healthy balance.
The author stresses the fact that emotions have a kaleidoscopic
nature, that all emotions are interlocked and that balance is vital
to emotions in the sense that they assume a rather negative and
devastating character when getting out of balance. The author
demonstrates that most passion crimes are committed because people
mishandle their emotions, or have never learnt to handle them in
the first place. This is so because in our culture the bioenergetic
nature of emotions is veiled or outright rejected; this means
emotions are not seen as what they are, that is, flowing streams of
vital energy that are part of our luminous body. The audience for
this guide is both the professional and lay audience, including
those who are directly concerned and who have a problem with
handling their emotional flow. The need for solutions to our
emotional problems is not only an individual quest, but also a
matter of public hygiene. It results from our our collective denial
of the basic patterns of living. This collective denial resulted in
our messing up the code of life, thereby bringing about large-scale
perversion and violence. The social and legal policies in place for
handling antisocial conduct are largely ineffective because they
are based on the ignorance of bioenergetic truth and reality. The
guide contains effective solutions both for the individual quest
for emotional sanity and for forging new and effective social and
legal policies for handling emotional flow within society at large,
and with the ultimate objective to regulate our social conduct
responsibly and without the need of law enforcement, coercion and
monolithic state control.
THE IDIOT GUIDE TO CONSCIOUSNESS presents a novelty approach to
consciousness research. I show that boosting our level of
self-awareness can be undertaken as a deliberate activity, and has
nothing 'magic' about it. 5000 years of patriarchy by and large
suppressed the intuitive wisdom of the ancient world and replaced
it by large-scale dogmatism and the control of the individual by
first the ecclesiastical dominators and later the nation states
with their blown-up police forces, their secret agents, and their
fast growing prison miles. This led to more and more people being
discarded out of mainstream society because of their intellectual,
emotional and sexual difference. However, people often do not
realize their highest potential because they lack a critical
mindset in the face of conformity pressure and the general
solidifying framework of modern consumer culture that models
citizens instead of accepting them as they are - in their full
humanity. To develop humanity at a level beyond the norm,
self-awareness and critical thinking must go together, whereas mere
criticism leads to inevitable projections. The approach I have
taken is to combine insights from my background in law and politics
with consciousness research, and to offer the reader practical work
tools for developing self-awareness. Sharpening self-awareness is
achieved through writing statements where the reader intuits their
present level of awareness in all areas treated in the guide, that
is General Level, Love, Power, Science, Health, Emotions, and
Peace. After having done this awareness check, consciousness will
do the rest, for it is self-healing, self-cleaning and
self-renewing from the moment the person sees herself without
projections and self-delusion.
WALTER'S ENCYCLOPEDIA is a unique scientific and personal research
glossary published by a maverick researcher of our times. This
present version of the glossary is addressed to the academic world.
An illustrated edition is equally available and comes in two
volumes. The research goes back to 1985 and thus spans a period of
25 years. In the first part, terms are explicated that are general,
redefined or proprietary. In the second part, personalities of fame
and renowned people are descibed who had some or the other impact
upon the author's perception and value system. The most important
entries of this research glossary are those that are proprietary to
the author, such as 'The Eight Patterns of Living', 'The Science of
Emonics', 'Emosexuality', 'Emosexcoaching', 'Life Authoring', 'Live
Your Love', 'Oedipal Culture', 'Pedoemotions', 'Pedoerotics',
'Primary Power', or 'The Legal Split in Child Protection'.
FRITJOF CAPRA AND THE SYSTEMS VIEW OF LIFE is a passionate study
about the great contemporary physicist and a review of six of his
books. The author considers Fritjof Capra as one of the most
important authors on new science and systems research. He found
Capra's Tao of Physics in 1985, at a time when his life was in a
complete reorientation. He compares the impact of the book on his
psyche and his personal evolution with his discovery of the I Ching
and Taoism, as well as the writings and psychoanalytic teaching of
Francoise Dolto. The author underlines Capra's unique gift of
genius to formulate and explain complex scientific and
philosophical insights and interrelations in a way that the
educated reader can understand. He sees certain parallels in
Capra's life with the lives of Albert Einstein and Wilhelm Reich
who, like him, were from Germanic origin and after their emigration
to the United States only wrote and published in English. The
author especially lauds Capra's basically non-judgmental worldview
and his ability to understand people from ultra-orthodox to very
liberal with the same generosity and magnanimity. Another
noteworthy instance from Capra's life is his long involvement in
the counter culture and his meeting with most of the celebrities of
that culture, as for example Timothy Leary, Stan Grof, Terence
McKenna, Gregory Bateson, or Ronald David Laing and Thomas Szasz,
the founders of the antipsychiatry movement. The author especially
notes Capra's merit is to have introduced the systems view of life
to scientific research, while he is not the originator of the idea,
which was mainly developed by Ludwig von Bertalanffy, Ilya
Prigogine, Humberto Maturana and Francisco Varela. But Capra has
carefully surveyed and summarized this important research that is
generally difficult to grasp to the non-scientific reader, and has
rendered the important idea accessible for the interested lay
audience.
CULINARY PLEASURES IN THE PROVENCE is not a cook book. There are no
recipes. Nor is it a book about food photography in the traditional
sense of the term. The photos are no digital high-quality prints,
but taken spontaneously before enjoying the food the author had
cooked. This being said, the book is rather autobiographical, and
that's why every photo is dated. It is noteworthy that Pierre F.
Walter's cuisine is not planned in any way, that there was no
daily, weekly or monthly setup, as he was at that time very busy
with his music, his videos, his art and his web sites. He cooks a
spontaneous kind of cuisine, and most of the dishes take only 5 to
15 minutes of preparation. All the ideas that you see displayed as
'menus' came up spontaneously and were executed on the spot. Any
kind of planned and organized cuisine would go against his way of
living. All in his life is spontaneous creation This is the secret
of the vibrancy of his photography, and generally, the secret of
happiness, of eternal youth, and of childlike adventure. In this
sense, Walter's food photography expresses the creativeness of his
inner child just as his visual art and his music. (All photos taken
with a Sony VX-2000 as 640x480 stills).
Pierre F. Walter presents a comparative law analysis that spans two
of the seven existing national statutes on foreign sovereign
immunity, the United States' Foreign Sovereign Immunities Act,
1976, and the Canadian State Immunity Act, 1982. The study
concludes in demonstrating two distinct rules of the burden of
proof, for each kind of immunity; the rules are widely uniform, and
were corroborated by case law and scholarly opinion in both of the
examined jurisdictions. In addition, they can be said to form today
rules of international law. The monograph is of high practical
importance for international lawyers and government counsel in both
the United States and Canada. It can be taken as a reference guide
for foreign sovereign immunity litigation in these important
jurisdictions. Pierre F. Walter shows in this study that solid
knowledge of procedural rules and the law of evidence in sovereign
immunity litigation is often the basis of winning a case. While
this is generally so, it is of even more importance in the highly
complex trials that involve foreign sovereign immunity. The law
firm stands out that can anticipate the judge's assessment of the
burden of proof situation in every phase of the trial, thereby
reducing cost for the client and substantially shifting probability
up for winning the case.
EVIDENCE AND BURDEN OF PROOF IN SOVEREIGN IMMUNITY LITIGATION is
the first specialized, and very practically important, analysis of
the evidence problems and the burden of proof in matters of foreign
sovereign immunity litigation, both regarding jurisdictional
immunities and immunity from execution. The monograph is a
comparative law analysis that spans six of the seven existing
national statutes on foreign sovereign immunity, starting with the
United States' Foreign Sovereign Immunities Act, 1976, to the
Canadian State Immunity Act, 1982. The study concludes in
demonstrating two distinct rules of the burden of proof, for each
kind of immunity; the rules are widely uniform, and were
corroborated by case law and scholarly opinion in all of the
examined jurisdictions. They can be said to form today rules of
international law. The monograph is of high practical value for
litigation involving foreign sovereign immunity, particularly for
international lawyers and government counsel. It can be taken as a
reference guide for solving the evidence problems in those trials,
and as such is a precious asset in any international law library.
The only titles that in scope, depth and size can be compared with
the present study are already quite out of date, and they have, if
ever, only randomly dealt with the specific procedural problems of
evidence and burden of proof in international sovereign immunity
litigation.

TOWARD SOCIAL CHANGE, Revised Edition, 2012, presents an articulate
Peace Agenda that contains twelve distinct proposals for reducing
violence to a minimum while promoting and encouraging
pleasure-seeking behaviors both in children and adults. The
proposals are based upon research evidence of the often overlooked
bioenergetic roots of violence demonstrating how the historical
turndown of the pleasure function through compulsive morality or
moralism resulted in an inevitable upsurge of violence through the
neurodissociative brain. Newest research on early tactile
deprivation conducted by James W. Prescott, Ashley Montagu,
Frederick Leboyer, Michel Odent and others namely shows the
correlation between mother-infant affectional bonding, tactile
pleasure and breastfeeding for the development of the healthy,
neurointegrative brain and the building of peaceful and
affectionate behaviors. The most important research results are: -
Violence is learnt, not inborn, and not part of natural human
behavior; - Violence is a response of the biosystem to the denial
of pleasure/desire; - Violence is a collective malfunctioning of a
society that replaced love with moralism. The Peace Agenda consists
of the following 12 Proposals: 01/12 - Crime Prevention 02/12 - The
Possible Human 03/12 - Fostering Public Sanity 04/12 - Respecting
Natural Intimacy 05/12 - Serving Children 06/12 - More Public
Education 07/12 - Free Education 08/12 - Politically Neutral
Science 09/12 - Humanism and Realism 10/12 - Promoting
Pleasure-Seeking Behaviors 11/12 - Male Affection as a Peace
Conductor 12/12 - Fostering Permissive Education
