In- und auslandische Marktteilnehmer mussen sich dabei nicht nur auf stabile rechtliche Verhaltnisse verlassen koennen, sondern haben groesstes Interesse an einem funktionierenden und verlasslichen Gerichtssystem bzw. aussergerichtlichen Mechanismen der Konflikt- und Streitbeilegung. This volume substantially demonstrates the principles anchored in sections 90-103 regarding all relationships related to property law and the resulting interaction of movable and real estate property law, as well as execution proceedings law. In addition, the elementary rules of the legal transaction are comprehensively presented; the influences of legal capacity on trade, company and employment law, among others, are also taken into account within the framework of sections 104 et. sec. The provisions regarding declaration of intent (sections 116-124 and sections 130-133), which are of particular significance for daily practice, are presented in detail.

Before the reform of law of contract the law on protection from inequitable standard business conditions was not applicable to contracts of employment. One objective of the modernization of contract law was to raise the protective level of employment law to the level of general civil law. Contracts of employment are now subject to a check of the contents in terms of the law on standard business conditions. However, suitable account must be taken of the special features that apply in employment law when the provisions governing standard business conditions are applied to contracts of employment.

[Writings pertaining to European and international private, banking and commercial law] Europeanization and internationalization challenge the realm of jurisprudence to an extraordinary degree. The division in special fields and the relationship with other social sciences necessitate critical reevaluation in view of many interactions.
