ADR-Verfahren sind in letzter Zeit zunehmend in die Kritik geraten.
Sie ermoeglichen es jedoch, den Rechtsstaatsgedanken in
verschiedener Weise zu foerdern: So koennen sie einen einfachen
Zugang zur Justiz schaffen, die Kosten und den Zeitaufwand fur
Streitbeteiligung verringern, eine Alternative zu korrupten oder
parteilichen Gerichtssystemen sein und auslandische Investitionen
foerdern. Daruber hinaus koennen diese Verfahren Minderheiten
besseren Zugang zur Justiz verschaffen und die
Eigenverantwortlichkeit und den Zusammenhalt von Burgern starken.
Verkannt werden darf dabei nicht, dass ADR-Verfahren und das
Gerichtssystem aufeinander angewiesen sind. ADR- und
Gerichtsverfahren sollten daher nicht als Alternative zueinander
verstanden werden, sondern als gegenseitige Erganzung. Der Band
geht diesen Fragen nach und stellt ausgewahlte Probleme der
Schiedsgerichtsbarkeit und der Mediation in den Landern
Deutschland, Polen und der Ukraine dar. Erganzend behandelt er die
Neuregelung der Schiedsgerichtsbarkeit in Rumanien.
Das Buch enthalt einen UEberblick uber die wichtigsten aktuellen
Entwicklungen im Bereich des Strafprozessrechts in Deutschland,
Polen und der Ukraine. In allen drei Staaten wurden - wenn auch in
unterschiedlichem Masse - adversatorische Elemente in die StPO
eingefugt. In dem Band werden zunachst die Modelle des
Strafprozesses erlautert und die Reformen vorgestellt,
anschliessend werden ausgewahlte, fur das Strafverfahren besonders
wichtige Bereiche fokussiert: die Verteidigung, verdeckte
Ermittlungsmassnahmen sowie Vereinbarungen im Strafprozess. Die
Autoren sind hochrangige Spezialisten auf dem Gebiet des
Strafrechts und des Strafprozessrechts mit Erfahrungen aus
Wissenschaft und Praxis und haben zum Teil an den Gesetzesnovellen
zur jeweiligen StPO massgeblich mitgearbeitet oder gutachterlich im
Gesetzgebungsprozess beraten. Die Beitrage in diesem Band wurden
groesstenteils wahrend des Projekts des IOR Strafprozessrecht im
Vergleich - die deutsche, polnische und ukrainische Perspektive
erarbeitet. Das Projekt sowie dieser Band wurden vom DAAD aus
Mitteln des Auswartigen Amtes gefoerdert.
