Alternative Dispute Resolution in the Construction Industry - An Evaluation of UK Research and Practice (Hardcover): Andrew... Alternative Dispute Resolution in the Construction Industry - An Evaluation of UK Research and Practice (Hardcover)
Andrew Agapiou
R2,452 Discovery Miles 24 520 Ships in 12 - 17 working days

Construction disputes by their very nature are often complex, sometimes multi-party disputes, many of which are not suited to either adjudication or traditional form of litigation (which are often slow, expensive and divisive). The sheer complexity of construction creates a compelling case for the introduction of alternative approaches within this adversarial industry. This book traces the history, development, current status and future direction of Alternative Dispute Resolution (ADR) in the UK construction industry. It draws on the largest collection of Royal Institution of Chartered Surveyors-funded surveys on Scottish and English disputants' perceptions and attitudes to ADR. It includes an examination of the key legislative and regulatory principles relating to ADR in the Construction sphere. The study also evaluates the role and functions of the Technology and Construction Court (TCC) in England and, with reference to case law, identifies its facilitative approach to ADR. The coherence of the TCC's approach to issues such as refusal to resort to ADR is also examined. It will be a valuable reference work for scholars and practitioners in construction and the built environment, in the UK and internationally.

A Contractor's Guide to the FIDIC Conditions of Contract (Hardcover): M D Robinson A Contractor's Guide to the FIDIC Conditions of Contract (Hardcover)
M D Robinson
R2,117 Discovery Miles 21 170 Ships in 12 - 17 working days

This guide will help the contractor's staff overcome some of the difficulties encountered on a typical international contract using FIDIC forms.

The majority of FIDIC-based contracts use the Red Book (Conditions of Contract for Construction), so this book concentrates on the use of those particular forms. Supplementary comments are included in Appendix C for the Yellow Book (Plant & Design-Build) recommended for use where the contractor has a design responsibility.
The Contractor is represented on site by the Contractor's Representative who carries the overall responsibility for all the Contractor's on-site activities. In order to provide guidance to the Contractor's Representative and his staff, this book is divided into five sections: A summarized general review of the Red Book from the Contractor's perspective.A review of the activities and duties of the Contractor's Representative in the same clause sequencing as they appear in the Red Book.A summary of these activities and duties but arranged in order of their likely time sequence on site. This has the added intention of providing the Contractor's Representative with a means of ensuring that documents are not only properly provided to the Employer and Engineer, but most importantly that they are provided within the time limits specified in the Contract.A selection of model letters is provided which make reference to the various clauses of the contract requiring the Contractor to make submissions to the Employer or Engineer.Various appendices.

The guide is not intended to be a review of the legal aspects of FIDIC- based contracts; legal advice should be obtained as and when necessary, particularly if the Contractor has little or no knowledge of the local law.

Armed on site with a copy of The Contractor and the FIDIC Contract, the Contractor's Representative will be more able to avoid contractual problems rather than spend considerable time and energy resolving those problems once they have arisen.

A Research Agenda for Construction Management (Hardcover): Roine Leiringer, Andy Dainty A Research Agenda for Construction Management (Hardcover)
Roine Leiringer, Andy Dainty
R3,335 Discovery Miles 33 350 Ships in 12 - 17 working days

Elgar Research Agendas outline the future of research in a given area. Leading scholars are given the space to explore their subject in provocative ways, and map out the potential directions of travel. They are relevant but also visionary. This impressive book challenges the orthodoxies that have dominated the construction management research (CMR) field for the past 50 years. Providing a comprehensive framework for understanding the complex and multi-faceted domain of construction, A Research Agenda for Construction Management sets out a range of alternative perspectives which problematise the axioms upon which much CMR knowledge is based and offers new directions for the research community to consider. Chapters range from exploring approaches to better understand the industry and its various functions, to discussing how alternative theoretical positions might be mobilised to shed new light on complex socio-economic activity. By challenging the ways in which construction is viewed, this Research Agenda subjects dominant research approaches and paradigms to critical scrutiny, ultimately encouraging future researchers to reflect on and adopt more creative and meaningful approaches to their work. By identifying new and emergent themes and exploring how these can be researched, this incisive Research Agenda will be of considerable interest to researchers and academics in the field of construction management research. Its thought-provoking chapters will also make this a fitting read for research-engaged construction practitioners.

Narratives in Megaprojects (Paperback): Natalya Sergeeva, Johan Ninan Narratives in Megaprojects (Paperback)
Natalya Sergeeva, Johan Ninan
R1,351 Discovery Miles 13 510 Ships in 9 - 15 working days

This book is a novel contribution to a field dominated by conventional approaches to project management, it is about narratives in megaprojects. Some of the questions examined in this original new book include: * What are narratives? * Why are they important in megaprojects? * How are they formed and used in megaprojects? * How do promotors of and protestors against megaprojects craft narratives to their advantage? * What strategies can project managers employ to effectively use narratives in megaprojects? Built from longitudinal research studies in combination with internationally recognised teaching materials, this book will provide readers with a theoretical understanding of narratives and projects, as well as practical international case studies, including HS2, the Eden Project, the Sochi Olympics, Hyderabad and Chennai Metros, Westconnex and Tideway, to support their understanding. The authors explain the different types of narrative, how and why they are important in general and in relation to a megaproject and its life-cycle, but also how to craft narratives in different situations, and how they are changed and maintained over a project life-cycle. Narratives in Megaprojects doubles as a text supporting more advanced courses on project management or aspects thereof, and as a reflection of the state of the art in this particular perspective on megaprojects. It is essential reading for all students and professionals in Project Management, Construction, Infrastructure and Executive Leaders involved in megaprojects and infrastructure delivery.
