Preventing the spread of weapons of mass destruction (WMD) is an urgent national and international security objective. How to realize this goal is a controversial matter, though. Chemical and biological weapons and missile technology are threats to peace equaled only by nuclear weapons. Yet for the grave dangers they pose, and despite the intense alarm expressed over the proliferation of non-nuclear WMD over the past decade, scholarly studies of national endeavors to stop the spread of these weapons is scant. Cooper remedies this by developing conceptual and normative frameworks to better understand national non-proliferation efforts, then examines competing U.S. and Australian strategies, respectively, of capability denial, non-possession norm building and consequence management. While not wholly incompatible, these competing strategies often impede one another's progress and illuminate larger fissures in Western non-proliferation policies; fissures that ultimately may splinter international coordination and enervate future attempts to prevent the pernicious multiplication of WMDs.

The internment of thousands of Japanese Americans during World War II is one of the most shameful episodes in American history. Why did the U.S. government take this extraordinary action? How was the evacuation and resettlement handled? The issue of prisoners in war is a highly timely topic that has received much attention from both scholars and practitioners since the start of the military operations in Afghanistan and Iraq and the ensuing legal and political problems concerning detainees in those conflicts. This book analyzes these contemporary problems and challenges against the background of their historical development. It provides a multidisciplinary yet highly coherent perspective on the historical trajectory of legal and ethical norms in this field by integrating the historical analysis of war with a study of the emergence of the modern legal regime of prisoners in war. In doing so, it provides the first comprehensive study of prisoners, detainees and internees in war, covering a broad range of both regular and irregular wars from the crusades to contemporary counterinsurgency campaigns.
The book revolves around two major developments: First, there has been a continuous increase in the political relevance of prisoners in war, in particular since the emergence of POW camps in the nineteenth century. Secondly, and related, the growth in the legal regime pertaining to prisoners had contradictory consequences. Whilst it enhanced the protection of prisoners in regular conflicts, its state-centric bias tends to exclude combatants who do not fit the template of regular inter-state war. Detainees in the 'war on terror' embody both tendencies, the development of which, however, is by no means a novel phenomenon.

The United States faces a small number of rogue states that either have or are working to acquire weapons of mass destruction. These NASTIs, or NBC-Arming Sponsors of Terrorism and Intervention, include such states as North Korea, Iraq, Iran, Libya, and Syria. U.S. nonproliferation programs and policies have helped to keep this number small, but U.S. and allied counterproliferation programs are essential to reduce the danger. It is up to deterrence, active defenses, passive defenses, decontamination, and counterforce to turn enemy weapons of mass destruction into instruments of limited destructive effect. Warfighters will also have to adopt a different strategy and concept of operations in fighting an adversary that is so heavily armed. This strategy will feature a combination of deception, dispersion, mobility and maneuver, diffused logistics, remote engagement, missile defense bubbles, non-combatant evacuation operations, and large area decontamination. It will also involve upgrades to NBC passive defense measures and equipment, as well as a counterforce capability that can find and destroy a variety of adversary targets, including mobile launchers and deeply buried and hardened underground structures.

Modern corporations are key participants in the new globalized economy. As such, they have been accorded tremendous latitude and granted extensive rights. However, accompanying obligations have not been similarly forthcoming. Chief among them is the obligation not to commit atrocities or human rights abuses in the pursuit of profit. Multinational corporations are increasingly complicit in genocides that occur in the developing world. While they benefit enormously from the crime, they are immune from prosecution at the international level. Prosecuting Corporations for Genocide proposes new legal pathways to ensure such companies are held criminally liable for their conduct by creating a framework for international criminal jurisdiction. If a state or a person commits genocide, they are punished, and international law demands such. Nevertheless, corporate actors have successfully avoided this through an array of legal arguments which Professor Kelly challenges. He demonstrates how international criminal jurisdiction should be extended over corporations for complicity in genocide and makes the case that it should be done promptly.

In a book certain to generate controversy and debate, Idith Zertal boldly interprets a much revered chapter in contemporary Jewish and Zionist history: the clandestine immigration to Palestine of Jewish refugees, most of them Holocaust survivors, that was organized by Palestinian Zionists just after World War II. Events that captured the attention of the world, such as the Exodus affair in the summer 1947, are seen here in a strikingly new light. At the center of Zertal's book is the Mossad, a small, unorthodox Zionist organization whose mission beginning in 1938 was to bring Jews to Palestine in order to subvert the British quotas on Jewish immigration. Zertal's moving story sweeps across four continents and encompasses a range of political cultures and international forces. According to Zertal, this psychologically painful yet politically powerful encounter was the Zionists' most effective weapon in their struggle for a sovereign Jewish state. Drawing on primary archival documents and new readings of canonical texts of the period, she analyzes this encounter from all angles - political, social, cultural, and psychological. The outcome is a gripping and troubling human story of a crucial period in Jewish and Israeli history, one that also provides a key to understanding the fundamental tensions between Israel and the Jewish communities and Israel and the world today.

Drawing on previously inaccessible and overlooked archival sources, The Herero Genocide undertakes a groundbreaking investigation into the war between colonizer and colonized in what was formerly German South-West Africa and is today the nation of Namibia. In addition to its eye-opening depictions of the starvation, disease, mass captivity, and other atrocities suffered by the Herero, it reaches surprising conclusions about the nature of imperial dominion, showing how the colonial state's genocidal posture arose from its own inherent weakness and military failures. The result is an indispensable account of a genocide that has been neglected for too long.

Controversy over Iranian nuclear policy has been mounting in both legal and political circles since the early 2000s. Most recently, the International Atomic Energy Association (IAEA), tasked with verifying compliance of Member States with the Nuclear Non-Proliferation Treaty, has been expressing concern that Iran's nuclear efforts are directed not solely toward peaceful uses, but also for military purposes. In response, various States have tried, individually and collectively, to engage Iran in agreed frameworks of action that would include an Iranian self-imposed restraint regarding its nuclear development. This volume documents the Iranian nuclear issue, tracing the evolution of international interest and concern with Iran's nuclear policy since the 1970s, when Iran began earnest efforts to acquire nuclear capabilities. Emphasis is nonetheless placed on events since 2002-2003, when it was established that Iran had concealed certain aspects of its nuclear activities from the IAEA. Alongside reports of the IAEA and Security Council documents, the volume covers diverse sources rather than relying solely on UN organs and agencies, international organizations, or dedicated ad hoc bodies.

The first book to study post-Cold War U.S. nuclear weapons policy. It is based on extensive original research with dozens of the key players, and sheds important new light US foreign policy. "Nuclear Inertia" examines why, despite the Cold War having ended more than ten years ago, the US still maintains an arsenal of over 10 000 nuclear warheads. Most explanations for this are to be found not in the structure of the international system but in domestic politics. Tom Sauer ascribes the lack of change to bureaucratic resistance, dogmatic thinking and lack of political leadership. Clinton tried to change US policy by initiating the 1993-1994 Nuclear Posture Review but was blocked by bureaucratic opposition. Sauer suggests that this points to a lack of civilian control over the military during the Clinton administration.

This work discusses the 16-year civil war in Lebanon which was caused by dissatisfaction over the distribution of political power. The system favoured Christians who fought to eject Palestinian armed forces, which sought to use the country as a spring board for attacks into adjacent Israel. Western intervention was repelled by suicide bombing attacks. Lebanese Christians and Muslims sub-divided to fight each other. Dominated by competing war lords, this civil war was notable for massacres, treachery, atrocities, kidnapping, assassination, changing alliances of convenience, and invasions.

This book provides the first comprehensive critical analysis of the regulation of naval weapons during armed conflict. It examines the experience this century with the use of naval mines, submarines and anti-ship missiles, the three main naval weapons. The sources of international law relevant to an assessment of the law, that is the extant conventions, state practice, military manuals, war crimes prosecutions, and the opinions of publicists, are each extensively examined so that a clear picture of the law emerges. The book examines the impact of agreements drawn up in peacetime on wartime conduct and focuses on the growth of law through customary practice. While stating the law as it is today, it also provides suggestions for the practical development of the law.

Exploring one of the least studied genocides in post-conquest South America, Robins calls into question many of the central assumptions currently held by genocide scholars. Victims of genocide usually lack the organization and weaponry to battle their enemies. During the 1780-1782 Great Rebellion in Peru and Upper Peru (now Bolivia), however, the Indian revolutionaries faced the better-organized and armed loyalist army. Whereas genocidal policies are usually characterized by centralized leadership, the Great Rebellion was highly fragmented and confederational in nature, undercutting the widely-held assumption that only the State is capable of committing genocide. The Rebellion is one of the rare cases when the victims of genocide emerged victorious.

Focusing on the events occurring in the region south of La Paz, Robins examines how a native millennial movement evolved into an Indian-led attempt at genocide, dealing an unprecedented challenge to Spanish rule in the Americas. In the eyes of the rebels, this revolt fulfilled prophecies of an inevitable, divinely assisted, and long-awaited return of native rule. Just like at the dawn of the colonial period, this new era was to be born of "pachacuti," or cataclysm. But this time the Spanish interlopers and their culture would be targeted for destruction.
