The FIDIC Handbook Series will form a series of low cost guides to all FIDIC Contract administrators. They will ensure that appropriate timely actions are taken during the course of a construction contract in order to improve communication, stimulate better administration and highlight accountability at an early stage, thereby improving the working relationships between the parties and reducing the potential for disputes. The guidelines suggest actions for each party to take, stipulate the time to take such action, provide relevant comments and includes model letters where appropriate for each Sub-Clause within the Contract. This book, FIDIC Handbook - Red, provides commentary on the Red Book: FIDIC Conditions of Contracts for Construction for building and engineering works designed by the Employer.
American women fare worse than men on virtually every major dimension of social status, financial wellbeing, and physical safety. Sexual violence remains common, and reproductive rights are by no means secure. Women assume disproportionate burdens in the home and pay a heavy price in the workplace. Yet these issues are not political priorities, and worse, there is a lack of consensus that there still is a serious problem, or at least one that women have any reason or capacity to address. This 'no problem' problem helps explain why women fail to mobilize around issues that materially affect the quality of their lives. Why is this, why does it matter, and how can we best respond? Nancy Gertner launched her legal career by defending antiwar
activist Susan Saxe, who was on trial for her role in a robbery

Constitutionalism affirms the idea that democracy should not lead to the violation of human rights or the oppression of minorities. This book aims to explore the relationship between constitutional law and feminism. The contributors offer a spectrum of approaches and the analysis is set across a wide range of topics, including both familiar ones like reproductive rights and marital status, and emerging issues such as a new societal approach to household labor and participation of women in constitutional discussions online. Gender oppression has been a feature of war and conflict throughout
human history, yet until fairly recently, little attention was
devoted to addressing the consequences of violence and
discrimination experienced by women in post-conflict states.
Thankfully, that is changing. Today, in a variety of post-conflict
settings--the former Yugoslavia, Afghanistan, Colombia, Northern
Ireland --international advocates for women's rights have focused
bringing issues of sexual violence, discrimination and exclusion
into peace-making processes.
Theories of gender justice in the twenty-first century must engage with global economic and social processes. Using concepts from economic analysis associated with global commodity chains and feminist ethics of care, Ann Stewart considers the way in which 'gender contracts' relating to work and care contribute to gender inequalities worldwide. Desire, Professor Yvonne Zylan explores the role of legal discourse
in shaping sexual experience, sexual expression, and sexual
identity. The book focuses on three topics: anti-gay hate crime
laws, same-sex sexual harassment, and same-sex marriage, examining
how sexuality is socially constructed through the
institutionally-specific production of legal discourse.
Title IX, a landmark federal statute enacted in 1972 to prohibit sex discrimination in education, has worked its way into American culture as few other laws have. It is an iconic law, the subject of web blogs and T-shirt slogans, and is widely credited with opening the doors to the massive numbers of girls and women now participating in competitive sports. Yet few people fully understand the law's requirements, or the extent to which it has succeeded in challenging the gender norms that have circumscribed women's opportunities as athletes and their place in society more generally. In this first legal analysis of Title IX, Deborah L. Brake assesses the statute's successes and failures. While the statute has created tremendous gains for female athletes, not only raising the visibility and cultural acceptance of women in sports, but also creating social bonds for women, positive body images, and leadership roles, the disparities in funding between men's and women's sports have remained remarkably resilient. At the same time, female athletes continue to receive less prestige and support than their male counterparts, which in turn filters into the arena of professional sports. Brake provides a richer understanding and appreciation of what Title IX has accomplished, while taking a critical look at the places where the law has fallen short. The common law action for breach of promise of marriage originated in the mid-seventeenth century, but it was not until the nineteenth century that it rose to prominence and became a regular feature in law courts and gossip columns. By 1940 the action was defunct, it was inconceivable for a respectable woman to bring such a case before the courts. What accounts for this dramatic rise and fall? This book ties the story of the action's prominence and decline between 1800 and 1940 to changes in the prevalent conception of woman, her ideal role in society, sexual relations, and the family. It argues that the idiosyncratic breach-of-promise suit and Victorian notions of ideal femininity were inextricably, and fatally, entwined. It presents the nineteenth-century breach-of-promise action as a codification of the Victorian ideal of true womanhood and explores the longer-term implications of this infusion of mythologized femininity for the law, in particular for the position of plaintiffs. Surveying three consecutive time periods - the early nineteenth century, the high Victorian and the post-Victorian periods - and adopting an interdisciplinary approach that combines the perspectives of legal history, social history, and literary analysis, it argues that the feminizing process, by shaping a cause of action in accordance with an ideal at odds with the very notion of women going to law, imported a fatal structural inconsistency that at first remained obscured, but ultimately vulgarized and undid the cause of action. Alongside more than two hundred and fifty real-life breach-of-promise cases, the book examines literary and cinematic renditions of the breach-of-promise theme, by artists ranging from Charles Dickens to P.G. Wodehouse, to expose the subtle yet unmistakable ways in which what happened (and what changed) in the breach-of-promise courtroom influenced the changing representation of the breach-of-promise plaintiff in nineteenth- and early twentieth-century literature and film.
All across America, angry fathers are demanding rights. These men claim that since the breakdown of their own families, they have been deprived of access to their children. Joining together to form fathers' rights groups, the mostly white, middle-class men meet in small venues to speak their minds about the state of the American family and, more specifically, to talk about the problems they personally face, for which they blame current child support and child custody policies. Dissatisfied with these systems, fathers' rights groups advocate on behalf of legal reforms that will lower their child support payments and help them obtain automatic joint custody of their children. In Defiant Dads, Jocelyn Elise Crowley offers a balanced examination of these groups in order to understand why they object to the current child support and child custody systems; what their political agenda, if enacted, would mean for their members' children or children's mothers; and how well they deal with their members' interpersonal issues concerning their ex-partners and their role as parents. Based on interviews with more than 150 fathers' rights group leaders and members, as well as close observation of group meetings and analysis of their rhetoric and advocacy literature, this important book is the first extensive, in-depth account of the emergence of fathers' rights groups in the United States. A nuanced and timely look at an emerging social movement, Defiant Dads is a revealing investigation into the changing dynamics of both the American family and gender relations in American society.

property offender. Only half a century later, this would have been
next to unthinkable. Lacey explores the disappearance of Moll, and
her supercession in the annals of literary female offenders by
heroines like Tess, serving as a metaphor for fundamental changes
in ideas of selfhood, gender and social order in 18th and 19th
Century England. Drawing on law, literature, philosophy and social
history, she argues that these broad changes underpinned a radical
shift in mechanisms of responsibility-attribution, with decisive
implications for the criminalization of women.

At what age do girls gain the maturity to make sexual choices? This question provokes especially vexed debates in India, where early marriage is a widespread practice. India has served as a focal problem site in NGO campaigns and intergovernmental conferences setting age standards for sexual maturity. Over the last century, the country shifted the legal age of marriage from twelve, among the lowest in the world, to eighteen, at the high end of the global spectrum. Ashwini Tambe illuminates the ideas that shaped such shifts: how the concept of adolescence as a sheltered phase led to delaying both marriage and legal adulthood; how the imperative of population control influenced laws on marriage age; and how imperial moral hierarchies between nations provoked defensive postures within India. Tambe's transnational feminist approach to legal history shows how intergovernmental debates influenced Indian laws and how expert discourses in India changed UN terminology about girls. Ultimately, the well-meaning focus on child marriage became tethered less to the well-being of girls themselves and more to parents' interests, population control targets, and the preservation of national reputation.
This book brings together leading legal scholars and practitioners from across the Asia-Pacific region to probe the ways in which trusts law has been adapted by various jurisdictions, and to analyse their causes and effects. The contributions discuss how the trust structure, with its inherent malleability, has been adapted to meet a diverse set of local needs, including social, religious, economic, commercial, or even historical needs. But in most instances, those needs - and the ways in which trusts law has been adapted to meet them - are not unique to a single jurisdiction: they often (coincidentally or otherwise) find much in common with others. Too much attention is paid to the absence of women leaders around the world rather than their presence, leaving a gap in our understanding of the difference women leaders make on the lives of fellow women. The Woman President presents a unique comparative study of women's leadership and the law, offering new ways for understanding the impact of female presidential leadership on women's everyday lives by analysing the legal legacies of four women presidents: Corazon Aquino (1986-1992), Gloria Macapagal Arroyo (2001-2010), Megawati Sukarnoputri (2001-2004), and Chandrika Bandaranaike Kumaratunga (1994-2005). Lifetime Disadvantage, Discrimination and the Gendered Workforce fills a gap in the literature on discrimination and disadvantage suffered by women at work by focusing on the inadequacies of the current law and the need for a new holistic approach. Each stage of the working life cycle for women is examined with a critical consideration of how the law attempts to address the problems that inhibit women's labour force participation. By using their model of lifetime disadvantage, the authors show how the law adopts an incremental and disjointed approach to resolving the challenges, and argue that a more holistic orientation towards eliminating women's discrimination and disadvantage is required before true gender equality can be achieved. Using the concept of resilience from vulnerability theory, the authors advocate a reconfigured workplace that acknowledges yet transcends gender. |
