The Syrian war has been an example of the abuse and insufficient delivery of humanitarian assistance. According to international practice, humanitarian aid should be channelled through a state government that bears a particular responsibility for its population. Yet in Syria, the bulk of relief went through Damascus while the regime caused the vast majority of civilian deaths. Should the UN have severed its cooperation with the government and neglected its humanitarian duty to help all people in need? Decision-makers face these tough policy dilemmas, and often the "neutrality trap" snaps shut. This book discusses the political and moral considerations of how to respond to a brutal and complex crisis while adhering to international law and practice. The author, a scholar and senior diplomat involved in the UN peace talks in Geneva, draws from first-hand diplomatic, practitioner and UN sources. This includes covering the key questions asked by Western diplomats, NGOs and international organizations, such as: Why did the UN not confront the Syrian government more boldly? Was it not only legally correct but also morally justifiable to deliver humanitarian aid to regime areas where rockets were launched and warplanes started? Why was it so difficult to render cross-border aid possible where it was badly needed? The meticulous account of current international practice is both insightful and disturbing. It tackles the painful lessons learnt and provides recommendations for future challenges where politics fails and humanitarians fill the moral void.
The politics of legitimacy is central to international relations. When states perceive an international organization as legitimate, they defer to it, associate themselves with it, and invoke its symbols. Examining the United Nations Security Council, Ian Hurd demonstrates how legitimacy is created, used, and contested in international relations. The Council's authority depends on its legitimacy, and therefore its legitimation and delegitimation are of the highest importance to states. Through an examination of the politics of the Security Council, including the Iraq invasion and the negotiating history of the United Nations Charter, Hurd shows that when states use the Council's legitimacy for their own purposes, they reaffirm its stature and find themselves contributing to its authority. Case studies of the Libyan sanctions, peacekeeping efforts, and the symbolic politics of the Council demonstrate how the legitimacy of the Council shapes world politics and how legitimated authority can be transferred from states to international organizations. With authority shared between states and other institutions, the interstate system is not a realm of anarchy. Sovereignty is distributed among institutions that have power because they are perceived as legitimate. This book's innovative approach to international organizations and international relations theory lends new insight into interactions between sovereign states and the United Nations, and between legitimacy and the exercise of power in international relations.
The issue of state succession continues to be a vital and complex focal point for public international lawyers, yet it has remained strangely resistant to effective articulation. The formative period in this respect was that of decolonization which marked for many the time when international law came of age and when the promises of the UN Charter would be realized in an international community of sovereign peoples. Throughout the 1990s a series of territorial adjustments placed succession once again at the centre of international legal practice, in new contexts that went beyond the traditional model of decolonization: the disintegration of the Soviet Union, Yugoslavia, and Czechoslovakia, and the unifications of Germany and Yemen brought to light the fundamentally unresolved character of issues within the law of succession. Why have attempts to codify the practice of succession met with so little success? Why has succession remained so problematic a feature of international law? This book argues that the answers to these questions lie in the political backdrop of decolonization and self-determination, and that the tensions and ambiguities that run throughout the law of succession can only be understood by looking at the historical relationship between discourses on state succession, decolonization, and imperialism within the framework of international law.
This is a study of the principal negotiating processes and
law-making tools through which contemporary international law is
made. It does not seek to give an account of the traditional - and
untraditional - sources and theories of international law, but
rather to identify the processes, participants and instruments
employed in the making of international law. It accordingly
examines some of the mechanisms and procedures whereby new rules of
law are created or old rules are amended or abrogated. It
concentrates on the UN, other international organizations,
diplomatic conferences, codification bodies, NGOs, and courts.

This book is a study of recent experiences in the international administration of war-torn territories. It examines the nature of these operations - their mandates, structures, and powers - and distinguishes them from kindred historical and contemporary experiences of peacekeeping, trusteeship, and military occupation. It analyses and assesses the effectiveness of international administrations and discusses, in thematic fashion, the key operational and political challenges that arise in the context of these experiences. It also reflects on the policy implications of these experiences, recommending reforms or new approaches to the challenge posed by localized anarchy in a global context. It argues that, despite many of the problems arising from both the design and implementation of international administrations, international administration has generally made a positive contribution to the mitigation of conflict in the territories where they have been established, thus removing or reducing a threat to peace and helping to improve the lives of the vast majority of the territories' inhabitants. The governance of post-conflict territories embodies a central contradiction: how does one help a population prepare for democratic governance and the rule of law by imposing a form of benevolent autocracy? Transitional administrations represent the most complex operations attempted by the United Nations. The operations in East Timor and Kosovo are commonly seen as unique in the history of the UN - perhaps never to be repeated. But they may also be seen as the latest in a series of operations that have involved the United Nations in 'state-building' activities, where it has attempted to develop the institutions of government by assuming some or all of those sovereign powers on a temporary basis. The circumstances that have demanded such interventions certainly will be repeated. Seen in the context of earlier UN operations, such as those in Namibia, Cambodia, and Eastern Slavonia, the view that these exceptional circumstances may not recur is somewhat disingenuous. This book examines the role of UNHCR in world politics since its founding 50 years ago, its relevance towards reaching solutions to global refugee problems, and its effectiveness as the international community's principal protection mechanism for persecuted populations who have been forced into exile. This book provides a legal analysis of the institutional mechanisms and processes which the UN employs to use force to maintain or restore peace. Over the centuries, societies have gradually developed constraints on the use of armed force in the conduct of foreign relations. The crowning achievement of these efforts occurred in the midtwentieth century with the general acceptance among the states of the world that the use of military force for territorial expansion was unacceptable. A central challenge for the twenty-first century rests in reconciling these constraints with the increasing desire to protect innocent persons from human rights deprivations that often take place during civil war or result from persecution by autocratic governments. "Humanitarian Intervention" is a detailed look at the historical development of constraints on the use of force and at incidents of humanitarian intervention prior to, during, and after the Cold War.
The United Nations Charter establishes six "principal organs". Five of these are expressly authorized or permitted to deal with human rights. The single exception is the Security Council, but the Council has increasingly concerned itself with human rights inside sovereign states. This book recounts how this trend has developed in the Security Council, reluctantly at first, but since 1989 with some enthusiasm and responsibilty. Some Third World countries are uneasy at this development, fearing that the Security Council, dominated by a single super power, will interfere in the internal affairs of states without the agreement of the government concerned.

After three decades of remarkable progress, improvements in the welfare of children and other vulnerable groups in many parts of the world began to falter in the 1980s. This study draws on UNICEF work and experience of recent years to illustrate the extent of the current crisis and point to ways to alleviate the effects caused by economic adjustment. Volume 1 developed a strategy for protecting vulnerable populations during adjustment. The strategy, "Adjustment with a Human Face", combines the promotion of economic growth, protection of the vulnerable, and macro-economic adjustment. An ethnography on early-career workers facing job insecurity at the United Nations. This ethnography focuses on the work and lifeworld at the United Nations in Geneva and Vienna. By emphasizing the perspectives of entry-level workers, this book addresses the increasing flexibility and job insecurity for those at the beginning of their potential UN careers. It explores questions such as: How do career aspirants reconcile their narratives with the organization's image built over the past decades? How can we understand institutional power and individual agency through the lens of ritual theory and the theory of social orders? This study finally examines the entangled discourses around privilege and prestige on the one hand and the precarity and vulnerability of a growing number of UN workers on the other hand. It shows that these phenomena are not contractionary but two sides of the coin. Using the UN as an example, the study considers mechanisms of flexible and unstable work environments in times of cognitive and affective capitalism.
