This book provides a detailed overview on methods used for the dating of past torrential activity on fans and cones and fosters the discussion on the impact of past and potential future climate change on torrential processes. Dendrogeomorphology Beginnings and Futures: A Personal Reminiscence My early forays into dendrogeomorphology occurred long before I even knew what that word meant. I was working as a young geoscientist in the 1960s and early 1970s on a problem with slope movements and deformed vegetation. At the same time, unknown to me, Jouko Alestalo in Finland was doing something similar. Both of us had seen that trees which produced annual growth rings were reacting to g- morphic processes resulting in changes in their internal and external growth p- terns. Dendroclimatology was an already well established field, but the reactions of trees to other environmental processes were far less well understood in the 1960s. It was Alestalo (1971) who first used the term, dendrogeomorphology. In the early 1970s, I could see that active slope-movement processes were affecting the growth of trees in diverse ways at certain localities. I wanted to learn more about those processes and try to extract a long-term chronology of movement from the highly diverse ring patterns.

Der Urlaub ist die Zeit, in der Arbeitnehmer Abstand von ihrer Arbeitstatigkeit gewinnen sollen. Gleichwohl kommt es vor, dass Arbeitnehmer fur ihren Arbeitgeber wahrend dieser Zeit erreichbar sind. Die Autorin geht den Rechtsfragen nach, ob Arbeitnehmer zu einem Erreichbarkeitsverhalten verpflichtet sein koennen und welche Auswirkungen dieses auf die Erfullbarkeit ihres Urlaubsanspruchs mit den entsprechenden Rechtsfolgen hat. Ferner untersucht die Autorin, welche Gestaltungsmoeglichkeiten bezuglich des vertraglichen Urlaubsanspruchs bestehen. Zudem wird auf die rechtlichen Unterschiede, die sich aus der Erreichbarkeit eines Arbeitnehmers in seiner Position als Betriebsratsmitglied ergeben, eingegangen. Abschliessend werden konkrete Regelungsvorschlage aufgezeigt
Das in der Betriebsverfassung nur fragmentarisch gezeichnete Verhaltnis vom Arbeitnehmer zum Betriebsrat bildet die Kernuntersuchung dieses Werks. Der fehlende Schutz des einzelnen Arbeitnehmers vor nachteiligen Entscheidungen der Interessenvertretung lasst sich dabei als Systemproblem der Betriebsverfassung begreifen. Die vorliegende Monographie adressiert diese Problematik erstmals umfassend. Unter Heranziehung des anerkannten Auslegungskanons und rechtsgebietsubergreifender sowie rechtsvergleichender Aspekte lasst sich nach Ansicht des Autors daruber hinaus bereits de lege lata eine Verbesserung der Rechtsstellung des Arbeitnehmers erreichen. Den Kern der UEberlegung bildet dabei 75 BetrVG.
Fingierte Arbeitsverhaltnisse bilden seltene Ausnahmen im deutschen Arbeitsrecht. Der Autor untersucht umfassend Tatbestand und Rechtsfolgen fingierter Arbeitsverhaltnisse aufgrund illegaler Arbeitnehmeruberlassung. Die durch die AUEG-Reform 2017 eingefuhrten Neuregelungen zu verdeckter Arbeitnehmeruberlassung und Verstoessen gegen die Hoechstuberlassungsdauer sind bereits berucksichtigt. Die Untersuchung resultiert in dem Vorschlag, anstelle der Fiktion eine Burgenhaftung des Entleihers einzufuhren.
Allgemeine Geschaftsbedingungen koennen gemass 307 Abs. 1 S. 2 BGB auch dann unangemessen benachteiligend und damit unwirksam sein, wenn sie nicht klar und verstandlich formuliert sind. Dieses Transparenzgebot wurde im Zuge der Schuldrechtsmodernisierung 2001 in der Generalklausel des AGB-Rechts verankert, nachdem es zuvor als richterrechtliches Prinzip entwickelt worden war. Der Autor untersucht in seiner Arbeit zunachst die methodischen und dogmatischen Auswirkungen dieser Kodifikation auf Grund, Inhalt und Grenzen des Transparenzgebots. Im Mittelpunkt steht dabei das Verhaltnis zwischen materieller Inhalts- und formaler Transparenzkontrolle. Einen weiteren Schwerpunkt bilden die Prinzipien zur Bestimmung von Intransparenz sowie deren Unangemessenheit. Daruber hinaus wird die Verortung der Transparenzkontrolle im Gesamtsystem der AGB-Kontrolle verortet und insbesondere zur Auslegung (Unklarheitenregel) abgegrenzt sowie im inhaltskontrollfreien Bereich deklaratorischer und leistungsbestimmender Klauseln definiert. Schliesslich werden die entwickelten Grundsatze anhand einiger praktischer Fragestellungen in dem gesonderten Bereich der Arbeitsvertragskontrolle exemplifiziert.
