The labour law applicable to the education environment is comprehensive and covers a vast variety of aspects that everyone within that environment will encounter at one time or another. In the past, most employees in education may have had a vague understanding of particular laws and regulations regarding conditions of employment, but now it is essential to have a basic understanding of all relevant laws and regulations that apply. Teachers, especially, could find themselves in a proverbial minefield if they do not ensure that they have a working knowledge of education law. This is evidenced by the numerous lawsuits, disputes, mediations, disciplinary hearings and often unpleasant implications for individuals (and their families) that arise from charges against offenders in all sectors of education. Legislative changes resulting from altered circumstances in education have led to the need to be constantly aware of the implications and applications of such changes. This urgent need applies not only to principals, but to everyone involved in education. On the one hand the responsibility for correct application and implementation of education legislation lies with the governing body and the head of an institution, but on the other hand it affects the people who work there. Fundamental human rights are a constitutive element of democracy and thus need to be safeguarded and upheld. Because democratic practices in schools leave indelible imprints on the youth and become imbedded in the culture and ethos of a society (eventually finding expression in the life of a nation), it is imperative to establish a human rights culture in schools and enhance democracy in the education system. Fundamentals of human rights and democracy in education: a South African perspective clarifies the interrelationship between fundamental rights, education and democracy. Over the past decade the teaching environment in South Africa has changed drastically. One of the thorny issues facing the current education dispensation is that of learner discipline. Traditional views and disciplinary methods have had to give way for the Constitution's Bill of Rights. In light of this, the Faculty of Education Sciences at North-West University launched a research project on learner discipline and found that where before the emphasis was on reward and punishment, aspects such as co-ownership, mutual respect and co-responsibility are now key to the creation of a learning environment characterised by order and discipline. A practical guide to discipline in schools introduces some of the information gained from this study in the form of a practical manual and explores creative ways to transform impending chaos in the classroom into opportunities. It discusses the formulation of an equitable, fair and reasonable code of conduct and outlines the correct procedure to be followed for disciplinary hearings. Met die goedgunstige en hoogs gewaardeerde steun van die Fakulteit se Fokusarea, die SAOU en die Dekaan van die Fakulteit - en in samewerking met 'n groot span akademici en medewerkers - kon die net breed gespan word om inligting plaaslik en oorsee te bekom. Hierdie publikasie is 'n poging om van die inligting in die vorm van 'n praktiese handleiding aan opvoeders en voornemende opvoeders bekend te stel. Ook het dit ten doel om deur middel van 'n ordelike onderrig-leerklimaat geborgenheid in die onderwyspraktyk te bevorder.
