This book explores the causes and implications of the Libyan crisis since the anti-Gaddafi uprisings of 2011 from the perspective of the EU and NATO. It asks the question of why those organizations failed to stabilize the country despite the serious challenges posed by the protracted crisis to European and transatlantic stakes in the region. This book argues that such failure originated in a twofold problem common to both organizations: their prioritization of legitimacy over strategy, and their path dependence - the insufficient degree of adaptation to meet the different needs of the crisis. Through a critical and integrated analysis of official sources and extensive interviews with EU, NATO, UN, and national government officials and militaries, as well as from NGO personnel, Libyan institutions and civil society, and media, the volume brings the perspective of both state and non-state actors to the fore. The 'peace versus justice' debate, wherein it is argued that the ICC has either positive or negative effects on 'peace', has spawned in response to the Court's propensity to intervene in conflicts as they still rage. This book is a response to, and a critical engagement with, this debate. Building on theoretical and analytical insights from the fields of conflict and peace studies, conflict resolution, and negotiation theory, the book develops a novel analytical framework to study the Court's effects on peace, justice, and conflict processes. This framework is applied to two cases: Libya and northern Uganda. Drawing on extensive fieldwork, the core of the book examines the empirical effects of the ICC on each case. The book also examines why the ICC has the effects that it does, delineating the relationship between the interests of states that refer situations to the Court and the ICC's institutional interests, arguing that the negotiation of these interests determines which side of a conflict the ICC targets and thus its effects on peace, justice, and conflict processes. Every year, hundreds of thousands of women become victims of sexual violence in conflict zones around the world; in the Democratic Republic of Congo alone, approximately 1,100 rapes are reported each month. This book offers a comprehensive analysis of the causes, consequences and responses to sexual violence in contemporary armed conflict. It explores the function and effect of wartime sexual violence and examines the conditions that make women and girls most vulnerable to these acts both before, during and after conflict. To understand the motivations of the men (and occasionally women) who perpetrate this violence, the book analyzes the role played by systemic and situational factors such as patriarchy and militarized masculinity. Difficult questions of accountability are tackled; in particular, the case of child soldiers, who often suffer a double victimization when forced to commit sexual atrocities. The Responsibility to Protect (R2P) principle is the international community's major response to the problem of genocide and mass atrocities - a problem seen in Bosnia, Rwanda and more recently in Syria. This book argues that although it is far from perfect R2P offers the best chance we have of building an international community that works to prevent these crimes and protect vulnerable populations. To make this argument, the book sets out the logic of R2P and its key ambitions, examines some of the critiques of the principle and its implementation in situations such as Libya, and sets out ways of overcoming some of the practical problems associated with moving this principle from words into deeds.

A revealing memoir by the Israeli leader who almost made peace with the Palestinians. Written almost entirely from inside a prison cell, Rise and Fall is the compelling memoir of former Israeli prime minister Ehud Olmert. The child of parents who were members of the Irgun, the paramilitary group that fought for the establishment of Israel, Olmert became the youngest member of the Israeli Knesset in 1973, serving in the right-wing Likud party. He rose quickly in the party, serving in national government before being elected mayor of Jerusalem in 1993. After Sharon suffered a debilitating stroke in 2006, Olmert took over as acting prime minister, then led Sharon's new centrist party Kadima to victory in elections. Heading a coalition government, Olmert led Israel through the war with Lebanon in July 2006 and approved the dramatic strike on Syria's nuclear reactor the following year. From late 2006 through 2008, Olmert engaged in some three dozen negotiations with Palestinian leader Mahmoud Abbas. The talks, Olmert says, came "within a hair's breadth" of reaching a comprehensive peace deal. At the same time, Olmert was fighting allegations that he had illegally accepted large sums of money from a well-connected American businessman. He was acquitted of all but a minor charge against him, but in 2014 he was convicted on charges of taking $15,000 in bribes involving the construction of an industrial park while he served as Minister of Industry and Trade. He served 16 months in prison, using his time to write these memoirs. Military robots and other, potentially autonomous robotic systems such as unmanned combat air vehicles (UCAVs) and unmanned ground vehicles (UGVs) could soon be introduced to the battlefield. Look further into the future and we may see autonomous micro- and nanorobots armed and deployed in swarms of thousands or even millions. This growing automation of warfare may come to represent a major discontinuity in the history of warfare: humans will first be removed from the battlefield and may one day even be largely excluded from the decision cycle in future high-tech and high-speed robotic warfare. Although the current technological issues will no doubt be overcome, the greatest obstacles to automated weapons on the battlefield are likely to be legal and ethical concerns. Armin Krishnan explores the technological, legal and ethical issues connected to combat robotics, examining both the opportunities and limitations of autonomous weapons. He also proposes solutions to the future regulation of military robotics through international law.

A popular myth emerged in the late 1990s: in 1900, wars killed one civilian for every eight soldiers, while contemporary wars were killing eight civilians for every one soldier. The neat reversal of numbers was memorable, and academic publications and UN documents regularly cited it. The more it was cited, the more trusted it became. In fact, however, subsequent research found no empirical evidence for the idea that the ratio of civilians to soldiers killed in war has changed dramatically. But while the ratios may not have changed, the political significance of civilian casualties has risen tremendously. Over the past century, civilians in war have gone from having no particular rights to having legal protections and rights that begin to rival those accorded to states. The concern for civilians in conflict has become so strong that governments occasionally undertake humanitarian interventions, at great risk and substantial cost, to protect strangers in distant lands. I n the early 1990s, the UN Security Council authorized military interventions to help feed and protect civilians in the Kurdish area of Iraq, Somalia, and Bosnia. And in May 2011 , Barack Obama 's National Security Advisor explained the United States' decision to support NATO's military intervention in these terms "When the president made this decision, there was an immediate threat to 700,000 Libyan civilians in the town of Benghazi. We've had a success here in terms of being able to protect those civilians." Counting Civilian Casualties aims to promote open scientific dialogue by high lighting the strengths and weaknesses of the most commonly used casualty recording and estimation techniques in an understandable format. Proscribing peace offers a systematic examination of the impact of proscription on peace negotiations. By introducing the concept of 'linguistic ceasefire', Haspeslagh adds to our understanding of the timing and sequencing of peace processes in the context of proscription. With relevance for more than half of the conflicts around the world in which an armed group is listed as a terrorist organisation, 'linguistic ceasefire' helps to explain why certain conflicts remain stuck in the 'terrorist' framing, while others emerge from it. International proscription regimes criminalise both the actor and the act of terrorism. Proscribing peace calls for an end to the amalgamation between acts and actors. By focussing on the acts instead, Haspeslagh argues, international policy would be better able to consider the violent actions both of armed groups and those of the state. This book interrogates the concept of the Responsibility to Protect (R2P) as a normative construct and how the construction and promotion of this norm may have contributed to a stagnation in humanitarian action. This interrogation includes a particular focus on the impact of R2P on prevailing attitudes and discourses concerning humanitarian military intervention as well as the (under)provision of same. The study seeks to bridge the proverbial gap between theory and policy, specifically concerning our collective understanding of contemporary dynamics of humanitarian intervention and crisis. This objective is accomplished through the application and critical reformulation of the norm life cycle model and its three component stages (emergence, cascade, and internalization) relative to the presumed norm of R2P. The book advances the argument that R2P has only partially cascaded - stagnating rather than fully diffusing after reaching the ‘tipping point’, and in the process leaving the life cycle of the R2P norm in a state of dynamic equilibrium (e.g., a ‘steady state’). Consequently, the chief implication of the dynamic of stagnation within international society which the book seeks to advance and support is the non-attainment of norm internalization. Through close examination of the genesis and evolution of R2P, the work contends that R2P actually poses a significant if not fundamental challenge to the animating logic of the norm life cycle model. Having reached the requisite tipping point through formal endorsement by the UN over a decade ago, R2P has failed to manifest itself in humanitarian intervention behavior. The key to understanding why resides in deficiencies of the norm life cycle model itself. By failing to provide a sufficient account of the dynamics of norm pre-emergence (whereby ideas are transformed into proto-norms) or to acknowledge the possibility norm stagnation (whereby a norm fails to diffuse and become internalized), the norm life-cycle model provides an underspecified mechanism for understanding how and why an idea may in fact cross the threshold of the ‘tipping point’—attaining the status of a norm in international society in the process—but fail to penetrate and influence policy discourses and processes. The study seeks to bridge the proverbial gap between theory and policy, specifically concerning our collective understanding of contemporary dynamics of humanitarian intervention and crisis. This book explores the ethical implications of using armed contractors, taking a consequentialist approach to this multidisciplinary debate. While privatization is not a new concept for the US military, the public debate on military privatization is limited to legal, financial, and pragmatic concerns. A critical assessment of the ethical dimensions of military privatization in general is missing. More specifically, in light of the increased reliance upon armed contractors, it must be asked whether it is morally permissible for governments to employ them at all. To this end, this book explores four areas that highlight the ethical implications of using armed contractors: how armed contractors are distinct from soldiers and mercenaries; the commodification of force; the belligerent equality of combatants; and the impact of armed contractors on the professional military. While some take an absolutist position, wanting to bar the use of private military altogether, this book reveals how these absolutist arguments are problematic and highlights that there are circumstances where turning to private force may be the only option. Recognising that outsourcing force will continue, this book thus proposes some changes to account for the problems of commodification, belligerent equality, and the challenge to the military profession. Proliferation of WMD technologies is by no means a new concern for the international community. Indeed, since the signing of the Nuclear Non-proliferation Treaty in 1968, tremendous energies have been expended upon diplomatic efforts to create a web of treaties and international organizations regulating the production and stockpiling of WMD sensitive materials within states, as well as their spread through the increasingly globalized channels of international trade to other states and non-state actors.
However, the intervention in 2003 by Western powers in Iraq has served as an illustration of the importance of greater understanding of and attention to this area of law, as disagreements over its content and application have once again lead to a potentially destabilizing armed intervention by members of the United Nations into the sovereign territory of another member state. Other ongoing disputes between states regarding the character of obligations work assumed under non-proliferation treaty instruments, and the effect of international organizations' decisions in this area, form some of the most contentious and potentially destabilizing issues of foreign policy concern for many states.
