This book investigates the modern privatisation of war. It specifically focuses on the legal regime regulating private military and security company (PMSC) personnel in armed conflicts. The law regulating PMSC personnel is analysed from two perspectives. Firstly, can one of the three following legal statuses established by international humanitarian law - "mercenary", "combatant" or "civilian" - be applied to PMSC personnel? Secondly, the book employs a context-dependent methodology to explore the legal regime regulating PMSC personnel. It argues that the legal regime regulating PMSC personnel in armed conflicts depends on who hires them: individual states, the United Nations, non-governmental organisations, or armed groups. This approach represents a departure from previous literature, where attention has primarily been paid to the use of PMSCs by states.

Listening to War: Sound, Music, Trauma, and Survival in Wartime Iraq is a groundbreaking study of the centrality of listening to the experience of modern warfare. Based on years of ethnographic interviews with U.S. military service members and Iraqi civilians, as well as on direct observations of wartime Iraq, author J. Martin Daughtry reveals how these populations learned to extract valuable information from the ambient soundscape while struggling with the deleterious effects that it produced in their ears, throughout their bodies, and in their psyches. This book offers a detailed examination of the effectiveness of the peacekeeping operations of the African Union. Despite its growing reputation in peacekeeping and its status as the oldest continental peacekeeper, the performance of the African Union (AU) has hitherto not been assessed. This book fills that gap and analyses six case studies: Burundi, Comoros, Somalia, Mali, Darfur and the Central African Republic. From a methodological perspective it takes a problem-solving approach and utilises process tracing in its analysis, with its standard for success resting on achieving negative peace (the cessation of violence and provision of security). Theoretically, this study offers a comprehensive list of factors drawn from peace literature and field experience which influence the outcome of peacekeeping. Beyond the major issues, such as funding, international collaboration and mandate, this work also examines the impact of largely ignored factors such as force integrity and territory size. The book modifies the claim of peace literature on what matters for success and advocates the indispensability of domestic elite cooperation, local initiative and international political will. It recognises the necessity of factors such as lead state and force integrity for certain peace operations. In bringing these factors together, this study expands the peacekeeping debate on what matters for stability in conflict areas. This book will be of much interest to students of peacekeeping, African politics, war and conflict studies, and International Relations in general.

Although the Genocide Convention was already adopted by the UN General Assembly in 1945, it was only in the late 1990s that groups of activists emerged calling for military interventions to halt mass atrocities. The question of who these anti-genocide activists are and what motivates them to call for the use of violence to end violence is undoubtedly worthy of exploration. Based on extensive field research, Anti-genocide Activists and the Responsibility to Protect analyses the ideological convictions that motivate two groups of anti-genocide activists: East Timor solidarity activists and Responsibility to Protect (R2P)-advocates. The book argues that there is an existential undercurrent to the call for mass atrocity interventions; that mass atrocities shock the activists' belief in a humanity that they hold to be sacred. The book argues that the ensuing rise of anti-genocide activism signals a shift in humanitarian sensibilities to human suffering and violence which may have substantial implications for moral judgements on human lives at peril in the humanitarian and human rights community. This book provides a fascinating insight into the worldviews of activists which will be of interest to practitioners and researchers of human rights activism, humanitarian advocacy and peace building.

This book offers an analysis of the existing normative framework regulating the right to reparation for child victims of armed conflict. The study questions whether the current framework is sufficiently developed to provide child victims with adequate, effective and prompt reparations; furthermore it presents and critically assesses the judicial and non-judicial mechanisms in place as well as the reparations awarded and implemented so far at the international and regional level.The research stems from the need to fill a gap in the current literature on transitional justice, in particular on the right to reparation. Even though reparations are well-established legal measures in several domestic judicial systems all over the world, in transitional periods reparations are not just a means to redress the harm suffered by the victims of wrongful acts, but they also seek to contribute to the reconstitution or the constitution of a new political community in the aftermath of an armed conflict. The overview of the relevant cases and materials provided in this book helps paving the way for reparations that are effective, adequate, prompt, and in line with the international standards set forth by the CRC and other instruments. This book ultimately strives to highlight the shortcomings of the existing mechanisms and it points out the main issues that need to be improved and/or overcome in pursuance of child victims' redress.

The history of war is also a history of its justification. The contributions to this book argue that the justification of war rarely happens as empty propaganda. While it is directed at mobilizing support and reducing resistance, it is not purely instrumental. Rather, the justification of force is part of an incessant struggle over what is to count as justifiable behaviour in a given historical constellation of power, interests, and norms. This way, the justification of specific wars interacts with international order as a normative frame of reference for dealing with conflict. The justification of war shapes this order, and is being shaped by it. As the justification of specific wars entails a critique of war in general, the use of force in international relations has always been accompanied by political and scholarly discourses on its appropriateness. In much of the pertinent literature the dominating focus is on theoretical or conceptual debates as a mirror of how international normative orders evolve. In contrast, the focus of the present volume is on theory and political practice as sources for the re- and de-construction of the way in which the justification of war and international order interact. With contributions from international law, history, and international relations, and from Western and non-Western perspectives, this book offers a unique collection of papers exploring the continuities and changes in war discourses as they respond to and shape normative orders from early modern times to the present.

Greater attention is given to American and British literature rather than Chinese or Japanese simply by virtue of the practical realities.

When Yugoslavia disintegrated in the early 1990s, competence in English was not widespread. This book explores how English came to be equated with economic survival for many during and after the ensuing war through a range of diverse social and professional contexts, from the classroom to the military to the International Criminal Court. While English provided social mobility for many, its abrupt arrival also contributed to the marginalization of those without the adequate language skills. The high level of international intervention in Bosnia and Herzegovina over the last two decades has contributed to a sense of normalization of the presence of English. Viewed as a far more complex issue than simple linguistic imposition, this book explores the widespread adoption of English and its effects on a nation recovering from war.

Most casual observers see the conflict between Greeks and Turks on a strategic Mediterranean island as a struggle within a sovereign state. Borowiec concludes that there has never been a Cypriot nation, only Greeks and Turks living in Cyprus, separated by the hostility reflecting the traditional animosity between their motherlands. If these two groups could forget their past conflicts--as did, for example, Germany and Poland--there might be a way to end the partition of Cyprus. At the present time, however, the crisis is likely to continue with varying degrees of tension, threatening the entire Eastern Mediterranean and undermining NATO's cohesion.

Borowiec traces the history of Cyprus from antiquity through Ottoman and British colonial rule and the post-independence period. He describes the break between the island's communities in 1963, the UN intervention of 1964, and the path toward the Athens junta's coup in 1974 which caused the Turkish invasion and occupation of the northern part of Cyprus. This book is based on extensive research and regular visits to East Timor since 1995. It considers the trials that the people of East Timor have undergone in their long struggle for independence, and issues that have arisen out of independence. This account places East Timor within the context of other post-colonial states, noting the problems that most of them have faced in coming to grips with their new-found freedoms, and how they have managed, or mismanaged, such freedoms. It also traces the themes and issues within the independence movement, noting how these have contributed to post-independence outcomes, in particular the political tensions that almost saw East Timor collapse as a viable state in 2006. The books concludes with an assessment of the 2007 elections which, despite some post-election violence, saw the consolidation of democratic processes in East Timor, and which marked it as having a brighter future in this one critical respect.

Clarke examines the role of North American and European armed forces in support of civil authorities in domestic contingencies. He seeks to answer the question of what roles are - and are not - appropriate for contemporary armed forces in carrying out task and functions within national borders. The book takes as its starting point, two key elements in the North American and European security debate: the decline of both the external threats to most North American and European states and that of budgetary resources available for defense. These twin declines are coupled with a desire on the part of civil leaders to engage the military in more domestic tasks and the desire of senior military leaders to preserve force structure, resulting in a dynamic in which civil leaders will ask their militaries to do more, and military leaders will be more inclined to say yes. Although it is often simplified as an "ethnic conflict" in popular media, the current crisis in Darfur can only be superficially defined across ethnic lines. Any long-term solution to the conflict must also address the underlying social and environmental influences such as changing resource dynamics, expanding poverty, lack of infrastructure, and political corruption, which have brought the crisis to a head. This project diverges from previous studies by examining how the dynamic interaction between the environment, local governance, and national policy in Sudan has resulted in the Darfur crisis. It demonstrates how ecological degradation and the breakdown of community governance have destabilized the region, and how corruption and incompetence at the national level have culminated in the current crisis. Analyzing the interplay of these factors will yield valuable insights as to how a concerned international community can both end the tragic genocide and address the underlying injustices that engendered it. The analysis presented will be informative and accessible to a wide readership of students, academics, and concerned citizens.

This book examines the continuing devastation in the Darfur region of Sudan, from the perspective of a multiplicity of conflicts of distinct types. The crisis reached its peak in 2003-2004, when certain Arab militias joined forces with the Sudan armed forces in a campaign against insurgent resistance movements. Engulfed in the tumult, Darfurians experienced systematic slaughter, sexual violence, and internal displacement on a massive scale. Although the violence has waned in recent years, the fighting continues to this day. The authors cast this crisis as a complex web of four distinct, yet interlacing, conflict types: long-standing disputes between farmers and herders and between different herder communities political struggles between the local elite leaders of the resistance movements, and those between traditional leaders (elders) and younger aspiring leaders long-standing grievances of marginalized groups against those at the national centre of power cross-border conflicts, primarily the proxy war waged between Chad and Sudan The crisis in South Sudan is also examined through the lens of conflict complementarity. This book will be of interest to students of African politics, genocide, political violence, ethnic conflict, war and conflict studies, peacebuilding and IR.
