Beginning in January 2011, the Arab world exploded in a vibrant demand for dignity, liberty, and achievable purpose in life, rising up against an image and tradition of arrogant, corrupt, unresponsive authoritarian rule. These previously unpublished, country specific case studies of the uprisings and their still unfolding political aftermaths identify patterns and courses of negotiation and explain why and how they occur. The contributors argue that in uprisings like the Arab Spring negotiation is "not just a 'nice' practice or a diplomatic exercise." Rather, it is a "dynamically multilevel" process involving individuals, groups, and states with continually shifting priorities-and with the prospect of violence always near. From that perspective, the essay sits analyze a range of issues and events-including civil disobedience and strikes, mass demonstrations and nonviolent protest, and peaceful negotiation and armed rebellion-and contextualize their findings within previous struggles, both within and outside the Middle East. The Arab countries discussed include Algeria, Bahrain, Egypt, Libya, Morocco, Syria, Tunisia, and Yemen. The Arab Spring uprisings are discussed in the context of rebellions in countries like South Africa and Serbia, while the Libyan uprising is also viewed in terms of the negotiations it provoked within NATO. Collectively, the essays analyze the challenges of up risers and emerging governments in building a new state on the ruins of a liberated state; the negotiations that lead either to sustainable democracy or sectarian violence; and coalition building between former political and military adversaries.

This book explores the last 25 years of international peacebuilding and recasts them as a growing crisis of confidence in universal ideas of peacebuilding and self-government. Since current peacebuilding interventions are abandoning domineering, top-down and linear methodologies, and experimenting with context-sensitive, self-reflexive and locally driven strategies, the book makes two suggestions. The first is that international policymakers are embracing some of the critiques of liberal peace. For more than a decade, scholarly critiques have pointed out the need to focus on everyday dynamics and local initiatives and resistances to liberal peace in order to enable hybrid and long-term practice-based strategies of peacebuilding. Now, the distance between the policy discourse and critical frameworks has narrowed. The second suggestion is that in stepping away from liberal peace, a transvaluation of peacebuilding values is occurring. Critiques are beginning to accept and valorise that international interventions will continuously fail to produce sensitive results. The earlier frustrations with unexpected setbacks, errors or contingencies are ebbing away. Instead, critiques normalise the failure to promote stability and peace. This book will be of much interest to students of peacebuilding, international intervention, conflict resolution, international organisations and security studies in general.

Since the historic Nuremberg Trial of 1945 an international customary law principle has developed that commission of a core crime under international law - war crimes, genocide, crimes against humanity and aggression - should not go unpunished. History shows, that when in Africa such violations occurred, especially as a result of election disputes, national and regional actors, including the African Union, resorted to political rather than legal responses. However, when crimes against humanity were alleged to have been committed in Kenya during the 2007-2008 post-election violence, a promising road map for criminal accountability was agreed upon alongside a political solution. In the spirit of this road map, the author analyzes the post-election violence in Kenya from a legal point of view. He extensively examines legal options for domestic criminal accountability and discusses both retributive (prosecutions) and restorative justice (mainly truth commission) mechanisms, being the main legal responses to the gross violations of human rights. Furthermore, he thoroughly investigates the Kenya situation before the ICC and the legal-cum-political responses to the ICC intervention in Kenya. In February 2014, al-Qaida issued a statement that shocked the entire Jihadi movement. For the first time in its history, the group declared that a local affiliate, the Islamic State in Iraq, was no longer part of al-Qaida. The renegade Iraqi group, led by Abu Bakr al-Baghdadi, had expanded its operations to Syria, taking over the regional branch Jabhat al-Nusra; but in the process, the group had defied orders from al-Qaida's amir, Ayman al-Zawahiri. Islamic State's actions, and increasingly aggressive posture towards fellow Jihadis, eventually ignited a Jihadi civil war--a period defined by internal tensions that ultimately turned global. With devastating impact, this fitna left the Jihadi movement more polarised and fragmented than ever, seriously threatening its internal cohesion. The question of who these anti-genocide activists are and what motivates them to call for the use of violence to end violence is undoubtedly worthy of exploration. Based on extensive field research, Anti-genocide Activists and the Responsibility to Protect analyses the ideological convictions that motivate two groups of anti-genocide activists: East Timor solidarity activists and Responsibility to Protect (R2P)-advocates. The book argues that there is an existential undercurrent to the call for mass atrocity interventions; that mass atrocities shock the activists' belief in a humanity that they hold to be sacred. This book offers a detailed examination of the effectiveness of the peacekeeping operations of the African Union. Despite its growing reputation in peacekeeping and its status as the oldest continental peacekeeper, the performance of the African Union (AU) has hitherto not been assessed. This book fills that gap and analyses six case studies: Burundi, Comoros, Somalia, Mali, Darfur and the Central African Republic. From a methodological perspective it takes a problem-solving approach and utilises process tracing in its analysis, with its standard for success resting on achieving negative peace (the cessation of violence and provision of security). Theoretically, this study offers a comprehensive list of factors drawn from peace literature and field experience which influence the outcome of peacekeeping. Beyond the major issues, such as funding, international collaboration and mandate, this work also examines the impact of largely ignored factors such as force integrity and territory size. The book modifies the claim of peace literature on what matters for success and advocates the indispensability of domestic elite cooperation, local initiative and international political will. It recognises the necessity of factors such as lead state and force integrity for certain peace operations. In bringing these factors together, this study expands the peacekeeping debate on what matters for stability in conflict areas. "Understanding Collective Political Violence" offers a unique view on contemporary processes of violent political mobilization across continents: Africa, Latin America, South East Asia and the Middle East. It pays particular attention to unconventional combatants such as women or children and details the drivers of their violent engagement.

This book investigates the modern privatisation of war. It specifically focuses on the legal regime regulating private military and security company (PMSC) personnel in armed conflicts. The law regulating PMSC personnel is analysed from two perspectives. Firstly, can one of the three following legal statuses established by international humanitarian law - "mercenary", "combatant" or "civilian" - be applied to PMSC personnel? Secondly, the book employs a context-dependent methodology to explore the legal regime regulating PMSC personnel. It argues that the legal regime regulating PMSC personnel in armed conflicts depends on who hires them: individual states, the United Nations, non-governmental organisations, or armed groups. This approach represents a departure from previous literature, where attention has primarily been paid to the use of PMSCs by states.

To witness war is, in large part, to hear it. And to survive it is, among other things, to have listened to it-and to have listened through it. Listening to War: Sound, Music, Trauma, and Survival in Wartime Iraq is a groundbreaking study of the centrality of listening to the experience of modern warfare. Based on years of ethnographic interviews with U.S. military service members and Iraqi civilians, as well as on direct observations of wartime Iraq, author J. Martin Daughtry reveals how these populations learned to extract valuable information from the ambient soundscape while struggling with the deleterious effects that it produced in their ears, throughout their bodies, and in their psyches. Two chapters dedicated to wartime music in Iraqi and U.S. military contexts show how music was both an important instrument of the military campaign and the victim of a multitude of violent acts throughout the war. The history of war is also a history of its justification. The contributions to this book argue that the justification of war rarely happens as empty propaganda. While it is directed at mobilizing support and reducing resistance, it is not purely instrumental. Rather, the justification of force is part of an incessant struggle over what is to count as justifiable behaviour in a given historical constellation of power, interests, and norms. This way, the justification of specific wars interacts with international order as a normative frame of reference for dealing with conflict. The justification of war shapes this order, and is being shaped by it. As the justification of specific wars entails a critique of war in general, the use of force in international relations has always been accompanied by political and scholarly discourses on its appropriateness. In much of the pertinent literature the dominating focus is on theoretical or conceptual debates as a mirror of how international normative orders evolve. In contrast, the focus of the present volume is on theory and political practice as sources for the re- and de-construction of the way in which the justification of war and international order interact. With contributions from international law, history, and international relations, and from Western and non-Western perspectives, this book offers a unique collection of papers exploring the continuities and changes in war discourses as they respond to and shape normative orders from early modern times to the present.

Borowiec portrays Cyprus as a permanent source of tension in the Eastern Mediterranean and a potential trigger for future conflict between Greece and Turkey. He describes the depth of animosity between Greek and Turkish Cypriots and analyzes the obstacles in the path of a search for a solution.

Most casual observers see the conflict between Greeks and Turks on a strategic Mediterranean island as a struggle within a sovereign state. Borowiec concludes that there has never been a Cypriot nation, only Greeks and Turks living in Cyprus, separated by the hostility reflecting the traditional animosity between their motherlands. If these two groups could forget their past conflicts--as did, for example, Germany and Poland--there might be a way to end the partition of Cyprus. At the present time, however, the crisis is likely to continue with varying degrees of tension, threatening the entire Eastern Mediterranean and undermining NATO's cohesion.

Borowiec traces the history of Cyprus from antiquity through Ottoman and British colonial rule and the post-independence period. He describes the break between the island's communities in 1963, the UN intervention of 1964, and the path toward the Athens junta's coup in 1974 which caused the Turkish invasion and occupation of the northern part of Cyprus. He compares the conflicting views of the protagonists--the Greek Cypriot majority and the Turkish Cypriot minority. Considerable attention is paid to the two separate economic and political entities on the island. Borowiec analyzes the futility of myriad international mediation efforts and suggests possible ways of creating a climate propitious to dialogue. This important new look at the Cypriot conflict will be valuable to researchers, policy makers, and scholars involved with the Eastern Mediterranean and conflict/peace studies.

This book is based on extensive research and regular visits to East Timor since 1995. It considers the trials that the people of East Timor have undergone in their long struggle for independence, and issues that have arisen out of independence. This account places East Timor within the context of other post-colonial states, noting the problems that most of them have faced in coming to grips with their new-found freedoms, and how they have managed, or mismanaged, such freedoms. It also traces the themes and issues within the independence movement, noting how these have contributed to post-independence outcomes, in particular the political tensions that almost saw East Timor collapse as a viable state in 2006. The books concludes with an assessment of the 2007 elections which, despite some post-election violence, saw the consolidation of democratic processes in East Timor, and which marked it as having a brighter future in this one critical respect.

Clarke examines the role of North American and European armed forces in support of civil authorities in domestic contingencies. He seeks to answer the question of what roles are - and are not - appropriate for contemporary armed forces in carrying out task and functions within national borders. The book takes as its starting point, two key elements in the North American and European security debate: the decline of both the external threats to most North American and European states and that of budgetary resources available for defense. These twin declines are coupled with a desire on the part of civil leaders to engage the military in more domestic tasks and the desire of senior military leaders to preserve force structure, resulting in a dynamic in which civil leaders will ask their militaries to do more, and military leaders will be more inclined to say yes. As such, this book focuses on the enormous increase in the provision of non-military services and support asked of North American and European military establishments. Looking at the historical context for how North America's and Europe's armed forces have been employed in the past, this book establishes guidelines for their employment in the future.

This book offers an analysis of the existing normative framework regulating the right to reparation for child victims of armed conflict. The study questions whether the current framework is sufficiently developed to provide child victims with adequate, effective and prompt reparations; furthermore it presents and critically assesses the judicial and non-judicial mechanisms in place as well as the reparations awarded and implemented so far at the international and regional level.The research stems from the need to fill a gap in the current literature on transitional justice, in particular on the right to reparation. Even though reparations are well-established legal measures in several domestic judicial systems all over the world, in transitional periods reparations are not just a means to redress the harm suffered by the victims of wrongful acts, but they also seek to contribute to the reconstitution or the constitution of a new political community in the aftermath of an armed conflict. The overview of the relevant cases and materials provided in this book helps paving the way for reparations that are effective, adequate, prompt, and in line with the international standards set forth by the CRC and other instruments. Although it is often simplified as an "ethnic conflict" in popular media, the current crisis in Darfur can only be superficially defined across ethnic lines. Any long-term solution to the conflict must also address the underlying social and environmental influences such as changing resource dynamics, expanding poverty, lack of infrastructure, and political corruption, which have brought the crisis to a head. This project diverges from previous studies by examining how the dynamic interaction between the environment, local governance, and national policy in Sudan has resulted in the Darfur crisis. It demonstrates how ecological degradation and the breakdown of community governance have destabilized the region, and how corruption and incompetence at the national level have culminated in the current crisis. Analyzing the interplay of these factors will yield valuable insights as to how a concerned international community can both end the tragic genocide and address the underlying injustices that engendered it. The analysis presented will be informative and accessible to a wide readership of students, academics, and concerned citizens.
