This book offers an analysis of the existing normative framework regulating the right to reparation for child victims of armed conflict. The study questions whether the current framework is sufficiently developed to provide child victims with adequate, effective and prompt reparations; furthermore it presents and critically assesses the judicial and non-judicial mechanisms in place as well as the reparations awarded and implemented so far at the international and regional level.The research stems from the need to fill a gap in the current literature on transitional justice, in particular on the right to reparation. Even though reparations are well-established legal measures in several domestic judicial systems all over the world, in transitional periods reparations are not just a means to redress the harm suffered by the victims of wrongful acts, but they also seek to contribute to the reconstitution or the constitution of a new political community in the aftermath of an armed conflict. The overview of the relevant cases and materials provided in this book helps paving the way for reparations that are effective, adequate, prompt, and in line with the international standards set forth by the CRC and other instruments. This book ultimately strives to highlight the shortcomings of the existing mechanisms and it points out the main issues that need to be improved and/or overcome in pursuance of child victims' redress.

The history of war is also a history of its justification. The contributions to this book argue that the justification of war rarely happens as empty propaganda. While it is directed at mobilizing support and reducing resistance, it is not purely instrumental. Rather, the justification of force is part of an incessant struggle over what is to count as justifiable behaviour in a given historical constellation of power, interests, and norms. This way, the justification of specific wars interacts with international order as a normative frame of reference for dealing with conflict. The justification of war shapes this order, and is being shaped by it. As the justification of specific wars entails a critique of war in general, the use of force in international relations has always been accompanied by political and scholarly discourses on its appropriateness. In much of the pertinent literature the dominating focus is on theoretical or conceptual debates as a mirror of how international normative orders evolve. In contrast, the focus of the present volume is on theory and political practice as sources for the re- and de-construction of the way in which the justification of war and international order interact. With contributions from international law, history, and international relations, and from Western and non-Western perspectives, this book offers a unique collection of papers exploring the continuities and changes in war discourses as they respond to and shape normative orders from early modern times to the present.

Borowiec portrays Cyprus as a permanent source of tension in the Eastern Mediterranean and a potential trigger for future conflict between Greece and Turkey. He describes the depth of animosity between Greek and Turkish Cypriots and analyzes the obstacles in the path of a search for a solution.

Most casual observers see the conflict between Greeks and Turks on a strategic Mediterranean island as a struggle within a sovereign state. Borowiec concludes that there has never been a Cypriot nation, only Greeks and Turks living in Cyprus, separated by the hostility reflecting the traditional animosity between their motherlands. If these two groups could forget their past conflicts--as did, for example, Germany and Poland--there might be a way to end the partition of Cyprus. At the present time, however, the crisis is likely to continue with varying degrees of tension, threatening the entire Eastern Mediterranean and undermining NATO's cohesion.

Borowiec traces the history of Cyprus from antiquity through Ottoman and British colonial rule and the post-independence period. He describes the break between the island's communities in 1963, the UN intervention of 1964, and the path toward the Athens junta's coup in 1974 which caused the Turkish invasion and occupation of the northern part of Cyprus. He compares the conflicting views of the protagonists--the Greek Cypriot majority and the Turkish Cypriot minority. Considerable attention is paid to the two separate economic and political entities on the island. Borowiec analyzes the futility of myriad international mediation efforts and suggests possible ways of creating a climate propitious to dialogue. This book is based on extensive research and regular visits to East Timor since 1995. It considers the trials that the people of East Timor have undergone in their long struggle for independence, and issues that have arisen out of independence. This account places East Timor within the context of other post-colonial states, noting the problems that most of them have faced in coming to grips with their new-found freedoms, and how they have managed, or mismanaged, such freedoms. It also traces the themes and issues within the independence movement, noting how these have contributed to post-independence outcomes, in particular the political tensions that almost saw East Timor collapse as a viable state in 2006. The books concludes with an assessment of the 2007 elections which, despite some post-election violence, saw the consolidation of democratic processes in East Timor, and which marked it as having a brighter future in this one critical respect.

Clarke examines the role of North American and European armed forces in support of civil authorities in domestic contingencies. He seeks to answer the question of what roles are - and are not - appropriate for contemporary armed forces in carrying out task and functions within national borders. The book takes as its starting point, two key elements in the North American and European security debate: the decline of both the external threats to most North American and European states and that of budgetary resources available for defense. These twin declines are coupled with a desire on the part of civil leaders to engage the military in more domestic tasks and the desire of senior military leaders to preserve force structure, resulting in a dynamic in which civil leaders will ask their militaries to do more, and military leaders will be more inclined to say yes. As such, this book focuses on the enormous increase in the provision of non-military services and support asked of North American and European military establishments. Looking at the historical context for how North America's and Europe's armed forces have been employed in the past, this book establishes guidelines for their employment in the future.

Although it is often simplified as an "ethnic conflict" in popular media, the current crisis in Darfur can only be superficially defined across ethnic lines. Any long-term solution to the conflict must also address the underlying social and environmental influences such as changing resource dynamics, expanding poverty, lack of infrastructure, and political corruption, which have brought the crisis to a head. This project diverges from previous studies by examining how the dynamic interaction between the environment, local governance, and national policy in Sudan has resulted in the Darfur crisis. It demonstrates how ecological degradation and the breakdown of community governance have destabilized the region, and how corruption and incompetence at the national level have culminated in the current crisis. Analyzing the interplay of these factors will yield valuable insights as to how a concerned international community can both end the tragic genocide and address the underlying injustices that engendered it. The analysis presented will be informative and accessible to a wide readership of students, academics, and concerned citizens.

Specifically, it identifies three regions where most significant transformative trends were witnessed in South Asia in 2010: conflict-ridden Sri Lanka, Af-Pak and the Naxalite regions of India.

This book aims at a deeper understanding of social processes, dynamics and institutions shaping collective violence. It argues that violence is a social practice that adheres to social logics and, in its collective form, appears as recurrent patterns. In search of characteristics, mechanisms and logics of violence, contributions deliver ethnographic descriptions of different forms of collective violence and contextualize these phenomena within broader spatial and temporal structures. The studies show that collective violence, at least if it is sustained over a certain period of time, aims at organization and therefore develops constitutive and integrative mechanisms. Practices of social mobilization of people and economic resources, their integration in functional structures, and the justification or legitimization of these structures sooner or later lead to the establishment of new forms of (violent) orders, be it at the margins of or beyond the state. Cases discussed include riots in Gujarat, India, mass violence in Somalia, social orders of violence and non-violence in Colombia, humanitarian camps in Uganda, trophy-taking in North America, and violent livestock raiding in Kenya. This book examines the continuing devastation in the Darfur region of Sudan, from the perspective of a multiplicity of conflicts of distinct types. The crisis reached its peak in 2003-2004, when certain Arab militias joined forces with the Sudan armed forces in a campaign against insurgent resistance movements. Engulfed in the tumult, Darfurians experienced systematic slaughter, sexual violence, and internal displacement on a massive scale. Although the violence has waned in recent years, the fighting continues to this day. The authors cast this crisis as a complex web of four distinct, yet interlacing, conflict types: long-standing disputes between farmers and herders and between different herder communities political struggles between the local elite leaders of the resistance movements, and those between traditional leaders (elders) and younger aspiring leaders long-standing grievances of marginalized groups against those at the national centre of power cross-border conflicts, primarily the proxy war waged between Chad and Sudan The crisis in South Sudan is also examined through the lens of conflict complementarity. This book will be of interest to students of African politics, genocide, political violence, ethnic conflict, war and conflict studies, peacebuilding and IR.

This book analyses the root causes of suicide terrorism at both the elite and rank-and- file levels of the Hamas and also explains why this tactic has disappeared in the post-2006 period. This volume adopts a multi-causal, multi-level approach to analyse the use of suicide bombings by Hamas and its individual operatives in the Israeli-Palestinian conflict. It uses extensive fieldwork and on-the-ground interviews in order to delve beneath the surface and understand why and how suicide operations were adopted as a sustained mechanism of engagement within the Israeli-Palestinian conflict. Three core factors fuelled Hamas's suicide bombing campaigns. First, Palestinian suicide operations are a complex combination of instrumental and expressive violence adopted by both organisations and individuals to achieve political and/or societal survival, retaliation and competition. In other words, suicide bombings not only serve distinct political and strategic goals for both Hamas and its operatives but they also serve to convey a symbolic message to various audiences, within Israel, the Palestinian territories and around the world. Second, suicide operations perform a crucial role in the formation and consolidation of Palestinian national identity and are also the latest manifestation of the historically entrenched cultural norm of militant heroic martyrdom. Finally, Hamas's use of political Islam also facilitates the articulation, justification and legitimisation of suicide operations as a modern-day jihad against Israel through the means of modern interpretations and fatwas. This approach not only facilitates a much needed, multifaceted, holistic understanding of suicide bombings in this particular region but also yields policy-relevant lessons to address extreme political violence in other parts of the world. This book will be of much interest to students of Hamas, terrorism, Middle East politics and security studies.
