"Understanding Collective Political Violence" offers a unique view on contemporary processes of violent political mobilization across continents: Africa, Latin America, South East Asia and the Middle East. This book investigates the modern privatisation of war. It specifically focuses on the legal regime regulating private military and security company (PMSC) personnel in armed conflicts. The law regulating PMSC personnel is analysed from two perspectives. Firstly, can one of the three following legal statuses established by international humanitarian law - "mercenary", "combatant" or "civilian" - be applied to PMSC personnel? Secondly, the book employs a context-dependent methodology to explore the legal regime regulating PMSC personnel. It argues that the legal regime regulating PMSC personnel in armed conflicts depends on who hires them: individual states, the United Nations, non-governmental organisations, or armed groups. This approach represents a departure from previous literature, where attention has primarily been paid to the use of PMSCs by states.

Legality and Legitimacy in Global Affairs focuses on the problematic relationship between legality and legitimacy when a nation (or nations) intervene in the work of other nations. Edited by Mark Juergensmeyer, Richard Falk, and Vesselin Popovski, this volume brings together a wide range of contributors with a broad set of cases that consider when such intervention is legitimate even if it isn't legal--and vice versa. Chapters cover humanitarian intervention, nuclear nonproliferation, military intervention, international criminal tribunals, interventions driven by environmental concerns, and the export of democracy. The book argues that while some interventions may not be technically legal, they may well be legitimate (e.g. Kosovo), and also concentrates on establishing the grounds for legitimate intervention. Some cases, like Iraq, fail the test. Transnational intervention by states and international institutions has increased since the globalization wave of the of the 1990's and especially since 9/11. This book, by focusing on a diverse array of cases, establishes a clear framework for judging the legitimacy of such actions.

The history of war is also a history of its justification. The contributions to this book argue that the justification of war rarely happens as empty propaganda. While it is directed at mobilizing support and reducing resistance, it is not purely instrumental. Rather, the justification of force is part of an incessant struggle over what is to count as justifiable behaviour in a given historical constellation of power, interests, and norms. This way, the justification of specific wars interacts with international order as a normative frame of reference for dealing with conflict. The justification of war shapes this order, and is being shaped by it. As the justification of specific wars entails a critique of war in general, the use of force in international relations has always been accompanied by political and scholarly discourses on its appropriateness. In much of the pertinent literature the dominating focus is on theoretical or conceptual debates as a mirror of how international normative orders evolve. In contrast, the focus of the present volume is on theory and political practice as sources for the re- and de-construction of the way in which the justification of war and international order interact. With contributions from international law, history, and international relations, and from Western and non-Western perspectives, this book offers a unique collection of papers exploring the continuities and changes in war discourses as they respond to and shape normative orders from early modern times to the present.

This book is based on extensive research and regular visits to East Timor since 1995. It considers the trials that the people of East Timor have undergone in their long struggle for independence, and issues that have arisen out of independence. This account places East Timor within the context of other post-colonial states, noting the problems that most of them have faced in coming to grips with their new-found freedoms, and how they have managed, or mismanaged, such freedoms. It also traces the themes and issues within the independence movement, noting how these have contributed to post-independence outcomes, in particular the political tensions that almost saw East Timor collapse as a viable state in 2006. The books concludes with an assessment of the 2007 elections which, despite some post-election violence, saw the consolidation of democratic processes in East Timor, and which marked it as having a brighter future in this one critical respect.

Clarke examines the role of North American and European armed forces in support of civil authorities in domestic contingencies. He seeks to answer the question of what roles are - and are not - appropriate for contemporary armed forces in carrying out task and functions within national borders. The book takes as its starting point, two key elements in the North American and European security debate: the decline of both the external threats to most North American and European states and that of budgetary resources available for defense. These twin declines are coupled with a desire on the part of civil leaders to engage the military in more domestic tasks and the desire of senior military leaders to preserve force structure, resulting in a dynamic in which civil leaders will ask their militaries to do more, and military leaders will be more inclined to say yes. As such, this book focuses on the enormous increase in the provision of non-military services and support asked of North American and European military establishments. This book offers an analysis of the existing normative framework regulating the right to reparation for child victims of armed conflict. The study questions whether the current framework is sufficiently developed to provide child victims with adequate, effective and prompt reparations; furthermore it presents and critically assesses the judicial and non-judicial mechanisms in place as well as the reparations awarded and implemented so far at the international and regional level.The research stems from the need to fill a gap in the current literature on transitional justice, in particular on the right to reparation. Even though reparations are well-established legal measures in several domestic judicial systems all over the world, in transitional periods reparations are not just a means to redress the harm suffered by the victims of wrongful acts, but they also seek to contribute to the reconstitution or the constitution of a new political community in the aftermath of an armed conflict. The overview of the relevant cases and materials provided in this book helps paving the way for reparations that are effective, adequate, prompt, and in line with the international standards set forth by the CRC and other instruments. Despite being a common driver of communal violence, blood revenge has received little attention from scholars. With many civil wars and insurgencies occurring in areas where the custom lingers, strengthening our understanding of blood revenge is essential for discerning how conflicts change and evolve. Drawing upon extensive multidisciplinary evidence, this book is the first in the literature on civil war and insurgency to analyse the impact of blood revenge and its modern remnants on irregular warfare. Even when blood revenge undergoes erosion, its unregulated version still shapes the social fabric of insurgency, although in different ways than its institutionalised counterpart. At times of political instability, the presence of a culture of retaliation weighs heavily on the dynamics of violent mobilisation, target selection, recruitment, and disengagement. Although it is often simplified as an "ethnic conflict" in popular media, the current crisis in Darfur can only be superficially defined across ethnic lines. Any long-term solution to the conflict must also address the underlying social and environmental influences such as changing resource dynamics, expanding poverty, lack of infrastructure, and political corruption, which have brought the crisis to a head. This project diverges from previous studies by examining how the dynamic interaction between the environment, local governance, and national policy in Sudan has resulted in the Darfur crisis. It demonstrates how ecological degradation and the breakdown of community governance have destabilized the region, and how corruption and incompetence at the national level have culminated in the current crisis. Analyzing the interplay of these factors will yield valuable insights as to how a concerned international community can both end the tragic genocide and address the underlying injustices that engendered it. The analysis presented will be informative and accessible to a wide readership of students, academics, and concerned citizens.

This book examines the continuing devastation in the Darfur region of Sudan, from the perspective of a multiplicity of conflicts of distinct types. The crisis reached its peak in 2003-2004, when certain Arab militias joined forces with the Sudan armed forces in a campaign against insurgent resistance movements. Engulfed in the tumult, Darfurians experienced systematic slaughter, sexual violence, and internal displacement on a massive scale. Although the violence has waned in recent years, the fighting continues to this day. The authors cast this crisis as a complex web of four distinct, yet interlacing, conflict types: long-standing disputes between farmers and herders and between different herder communities political struggles between the local elite leaders of the resistance movements, and those between traditional leaders (elders) and younger aspiring leaders long-standing grievances of marginalized groups against those at the national centre of power cross-border conflicts, primarily the proxy war waged between Chad and Sudan The crisis in South Sudan is also examined through the lens of conflict complementarity. This volume delves into the way conventional deterrence operates between nuclear-armed states in the third nuclear age. Unlike the first and second ages the advent of this new age has witnessed greater strain on the principles of mutual vulnerability and survivability that may result in increased risks of advertent or inadvertent escalation and horizontal nuclear proliferation. This book aims at a deeper understanding of social processes, dynamics and institutions shaping collective violence. It argues that violence is a social practice that adheres to social logics and, in its collective form, appears as recurrent patterns. In search of characteristics, mechanisms and logics of violence, contributions deliver ethnographic descriptions of different forms of collective violence and contextualize these phenomena within broader spatial and temporal structures. The studies show that collective violence, at least if it is sustained over a certain period of time, aims at organization and therefore develops constitutive and integrative mechanisms. Practices of social mobilization of people and economic resources, their integration in functional structures, and the justification or legitimization of these structures sooner or later lead to the establishment of new forms of (violent) orders, be it at the margins of or beyond the state. Cases discussed include riots in Gujarat, India, mass violence in Somalia, social orders of violence and non-violence in Colombia, humanitarian camps in Uganda, trophy-taking in North America, and violent livestock raiding in Kenya.
