This volume offers a comprehensive and consistently theological interpretation of Canon Law. It is inspired by the key conciliar notion of "communio ecclesiarum", implying a structural and human reality in which is embodied a theological dimension, namely, the grace conceded by means of word and sacrament and guaranteed by apostolic succession, for which Canon Law is founded, not only anthropologically and sociologically, but also theologically. The whole of Canon Law, in this perspective, conforms to and clarifies the original elements of the church: word, sacrament, apostolic succession and charism. It also agrees with Hans Urs von Balthasar's notion that Canon Law has the function of guaranteeing that the church as "communio" is and continues to be a community in love: in that love whose origin is Jesus Christ and which is given to humanity by the Holy Spirit.

Many members of the Catholic Church today--clergy as well as laity--find no useful purpose for the Church's legal structure, or canon law. They may view canon law as arbitrary, antiquated, or even a hindrance to the movement of the Spirit, especially within the context of developments following the Second Vatican Council. Kevin E. McKenna counters this attitude with an overview of the positive features of Church law and a modern analysis of the canonical tradition of the Church. McKenna argues that the utilization of canon law in the Church today is not only desirable, but necessary and that it can be highly constructive when the law is viewed as a ministry of service. This study contributes to the new approach to the problem of the authority of the Bible and religious authority in general known as canon criticism, and will at the same time promote better understanding and cooperation between Christian and Jewish biblical scholars. Natural law has long been considered the traditional source of Roman Catholic canon law. However, new scholarship is critical of this approach as it portrays the Catholic Church as static, ahistorical, and insensitive to cultural change. In its attempt to stem the massive loss of effectiveness being experienced by canon law, the church has to reconsider its theory of legal foundation, especially its natural law theory. Church Law in Modernity analyses the criticism levelled at the church and puts forward solutions for reconciling church law with modernity by revealing the historical and cultural authenticity of all law, and revising the processes of law making. In a modern church, there is no way of thinking of the law without the participation of the faithful in legislation. Judith Hahn therefore proposes a reformed legislative process for the church in the hope of reconciling the natural law origins of church law with a new, modern theology.

The work of St. Bartholomew of Braga, O.P. (1514-1590) appears here in English for the first time despite its long and enduring influence in ecclesiastical circles. His meditations on the office of pastor have provided critical insight bishops since their initial circulation and have helped form the most famous among them, including Bartholomew's proteges Charles Borromeo. This newest volume in the History of Medieval Canon Law series surveys the history of Byzantine and Eastern canon law. Beginning in the Patristic Age, Susan Wessel outlines the evolution of ecclesiastical law before the Council of Nicaea (325 A.D.). She covers the earliest documents and councils in the Christian tradition, and concludes that the councils replaced other sources of authority as bishops moved to a more democratic model of church organisation. Heinz Ohme then offers a detailed analysis of the Greek councils and the writings of the Greek Fathers. He treats the sources of canonical material of Byzantine canon law down to the Quinisext Council (Trullanum, 692). Spyros Troianos presents a comprehensive survey of the Greek canonical collections and their compilers from the fourth to the eleventh century. In extending his coverage to 1500, Troianos provides bibliographical and biographical information about the most important Byzantine canonists who remain virtually unknown in English language literature: John Zonaras, Alexios Aristenos, and the Byzantine Gratian, Theodore Balsamon. With Hubert Kaufhold's contribution, the book also explores the wide range and variety of law in Eastern Christian communities, including Western Syrians (Jacobites), the Copts, Ethiopians, Armenians, Georgians, Nestorians, and Maronites.

Die katholische Kirche sieht sich haufig der Kritik ausgesetzt, die Menschenrechte hatten zu jeder Zeit gegen ihren erbitterten Widerstand durchgesetzt werden mussen. Die Kirche selbst nimmt hingegen fur sich in Anspruch, Initiatorin und "oberste Huterin der Menschenrechte" zu sein. Diese Arbeit verfolgt das Ziel, anhand der Beobachtung der weltlichen Menschenrechtsentwicklung und ihrer sichtbaren Auspragungen in Rechtsdokumenten sowie der jeweiligen offiziellen Stellungnahmen der Kirchen hierzu herauszufinden, wie die innerkirchliche Entwicklung zum Thema Menschenrechte tatsachlich, also frei von ideologischen Ansichten war.
