Canon Law: A Comparative Study with Anglo-American Legal Theory, by the Reverend John J. Coughlin, explores the canon law of the Roman Catholic Church from a comparative perspective. The Introduction to the book presents historical examples of antinomian and legalistic approaches to canon law (antinomianism diminishes or denies the importance of canon law, while legalism overestimates the function of canon law in the life of the Catholic Church). The Introduction discusses these approaches as threats to the rule of law in the Church, and describes the concept of the rule of law in the thought of various Anglo-American legal theorists. Chapter One offers an overview of canon law as the "home system" in this comparative study. The remaining chapters consider antinomian and legalistic approaches to the rule of law in light of three specific issues: the sexual abuse crisis, ownership of church property, and the denial of Holy Communion to Catholic public officials. Chapters Two and Three discuss the failure of the rule of law as a result of antinomian and legalistic approaches to the sexual abuse crisis. Chapters Four and Five compare the concept of property in canon law with that of liberal political theory; they discuss the ownership of parish property in light of diocesan bankruptcies, the relationship between church property and the law of the secular state, and the secularization of Catholic institutions and their property. Chapters Six and Seven raise the indeterminacy claim with regards to canon law and the arguments for and against the denial of Holy Communion to Catholic public officials. Although the three issues arise in the context of the United States, they raise broader theoretical issues about antinomianism, legalism, and the rule of law. Throughout the comparative study, American legal theory functions to clarify these broader issues in canon law. The concluding chapter offers a synthesis of this comparative study.

Many members of the Catholic Church today--clergy as well as laity--find no useful purpose for the Church's legal structure, or canon law. They may view canon law as arbitrary, antiquated, or even a hindrance to the movement of the Spirit, especially within the context of developments following the Second Vatican Council. Kevin E. McKenna counters this attitude with an overview of the positive features of Church law and a modern analysis of the canonical tradition of the Church. McKenna argues that the utilization of canon law in the Church today is not only desirable, but necessary and that it can be highly constructive when the law is viewed as a ministry of service. This study contributes to the new approach to the problem of the authority of the Bible and religious authority in general known as canon criticism, and will at the same time promote better understanding and cooperation between Christian and Jewish biblical scholars. The author considers the Hebrew canon, and especially the juxtaposition of law and prophecy within it, not as a component of Christian canon, as is usually done, but as a historical and theological problem focusing on the issue of religious and sociological implications of the claims that underlie the formation of the tripartite canon, particularly the claims staked by the authority of the Bible and how this bears on the self-understanding of Judaism-and Christianity. The work of St. Bartholomew of Braga, O.P. (1514-1590) appears here in English for the first time despite its long and enduring influence in ecclesiastical circles. His meditations on the office of pastor have provided critical insight bishops since their initial circulation and have helped form the most famous among them, including Bartholomew's proteges Charles Borromeo. Pope Paul VI ordered a copy of Bartholomew's work to be distributed among the Catholic bishops at the Second Vatican Council. Donald Prudlo's translation situates St. Bartholomew of the Martyrs in his historical context as a lynchpin of Catholic Reform and affirms him as a figurehead of pastoral administration even in our own times.

Farag persuasively demonstrates that three groups in late antiquity were concerned with these questions: Christian leaders, wealthy laypersons, and lawmakers. Conflicting answers usually coexisted, but from time to time they clashed and caused significant tension. In these disputes, juridical regulations and opinions mattered more than has been traditionally recognized. Considering familiar Christian controversies in novel ways, Farag's investigation shows that scholarship has misunderstood well-known religious figures by ignoring the legal issues they faced. This seminal text nuances vital aspects of scholarly conversations on sacred space, gift giving, wealth, and poverty in the late antique Mediterranean world, making use not only of Latin and Greek sources but also Coptic and Arabic evidence.

Seither mussen Ehenichtigkeitsverfahren, die mit einem positiven Urteil enden, nicht mehr von Amts wegen an die zweite Instanz weitergeleitet werden. This volume offers a comprehensive and consistently theological interpretation of Canon Law. It is inspired by the key conciliar notion of "communio ecclesiarum", implying a structural and human reality in which is embodied a theological dimension, namely, the grace conceded by means of word and sacrament and guaranteed by apostolic succession, for which Canon Law is founded, not only anthropologically and sociologically, but also theologically. The whole of Canon Law, in this perspective, conforms to and clarifies the original elements of the church: word, sacrament, apostolic succession and charism. It also agrees with Hans Urs von Balthasar's notion that Canon Law has the function of guaranteeing that the church as "communio" is and continues to be a community in love: in that love whose origin is Jesus Christ and which is given to humanity by the Holy Spirit.

Die katholische Kirche sieht sich haufig der Kritik ausgesetzt, die Menschenrechte hatten zu jeder Zeit gegen ihren erbitterten Widerstand durchgesetzt werden mussen. Die Kirche selbst nimmt hingegen fur sich in Anspruch, Initiatorin und "oberste Huterin der Menschenrechte" zu sein. Diese Arbeit verfolgt das Ziel, anhand der Beobachtung der weltlichen Menschenrechtsentwicklung und ihrer sichtbaren Auspragungen in Rechtsdokumenten sowie der jeweiligen offiziellen Stellungnahmen der Kirchen hierzu herauszufinden, wie die innerkirchliche Entwicklung zum Thema Menschenrechte tatsachlich, also frei von ideologischen Ansichten war. Neben der historischen Untersuchung wird auch der Frage nachgegangen, wie die Kirche heute in ihrem Lehrverstandnis und vor allem ihrer Gesetzgebung im CIC/1983 zu der Frage der Menschenrechte steht.

Sowohl in der OEffentlichkeit als auch innerkirchlich wird der Katholischen Kirche zuweilen vorgehalten, dass ihre Vermoegens-, Finanz- und Ertragslage intransparent sei. Ein Instrument, solche Informationsasymmetrien zu verringern, ist die Rechnungslegung, die auch im Codex luris Canonici kodifiziert ist. Nicht spezifiziert ist jedoch, welche normativen Anforderungen an die Rechnungslegung zu stellen sind. In dieser Arbeit geht es daher um die Bestimmung von Grundsatzen ordnungsmassiger Rechnungslegung (GoR) fur ein gesamtkirchliches Vermoegensrecht, das kanonische und betriebswirtschaftliche Betrachtungsweisen verbindet. Das dieser Arbeit zugrunde gelegte kaufmannische Rechnungslegungskonzept hat Besonderheiten des Kirchenrechts zu berucksichtigen, die sich z. B. in den Pensionsverpflichtungen gegenuber Priestern zeigen. Auf der Grundlage der GoR werden die Besonderheiten der Rechnungslegung der Katholischen Kirche am Beispiel der Pensionsverpflichtungen gegenuber Priestern konkretisiert.

Die Beitrage des spanischen Spatscholastikers Francisco Suarez (1548-1617) zur juristischen Methodenlehre wurden bis jetzt wenig erforscht. Das Ziel dieses Buches ist es, durch ausschliessliche Arbeit an den Quellen seine Theorie der Interpretation des Gesetzes umfassend darzustellen. Die Untersuchung widmet sich dem Begriff des Gesetzes und den verschiedenen Interpretationsverfahren. Durch die Berufung auf Gott als Gesetzgeber und seinen persoenlichen Glauben gelingt es Suarez stets, seiner Theorie eine grundlegende und letzte Einheit zu geben.

Bei Ehenichtigkeitsverfahren wegen psychischer Eheunfahigkeit gemass c. 1095 ist der Richter auf Sachverstandigengutachten angewiesen. Das Ziel dieser Studie ist es, psychische Stoerungen auf ihre Auswirkungen auf die Ehefahigkeit zu untersuchen und darzustellen, welche konkreten Aufgaben der psychiatrische/psychologische Gutachter im Ehenichtigkeitsprozess hat, damit das Sachverstandigengutachten dem Richter als hilfreiches Beweismittel bei der Urteilsfindung dienen kann. Relevante psychische Stoerungen werden in ihrer Symptomatik, ihrer Natur und ihrem Verlauf aus Sicht der Psychologie und Psychiatrie erklart. Dabei wird auch diskutiert, wie sich die jeweiligen Stoerungen auf die Voraussetzungen fur eine gultige Eheschliessung auswirken koennen.
