Judicial networks have proved effective in influencing recent judicial policies enacted by both old and new EU member states. However, this influence has not been standard. This volume seeks to improve our understanding of how networks function, as well as the extent they matter in the governance of a constitutional democracy. The authors examine the judicial function of networks, the way they cross the legal and territorial borders that confine the jurisdiction of the domestic institutions, and whether or not they are independent of the capacity and the leadership of their members. A highly salient issue in contemporary law and politics, judicial networks are now qualified actors of governance. With the aim to understand how, to what extent, and with what consequences networks interact with hierarchical institutions that still exist within the States, this book is essential reading for legal experts, policy makers engaged in promoting the rule of law, members of the judicial networks in the EU and extra EU countries, as well as academics and students.
This book addresses the complex origins of the Ukrainian crisis. It places the crisis in a longer-term perspective and shows how the domestic political regime interpreted, balanced and eventually chose between the competing integration offers of Russia and the EU. The term 'social dumping' regularly appears in public debates and in policymaking circles. However, due to its ambiguity it is used in a manner that is convenient for individual discourse participants, thus opening the door for misconceptions and ill-grounded accusations. This book systematically examines social dumping in the context of the European integration process. It defines social dumping as the practice, undertaken by self-interested market participants, of undermining or evading existing social regulations with the aim of gaining a competitive advantage. It also shows how the two major EU integration projects the creation of the Internal Market, and EU enlargement to the east and to the south have provided market actors with new incentives and opportunities to contest existing social 'constraints'. The empirical chapters examine social dumping practices accompanying labour migration, employee posting and cross-border investment distribution. In addition, they outline the process of formation of social standards and trace initiatives at EU and national levels that contribute to the spread of social dumping in Europe. This book will be of interest to scholars and students of employment relations, EU studies, international political economy, globalisation studies, welfare studies, social policy and migration studies.
Jan L. van Zanden in The Economic History of the Netherlands 1914-1995 answers these questions. In the first four chapters the long development of the economy is analysed in detail. Central to this part of the book are the rise (and decline) of managerial enterprise; the growth (and fall) of trade unions; and the expansion (and crisis) of the welfare state. The particular Dutch features of these institutional changes are highlighted. The second part of the book deals with different periods of growth (from 1914-1929, and 1950-1973), and relative stagnation (1929-1950, and 1973-1995). Moreover, van Zanden examines the role the Netherlands played in the process of European integration, and gives an explanation of the success of the 'Dutch job machine' in the 1980s and 1990s.

This volume explores institutional and policy developments in the EU and its member states in a parallel examination of citizens' views of the effectiveness of crisis response reflected in public trust, output legitimacy, and satisfaction with democracy. Our approach to understanding the crisis posits EU-level governance and institutional change, national-level policymaking, and domestic politics as interrelated, interdependent domains of political action and public spheres that collectively shape the political landscape of post-crisis Europe. The volume sheds new light on the relationship among the institutional, policy, and polity consequences of the crisis. The book has two fundamental aims. The first is to demonstrate the interconnected nature of European governance, domestic reform, and democratic politics. The unprecedented complexity of the financial, sovereign debt, economic, and social crises in Europe has led to a political crisis that reflects the struggle to effectively address its various causes and effects. The second objective is to present a theoretically informed assessment of the consequences of the European crises for state-society relations and democratic legitimacy. Our analysis of the crisis in a variety of national contexts and European governance highlights the difficulties faced by political decision-makers. We find that the domestic policy process is selectively affected or disconnected from the process of rule-making at the EU level, that public opinion still matters in the process of policy formation and EU crisis response, and that the salience of the EU agenda in the domestic public sphere increasingly depends on the preferences of political actors. Public response to the crisis has become increasingly complex as well, ranging from declining trust in the political institutions, emerging national stereotypes, changing expectations of the EU level of crisis response, growing disconnect between political parties and voters, and evolving intra-regional distinctions across the EU's east-west divide.
This book examines lobbying in EU foreign policy-making and the activities of non-state actors (NSAs), focusing on EU foreign policy on the Israeli-Palestinian conflict. It sheds light on the interactions between the EU and NSAs as well as the ways in which NSAs attempt to shape EU foreign policies. By analysing issues that have not yet received systematic attention in the literature, this book offers new insights into lobbying in EU foreign policy, EU relations surrounding the conflict and the EU's broader role in the peace process. This book deals with two key questions. First, is there a firm scientific basis for the major applications of psychology in organizations? Second, does the practice of psychology in organizations contribute in any meaningful way to psychological research? This text attempts to answer these questions by describing some of the unique ways in which Industrial/Organizational (I/O) psychologists integrate science and practice in applying psychology in organizations. The editors of this volume believe that there is great potential for the effective interplay of science and practice in I/O psychology. Aware, however, that much work must still be done before a truly effective integration can be achieved and maintained, they have created a text that offers specific suggestions for improvement as well as many examples of successful integration. Psychology in Organizations explores the unique relationship between science and practice within industrial/organizational psychology. The contributors seek to answer two main questions: * Is there a firm scientific basis for the major applications of psychology in organizations? * Does the practice of psychology in organizations contribute in any meaningful way to psychological research? After an initial examination of the industrial/organizational psychologist as a scientist and practitioner, Psychology in Organizations looks at specific roles played in such issues as job performance and productivity, sexual harassment, drug abuse, and drug testing. The dramatic results of the 2014 European Parliament elections have highlighted the European Union's urgent need for a review of the scope and purpose of its social objectives and for a reordering of European priorities. This book advocates a radical and original alternative to the current philosophy that determines the set of rules for the awarding of EU public procurement contracts. It calls for a reordering of the EU's economic and social priorities. In doing so, it advocates for a social dimension to be placed at the core of public procurement, which could elicit a social model of integration in the EU in which the European citizen is the key actor. In almost all fields of cooperation that are covered by the EC Treaty, the formal competence to adopt legislation has been assigned to the Council (which must normally collaborate with the European Parliament), and in order to separate powers, the formal competence to prepare the necessary proposals (the right to initiate legislation), has been assigned to the European Commission. Over the years, however, it has become clear that the reality is far more complex. This book examines the fact that the Council is now passing an increasing part of the responsibility for adopting legislation to the Commission, subject to the requirement that it has to collaborate with a vast number of committees that consist of representatives of the various national administrations. This is known as comitology. Comitology provides the Council and the national governments with a mechanism for controlling the Commission, and so comitology is often thought to manifest a conflict of interests. Bergstroem argues that, despite much support in principle for this assumption; in practice, comitology does not give rise to the kinds of conflicts many expect or fear. He contends that in fact it appears to be a fruitful cooperation between the national administrations and the Commission. Against this background, Bergstroem explains how and why comitology has developed, explores the nature of comitology and examines its present and future place in the legal order of the European Union.
The EU and Japan have one of the most important trade relationships in the world. Fittingly, this book presents a detailed analysis of their bilateral regulatory environment and negotiation processes. This book explores the drivers of the EU's recent forays into peace- and state-building operations. Since the Union's European (now Common) Security and Defence Policy (ESDP/CSDP) became operational in 2003, the EU has conducted more than 20 civilian and military operations that broadly served to either deter aggression in host countries, and/or to build or strengthen the rule of law. This sudden burst of EU activity in the realm of external security is interesting from both a scholarly and a policy perspective. On one hand, institutionalised cooperation in the field of foreign, security and defence policy challenges the mainstream in IR theory which holds that in such sovereignty-sensitive areas cooperation would necessarily be limited. On the other hand, the sheer quantity of operations suggests that the ESDP may represent a potentially significant feature of global governance. In order to understand the drivers behind CSDP, EU Foreign Policy and Crisis Management Operations analyses the policy output in this area, including the operations conducted in the CSDP framework. Up until now, many studies inferred the logic behind CSDP from express intentions, institutional developments and (the potential of) pooled capabilities. By mining the rich data that CSDP operations represent in terms of the motives and ambitions of EU governments for the CSDP, this book advances our understanding of the framework at large. This book traces the positions of national partisan actors towards the development of the European polity in an in-depth comparative analysis covering all member states of the European Union over a period of 60 years. The 'Golden Age' of the welfare state in Europe was characterised by a strengthening of social rights as citizens became increasingly protected through the collective provision of income security and social services. The oil crisis, inflation and high unemployment of the 1970s largely saw the end of welfare expansion with critical voices claiming the welfare state had created an unbalanced focus on the social rights of individuals, above their responsibilities as citizens. During the 1980s many western countries developed contractual modes of thinking and regulation within welfare policy. Contractualism has proved a significant organising principle for public reforms in general, and for social policy reforms in particular as it embraces both a way of justifying certain welfare policies and of constructing specific socio-legal policy instruments. Engaging with both the critique of the welfare state and the subsequent policy responses, expert contributors in this book examine contractualism as a discourse, comprising principles and justifying ideas, and as a legal and social practice. Covering the international debate on conditionality they discuss European experiences with active social citizenship ideas and contractualism providing individual case studies and comparisons from a wide range of European countries.

Amongst the most serious consequences of the 2008 global financial collapse and sovereign debt crisis were a series of unprecedented international bailouts for Greece, Ireland, and Portugal between 2010 and 2011. This book analyses the development policies of Greece, Ireland, and Portugal between 1990 and 2008, before the Eurozone crisis. It identifies national-level differences between the policy strategies and outcomes that have characterized recent developments in the Greek, Irish, and Portuguese political economies. In addition, it provides an explanation for these differences that takes into account variations in political institutions and state-society relations. In doing so, it locates an explanation for policy divergence in the presence or absence of the policy-making institutions and processes that make up a 'zone of mediation'. Overall, it argues there is significant variation in the extent to which Ireland, Portugal and Greece have adapted their developmental goals and strategies in order to address the labour market challenges posed by the post-industrial era. Governing Europe's Marine Environment is a coherent up-to-date multidisciplinary analysis of current approaches and challenges to the sustainable governance of Europe's marine environment. The EU is a supranational organization, whose reach and influence extends well beyond its member states, especially to the many states that have signed various forms of association agreement with it. This book asks whether qualifying states who have eschewed EU membership experience negative effects on their legal and political self-governing abilities, or whether they manage their independence with few such effects. It explores the idea that the closer the affiliation a non-member state has with the EU, the more susceptible to hegemony the relationship appears to be. Under what conditions does the internal cohesiveness of the European Union determine its external effectiveness on the world stage? This book asks this question, investigating the frequent political assumption that the more cohesive the EU presents itself to the world, the more effective it is in achieving its goals. Contributions to this book explore this theory from a range of perspectives, from trade to foreign policy, and highlight complex patterns between internal cohesiveness and external effectiveness. These are simplified into three possible configurations: internal cohesiveness has a positive impact on external effectiveness; internal cohesiveness has no impact on external effectiveness; and internal cohesiveness has a negative impact on external effectiveness. The international context in which the EU operates, which includes the bargaining configuration and the policy arena, functions as an intervening variable that helps us to explain variation in these causal links. The book also launches a research agenda aimed at explaining these patterns more systematically and determining the marginal impact of cohesiveness on effectiveness. This book was originally published as a special issue of the Journal of European Public Policy.
Many theoretical explanations had been offered for the rise of the European Community, but none had used historical analysis to draw out the deeper significance of the events that surrounded Maastricht. However, in this book, first published in 1993, the authors explored the process of European integration, and its future, drawing on extensive empirical research into the national archives of the member states. This edited collection explores the legal foundations of the single market project in Europe, and examines the legal concepts and constructs which underpin its operation.
