The authors of this book engage in essay form in a lively debate over the fundamental characteristics of legal and moral rights. They examine whether rights fundamentally protect individuals' interests or whether they instead fundamentally enable individuals to make choices. In the course of this debate the authors address many questions through which they clarify, though not finally resolve, a number of controversial present-day political debates, including those over abortion, euthanasia, and animal rights.
A collection of essays that discuss almost all of the great constitutional issues of the last two decades, including abortion, euthanasia, capital punishment, homosexuality, pornography and free speech. Professor Dworkin offers a consistently liberal view of the Constitution and argues that fidelity to it and to law demands that judges make moral judgments. He proposes that we all interpret the abstract language of the Constitution by reference to moral principles about political decency and justice. His moral reading therefore brings political morality into the heart of constitutional law. The various chapters of this book were originally published separately and are now drawn together to provide the reader with a full-length treatment of Dworkin's general theory of law.
All five contemporary practitioners of the death penalty in the Association of Southeast Asian Nations (ASEAN)- Indonesia, Malaysia, Thailand, Singapore and Vietnam- have performed executions on a regular basis over the past few decades. NGO Amnesty International currently classifies each of these nations as death penalty 'retentionists'. However, notwithstanding a common willingness to execute, the number of death sentences passed by courts that are reduced to a term of imprisonment, or where the prisoner is released from custody altogether, through grants of clemency by the executive branch of government, varies remarkably among these neighbouring political allies. Last Chance for Life: Clemency in Southeast Asian Death Penalty Cases explores the patterns which explain why some countries in the region award clemency far more often than others in death penalty cases. Over the period under analysis from 1991 to 2016, the regional outliers were Thailand (with more than 95% of condemned prisoners receiving clemency after exhausting judicial appeals) and Singapore (with fewer than 1% of condemned prisoners receiving clemency). Malaysia, Indonesia and Vietnam fall at points in between these two extremes. What results is the first research monograph, anywhere in the world, to compare death penalty clemency across national borders using empirical methodology, the latter a systematic collection of clemency data in multiple jurisdictions using archival and 'elite' interview sources. Last Chance for Life is an authoritative resource for legal practitioners, criminal justice policy makers, scholars and activists throughout the ASEAN region and around the retentionist world.

In 1983-as France struggled with race-based crimes, police brutality, and public unrest-youths from Venissieux (working-class suburbs of Lyon) led the March for Equality and Against Racism, the first national demonstration of its type in France. In all groups - from couples to nation-states - people influence one another. Much of this influence is benign, for example giving advice to friends or serving as role models for our children and students. Some forms of influence, however, are clearly morally suspect, such as threats of violence and blackmail. A great deal of attention has been paid to one form of morally suspect influence, namely coercion. Less attention has been paid to what might be a more pervasive form of influence: manipulation. The essays in this volume address this relative imbalance by focusing on manipulation, examining its nature, moral status, and its significance in personal and social life. They address a number of central questions: What counts as manipulation? How is it distinguished from coercion and ordinary rational persuasion? Is it always wrong, or can it sometimes be justified, and if so, when? Is manipulative influence more benign than coercion? Can one manipulate unintentionally? How does being manipulated to act bear on one's moral responsibly for so acting? Given various answers to these questions, what should we think of practices such as advertising and seduction?

Will my money improve welfare more if I spend it on helping people or if I benefit chickens? How can we assess the harm of climate change for both humans and non-humans? If we want to systematically compare welfare across species, we first need to explore whether welfare subjects of different species have the same or rather a different capacity for welfare. According to what seems to be the dominant philosophical view, welfare subjects with higher cognitive capacities have a greater capacity for welfare and are generally much better off than those with lower cognitive capacities. Visak carefully explores and rejects this view. She argues instead that welfare subjects of different species have the same capacity for welfare despite different cognitive capacities. This book prepares the philosophical ground for comparisons of welfare across species. It will inform and inspire ethicists and animal welfare scientists alike, as well as a broader readership interested in wellbeing, animals, and ethics. Besides different views about capacity for welfare across species, the book discusses animal capacities, moral status, harm of death, whether bringing additional well-off individuals into existence is a good thing, and practical implications of these topics for counting and comparing the welfare of animals of different species.

Ethics for Robots describes and defends a method for designing and evaluating ethics algorithms for autonomous machines, such as self-driving cars and search and rescue drones. Derek Leben argues that such algorithms should be evaluated by how effectively they accomplish the problem of cooperation among self-interested organisms, and therefore, rather than simulating the psychological systems that have evolved to solve this problem, engineers should be tackling the problem itself, taking relevant lessons from our moral psychology. Leben draws on the moral theory of John Rawls, arguing that normative moral theories are attempts to develop optimal solutions to the problem of cooperation. A central question in the debate on justice in immigration is whether immigrants have a right to stay; this book argues that liberal-democratic receiving states should also grant migrants a right not to stay. This claim runs against the presumption that migrants always desire to move on a permanent basis and intend to forge a completely new life in the country of destination. From this perspective, temporary migration is always a second-best option for migrants, engendered by the closed and often punitive migration policies of receiving countries. This book's innovative focus on the right not to stay is prompted instead by the realization that increasing numbers of migrants throughout the world conceive and plan their migratory experience as circumscribed in time and instrumental to goals and projects that they will pursue once back in their country of origin. These temporary migration projects are worthy of being accommodated by the receiving states as much as the migratory plans of those who resolve or aim to immigrate on a permanent basis. Accommodating them entails setting up the appropriate welfare measures and programs in the host country and, through bi-lateral agreements, in the country of return. This is especially important in view of the fact that very often the migrants who engage in temporary migration projects find themselves in a condition of high vulnerability and risk. The "right not to stay" advocated in this book is a positive and substantive right to see one's project of temporary migration-and-return protected and accommodated by institutions.
