Die Kommission hat nun, nachdem sie zuvor im April 2004 weitergehende Angleichungsplane angekundigt hatte, kurzfristig im Oktober 2005 eine Empfehlung fur den Bereich der Online-Musikdienste verabschiedet. Die Entwicklung ist im Fluss. Sie bedarf einer breiten und tiefgehenden Eroerterung. Dabei sind die Vorgaben des Primarrechts und des Internationalen Urheberrechts ebenso zu berucksichtigen wie Wahrnehmungsrecht und Wahrnehmungspraxis der Mitgliedstaaten. Die hier nebst Materialien veroeffentlichten Beitrage zur INTERGU-Tagung 2005 an der Europa-Universitat Viadrina sollen einen Beitrag zu dieser Diskussion leisten. Auf der Grundlage eines deutsch-polnischen Rechtsvergleichs werden die Grundlagen der gemeinschaftsrechtlichen Rechtsangleichung sowie die Entwicklung der Marktordnung im Bereich der Wahrnehmung von Online-Rechten an Werken der Musik eroertert.

Die Reichweite ihrer Tatigkeit ergibt sich aus der Rechteubertragung, die im sog. Berechtigungsvertrag erfolgt. Die Verfasserin analysiert die Rechteubertragungen im Berechtigungsvertrag der GEMA umfassend und systematisch. An Hand eines einheitlichen Untersuchungsrahmens, der sich aus den vertragsrechtlichen und urheberrechtlichen Auslegungsgrundsatzen, den Verwertungsrechten des Urheberrechtsgesetzes sowie den wahrnehmungsrechtlichen und kartellrechtlichen Kontrolltatbestanden ergibt, eroertert sie die Vielzahl der Einzelregelung des Berechtigungsvertrags. Ergebnis der Untersuchung ist eine Abgrenzung der Rechte und Anspruche, die auf die GEMA zur kollektiven Wahrnehmung ubertragen werden von denen, die zur individuellen Wahrnehmung bei den Rechteinhabern verbleiben. Reimagines photography through the long history of ideas of expression The end of the nineteenth century saw massive developments and innovations in photography at a time when the forces of Western modernity—industrialization, racialization, and capitalism—were quickly reshaping the world. The Unintended slows down the moment in which the technology of photography seemed to speed itself—and so the history of racial capitalism—up. It follows the substantial shifts in the markets, mediums, and forms of photography during a legally murky period at the end of the nineteenth century. Monica Huerta traces the subtle and paradoxical ways legal thinking through photographic lenses reinscribed a particular aesthetics of whiteness in the very conceptions of property ownership. The book pulls together an archive that encompasses the histories of performance and portraiture alongside the legal, pursuing the logics by which property rights involving photographs are affirmed (or denied) in precedent-setting court cases and legal texts. Emphasizing the making of “expression” into property to focus our attention on the failures of control that cameras do not invent, but rather put new emphasis on, this book argues that designations of control’s absence are central to the practice and idea of property-making. The Unintended proposes that tracking and analyzing the sensed horizons of intention, control, autonomy, will, and volition offers another way into understanding how white supremacy functions. Ultimately, its unique historical reading practice offers a historically-specific vantage on the everyday workings of racial capitalism and the inheritances of white supremacy that structure so much of our lives.

Since the economic crisis unfolded in 2008, the European Union economic governance framework has been profoundly transformed from a legal perspective. The EU has adopted new tools, institutions and rules to tackle the changes and is arguably better prepared to combat any future crises. This book analyses the basic legal framework of EU economic governance and considers the economic underpinnings which underlie legal institutions in this area. This open access book investigates the role of collective bargaining in the gig economy. Despite the variety of situations covered by the term “gig economy”, collective agreements for employees and non-employees are being concluded in various countries, either at company or at branch level. Offline workers such as riders, food deliverers, drivers or providers of cleaning services are slowly gaining access to the series of negotiated rights that, in the past, were only available to employees. The chapters analyse recent high-profile decisions including Uber in France’s Court de Cassation, Glovo in the Spanish Supreme Court, and Uber in the UK Supreme Court. They evaluate the bargaining agents in different Member States of the EU, to determine whether established actors are participating in the dynamics of the gig economy or if they are being substituted, totally or partially, by new agents. Interesting best practices are drawn from the comparison, also as regards the contents of collective bargaining, raising awareness in those countries that are being left behind in the dynamics of the gig economy. The book collects the results of the COGENS (VS/2019/0084) research project, funded by the European Union, that gathered scholars and stakeholders from 17 countries. It will be an invaluable resource for scholars, trade unionists and policy makers.
