This collection of essays examines the diplomatic corps as an institution of international society. Contributors include both leading scholars from the field of diplomatic studies, serving diplomats, and scholar-diplomats. The central argument of the volume is that the diplomatic corps provides one of the few unambiguous ways by which an international society is constituted and finds expression. As the chapters show, however, what this means precisely varies hugely by setting and circumstance.
Advancing a constructivist conceptual approach, this book explains the surprising outcome of the Economic Partnership Agreements (EPAs) between the European Union and developing countries in Africa, the Caribbean and the Pacific (the ACP countries). Despite the EU's huge market power, it had limited success with the EPAs; an outcome that confounds materialist narratives equating trade power with market size. Why was the EU unable to fully realise its prospectus for trade and regulatory liberalisation through the EPA negotiations? Emphasising the role of social legitimacy in asymmetrical North-South trade negotiations, Murray-Evans sets the EPAs within the broader context of an institutionally complex global trade regime and stresses the agency of both weak and strong actors in contesting trade rules and practices across multilateral, regional and bilateral negotiating settings. Over the last century, international courts, once reserved for arcane matters of diplomacy and trade, have begun to address a broad range of human experience and activity. This volume corrects some of the common misperceptions about international judges, while providing a balanced introduction to both the strengths and shortcomings of their work. As they rule on crucial issues of war and peace, human rights, and trade, in addition to high-profile criminal trials, international judges are playing a critical role in developments that will affect world affairs for years to come. Based on interviews with more than 30 international judges, this volume is the first comprehensive portrait of the men and women in this new global profession. The working environment of international judges is closely examined in courts around the world, highlighting the challenge of carrying out work in multiple languages, in the context of intricate bureaucratic hierarchies, and with a necessary interdependence between judges and their courts' administration. This book shows that the executive branch of government has added a supranational level that increasingly seems to operate in a similar way to national governments. The European Commission administration has enhanced its professional integrity while the College emerges as a fully-fledged political body. As a whole the Commission seems to operate very much according to a sectoral logic rather than a territorial one. Case studies illuminate how a genuine Community Administration might evolve.
THEBACKGROUND Why a book on Europe - Toward the Year 200l? There are two principal reasons why a European should embark upon such a hazardous enterprise. First, when the Treaty on European Union (popularly known as the Maastricht Treaty, and, hereafter referred to as the Treaty in this introduction) was signed in February 1992, it was agreed that the heads of government of the EU Member States would assemble, in 1996, to examine its workings. This meeting will be known as the Intergovernmental Conference (IGC). Second, by the end of the century, it is certain that arrangements will have been made for the admission of some countries of Central and Eastern Europe into the European Union (EU). Consequently, even with or without the holding of the IGC, it will be urgently necessary to reform some of the Community's policies - notably the Common Agricultural Policy (CAP) and the structural poliCies which are linked, for example, 2 Europe - Toward 2001 with the Regional and Social Funds - before these countries become members. Failure to do this could result in bankruptcy for the EU. Of almost equal importance is the reform of the institutions and the actual workings of the Community. Already with 12 Member States, it was difficult enough to manage things on a daily basis. Now, as more countries join the Union, things could literally grind to a stop. Thus, changes in this area are indispensable.
Under pressure from globalization, the classical distinction
between domestic and international law has become increasingly
blurred, spurring demand for new paradigms to construe the emerging
postnational legal order. The typical response of constitutional
and international lawyers as well as political theorists has been
to extend domestic concepts - especially constitutionalism - beyond
the state. Yet as this book argues, proposals for postnational
constitutionalism not only fail to provide a plausible account of
the changing shape of postnational law but also fall short as a
normative vision. They either dilute constitutionalism's origins
and appeal to 'fit' the postnational space; or they create tensions
with the radical diversity of postnational society.
This book is one of the rare studies embracing, through a comparative and prospective approach, the emerging pan-Euro-Mediterranean regional integration. Once the sound of NATO bombing campaigns on Serbia died away, Europe was left with the problem of the hundreds of thousands of people displaced by the conflict, both from Kosovo and from Serbia. The aim of this study is to examine the extent to which the end of the Cold War led to Europeanisation in the Common Security and Defence Policy (CSDP). The analysis takes into consideration previous studies on Europeanisation and its impact on the transformation of national security and defence, and attempts to account for the development of Europeanisation and related mechanisms. These mechanisms, which have been described as framing mechanisms and negative integration, incorporate all the major relevant factors identified here (i.e. a common Strategic Culture, new security identity, domestic political decision-making, industrial base and defence-spending decline) that contributed to the realisation of the CSDP. The relevance of these factors for CSDP Europeanisation is examined through an historical and empirical analysis, and the relationship between the CSDP and North Atlantic Treaty Organization (NATO) is also explored. This approach facilitates analysis of the debate concerning the emergence of the CSDP and throws light on the political shift that led European Union (EU) leaders to support the CSDP. Another aspect of this study is the empirical examination of the dynamics and limitations of the European defence sector. The changes which took place in this sector facilitated the emergence of the CSDP and are therefore analysed in the light of globalisation issues, economies of scale, economic crises, military autonomy, new security strategy and Research and Development (R&D) impact. This book will be of interest to students of European security, EU politics, defence studies and International Relations.
