Schon das von einer Interessentenklage angestrebte Ziel zu bestimmen, fallt nicht so leicht wie bei einer Popularklage oder einer Verletztenklage. Nur um Rechtskontrolle des Verwaltungshandelns kann es naturlich solange nicht gehen, als die Klagelegitimation auf einer Beziehung des Klagers zum Klagegegenstand beruht. Andererseits muss dieser negative Befund auch fur den reinen Schutz subjektiver Rechte der Gewaltunterworfenen gelten, weil uber die Beeintrachtigung dieser Rechte hinaus jedes "Interesse" zur Klage berechtigt. Da diese beiden Ziele schon von der Verletzten- und Popularklage bedient werden, liegt der Schluss nahe, dass bei der Interessentenklage beide Zielrichtungen kombiniert sind. Nun ist die Einfuhrung einer Interessentenklage im deutschen Recht eines der am heftigsten umstrittenen Themen im Bereich des Verwaltungsprozessrechts. Dieser Streit ist kein junger. Er erfreut sich schon seit Jahrzehnten einer regen Auseinendersetzung. Dies mag vor allem daran liegen, dass es hier nicht einfach um die Einfuhrung einer weiteren Klageart in das nationale Recht geht. Zundstoff bietet vor allem die Tatsache, dass hier auch und besonders die Systementscheidung des Verwaltungsprozessrechts fur den Schutz subjektiv-offentlicher Rechte als gewichtiges Argument gegen eine weite Einfuhrung der Interessentenklage dient. Demgegenuber dient die Interessentenklage nicht zu geringem Teil, ja fast hauptsachlich, der Kontrolle der objektiven Rechtmassigkeit des Verwaltungshandelns. Der Gesetzgeber reagierte auf die zunehmende Gewaltbereitschaft bei Jugendlichen infolge des gesteigerten Konsums der Neuen Medien zum 1.4.2003 mit verscharften gesetzlichen Vorgaben in Form eines Jugendschutzgesetzes und des Jugendmediendienste-Staatsvertrages. Inhalt dieser Diplomarbeit war primar die Frage, inwieweit der von staatlicher Seite angestrebte effektive Jugendschutz im Internet einerseits und die verfassungsrechtlich garantierte Meinungsausserungsfreiheit andererseits gewahrleistet werden konnen. Daruber hinaus wird in dieser Arbeit geklart, inwieweit anhand der bestehenden gesetzlichen Regelungen eine umfassende Kontrolle des Mediums Internet moglich ist und ob diese im Rahmen der Grundlagen eines demokratischen Verfassungsstaats vollstandig in der Hand staatlicher Organe liegen sollte. Uber eine Bewertung der bestehenden gesetzlichen Grundlagen hinaus, wird die Aufgabe des Staates, die Moglichkeiten praventiver wie repressiver Kontrolle von Internetinhalten und die notwendigen Grenzen staatlicher Kontrolle aufgezeigt. Den Abschluss bildet die Einbeziehung des internationalen Wirkungsbereiches des Internets. Die Klarung der vorgenannten Leitfragen wird im Rahmen dieser Arbeit durch folgende inhaltliche Schwerpunkte vorgenommen: - Darstellung und Bewertung der Grundlagen fur den Jugendschutz im Internet Empirische Daten und Anlassfalle. - Abwagung zwischen effektivem Jugendschutz und Meinungsausserungsfreiheit Darstellung und Bewertung der anwendbaren Rechtsgrundlagen. - Analyse der Rolle und Aufgabe des Staates im Rahmen der Kontrolle v
This book focuses on the nuts and bolts of complex construction disputes and their resolution. Construction projects are highly technical long-term projects. They involve many parties, which - although supposedly committed to achieve a common goal - all have their own interests. This creates legal complexities, which increase the risk of disputes and the need for effective dispute resolution. The book covers dispute avoidance, alternative dispute resolution, arbitration, litigation, and evidence in construction disputes as well as future trends, such as the digitalised construction site and legal tech in construction disputes. It also examines construction disputes from an international perspective, giving insight into the common issues faced along the way.
A Critical Account of Article 106(2) TFEU: Government Failure in Public Service Provision offers a sceptical perspective on how EU law applies to public services. Article 106(2) provides that other Treaty rules may be disapplied in order to sustain a Service of General Economic Interest (SGEI). The rhetorical presentation of Article 106(2) is as a strict exception. As a result, Article 106(2) is often presented as a threat to Europe's public service tradition. This book challenges those shibboleths by using the concept of government failure. It is concerned with instances of government intervention that are unnecessary, generate avoidable inefficiencies, or that can be bettered so as to realise general interest goals more efficaciously. As an element of the government failure critique, a market feasibility test incorporating the concept of market failure is used to expose laxity in the review of general interests under Article 106(2). Complementing that, the process of disapplying other Treaty rules under Article 106(2) is shown to have evolved from being strict to being highly indulgent of SGEI providers, with a relatively recent but only partial correction post Altmark. Overall, the strict exception label for Article 106(2) does not hold. Moreover, it is contingent and presents no legitimate general interest related threat to the organisation and delivery of public services. A comprehensive re-orientation of Article 106(2) on issues of proof is required, as is greater reliance on market counterfactuals, and much more careful separation of objectives and means in SGEI operation and design. Through these measures, the toleration of government failure can be stemmed and Article 106(2)'s contingency reduced.

The European codification project has rapidly gathered pace since the turn of the century. This monograph considers the codification project in light of a series of broader analytical frameworks - comparative, historical and constitutional - which make modern codification phenomena intelligible. This new reading across fields renders the European codification project (currently being promoted through the Common Frame of Reference and the Optional Sales Law Code proposal) vulnerable to constitutionally-grounded criticism, traceable to normative considerations of private law authority and legitimacy. Arguing that modern codification phenomena are more complex than positivist, socio-legal and historical approaches have suggested over the past two centuries, the book stages a pathbreaking method of analysis of the law-discourse (nomos-centred) which questions at once the reduction of private law to legislation and of law to power and, on this basis, redefines the ways in which to counter law's disintegration and crisis in the context of Europeanisation. Professor Niglia reconstructs the European codification project as a complex structure of government-in-the-making that embodies a set of contingent world views, excludes alternatives, challenges the plurality of private laws and entrenches conflicts that pertain not only to form (codification, de-codification, recodification) but also to dilemmas implicated in determining the substantive orientation of European private law.
