Drawing together an international team of historians, lawyers and historical sociolinguists, this volume investigates urban cultures of law in Scotland, with a special focus on Aberdeen and its rich civic archive, the Low Countries, Norway, Germany and Poland from c. 1350 to c. 1650. In these essays, the contributors seek to understand how law works in its cultural and social contexts by focusing specifically on the urban experience and, to a great extent, on urban records. The contributions are concerned with understanding late medieval and early modern legal experts as well as the users of courts and legal services, the languages and records of law, and legal activities occurring inside and outside of official legal fora. This volume considers what the expectations of people at different status levels were for the use of the law, what perceptions of justice and authority existed among different groups, and what their knowledge was of law and legal procedure. By examining how different aspects of legal culture came to be recorded in writing, the contributors reveal how that writing itself then became part of a culture of law. Cultures of Law in Urban Northern Europe: Scotland and its Neighbours c.1350-c.1650 combines the historical study of law, towns, language and politics in a way that will be accessible and compelling for advanced level undergraduates and postgraduate to postdoctoral researchers and academics in medieval and early modern, urban, legal, political and linguistic history.
Embodiment, Expertise, and Ethics in Early Modern Europe highlights the agency and intentionality of individuals and groups in the making of sensory knowledge from approximately 1500 to 1700. Focused case studies show how artisans, poets, writers, and theologians responded creatively to their environments, filtering the cultural resources at their disposal through the lenses of their own more immediate experiences and concerns. The result was not a single, unified sensory culture, but rather an entangling of micro-cultural dynamics playing out across an archipelago of contexts that dotted the early modern European world-one that saw profound transitions in ways people used sensory knowledge to claim ethical, intellectual, and practical authority.
This book shows how international discourse citing 'self-determination' over the last hundred years has functioned as a battleground between two ideas of freedom: a 'radical' idea of freedom, and a 'liberal-conservative' idea of freedom. The book examines each of the major moments in which 'self-determination' has been a central part of the language of high-level international politics and law: the early 20th century discourse of V.I. Lenin and U.S. President Woodrow Wilson, the aftermath of the First World War and the formulation of the UN Charter, the 1950-1960s UN debates on 'self-determination', and the 2008-2010 International Court of Justice case on Kosovo's declaration of independence. At each of these moments in history, 'self-determination' was at the top of the international agenda. And at each moment, a fight over the meaning of freedom played out in 'self-determination' discourse. Besides providing insights into the historical times in which self-determination was prominently cited internationally, the book offers a recasting and renewal of international debates on freedom in international discourse.
This volume takes an important step towards developing global perspectives on the history of national history writing. With chapters spanning all five continents, contributors address a common framework which has been developed by the editor as part and parcel of his five-year European Science Foundation-funded project on the writing of national histories in Europe. Here the question is how and in which way European national histories may be compared to non-European national histories. In addition the volume pursues the question of the many influences, transfers, adaptations and interrelations between national historiographies in different parts of the globe.
This book focuses on the "after-life" of historical texts in the period between the arrival of printing in England and the early eighteenth century. Whereas previous studies of historical writing during this period have focused on their authors and on their style or methodology, this work examines the social forces that controlled what was written, and the impact of readers and publishers on authors. The intent is to situate the study of history books within the current literature on the history of the book and the history of print culture.
How was history written in Europe and Asia between 400-1400? How was the past understood in religious, social and political terms? And in what ways does the diversity of historical writing in this period mask underlying commonalities in narrating the past? This book addresses the importance of the theory of values that rests on a general metaphysical understanding founded on a comprehensive view of all aspects of the world. The author speaks against the absolutist theories with a realistic one encompassing a theory of space and time and considering value as an object of immediate intuition. These great philosophical questions feed into discussions of the philosophy of religion and of science. Garnett distinguishes between spiritual and other values on the ground that the spiritual values are not subjective to satiety, while other values are. He contends that our knowledge of mind is as direct and reliable as our knowledge of the physical world. This is an important early book by an influential 20th Century thinker.

This book looks at contemporary conundrums in philosophical tendencies, bringing the reader a first-principles review of the purpose of such enquiries in relation to modern life. It presents the importance of the history of the development of philosophical thought, beginning in Part 1 with perception. Significant definitions and theories are identified and later refinements discussed - in particular conceptualism and its development from the Greeks through Berkeley to modern realism and its limitations and critiques. Part 2 brings problems identified by past thinkersto the fore, from Plato's forms to Christian theology, in an examination of the apparent dichotomy between metaphysics and scientific methods. Part 3 examines the Rationalist and the Empiricist attacks on Scepticism and Kant's reconciliation of the differences of both. This provides the context and structure for discussion of the works of Hegel, and ultimate refutation thereof as a confusion between metaphysics and theology. Part 4 identifies the developments in thinking of Positivism, both Modern and Logical, and the New Synthesis of Alexander and Whitehead as the most recent approach.

This book seeks to highlight the influence of the Enlightenment idea of social progress on the character of the "civilising mission" in early Australia by tracing its presence in the various "civilising" attempts undertaken between 1788 and 1850. It also represents an attempt to marry the history of the British Enlightenment and the history of settler-Aboriginal interactions. The chronological structure of the book, as well as the breadth of its content, will facilitate the readers' understanding of the evolution of "civilising attempts" and their epistemological underpinnings, while throwing additional light on the influence of the Enlightenment on Australian history as a whole.
Viewing Samuel Taylor Coleridge's pursuit of continental intellectualism through the lens of cosmopolitanism, Maximiliaan van Woudenberg examines the so-called 'German Mania' of the writer in the context of the intellectual history of the university. At a time when the confessional model of Oxbridge precluded a liberal education in England, van Woudenberg argues, Coleridge's pursuit of continental methodologies and networks encountered at the University of Goettingen anticipated the foundation of the modern von Humboldt research-university model. Founded by the Hanoverian rulers of Great Britain, this cosmopolitan institution of knowledge successfully fostered cross-cultural interchange between German and British intellectuals during the latter half of the eighteenth century. van Woudenberg links the origins of Coleridge's engagement with European intellectualism to his first encounter with the innovations of a Reform university during his studies at the University of Goettingen in 1799, a period that many critics and biographers believe spoiled his poetry. Drawing on hitherto unexamined primary records and documents in German Kurrentschrift, this study shows Coleridge to be a visionary whose cross-cultural dissemination of continental intellectualism in England was ahead of its time and presents an intriguing episode in Cosmopolitan Romanticism by a major canonical figure.
John Wallis (1616-1703), was one of the foremost British mathematicians of the seventeenth century, and is also remembered for his important writings on grammar and logic. An interest in music theory led him to produce translations into Latin of three ancient Greek texts - those of Ptolemy, Porphyry and Bryennius - and involved him in discussions with Henry Oldenburg, the Secretary of the Royal Society, Thomas Salmon and other individuals as his ideas developed. The texts presented in this volume cover the relationship of ancient and modern tuning theory, the building of organs, the phenomena of resonance, and other musical topics.
Einhorn, a rhetorical scholar, explores the rich history of the Native American oral tradition, focusing on stories, orations, prayers, and songs. Because American Indians existed without written language for many generations, their culture was strongly dependent on an oral tradition for continuity and preservation. Not surprisingly, they spent many hours perfecting the art of oral communication and learning methods for committing their messages to memory. Einhorn thoroughly examines the important aspects of this unique oral tradition from a rhetorical perspective, covering individual speakers, nations, and time periods. In the first half of the book, the author examines how the Native American oral tradition has affected their cultural assumptions, principles, values, beliefs, and experiences. These chapters focus primarily on characteristics of the Native American oral tradition that transcend individual nations. The second half of the book includes translated transcripts of representative speeches, stories, prayers, and songs. In accessible and compelling prose, Einhorn discusses the sanctity of the spoken word to Native Americans, concluding that their oral tradition helps to account for the survival of their people and their culture.

Are Jane Austen and Charles Darwin the two great English empiricists of the nineteenth century? Peter W. Graham poses this question as he brings these two icons of nineteenth-century British culture into intellectual conversation in his provocative new book. Graham shows that while the one is generally termed a naturalist (Darwin's preferred term for himself) and the other a novelist, these characterizations are at least partially interchangeable, as each author possessed skills that would serve well in either arena. Both Austen and Darwin are naturalists who look with a sharp, cold eye at the concrete particulars of the world around them. Both are in certain senses novelists who weave densely particularized and convincingly grounded narratives that convey their personal observations and perceptions to wide readerships. When taken seriously, the words and works of Austen and Darwin encourage their readers to look closely at the social and natural worlds around them and form opinions based on individual judgment rather than on transmitted opinion. Graham's four interlocked essays begin by situating Austen and Darwin in the English empirical tradition and focusing on the uncanny similarities in the two writers' respective circumstances and preoccupations. Both Austen and Darwin were fascinated by sibling relations. Both were acute observers and analysts of courtship rituals. Both understood constant change as the way of the world, whether the microcosm under consideration is geological, biological, social, or literary. Both grasped the importance of scale in making observations. Both discerned the connection between minute, particular causes and vast, general effects. Employing the trenchant analytical talents associated with his subjects and informed by a wealth of historical and biographical detail and the best of recent work by historians of science, Graham has given us a new entree into Austen's and Darwin's writings.

Second, they review the waxing, prominence, and waning of Community Mental Health as an example of a segment of this cyclical history of psychiatry. Third, they provide the first biography of Erich Lindemann, one of the founders of social and community psychiatry, and explore the interaction of the prominent contributor with the historical environment and the influence this has on both. We return to the issue of values and ideologies as influences on psychiatry, whether or not it is accepted as professionally proper. This is intended to stimulate self-reflection and the acceptance of the values sources of ideology, their effect on professional practice, and the effect of values-based ideology on the community in which psychiatry practices. The books will be of interest to psychiatric teachers and practitioners, health planners, and socially responsible citizens.
