The field of 'critical indigenous rights studies' is a complex one that benefits from an interdisciplinary perspective and a realist (as opposed to an idealised) approach to indigenous peoples. This book draws on sociology of law, anthropology, political sciences and legal sciences in order to address emerging issues in the study of indigenous rights and identify directions for future research. The first part of the volume investigates how changing identities and cultures impact rights protection, analysing how policies on development and land, and processes such as migration, interrelate with the mobilisation of identities and the realisation of rights. In the second part, new approaches related to indigenous peoples' rights are scrutinised as to their potential and relevance. They include addressing legal tensions from an indigenous peoples' rights perspective, creating space for counter-narratives on international law and designing new instruments. Throughout the text, case studies with wide geographical scope are presented, ranging from Latin America (the book's focus) to Egypt, Rwanda and Scandinavia.

Joanna Overing, London School of Economics The Arakmbut are an indigenous people who live in the Madre de Dios region of thesoutheastern Peruvian rain forest. Since their first encounters with missionaries in the 1950s, they have shown resilience and a determination to affirm their identity in the face of many difficulties. During the last fifteen years, Arakmbut survival has been under threat from a goldrush that has attracted hundreds of colonists onto their territories. This trilogy of books traces the ways in which the Arakmbut overcome the dangers that surround them: their mythology and cultural strength; their social flexibility; and their capacity to incorporate non-indigenous concepts and activities into their defence strategies. Each area is punctuated by the constant presence of the invisible spirit, which provides a seamless theme connecting the books to each other. Following the Arakmbuts' recommendation, the author uses their three greatest myths to introduce social, cultural and historical aspects of their lives. He ends with a discussion of the relationship between myth and history showing how the Arakmbut recreate their myths at the dramatic moments of their history.
Over the past thirty years the Australian travel experience has been 'Aboriginalized'. Aboriginality has been appropriated to furnish the Australian nation with a unique and identifiable tourist brand. This is deeply ironic given the realities of life for many Aboriginal people in Australian society. On the one hand, Aboriginality in the form of artworks, literature, performances, landscapes, sport, and famous individuals is celebrated for the way it blends exoticism, mysticism, multiculturalism, nationalism, and reconciliation. On the other hand, in the media, cinema, and travel writing, Aboriginality in the form of the lived experiences of Aboriginal people has been exploited in the service of moral panic, patronized in the name of white benevolence, or simply ignored. For many travel writers, this irony - the clash between different regimes of valuing Aboriginality - is one of the great challenges to travelling in Australia. Travel Writing from Black Australia examines the ambivalence of contemporary travelers' engagements with Aboriginality. Concentrating on a period marked by the rise of discourses on Aboriginality championing indigenous empowerment, self-determination, and reconciliation, the author analyses how travel to Black Australia has become, for many travelers, a means of discovering 'new'-and potentially transformative-styles of interracial engagement.
In 70 countries worldwide, there is an estimated 370 million indigenous peoples, and their rich diversity of cultures, religions, traditions, languages and histories has been significant source of our scholarships. However, the health status of this population group is far below than that of non-indigenous populations by all standards. Could the persisting reluctance to understand the influence of self-governance, globalization and social determinants of health in the lives of these people be deemed as a contributor to the poor health of indigenous peoples? Across the globe, there are numerous examples of treaties, compacts, or other negotiated agreements that mediate relationships between Indigenous peoples and states or settler communities. Perhaps the best known of these, New Zealand's Treaty of Waitangi is a living, and historically rich, illustration of this types of negotiated agreement, and both the symmetries and asymmetries of Indigenous-State relations. This collection refreshes the scholarly and public discourse relating to the Treaty of Waitangi and makes a significant contribution to the international discussion of Indigenous-State relations and reconciliation. The essays in this collection explore the diversity of meanings that have been ascribed to Indigenous-State compacts, such as the Treaty, by different interpretive communities. As such, they enable and illuminate a more dynamic conversation about their meanings and applications, as well as their critical role in processes of reconciliation and transitional justice today.
The tragic tale of the Nez Perce flight for freedom in the summer of 1877 is a touchstone in the history of the American West. This first volume of John Worth's substantial two-volume work studies the assimilation and eventual destruction of the indigenous Timucuan societies of interior Spanish Florida near St. Augustine, shedding new light on the nature and function of La Florida's entire mission system. Beginning in this volume with analysis of the late prehistoric chiefdoms, Worth traces the effects of European exploration and colonization in the late 1500s and describes the expansion of the mission frontier before 1630. As a framework for understanding the Timucuan rebellion of 1654 and its pacification, he explores the internal political and economic structure of the colonial system. In volume 2, he shows that after the geographic and political restructuring of the Timucua mission province, the interior of Florida became a populated chain of way-stations along the royal road between St. Augustine and the Apalachee province. Finally, he describes rampant demographic collapse in the missions, followed by English-sponsored raids, setting a stage for their final years in Florida during the mid-1700s. The culmination of nearly a decade of original research, these books incorporate many previously unknown or little-used Spanish documentary sources. As an analysis of both the Timucuan chiefdoms and their integration into the colonial system, they offer important discussion of the colonial experience for indigenous groups across the nation and the rest of the Americas. Native nations, like the Navajo nation, have proven to be remarkably adept at retaining and exercising ever-increasing amounts of self-determination even when faced with powerful external constraints and limited resources. Now in this fourth edition of David E. Wilkins' The Navajo Political Experience, political developments of the last decade are discussed and analyzed comprehensively, and with as much accessibility as thoroughness and detail. In Everyday Food Practices, Tarunna Sebastian explores the teaching and learning dimensions of people's food choices and practices as they are played out in their everyday lives and local community. Using multi-sited critical ethnographic methodology, Sebastian followed people on their journeys while planning, shopping, preparing, cooking, and eating food. These journeys reveal that supermarket corporations play a hegemonic role, creating and sustaining class-based diets and cultural dynamics which undermine individual agency. Rebuking corporate hegemony, food education at counter-cultural sites-such as farmers' markets, food cooperatives, and community gardens-seeks to empower people with knowledge and skills derived from socially and environmentally sustainable food curricula. However, class and ethnicity-based patterns of engagement compromise learning at these sites. Sebastian argues that, by contrast, the embodied experiences of inter-generational, home-based food practices are more effective in teaching sustainable cooking skills and the production of healthy meals.
This book takes an interdisciplinary approach to the complicated power relations surrounding the recognition and implementation of Indigenous Peoples' rights at multiple scales. The adoption of the United Nations Declaration on the Rights of Indigenous Peoples in 2007 was heralded as the beginning of a new era for Indigenous Peoples' participation in global governance bodies, as well as for the realization of their rights - in particular, the right to self-determination. These rights are defined and agreed upon internationally, but must be enacted at regional, national, and local scales. Can the global movement to promote Indigenous Peoples' rights change the experience of communities at the local level? Or are the concepts that it mobilizes, around rights and political tools, essentially a discourse circulating internationally, relatively disconnected from practical situations? Are the categories and processes associated with Indigenous Peoples simply an extension of colonial categories and processes, or do they challenge existing norms and structures? This collection draws together the works of anthropologists, political scientists, and legal scholars to address such questions. Examining the legal, historical, political, economic, and cultural dimensions of the Indigenous Peoples' rights movement, at global, regional, national, and local levels, the chapters present a series of case studies that reveal the complex power relations that inform the ongoing struggles of Indigenous Peoples to secure their human rights. The book will be of interest to social scientists and legal scholars studying Indigenous Peoples' rights, and international human rights movements in general.
This book is about the presence of the absent- the tribes of Punjab, India, many of them still nomadic, constituting the poorest of the poor in the state. Drawing on exhaustive fieldwork and ethnographic accounts of more than 750 respondents, it explores the occupational change across generations to prove their presence in the state before the Criminal Tribes Act was implemented in 1871. The archival reports reveal the atrocities unleashed by the colonial government on these people. The volume shows how the post-colonial government too has proved no different; it has done little to bring them into the mainstream society by not exploiting their traditional expertise or equipping them with modern skills. This book will be of great interest to scholars of sociology, social anthropology, social history, public policy, development studies, tribal communities and South Asian studies.

Child Survivors of Genocide: Trauma, Resilience, and Identity in Guatemala presents mixed-method, comparative ethnographic research conducted with orphaned child survivors who are now adults. These survivors were orphaned during Guatemala's 36-year internal armed conflict and particularly during the heightened period of genocide from 1978 to 1983, referred to as la violencia. Raised for the majority of their childhoods in a family-style permanent residential home in the highlands region, the author examines the long-term consequences that these individuals have faced not only from grieving the loss of their parents and family members but also because of their orphan status. While they suffer from lasting trauma, these child survivors have become resilient, well-adapted adults with a strong internalized sense of ethnic identity. They also engage in creative and transformative practices regarding ethnic identity and belonging that have contributed to their abilities to adapt to their life circumstances in positive, constructive ways, and have expanded what it means to be Maya Indigenous Guatemalans today. Child survivors' experiences offer inspiration, justify expanded research with child survivors as their own distinct social group of survivors, and warrant reconsideration of in-country residential care when other forms of loving, nurturing in-country care are unavailable.
How do videos, movies and documentaries dedicated to indigenous communities transform the media landscape of South Asia? Based on extensive original research, this book examines how in South Asia popular music videos, activist political clips, movies and documentaries about, by and for indigenous communities take on radically new significances. Media, Indigeneity and Nation in South Asia shows how in the portrayal of indigenous groups by both 'insiders' and 'outsiders' imaginations of indigeneity and nation become increasingly interlinked. Indigenous groups, typically marginal to the nation, are at the same time part of mainstream polities and cultures. Drawing on perspectives from media studies and visual anthropology, this book compares and contrasts the situation in South Asia with indigeneity globally.

On September 27, 1975, activist Bernie Whitebear (Sin Aikst) and Seattle Mayor Wes Uhlman broke ground on former Fort Lawton lands, just outside Seattle Washington, for the construction of the Daybreak Star Indian Cultural Center. The groundbreaking was the culmination of years of negotiations and legal wrangling between several government entities and the United Indians of All Tribes, the group that occupied the Fort lands in 1970. The peaceful event and sense of co-operation stood in marked contrast to the turbulent and sometimes violent occupation of the lands years before. Native Americans who joined the UIAT came from all parts of the Pacific Northwest and beyond. Inspired by the Civil Rights and protest era of the 1960s and 1970s, they squared off with local and federal government to demand the protection of civil and political rights and better social services. Both the scope and the purpose of this book are manifold. The first purpose is to challenge the predominant narrative of Anglo American colonization in the region and re-assert self-determination by re-defining the relationship between Pacific Northwest Native Americans, the larger population of Washington State, and government itself. The second purpose is to illustrate the growth in Pan-Indian/Pan-Tribal activism in the second half of the twentieth century in an attempt to place the Pacific Northwest Native American protests into a broader context and to amend the scholarly and popular trope which characterizes the Red Power movement of the 1960s as the creation of the American Indian Movement (AIM). In this book, casual students of history as well as academics will find that Fort Lawton represents the zone of conflict and compromise occupied by Indigenous people of the Pacific Northwest in their ongoing struggle with colonial society.
American Indian nations are sovereign political entities within the United States. They have complex relationships with the federal government and increasingly with state governments. Regulatory conflict between Native nations and states has increased as Native nations have developed their own independent economies and some states have sought to assert their control over reservation territory. This book explores the intergovernmental conflict between Native nations and states, with a focus on the tension over the enforcement of state cigarette taxes for on-reservation sales. Anne F. Boxberger Flaherty asks: when do states and Native nations come to agreement, when do they disagree, and why are states sometimes willing to extend great efforts to assert their taxes on reservations? Flaherty uses a multi-method approach, with a historical review of expanding state involvement on reservations, a quantitative analysis of state enforcement of cigarette taxes on reservations, and a qualitative analysis of several specific case studies, including the potential for intergovernmental conflict over marijuana cultivation and sales on reservations to answer these questions. This book will be interest to scholars and researchers of Indigenous Politics, Native American Indian Politics, State Politics, and Intergovernmental Politics.
This edited collection argues for the importance of recovering Indigenous participation within global networks of imperial power and wider histories of "transnational" connections. It takes up a crucial challenge for new imperial and transnational histories: to explore the historical role of colonized and subaltern communities in these processes, and their legacies in the present. Bringing together prominent and emerging scholars who have begun to explore Indigenous networks and "transnational" encounters, and to consider the broader significance of "extra-local" connections, exchanges and mobility for Indigenous peoples, this work engages closely with some of the key historical scholarship on transnationalism and the networks of European imperialism. Chapters deploy a range of analytic scales, including global, regional and intra-Indigenous networks, and methods, including histories of ideas and cultural forms and biography, as well as exploring contemporary legacies. In drawing these perspectives together, this book charts an important new direction in research.
Unsettling America explores the cultural politics of Indianness in the 21st century. It concerns itself with representations of Native Americans in popular culture, the news media, and political debate and the ways in which American Indians have interpreted, challenged, and reworked key ideas about them. It examines the means and meanings of competing uses and understandings of Indianness, unraveling their significance for broader understandings of race and racism, sovereignty and self-determination, and the possibilities of decolonization. To this end, it takes up four themes: *false claims about or on Indianness, that is, distortions, or ongoing stereotyping; *claiming Indianness to advance the culture wars, or how indigenous peoples have figured in post-9/11 political debates; *making claims through metaphors and juxtaposition, or the use of analogy to advance political movements or enhance social visibility; and *reclamations, or exertion of cultural sovereignty. |
