International law is not merely a set of rules or processes, but is a professional activity practised by a diversity of figures, including scholars, judges, counsel, teachers, legal advisers and activists. Individuals may, in different contexts, play more than one of these roles, and the interactions between them are illuminating of the nature of international law itself. This collection of innovative, multidisciplinary and self-reflective essays reveals a bilateral process whereby, on the one hand, the professionalisation of international law informs discourses about the law, and, on the other hand, discourses about the law inform the professionalisation of the discipline. Father Ignacio Gordon, SJ, taught canon law (the Catholic Church's law) from 1960 until 1985 at the Pontifical Gregorian University in Rome, with a concentration on procedural law, or the laws on trials. By all testimonies, he was outstanding for the clarity of his teaching, his humble affection for his students, his indefatigable and hidden service to the Apostolic See, and his priestly zeal. Notable among his endeavors was an educational initiative for the ongoing formation of judges and other ministers of justice in ecclesiastical tribunals. In his teaching, he stressed the ecclesial importance and supernatural implications of procedural law in general, and the indispensability of the judicial protection of marriage in particular. Special efforts were made to make procedural law understandable to his students and to canonists in general, at a time when the Church was celebrating and implementing the teachings of the Second Vatican Ecumenical Council, as a result of which her law was undergoing a major revision. Father Gordon taught from the consistent canonical tradition, while also laying bare the latest developments in law and jurisprudence. He taught the entirety of the law on trials, producing numerous scholarly works on questions both timeless and new, giving marked emphasis to the problem of the excessive length of trials and the causes of delayed justice. An area of his particular attention and dedication was the Supreme Tribunal of the Apostolic Signatura-of which he was a consultor (referendary and later votans)-including both its proper law and its history. This history displayed, in part, why that Tribunal was the natural one to function as the supreme administrative tribunal of the Church. Father Gordon's contribution to the question of ecclesiastical administrative justice was among those leading the novel and dynamic discussion about it in the 1960s and 1970s.

Die Arbeit zeigt das traditionell haushaltsrechtliche Anliegen der Regelungen zur Auftragsvergabe auf. Sie wendet sich der voneinander abweichenden Entwicklung des Vergaberechts in Staat und Kirche zu und begrundet vor dem Hintergrund einer Vielzahl ungeklarter Fragen im europarechtlich bestimmten staatlichen Vergaberecht, warum die evangelischen Landeskirchen in Deutschland keine oeffentlichen Auftraggeber sind. Fur staatlich gefoerderte kirchliche Auftrage werden die Voraussetzungen und Moeglichkeiten untersucht, religionsspezifische Anliegen bei der Auftragsvergabe einzubeziehen.
Diese Gedenkschrift wurdigt Carl Gerold Furst als Wissenschaftler, der sich durch sein kompetentes und selbstloses Engagement hohe Verdienste um Lehre und Praxis des kanonischen Rechtes erworben hat. Papst Johannes Paul II. erwahnte Furst bei der Vorstellung dieses Codex namentlich. Sein Heimatland OEsterreich verlieh dem geburtigen Wiener das "Ehrenkreuz fur Wissenschaft und Kunst I. Klasse", Johannes Paul II. zeichnete ihn mit dem Orden eines Grossoffiziers (Komtur mit Stern) des Papstlichen Gregoriusordens aus.
Martial law is not a body of substantive law, but rather summary powers employed by the military commanders when the ordinary rule of law is suspended. Under the British rule, martial law was proclaimed on many occasions in different territories in India, wherein excessively harsh provisions were used to humiliate Indians. The framers of the Indian Constitution did not make any express provision about martial law under the Constitution. However, an implied reference to the possibility of imposing martial rule in India has indicated in Article 34 wherein it provides that an Act of Indemnity may be passed by the Parliament in respect of acts done under martial law. This book covers the historical perspective of martial law in India and compares it with a few other countries. The possibility of arrest and detention of an offender during martial law, the rights to the habeas corpus in such circumstances, and the power of constitutional courts to issue such a writ has been analyzed. The book examines the powers of the military commander under the Armed Forces Special Powers Act and critically evaluates whether it amounts to the de facto proclamation of martial law. The Book also analyses whether the proclamation of martial law is feasible in India in the future. This book is intended for not only those who are involved in promoting, protecting, and enforcing human rights, but also for those engaged in the security of the country. It will of relevance to parliamentarians, government officials, military authorities, judges, lawyers, and members of the civil society who have a stake in the armed forces.
La question de l'obligation pour les femmes de porter un voile ou de se couvrir la chevelure a ete traitee par les sociologues dans son contexte social et politique. Mais l'histoire de ce voile, ses origines, sa tradition et donc sa signification meme, ont ete largement delaisses par la recherche. D'ou vient donc l'obligation pour les femmes de porter le voile? Est-elle veritablement religieuse? Est-elle, dans son essence, paienne, juive, chretienne, musulmane? Ou bien est-elle, en realite, issue de conflits psychologiques et sociaux vieux comme le monde? Les arguments utilises par les integristes pour voiler les femmes, ne seraient-ils pas eux-memes un voile, dissimulant la portee reelle de cette piece de vetement particuliere? La recherche historique permet de mieux saisir les enjeux du port obligatoire du voile par les femmes a une epoque ou les fanatismes religieux se developpent.
Der Verein Fundare e.V., Gemeinnutziger Verein zur Foerderung des Stiftungswesens hat es sich zum Ziel gesetzt, zu einer aufbluhenden Stiftungskultur in Deutschland beizutragen. Dazu sollen insbesondere die wissenschaftlichen und praktischen Grundlagen des Stiftens erforscht werden. Der Erfullung dieser Aufgabe dient die Zeitschrift Die Stiftung - Jahreshefte zum Stiftungswesen. Sie beinhaltet in ihrer siebten Ausgabe vor allem die Vortrage, die auf dem von Fundare e.V. veranstalteten 7. Stiftungsrechtstag an der Ruhr-Universitat Bochum gehalten wurden. Daruber hinaus haben noch weitere Beitrage Aufnahme gefunden. Es werden nicht nur eingehend zivilrechtliche, sondern auch verwaltungs- und steuerrechtliche Problematiken des Stiftungsrechts beleuchtet.
