This volume highlights important aspects of the complex relationship between common language and legal practice. It hosts an interdisciplinary discussion between cognitive science, philosophy of language and philosophy of law, in which an international group of authors aims to promote, enrich and refine this new debate. Philosophers of law have always shown a keen interest in cognitive science and philosophy of language in order to find tools to solve their problems: recently this interest was reciprocated and scholars from cognitive science and philosophy of language now look to the law as a testing ground for their theses. Using the most sophisticated tools available to pragmatics, sociolinguistics, cognitive sciences and legal theory, an interdisciplinary, international group of authors address questions like: Does legal interpretation differ from ordinary understanding? Is the common pragmatic apparatus appropriate to legal practice? What can pragmatics teach about the concept of law and pervasive legal phenomena such as testimony or legal disagreements?
This book argues against the mainstream view that we should treat propositional attitudes as internal states, suggesting that to treat beliefs as things of certain sort (i.e. to reify them) is a mistake. The reificatory view faces several problems that the non-reificatory view avoids, and it is argued the non-reificatory view is more faithful to the everyday concept of belief. There are several major reasons why it might be thought that a reificatory approach to mental states is nevertheless unavoidable, but this book attempts to show that none of these reasons is at all convincing; in each case, the evidence is consistent with a non-reificatory view. Having argued that the popularity of the reificatory view is unjustified, the author examines history of psychology and philosophy of mind, and the structure of psychological language, in order to show that this popularity is quite understandable, but mistaken nonetheless.
This book analyzes the role of language in scientific research and develops the semantics of science from different angles. The philosophical investigation of the volume is divided into four parts, which covers both basic science and applied science: I) The Problem of Reference and Potentialities of the Language in Science; II) Language and Change in Scientific Research: Evolution and Historicity; III) Scientific Language in the Context of Truth and Fiction; and IV) Language in Mathematics and in Empirical Sciences. This book proposes a comprehensive discussion of the issue of linguistic feeling, the subject’s metalinguistic capacity to intuitively apprehend the normative – lexical, syntactic, morphological, phonological… – dimensions of a definite language he or she is acquainted with. The volume’s twelve contributions aim to revisit a concept that, through a fluctuating terminology (“Sprachgefühl,” “sentiment de la langue,” “linguistic intuitions,” etc.), had developed, since the late 18th century, within a variety of cultural contexts and research traditions, and whose theoretical, epistemological, and historical ins and outs had not been systematically explored so far. Beginning with a long opening chapter, the book consists of two parts, one tracing the multifaceted approaches to linguistic feeling from Herder to Wittgenstein, and one offering a representative overview of the debates about the issue at stake in current linguistics and philosophy, while addressing the question of the place of metacognition, normativity, and affectivity in language processes.
This monograph on indirect reports offers insights on the semantics/pragmatics interface and a refinement of the notion of explicature. The volume is written in an engaging style and guides the reader through the theoretical problems and their ramifications. The thorniest problem in the study of indirect reports is their polyphonic nature, and how the listener distinguishes between the reporter's voice and the original speaker's voice, either by contextual clues or, in the absence of such clues, by resorting to pragmatic principles. The introductory chapter discusses the main issues that will be addressed in the volume. The next chapters focus on the various aspects of indirect reports, covering both theory and practical applications.
In this study two strands of inferentialism are brought together: the philosophical doctrine of Brandom, according to which meanings are generally inferential roles, and the logical doctrine prioritizing proof-theory over model theory and approaching meaning in logical, especially proof-theoretical terms.

This book presents the results of a large-scale experiment into interpretations of the metaphor "the Nation as a Body" among 1,800+ respondents from 30 linguistic and cultural backgrounds. In this first account of an empirical study of cross-cultural global metaphor interpretation of that scale, Musolff confirms that the meanings of metaphors are complex, culturally mediated and may differ for senders and recipients. The book provides a historical and cultural map of the traditions underlying differences in how the nation as a body - or, "the body politic" - is understood. Musolff challenges the hypotheses of the universality of "the nation" as a predominantly male-gendered and hierarchically organized concept and, in so doing, puts into question some of the key presuppositions of traditional historical and cognitive approaches to metaphor. For scholars and students of figurative language, the book lays out methodological foundations for cross-cultural metaphor comparison and reveals hidden meaning differences in political metaphor in English as lingua franca.
Walton's book is a study of several fallacies in informal logic. Focusing on question-answer dialogues, and committed to a pragmatic rather than a semantic approach, he attempts to generate criteria for evaluating good and bad questions and answers. The book contains a discussion of such well-recognized fallacies as many questions, black-or-white questions, loaded questions, circular arguments, question-begging assertions and epithets, ad hominem and tu quoque arguments, ignoratio elenchi, and replying to a question with a question. In addition, Walton develops several artificial dialogue games and has an excellent discussion of burden of proof in nonlegal contexts. The discussion is for the most part nontechnical and does not presuppose any training in formal logic. It is illustrated with many (sometimes overlong) examples of fallacies drawn from real life--mostly debates in the Canadian House of Commons. . . . Walton's book breaks new ground on a number of issues. Choice This first full-length study of logical fallacies, errors, faults, illicit attacks, blunders, and other critical deficiencies in interrogation and reply has been written in the tradition of informal fallacies in logic. It is especially valuable, readable, and interesting because of the 139 case studies it presents, many of these case studies come from political debates and some from interviews, legal cross-examinations, and other sources. Walton uses these challenging examples of tricky, aggressive, argumentative, or fallacious questions to develop coherent and pragmatic guidelines for criticizing questionable questions (and in some cases their replies) on logical grounds. Among the types of problematic questions analyzed are: the traditional so-called fallacy of many questions, illustrated by the famous Have you stopped beating your wife?; black and white questions; terminologically loaded questions; and questions containing personal attacks. These and other types of problematic questions as well as evasive replies and replying to a question with a question are studied. Critical errors of reasoning are identified and analyzed by developing context-based, normative models of reasonable dialogue in which a questioner must have freedom to ask informative and probing questions, and the respondent must be constrained to give reasonably direct, not overly evasive answers. In this era of negative and evasive political campaigning, with candidates employing skillful tactics of manipulating public opinion to assure election rather than taking clear stands and seriously debating issues in an informed and sincere manner, Question-Reply Argumentation is especially relevant reading for those who take democracy seriously. The methods used reflect a significant shift from earlier semantically based theories to current pragmatic, dialogue-based models, and will be of interest to logicians and linguists. The volume's conclusions should challenge some current preconceptions. Recommended reading for courses in logic, speech communications, linguistics, philosophy of language, areas of political science relating to political discourse and debate, courses on questioning in cognitive psychology, and courses on critical thinking in education.
This open access book introduces a general framework that allows natural language researchers to enhance existing competence theories with fully specified performance and processing components. Gradually developing increasingly complex and cognitively realistic competence-performance models, it provides running code for these models and shows how to fit them to real-time experimental data. This computational cognitive modeling approach opens up exciting new directions for research in formal semantics, and linguistics more generally, and offers new ways of (re)connecting semantics and the broader field of cognitive science. The approach of this book is novel in more ways than one. Assuming the mental architecture and procedural modalities of Anderson's ACT-R framework, it presents fine-grained computational models of human language processing tasks which make detailed quantitative predictions that can be checked against the results of self-paced reading and other psycho-linguistic experiments. All models are presented as computer programs that readers can run on their own computer and on inputs of their choice, thereby learning to design, program and run their own models. But even for readers who won't do all that, the book will show how such detailed, quantitatively predicting modeling of linguistic processes is possible. A methodological breakthrough and a must for anyone concerned about the future of linguistics! (Hans Kamp) This book constitutes a major step forward in linguistics and psycholinguistics. This present book explores recent advances in modeling discourse processes, in particular, new approaches aimed at understanding pathological language behavior specific to schizophrenia. The contributors examine the modeling paradigm of formal semantics, which falls within the scope of both linguistics and logic while providing overlapping links with other fields such as philosophy of language and cognitive psychology. This book is based on results presented during the series of workshops on (In)Coherence and Discourse organized by SLAM (Schizophrenia and Language: Analysis and Modeling), a project developed to systemize the study of pathological language processing by taking an overarching interdisciplinary approach combining psychology, linguistics, computer science and philosophy. The principle focus is on conversations produced by people with psychiatric disorders such as schizophrenia and autism. The contributions come from young and experienced researchers, and invited speakers. The book appeals to likeminded students and researchers.
Truth is a pervasive feature of ordinary language, deserving of systematic study, and few theorists of truth have endeavoured to chronicle the tousled conceptual terrain forming the non-philosopher's ordinary view. In this book, the author recasts the philosophical treatment of truth in light of historical and recent work in experimental philosophy. He argues that the commonsense view of truth is deeply fragmented along two axes, across different linguistic discourses and among different demographics, termed in the book as endoxic alethic pluralism. To defend this view, four conclusions must be reached: (1) endoxic alethic pluralism should be compatible with how the everyday person uses truth, (2) the common conception of truth should be derivable from empirical data, (3) this descriptive metaphysical project is one aspect of a normative theory of truth, and (4) endoxic alethic pluralism is at least partially immune to challenges facing the ecological method in experimental philosophy and alethic pluralism.
Together with the volume "Inquiries in philosophical pragmatics: Linguistic and theoretical issues," this book provides a journey through the more recent developments of pragmatics, considering both its philosophical and linguistic nature. Critical Semiotics provides long overdue answers to questions at the junction of information, meaning and 'affect'. The affective turn in cultural studies has received much attention: a focus on the pre-individual bodily forces, linked to automatic responses, which augment or diminish the body's capacity to act or engage with others. In a world dominated by information, how do things that seem to have diminished meaning or even no meaning still have so much power to affect us, or to carry on our ability to affect the world? Linguistics and semiotics have been accused of being adrift from the affective turn and not accounting for these visceral forces beneath or generally other from conscious knowing. In this book, Gary Genosko delivers a detailed refutation, with analyses of specific contributions to critical semiotic approaches to meaning and signification. People want to understand how other people are moved and to understand embodied social actions, feelings and passions at the same time as understanding how this takes place. Semiotics must make the affective turn.
Ludwig Wittgenstein's Tractatus Logico-Philosophicus (1922) remains one of the most enigmatic works of twentieth century thought. In this bold and original new study, Ben Ware argues that Wittgenstein's early masterpiece is neither an analytic treatise on language and logic, nor a quasi-mystical work seeking to communicate 'ineffable' truths. Instead, we come to understand the Tractatus by grasping it in a twofold sense: first, as a dialectical work which invites the reader to overcome certain 'illusions of thought'; and second as a modernist work whose anti-philosophical ambition is intimately tied to its radical aesthetic character. By placing the Tractatus in the force field of modernism, Dialectic of the Ladder clears the ground for a new and challenging exploration of the work's ethical dimension. It also casts new light upon the cultural, aesthetic and political significances of Wittgenstein's writing, revealing hitherto unacknowledged affinities with a host of philosophical and literary authors, including Hegel, Kierkegaard, Marx, Nietzsche, Adorno, Benjamin, and Kafka.
Frege's puzzle concerning belief reports has been in the middle of the discussion on semantics and pragmatics of attitude reports: The intuition behind the opacity does not seem to be consistent with the thesis of semantic innocence according to which the semantic value of proper names is nothing but their referent. Main tasks of this book include providing truth-conditional content of belief reports. Especially, the focus is on semantic values of proper names. The key aim is to extend Crimmins's basic idea of semantic pretense and the introduction of pleonastic entities proposed by Schiffer. They enable us to capture Frege's puzzle in the analysis without giving up semantic innocence. To reach this conclusion, two issues are established. First, based on linguistic evidence, the frame of belief reports functions adverbially rather than relationally. Second, the belief ascriptions, on which each belief report is made, must be analyzed in terms of the measurement-theoretic analogy.

This book examines the concept of meaning and our general understanding of reality in a legal and philosophical context. Starting from the premise that meaning is a matter of linguistic and other forms of articulation, it considers the inherent philosophical consequences. Part I presents Klages', Derrida's, Von Hofmannsthal's and Wittgenstein's explorations of silence as a source of articulation and meaning. Debates about 20th century psychologism gave the attitude concept a pivotal role; it illustrates the importance of the discovery that a word is globally qualified as 'the basic unit of language'. This is mirrored in the fact that we understand reality as a matter of particles and thus interpret the real as a component of an all-embracing 'particle story'. Each chapter of the book focuses on an aspect of legal semiotics related to the chapter's theme: for instance on the meaning of a Judge's 'Saying for Law', on law students training in varying attitudes or on the ties between law and language. Part II of the book illustrates our general understanding of reality as a matter of particles and partitioning, and examines texts that prove that particle thinking is basic for our meaning concept. It shows that physics, quantum theory, holism, and modern brain research focusing on human linguistic capabilities, confirm their ties to the particle story. In contrast, the book concludes that partitions and particles are neither a fact in the history of the cosmos nor a determinant of knowledge and the sciences, and that meaning is a process: a constellation rather than a fixation. This is manifest once one understands meaning as the result of continuously changing attitudes, which create our narratives on cosmos and creation. The book proposes a new key for meaning: a linguistic occurrence anchored in dimensions of human narrativity.
This monograph examines truth in fiction by applying the techniques of a naturalized logic of human cognitive practices. The author structures his project around two focal questions. What would it take to write a book about truth in literary discourse with reasonable promise of getting it right? What would it take to write a book about truth in fiction as true to the facts of lived literary experience as objectivity allows? It is argued that the most semantically distinctive feature of the sentences of fiction is that they areunambiguously true and false together. It is true that Sherlock Holmes lived at 221B Baker Street and also concurrently false that he did. A second distinctive feature of fiction is that the reader at large knows of this inconsistency and isn't in the least cognitively molested by it. Why, it is asked, would this be so? What would explain it? Two answers are developed. According to the no-contradiction thesis, the semantically tangled sentences of fiction are indeed logically inconsistent but not logically contradictory. According to the no-bother thesis, if the inconsistencies of fiction were contradictory, a properly contrived logic for the rational management of inconsistency would explain why readers at large are not thrown off cognitive stride by their embrace of those contradictions. As developed here, the account of fiction suggests the presence of an underlying three - or four-valued dialethic logic. The author shows this to be a mistaken impression. There are only two truth-values in his logic of fiction. The naturalized logic of Truth in Fiction jettisons some of the standard assumptions and analytical tools of contemporary philosophy, chiefly because the neurotypical linguistic and cognitive behaviour of humanity at large is at variance with them. Using the resources of a causal response epistemology in tandem with the naturalized logic, the theory produced here is data-driven, empirically sensitive, and open to a circumspect collaboration with the empirical sciences of language and cognition. |
