This book provides fresh perspectives in the legal study of the Court of Justice of the European Union. In the context of European studies, the Court has mainly been analysed in light of its central role in the process of continental integration. Moreover, the Court has traditionally been studied by specialists for its important role as an agent of comparative law. This book studies the evolution of the Court itself, rather than that of the EU legal order in its judge-made dimension, and addresses several institutional aspects of its structure and organization, selected and constructed as a complete range of symptomatic figures of judicial institutionalisation. In doing so, the author seeks to showcase how the development and the institutional evolution of the CJEU happened through a selective internalization of comparative influences.
This study describes and analyzes the significant political events that occurred between the fiftieth anniversary of Indian Independence and the coming of the third millennium. It challenges much of the prevailing public image of India based upon the mistaken notion that it is still the country of Mahatma Gandhi and Jawaharlal Nehru. Nehru's principle that India should be a secular state has been lost, and it has become a country dominated by Hindu communalism. Mahatma Gandhi's non-violence has been forgotten, and India has built what will soon be the third largest military force in the world, including nuclear weapons. The caste-less society that was identified in its Constitution as one of free India's goals has become a society in which the salience of caste membership is greater today than in 1947. Dettman examines events during the thirty months from August 1997 to January 2000 on the political, economic, and military fronts. During this period, the continuing skirmishes with Pakistan along the Line of Control in Kashmir escalated into a short, high altitude war that ended with Indo-Pakistan relations at their lowest ebb since the Bangladesh War of 1971. India's decision to allocate vast resources to building up its armed forces and supplying them with nuclear weapons will greatly diminish the government's support for the demographic, environmental, and social welfare programs that are needed to avoid a long-term degradation of its quality of life.
This book establishes a nexus between corruption in public procurement and the prevailing crisis of governance in Africa. The African continent is characterised by the growing concern for the deteriorating human security. In the midst of these woes, African political leaders are known for their stupendous wealth and riches through expropriation of national resources for personal benefits. This growing inequality in the continent has become a major driver for a series of violent and criminal activities, which have added to the worsening governance crisis. Thus, the abuse of public power for advancing private gain constitutes an impediment to effective public service delivery, thereby engendering a crisis of governance. The consequence of this is not limited to the socio-economic growth and welfare of citizens, but it often also jeopardizes the democratic credentials and objectives of the state.
This book assesses the impact of the May 2019 European elections as well as the Covid-19 pandemic on the EU's politics, institutions, and policies. Special attention is paid to the impact of these events on the different political forces as well as on the Union's institutional balance, its priorities and the reform of its budget and policies. Because of the many post-electoral uncertainties, the book also takes into account how the relations between the Parliament, the European Council and the new Commission have developed. Furthermore, it analyses the capacity of the von der Leyen Commission to implement an ambitious programme, especially in the context of an unfolding pandemic. The objective of this book is to study the 2019 electoral sequence (parliamentary elections, appointment of EU institutions leaders, investiture of the Commission, new legislative programme) and determine its influence on the main institutional and political challenges for the 2019-2024 legislature. In other words, the volume deals with the question of who holds the EU's leadership after the 2019 elections and how it handles the 2020-2021 pandemic.

This book examines the functions of conferences within Arctic governance, as a third dimension between sovereign states and formalized cooperative arrangements. It analyzes conferences against the background of three main empirical topics. Firstly, the functions of conferences for different actor groups, both Arctic rights holders and emerging non-Arctic state actors claiming stakeholder status. From this, the book also analyzes how conferences contribute to altering the actor composition of Arctic governance as a whole. Secondly, conferences as agenda setting arenas - whether conference activities can contribute to influencing the broader agenda in the region, and conferences as arenas for agenda setting - whether participants can bring with them topics that are picked up and brought into other processes. This book demonstrates the crucial link between gender and structures of power in democratic Indonesia, and the role of the online news media in regulating this relationship of power. Using critical discourse analysis (CDA) as a theoretical framework, and social actor analysis as the methodological approach, this book examines the discursive representation of three prominent female Indonesian political figures in the mainstream Indonesian online news media in a period of social-political transition. It presents newfound linguistic evidence in the form of discourse strategies that reflect the women's dynamic relationship with power. More broadly, the critical analysis of the news discourse becomes a way of uncovering and evaluating implicit barriers and opportunities affecting women's political participation in Indonesia and other Asian political contexts, Indonesia's process of democratisation, and the influential role of the online news media in shaping and reflecting political discourse.
This book explores how public opinion is used to design, monitor and evaluate government programmes in Australia, Canada, New Zealand, and the United Kingdom. Using information collected from the media and from international practitioners in the public opinion field, as well as interviews in each of the 4 countries, the author describes how views of public opinion and governance differ significantly between elites and the general public. Bennett argues that elites generally risk more by allowing the creation of new data, fearing that its analysis may become public and create communications and political problems of various kinds. The book finds evidence that recent conservative governments in several countries are changing their perspective on the use of public opinion, and that conventional public opinion studies are facing challenges from the availability of other kinds of information and new technologies. This book is a hugely valuable contribution to a hitherto little explored field and will appeal to academics and practitioners alike.
In this book Pragati Rawat and John C. Morris identify and evaluate the impact of factors that can help explain the difference in e-participation, public participation using information and communication technology, in different countries. While cross-sectional studies have been covered, few have taken an in-depth look at cross-national studies. This book attempts to fill the gap using quantitative panel data to explore the influence of technology and institutions, and the impact of their complex relationships in a mediation and moderation analysis, on e-participation. The current study reviews the scholarly work in the field of "offline" and "online participation" to identify a set of antecedents that influence e-participation. A conceptual framework is developed, supported by the theories from the public policy and socio-technical premise. The authors utilize secondary data, primarily from the UN and World Economic Forum, for 143 countries from three waves of surveys to measure the dependent and explanatory variables. The panel data is statistically analyzed and findings reveal the role of technology as a mediator as well as a moderator for institutions' impact on e-participation. The Effects of Technology and Institutions on E-Participation provides a groundbreaking country-level analysis that will appeal to academics and students of e-government and Digital Government, Public Policy, Public Administration, Public Sector Innovation, and Public Participation.
Analysing the conditions under which governments are more likely to present an executive law or a government bill, this book addresses a central aspect of the decision-making process of public policies. Drafting legislation is an important action to achieve specific policy goals, and the path chosen for this process is part of governmental strategy. This book presents a new theoretical explanation of how executives wield legislative power, based in a formal model. The model is tested using new data from Portugal. It shows that in political systems where one of the political actors has veto powers which can easily be overridden, the type of parliamentary majority is the main consideration for the government's choice of legislative instrument. More specifically, when a government does not have the majority in parliament it is more likely to propose an executive law, and contrary, when a government has a majority in parliament, it is more likely to propose a government bill.

This book reconsiders the place of magic at the foundations of modernity. Through careful close reading of plays, spell books, philosophical treatises, and witch trial narratives, Andrew Moore shows us that magic was ubiquitous in early modern England. Rather than a "decline of magic," this study traces a broad cultural fascination with supernatural power. In the sixteenth and seventeenth centuries, poets, philosophers, jurists, and monarchs debated the reality and the morality of magic, and, by extension, the limits of human power. In this way, early modern English writing about magic was closely related to the scientific and political philosophical writing from the period, which was likewise reimagining humanity's relationship to nature. Moore reads Thomas Hobbes's Leviathan alongside contemporary writing by the notorious witch hunters Matthew Hopkins and John Stearne. He reminds us that Francis Bacon's scientific works were addressed to King James I, whose own Daemonologie insists on the reality of witchcraft. The fantastical science fiction of Margaret Cavendish, he argues, must be understood within a tradition that includes works like Christopher Marlowe's Doctor Faustus and the peculiar autobiography of criminal astrologer Simon Forman. By considering these disparate works together Moore reveals the centrality of magic to the early modern project.
This study explores the use of precedents in the case law of the Court of Justice of the European Union (CJEU). It argues that a strategic use of precedent-based discourses aids the Court in developing its jurisprudence autonomously; that is, independent of the political preferences of EU member states. The study is based on a long-term assessment of CJEU case law in the politically sensitive area of immigration law. It traces the Court's rulings in this area from the 1970s up until the most recent period. The study identifies a series of consistent discursive patterns that slowly, but surely, moved EU immigration law beyond what member states had intended. The work takes an interdisciplinary approach, engaging with both political science and legal discussions on the Court of Justice and its role in processes of European integration.
Swiss citizens approve of their government and the way democracy is practiced; they trust the authorities and are satisfied with the range of services Swiss governments provide. This is quite unusual when compared to other countries. This open access book provides insight into the organization and the functioning of the Swiss state. It claims that, beyond politics, institutions and public administration, there are other factors which make a country successful. The authors argue that Switzerland is an interesting case, from a theoretical, scientific and a more practice-oriented perspective. A stirring war leader, an orator unequaled as the rallier of a nation under siege, a powerful writer - Winston Churchill was all these and more. By now he has become a figure of almost mythic proportions. To find the man within the legend is the task to which twenty-nine renowned British and American historians and political leaders dedicate themselves in this volume. It may be the last assessment possible of Churchill's life and career by those who, for the most part, came of age during the Churchill era. From his youth in the landed aristocracy through his early experiences of war to service in Parliament over seven storm-tossed decades, Churchill takes us far beyond the surface of events. Here is Winston Churchill, surprisingly, a founder of the modern welfare state, when he became a principal driving force behind the Liberal welfare reforms of 1908-11. In the 1920s, we find him astonished to be offered the position of Chancellor of the Exchequer (after accepting, he reflected that "I should have...answered, 'Will the bloody duck swim?'"). His concern with domestic affairs bracketed the years of the First World War which saw him, initially, as First Lord of the Admiralty. Churchill tasted failure in the disastrous defeat of the Dardanelles expedition in 1915. There followed two years "in the wilderness" during which he took a battalion command on the western front. "He hankered after brilliant coups, heroic adventure on a small but decisive scale" but he had learned a crucial lesson for his later years as war leader of Britain: "against an adversary as formidable as the Germans, there was no substitute for the massive organization and skillful application of force on the largestpossible scale, backed up by...science and technology...". Appointed Colonial Secretary, Churchill had to deal with some regions that were to remain trouble spots to the century's end: Palestine and Southern Africa among them. A staunch defender of the Empire, he believed that British rule would bring benefits and harmony to distant populations. Still, Churchill's finest hours were to come when, with the German army marching across the Low Countries into France, he succeeded to the Prime Ministership. The events of that crucial time are closely examined. "There was only one person I could send for to form a Government who had the confidence of his country", wrote King George VI, "and that was Winston". In fascinating detail, Churchill's conduct of the war is viewed from both diplomatic and military angles - with revealing light shed on his relationships with Roosevelt and Stalin, his handling of special intelligence, the "ceaseless" prodding "of the generals, admirals and air marshal is who were prosecuting the war whether as Defence chiefs or in the arenas of combat". The volume carries us through the postwar period and the realignment of Europe to face a formidable power to the Eastthe Soviet Union. We discover a Churchill resigned to letting the ties of Empire lessen even as, at home, a triumphant Labour party greatly alters Britain's economic and social structure. Under the scrutiny of experts, Churchill emerges very much the dominant figure of his time. His stature, as attested by the contributors to this volume, does not change; the features, however, become more finely chiseled.
The widespread adoption of smartphones has led to an explosion of mobile social media data, more than a billion messages per day that continuously track location, content, and time. Social Media in the Contemporary City focuses on the effects of social media on local communities and urban space in a variety of political and economic settings related to social activism, informal economic activity, public art, and global extremism. The book covers events ranging from Banksy art installations, mobile food trucks, and underground restaurants, to a Black Lives Matter protest, the Christchurch mosque shootings, and the Pulse nightclub shooting. The interplay between urban space, local community, and social media in each case study requires diverse methodologies that are both computational (i.e. machine learning, social network analysis, and natural language processing) and ethnographic (i.e. semi-structured interviews, thematic analysis, and site analysis). The book views social media not as a replacement for the local community or urban space but rather as a translation of the uses and meanings of all three realms. The book will be of interest to students, researchers, and instructors in a number of disciplines including urban design/planning, media studies, geography, and communications.
This book explores contemporary and historical examples of bureaucratic discretion to describe a continuum of resistance to authoritative directives by hierarchical superiors. Resistance ranges from blind obedience or complete nonresistance to street-level opposition; in between these extremes, however, are minimal compliance and resistance sanctioned by immediate superiors. Although politicians may pass legislation, the subject of bureaucratic implementation or lack thereof remains an area of vital concern. Grounded in administrative theory (beginning with Woodrow Wilson's seminal discussion of the virtue of adopting a businesslike approach to American governing) and emphasizing the power of street-level bureaucrats, the aim of this book is to expand awareness of the potentially dangerous power of insulated bureaucrats.
This book will illustrate that despite the variations of nuclear tensions during the Cold War period-from nuclear inception, to mass proliferation, to arms control treaties and detente, through to an intensification and "reasonable" conclusion (the INF Treaty and START being case points)-the "lessons" over the last decade are quickly being unlearned. Given debates surrounding the emerging "new Cold War," the deterioration of relations between Russia and the United States, and the concurrent challenges being made by key nuclear states in obfuscating arms control mechanisms, this book attempts to provide a much needed revisit into US presidential foreign policy during the Cold War. Across nine chapters, the monograph traces the United States' nuclear diplomacy and Presidential strategic thought, transitioning across the early period of Cold War arms racing through to the era's defining conclusion. It will reveal that notwithstanding the heightened periods when great power conflict seemed imminent, arms control fora and seminal agreements were able to be devised, implemented, and provided a needed base in bringing down the specter of a cataclysmic nuclear war, as well as improving bilateral relations. This book offers a critical analysis of the rise of the US to global hegemony against a background of increased erosion of democracy and rule of law, and a rising linear pattern of near-absolute capitalist development. The author argues that the significant shrinkage of the ideological spectrum globally, as a result of worrisome levels of business and government interpenetration, has created a dangerous 'prefascist configuration' whereby unthinkable levels of violence have been normalized through the use of technologies such as drones, increasingly condoned even by 'liberal' groups and the so-called political left. Using the example of the Obama administration and its increased reliance on drone assassinations, the volume makes a case for the dangers that lie in today's unique convergence of lack of transparency in government, business-government interpenetration, informal social regimentation, and militarization of capitalism. |
