This book provides an overview of disability exceptions to copyright infringement and the international and human rights legal framework for disability rights and exceptions. The focus is on those exceptions as they apply to visual art, while the book presents a comprehensive study of copyright's disability exceptions per se and the international and human rights law framework in which they are situated. 3D printing now allows people with a visual impairment to experience 3D reproductions of paintings, drawings and photographs through touch. At the same time, the uncertain application of existing disability exceptions to these reproductions may generate concerns about legal risk, hampering sensory art projects and reducing inclusivity and equity in cultural engagement by people with a visual impairment. The work adopts an interdisciplinary approach, with contributions from diverse stakeholders, including persons with disabilities, cultural institutions and the 3D printing industry. The book sketches the scene relating to sensory art projects. Experts in intellectual property, human rights, disability and art law then critically analyse the current legal landscape relating to disability access to works of visual art at both international and regional levels, as well as across a broad representative sample of national jurisdictions, and identify where legal reform is required. This book explores the intersection of geographical knowledge and artistic research in terms of both creative methods and practice-based research. In doing so it brings together geography's 'creative turn' with the art world's 'research turn.' Based on a decade and a half of ethnographic stories of working at the intersection of creative arts practices and geographical research, this book offers a much-needed critical account of these forms of knowledge production. Adopting a geohumanities approach to investigating how these forms of knowledge are produced, consumed, and circulated, it queries what imaginaries and practices of the key sites of knowledge making (including the field, the artist's studio, the PhD thesis, and the exhibition) emerge and how these might challenge existing understandings of these locations. Inspired by the geographies of science and knowledge, art history and theory, and accounts of working within and beyond disciplines, this book seeks to understand the geographies of research at the intersection of geography and creative arts practices, how these geographies challenge existing understandings of these disciplines and practices, and what they might contribute to our wider discussions of working beyond disciplines, including through artistic research. This volume examines the global influence and impact of DIY cultural practice as this informs the production, performance and consumption of underground music in different parts of the world. The book brings together a series of original studies of DIY musical activities in Europe, North and South America, Asia and Oceania. The chapters combine insights from established academic writers with the work of younger scholars, some of whom are directly engaged in contemporary underground music scenes. The book begins by revisiting and re-evaluating key themes and issues that have been used in studying the cultural meaning of alternative and underground music scenes, notably aspects of space, place and identity and the political economy of DIY cultural practice. The book then explores how the DIY cultural practices that characterize alternative and underground music scenes have been impacted and influenced by technological change, notably the emergence of digital media. Finally, in acknowledging the over 40-year history of DIY cultural practice in punk and post-punk contexts, the book considers how DIY cultures have become embedded in cultural memory and the emotional geographies of place. Through combining high-quality data and fresh conceptual insights in the context of an international body of work spanning the disciplines of popular-music studies, cultural and media studies, and sociology the book offers a series of innovative new directions in the study of DIY cultures and underground/alternative music scenes. Based on ethnographic research, this book examines the paranormal investigation subculture in the US. Presenting interviews with investigators as well as extensive field observations, it explores their reasons for getting involved, their use of different investigative methods, the interpretive processes by which they individually and collectively 'sense' spirits, the ways in which these processes are influenced by small group power dynamics, and what paranormal investigation ultimately means to those who participate. While focusing on the practices by which investigators 'sense' spirits in small groups, the author also situates paranormal investigation within a broader cultural context and attends to how investigators attempt to legitimize their practice despite being marginalized by both science and religion. How does migration affect us in the deeper layers of our minds, where forces are at work that affect our mental and physical health, our experiences in the world and our behaviour? White Privilege: Psychoanalytic Perspectives looks at race and the significant role it plays in society and in clinical practice. Much of the effort going into racial consciousness-raising rests on the concept of unearned "white privilege". In this book, Neil Altman looks deeply into this notion, suggesting that there are hidden assumptions in the idea of white privilege that perpetuate the very same racially prejudicial notions that are purportedly being dismantled. The book examines in depth the structure of racial categories, polarized between white and black, that are socially constructed, resting on fallacious ideas of physical or psychological differences among peoples. Altman also critically examines such related concepts as privilege, guilt, and power. It is suggested that political positions are also artificially polarized into categories of "liberal", "left" and "conservative", "right", in ways that contribute to stereotyping between people with different political leanings, foreclosing mutual respect, dialogue, and understanding. Finally, White Privilege: Psychoanalytic Perspectives explores the implications for the theory and practice of psychoanalytic psychotherapy, discussing these ideas in detail and depth with clinical illustrations. The Supreme Court of the United States in Feist v. Rural (1991) required that databases must have a minimal degree of creativity for copyright. The judgment was highly significant and the subsequent period is understood as the post-Feist era. It has been globally influential. However, the decision is extremely complex and remains unsatisfactorily interpreted. In particular, it has been impossible to illuminate the creativity requirement. The book gives an account of the decision's conceptual structure, focusing on its full delineation of the opposite to creativity. In a radical and unprecedented innovation, it is correlated with an automatic computational process. Creativity itself is understood as non-computational or directly human activity concerned with meaning. Determining the presence of creativity is reduced to a four-stage test. This work then has acute practical current relevance to property in data in the digital age; it will also be of theoretical interest to, and is aimed at, researchers in, practitioners, and students of intellectual property worldwide.
This book applies a framework of 'trans vitalities' through an ethnographically-anchored exploration of trans coalitional labor and activism in Washington, DC. Specifically, it considers how trans social justice work at the local level exemplifies why and how the notions of 'trans community' or 'trans rights' must be reconfigured. Trans vitalities, as a framework developed in this volume, functions in three particular ways: 1) to disrupt and rethink what valuable, viable, or quantifiable quality of life looks like; 2) to shift our understandings of community towards 'coalition'; and 3) as a methodological, theoretical, and application-based set of tools that integrates a radical trans politics and community-based approach towards addressing trans lives. Trans Vitalities incorporates one-on-one interviews, community map-making projects, and an analysis of the DC Trans Needs Assessment, produced through trans coalitional labor. An accessible case study for both how to research trans-specific topics and how to apply a framework of trans vitalities, this book is valuable reading for those who research or instruct on LGBTQ topics as well as activists, policy makers, and law makers.
Offering a range of critical perspectives on a vibrant body of films, this collection of essays engages with questions specific to the various cinemas and films addressed while putting forward an argument for their inclusion in current debates on world cinema. The collection brings together 11 chapters by recognized scholars, who analyze a variety of films and videos from Angola, Cape Verde, Guine-Bissau, and Mozambique. It also includes an interview with Pedro Pimenta, one of the most distinguished African film festival organizers. Drawing on various theoretical perspectives, the volume strives to reverse the relative invisibility that has afflicted these cinemas, arguing that most, if not all, Lusophone films are transnational in all aspects of production, acting, and reception. This book examines how representations of African in the Anglophone West have changed in the post-imperial age. The period since the Second World War has seen profound changes in sub-Saharan Africa, notably because of decolonization, the creation of independent nation-states and the transformation of the relationships with the West. Using a range of case studies from news media, maps, popular culture, film and TV the contributions assess how narrative and counter-narratives have developed and been received by their audiences in light of these changes. Examining the overlapping areas between media representations and historical events, this book will be of interest to students and scholars of African Studies and Media and Cultural Studies.

Shortlisted for the 2018 BAAL Book Prize This book is a sociolinguistic ethnography of LGBT Mexicans/Latinxs in Phoenix, Arizona, a major metropolitan area in the U.S. Southwest. The main focus of the book is to examine participants' conceptions of their ethnic and sexual identities and how identities influence (and are influenced by) language practices. This book explores the intersubjective construction and negotiation of identities among queer Mexicans/Latinxs, paying attention to how identities are co-constructed in the interview setting in coming out narratives and in narratives of silence. The book destabilizes the dominant narrative on language maintenance and shift in sociolinguistics, much of which relies on a (heterosexual) family-based model of intergenerational language transmission, by bringing those individuals often at the margin of the family (LGBTQ members) to the center of the analysis. It contributes to the queering of bilingualism and Spanish in the U.S., not only by including a previously unstudied subgroup (LGBTQ people), but also by providing a different lens through which to view the diverse language and identity practices of U.S. Mexicans/Latinxs. This book addresses this exclusion and makes a significant contribution to the study of bilingualism and multilingualism by bringing LGBTQ Latinas/os to the center of the analysis.
From its beginnings in the 1970s and 1980s, interest in the topic of gender and migration has grown. Earth Matters on Stage: Ecology and Environment in American Theater tells the story of how American theater has shaped popular understandings of the environment throughout the twentieth century as it argues for theater's potential power in the age of climate change. Using cultural and environmental history, seven chapters interrogate key moments in American theater and American environmentalism over the course of the twentieth century in the United States. It focuses, in particular, on how drama has represented environmental injustice and how inequality has become part of the American environmental landscape. As the first book-length ecocritical study of American theater, Earth Matters examines both familiar dramas and lesser-known grassroots plays in an effort to show that theater can be a powerful force for social change from frontier drama of the late nineteenth century to the eco-theater movement.
