Unter Berucksichtigung der eingetretenen AEnderungen durch das Patientenrechtegesetz und deren Auswirkungen auf die Rechtsfolgen einer Beweisvereitelung beleuchtet sie diese im Arzthaftungsrecht. Sie uberpruft, ob eine fur alle Beweisarten einheitliche gesetzliche Regelung uber die Beweisvereitelung erforderlich und sachdienlich ist. Ihre Ergebnisse zeigen, dass die inklusive Beschulung von Kindern mit SSES nach dem RTI-Ansatz mit der in Sprachheilklassen vergleichbar, der Regelunterricht dagegen weniger geeignet ist. Davon zeugen der dargestellte und analysierte Verlauf in den Entwicklungs- und Lernbereichen sowie UEberlegungen zur Verbesserung der Beschulungssituation.
