The first edition of The Paris System for Reporting Urinary Cytology introduced a completely new paradigm for detecting bladder cancer by urine cytology. Dieses Verbot beansprucht fur alle Beweisarten eine uber die im Gesetz bereits bestehenden Regelungen hinausgehende Geltung. Die Autorin untersucht des Weiteren Tatbestandsvoraussetzungen und Rechtsfolgen einer Beweisvereitelung. Unter Berucksichtigung der eingetretenen AEnderungen durch das Patientenrechtegesetz und deren Auswirkungen auf die Rechtsfolgen einer Beweisvereitelung beleuchtet sie diese im Arzthaftungsrecht. Sie uberpruft, ob eine fur alle Beweisarten einheitliche gesetzliche Regelung uber die Beweisvereitelung erforderlich und sachdienlich ist. Die Autorin entwickelt zudem einen eigenen Formulierungsvorschlag fur eine entsprechende neue Vorschrift in der ZPO und untersucht deren Verfassungsmassigkeit.

Dabei vergleicht sie Unterricht in regularen Grundschulklassen, Unterricht unter den praventiven Aspekten des Response-to-Intervention-Ansatzes (RTI) sowie Unterricht in Sprachheilklassen. In einer zweijahrigen Langsschnittstudie verfolgte die Autorin die Entwicklung von 64 Kindern mit SSES in den unterschiedlichen Beschulungsformen. Ihre Ergebnisse zeigen, dass die inklusive Beschulung von Kindern mit SSES nach dem RTI-Ansatz mit der in Sprachheilklassen vergleichbar, der Regelunterricht dagegen weniger geeignet ist. Davon zeugen der dargestellte und analysierte Verlauf in den Entwicklungs- und Lernbereichen sowie UEberlegungen zur Verbesserung der Beschulungssituation. |
