This collection documents the efforts of the Prison Communication, Activism, Research, and Education collective (PCARE) to put democracy into practice by merging prison education and activism. The probation service has committed itself to anti-racist initiatives and those promoting equal opportunities for some time. However, the experiences of black people, whether as workers or 'clients' indicates that the realities of day-to-day practice are far removed from this. Moreover, the picture is just as bleak if not even more so in other parts of the criminal justice system including the judiciary and the prison service. Anti-Racist Probation Practice addresses this conundrum and drawing on the experiences of black people makes practical proposals for moving forward in non-tokenistic ways. These include core areas of practice, for example court reports monitoring systems; resource allocation; and working relations. Arguing that process, procedures and outcomes in the work done must be taken together if individual, institutional and cultural racism are to be eradicated, the book shows that anti-racist probation practice must be taken seriously by both black and white people if it is to materialise.

This book examines the impact and implications of the relationship between risk and criminal justice in advanced liberal democracies, in the context of the 'revolt against uncertainty' which has underpinned the rise of populist politics across these societies in recent years. It asks what impact the demands for more certainty and security, and the insistence that national identity be reasserted, will have on criminal law and penal policy. Drawing upon contributions made at a symposium held at Victoria University of Wellington, New Zealand in November 2018, this edited collection also discusses the way in which risk has come to inform sentencing practices, broader criminal justice processes and the critical issues associated with this. Substance misuse (including alcohol) and mental health problems constitute a significant proportion of the work carried out in the criminal justice system. Approaches to these often intractable problems have seen the rise of a dominant risk paradigm concerned with public protection and the use of coercion through court orders to access treatment. This original and valuable book considers notions of risk and rehabilitation in detail within the practice of those court orders, whilst contextualising them within a wider comparative literature and research base. The efficacy of these approaches, practice issues and innovations including for example therapeutic jurisprudence are analysed. Rethinking Black Motherhood and Drug Addictions: Counternarratives of Black Family Resilience offers a unique perspective on the complexities of being a Black mother addicted to crack, powder cocaine, heroin, and crank. Qualitative interviews provide rich narratives from five Black mothers challenging negative controlled images and stereotypes of Black motherhood and drug addiction. Using Black Feminist Thought, Critical Race Feminism, and Resilience as conceptual frameworks, this book confronts hegemonic constructions of Black mothers and their children within the context of drug addictions. Particular attention is focused on using the mothers' self-definitions of struggles and family resilience to dismantle the negative controlled images of the junkie and the crack ho' and her crack baby. The mothers in this book speak truth to their experiences with motherhood and addictions to some of the most powerful street drugs that explicitly defy the junkie, crack ho', and crack baby images. The book also addresses tensions existing within researcher-participant relationships and nuances unique to research with Black mothers in recovery. Personal lessons learned and challenges experienced during the research process are highlighted as Tivis shares dilemmas of self-reflections of positionality, accountability and use of language. Circles of Support and Accountability is a voluntary initiative that assists people with convictions for sexual offences to resettle in the community. People leaving prison with such convictions often have difficulties in resettling. They carry the burden of the conviction itself, which may be both stigmatising and isolating, and they are the subject of sex offender register requirements, parole and other supervisory conditions. Circles of Support and Accountability in the UK started over ten years ago and have slowly spread across the country. They work closely with the police and probation services but rely entirely on volunteers prepared to give up their time to work with people often otherwise shunned by communities. Circles offer support to the person concerned but also hold them accountable for their future behaviour. They aim to ensure there are 'no more victims'. This book is based on original research and provides a close-up picture of how these Circles of Support and Accountability work in practice. It brings together for the first time the voices of all the participants, from the offenders and the volunteers through to the Coordinators who link the volunteers to the professionals in the form of the police and probation services. The research was commissioned by Circles UK and funded by the Wates Foundation and the University of Leeds, School of Law.

This is a comparative study of prisoners' human rights in England, Wales and the Netherlands. Over the years changes in Dutch penal policy have smoothed to some degree the sharp contrasting differences that were once characteristic of the English and the Dutch prison systems. In this context, the study documents the impact of the two countries' penal policies on prisoners' human rights and presents prisoners' views on the human rights contribution to prison life and prisoner treatment. English and Dutch prisoners treat human rights recognition and protection as the yardstick of the prison's legitimacy in contemporary democracies. Drawing on their respective experiences, Karamalidou highlights valuable lessons on what practices to adopt and what practices to cease with a view to embedding human rights in prison. A compassionate and thought-provoking study, this book will be of interest to undergraduate and postagraduate students of penology and human rights.

Dynamic risk factors are the children of risk prediction. They were identified to help practitioners assess risk of recidivism and to set treatment targets likely to reduce reoffending. This resulted in the development of intervention programs designed to modify the characteristics of individuals and their environments associated with crime. The predictive nature of their legacy lies in their ability to provide reliable information about the likelihood of future reoffending. In this respect, dynamic risk factors are useful complements to static risk factors such as age, gender, and history of offending, and add incremental validity to recidivism prediction. Their treatment utility resides in the fact that practitioners increasingly rely on the identification of dynamic risk factors to direct correctional assessment and interventions. Thus, dynamic risk factors have a dual status. They are both useful predictors of reoffending and measures of risk status, and potential causes of reoffending, capable of serving an explanatory role as well as a predictive one. It is a simple and powerful conceptualization that has streamlined forensic and correctional research, program development, and the delivery of treatment. Despite its conceptual elegance we believe that the dual conceptualization of dynamic risk factors is problematic and these difficulties spill over into their role in assessment, assessment, treatment, and desistance contexts. In this publication, the nature and function of dynamic risk factors are investigated and their strengths and limitations identified. Sexual offending is an extensive problem in our societies causing untold harm to many innocent victims. Sexual offenders typically have a personal history of abuse of various kinds and it seems that most of them would prefer to live offence-free lives. It takes courage for these offenders to face their own problems and to deal with the consequences of their actions on their victims, the victim’s families, and their own families and friends. This book presents Responsible Adult Culture (RAC), a truly comprehensive program for helping offenders to think and act responsibly. It provides the tools of the program with great clarity. In addition to exploring the needs of all offenders, the book addresses the special needs of both female and dual-diagnosis offenders. Responsible thinking means habitually seeing others and situations accurately, rather than in self-serving and egocentrically distorted ways. Because self-centered thinking is typically reinforced by negative group norms, RAC starts with the cultivation of a constructive climate ("mutual help" groups) to motivate change. Motivated group members then gain tools for responsible thinking through "equipment" (cognitive behavioral) meetings. These tools pertain to social skills, anger management, and the correction of self-centered thinking through social perspective taking (cognitive restructuring). Beyond documented reductions in distorted thinking and recidivism rates, RAC's synergy or round-the-clock interpenetration of positive groups and tools promotes a safer and more humane institutional culture.
Within the past three decades, judicial decisions and legal changes have transformed the juvenile court from a nominally rehabilitative welfare agency into a scaled-down criminal court for young offenders. Emotions remain largely invisible in the management of criminal justice practice. Offender supervision in Europe has developed rapidly in scale, distribution and intensity in recent years. However, the emergence of mass supervision in the community has largely escaped the attention of legal scholars and social scientists more concerned with the mass incarceration reflected in prison growth. As well as representing an important analytical lacuna for penology in general and comparative criminal justice in particular, the neglect of supervision means that research has not delivered the knowledge that is urgently required to engage with political, policy and practice communities grappling with delivering justice efficiently and effectively in fiscally straitened times, and with the challenges of communicating the meaning, legitimacy and utility of supervision to an insecure public. This book reports the findings from a survey of European research on this topic, undertaken during the first year of a European research network that spans twenty countries. As such, it provides the first comprehensive review of research on offender supervision in Europe, opening up an important new field of enquiry for comparative social science, and offering the prospects of better informed democratic deliberation about key challenges facing contemporary justice systems, policymakers and practitioners, and the societies they seek to serve.
Conferencing and Restorative Justice: International Practices and Perspectives offers an analysis of conferencing practices around the world, examining the range of approaches to different types of crimes and offender age groups, and assessing their outcomes.
