This book takes an interdisciplinary approach to the complicated power relations surrounding the recognition and implementation of Indigenous Peoples' rights at multiple scales. The adoption of the United Nations Declaration on the Rights of Indigenous Peoples in 2007 was heralded as the beginning of a new era for Indigenous Peoples' participation in global governance bodies, as well as for the realization of their rights - in particular, the right to self-determination. These rights are defined and agreed upon internationally, but must be enacted at regional, national, and local scales. Can the global movement to promote Indigenous Peoples' rights change the experience of communities at the local level? Or are the concepts that it mobilizes, around rights and political tools, essentially a discourse circulating internationally, relatively disconnected from practical situations? Are the categories and processes associated with Indigenous Peoples simply an extension of colonial categories and processes, or do they challenge existing norms and structures? This collection draws together the works of anthropologists, political scientists, and legal scholars to address such questions. Examining the legal, historical, political, economic, and cultural dimensions of the Indigenous Peoples' rights movement, at global, regional, national, and local levels, the chapters present a series of case studies that reveal the complex power relations that inform the ongoing struggles of Indigenous Peoples to secure their human rights. Originally published in 1996. The Montreal Protocol on Substances that Deplete the Ozone Layer is one of the most effective multilateral environmental agreements currently in existence. Established to control the production and consumption of CFCs and other ozone-depleting chemicals, the Protocol is an important example of an agreement which places restrictions on international trade in the interests of the global environmental - a feature which may become common in future treaties. This report examines the development, effectiveness and future of the trade provisions of the ozone regime, concluding that they have contributed significantly to its success in attracting signatories and in limiting ozone depletion. Issues considered include the compatibility of the trade provisions and the GATT, trade restrictions and developing countries, and the new problems of non-compliance and illegal trade in CFCs.
The Origins of UNICEF traces the history of the founding of the world's most well-known and often controversial relief aid organization for children. UNICEF modeled itself after several national organizations as well as some of the early twentieth-century transnational and international relief aid organizations, catering to a clientele that many observers claimed would be impossible to resist or ignore. This book offers insight into the use of empirical diffusionist models for analysis of cross-cultural and cross-national communication, translation and adaptation of the United Nation's (UN) Sustainable Development Goals (SDGs). The book looks at three social analytical instruments of particular utility for the cross-national study of the translation and diffusion of global sustainable development discourses in East Asia (China and Japan). It explains the underlying hypothesis that, in the transmission and adaptation of global SDGs in different national contexts, three large groups of social actors encompassing sources of information, mediating actors and socio-industrial end-users form, shape and contribute to the complex, latent networks of social engagement. It illuminates how the distribution within these networks largely determines the level and breadth of the diffusion of global SDGs and their associated environmentalist norms. This book analyzes UN intervention discourses and practices in Iraq and develops a deconstructive approach to international interventions. Hitherto, most analyses of the conflict in Iraq in 2003 have established the UN's role as path-dependent on the foreign policy of the US and the UK, and largely portrayed it as a mediator and fervent opponent of international intervention. Analyzing the UN Security Council and the later UN Assistance Mission for Iraq (UNAMI) from 2000 to 2010, this book undoes this path-dependency and puts the UN's relationship with Iraq center-stage. It develops a deconstructive, critical approach that identifies subject construction and reflexivity as central processes of intervention practices and concludes that (non-)intervention is deeply connected to the stabilization of political identities and representations. Using extensive primary data, the book contributes a new perspective on international interventions. This book will be of much interest to students of peace and conflict studies, intervention and statebuilding, Middle Eastern studies and International Relations.
International security must be understood in much broader terms in the aftermath of the Cold War. This book provides a detailed analysis of the policy-making processes of EU strategies in foreign and security policy and external action. It uses the European Security Strategy and the EU Global Strategy to assess their policy-making dynamics both before and after the Lisbon Treaty. Inter-institutional relations in strategy-making are put into the context of current debates in European integration, questioning the assumption that the EU is a body increasingly ruled by intergovernmentalism - as reflected by the new intergovernmentalism literature. The UN Security Council formally acknowledged an obligation to promote justice and the rule of law in 2003. Despite the key importance of accountability for the legitimacy of humanitarian action, inadequate academic attention has been given to how the concept of accountability is evolving within the specific branches of the humanitarian enterprise. This book analyses the exercise of authority by the UN Security Council and its subsidiary organs over individuals. The UN Security Council was created in 1945 as an outcome of World War II under the predominant assumption that it exercises its authority against states. Under this assumption, the UN Security Council and those individuals were 'distanced' by the presence of member states that intermediate between the Security Council's international commands and those individuals that are subject to member states' domestic law. However, in practice, the UN Security Council's exercise of authority has incrementally removed the presence of state intermediaries and reduced the Security Council's distance to individuals. This book demonstrates that this phenomenon has increased the relevance of domestic law in developing the international normative frameworks governing the UN Security Council and its subsidiary organs in safeguarding the rights, obligations, and interests of those affected individuals. This book presents how the UN Security Council's exercise of authority has been received at the domestic level, and what would be the international implications of the Security Council's extensive encounter with the actors who primarily reside in a domestic legal order.
"The United Nations Democracy Agenda" is a critical, conceptual-historical analysis of democracy at the United Nations, detailed in four "visions" of democracy: civilization, elections, governance, and developmental democracy. "I know it when I see it" were the famous words of US Supreme Court Justice Potter Stewart on defining obscenity. It is with the same conviction and (un)certainty with which liberal peacebuilders and democracy promoters have used democracy to achieve both the immediate goals of peacekeeping and the broader, global mission of the United Nations. Today, democracy may have gained an international dimension, yet its success as an organizational practice depends on how democracy has been defined. Drawing on political theory and democratization scholarship, "The United Nations Democracy Agenda" questions the meaning of this "well-known" idea. The book analyzes the way in which the UN, through its Secretary-General, relevant agencies, and organizational practices, have thought about, conceptualized, and used democracy. "The United Nations Democracy Agenda" shows that while the idea of democracy's "civilizing" nature has played a prominent part in its use by the UN, an early focus on sovereignty and self-determination delayed the emergence of the democracy agenda until the 1990s. Today, a comprehensive democracy agenda incorporates not only elections but a broad range of liberal democratic institutions. Despite this, the democracy agenda is at an impasse, both practically and philosophically. "The United Nations Democracy Agenda" questions whether an extension of the UN democracy agenda to include "developmental democracy" is feasible.
The institutional procedures for the UN's decision-making on issues of global peace and security, first and foremost the Security Council (SC), were conceived with the objective of enabling a swift but internationally coordinated response to irregular situations of crises. Today, however, the UN is constantly involved in situations of conflict and has expanded its range of activities.
Both the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR) are now about to close. Bachmann and Fatic look back at the achievements and shortcomings of both tribunals from an interdisciplinary perspective informed by sociology, political science, history, and philosophy of law and based upon on two key notions: the concepts of legitimacy and efficiency. The first asks to what extent the input (creation) of, the ICTY and the ICTR can be regarded as legitimate in light of the legal and public debate in the early 1990s. The second confronts the output (the procedures and decisions) of the ICTY and the ICTR with the tasks both tribunals were assigned by the UN Security Council, the General Assembly, and by key organs (the president and the chief prosecutors). The authors investigate to what extent the ICTY and the ICTR have delivered the expected results, whether they have been able to contribute to 'the maintenance of peace', 'stabilization' of the conflict regions, or even managed to provide 'reconciliation' to Rwanda. Furthermore, the book is concerned with how many criminals, over whom the ICTY and the ICTR wield jurisdiction, have actually been prosecuted and at what cost. Offering the first balanced and in depth analysis of the International Criminal Tribunals, the volume provides an important insight into what lessons have been learned, and how a deeper understanding of the successes and failures can benefit the international legal community in the future.
This book seeks to explore how the UN has generated, warehoused, disseminated, structured, packaged, expanded, transferred and leveraged its vast resources of accumulated information and experience throughout the decades and, particularly, since the start of the 21st century with the introduction of more connective information and communications technology. It examines the overarching objectives that have guided such activity and divides UN knowledge management into three distinct, but often overlapping and intertwining, categories: knowledge for social and organizational learning; knowledge for norm setting; and knowledge for creation of products and services.
