This book offers a comparative survey of 18 contemporary peace processes conducted by leading international scholars. There is no standard model of peace processes and all will vary according to the context, type of conflict, timing, national and global economic climate, and factors like natural disasters. Therefore, making comparisons between peace processes is difficult, but it is beneficial - indeed, imperative - and is the principal motivation behind this volume. What works in one context may not work in another, but it can be modified and adapted to fit another context. The book is structured to maximise comparison between processes, and the case studies chosen are topical and span the major regions of the world. The concluding chapter systematically compares the case studies around 11 variables that cover the conflict context, peace process procedures, the responsiveness of the peace process to demands, and levels of participation and inclusion. Each peace process is then given a numeric score according to each of these variables, and the book thereby reaches judgements on whether each case can be termed a 'success' or a 'failure'. This book will be essential reading for students of peace studies, conflict resolution, war and conflict studies, security studies, and IR.

This work examines the ability of existing and evolving PMC regulation to adequately control private force, and it challenges the capacity of international law to deliver accountability in the event of private military company (PMC) misconduct. From medieval to early modern history, private soldiers dominated the military realm and were fundamental to the waging of wars until the rise of a national citizen army. Today, PMCs are again a significant force, performing various security, logistics, and strategy functions across the world. Unlike mercenaries or any other form of irregular force, PMCs acquired a corporate legal personality, a legitimising status that alters the governance model of today. Drawing on historical examples of different forms of governance, the relationship between neoliberal states and private military companies is conceptualised here as a form of a 'shared governance'. It reflects states' reliance on PMCs relinquishing a degree of their power and transferring certain functions to the private sector. As non-state actors grow in authority, wielding power, and making claims to legitimacy through self-regulation, other sources of law also become imaginable and relevant to enact regulation and invoke responsibility.

In a consolidated democracy, amnesties and pardons do not sit well with equality and a separation of powers; however, these measures have proved useful in extreme circumstances, such as transitions from dictatorships to democracies, as has occurred in Greece, Portugal and Spain. Focusing on Spain, this book analyses the country's transition, from the antecedents from 1936 up to the present, within a comparative European context. The amnesties granted in Greece, Portugal and Spain saw the release of political prisoners, but in Spain amnesty was also granted to those responsible for the grave violations of human rights which had been committed for 40 years. The first two decades of the democracy saw copious normative measures that sought to equate the rights of all those who had benefitted from the amnesty and who had suffered or had been damaged by the civil war. But, beyond the material benefits that accompanied it, this amnesty led to a sort of wilful amnesia which forbade questioning the legacy of Francoism. In this respect, Spain offers a useful lesson insofar as support for a blanket amnesty - rather than the use of other solutions within a transitional justice framework, such as purges, mechanisms to bring the dictatorship to trial for crimes against humanity, or truth commissions - can be traced to a relative weakness of democracy, and a society characterised by the fear of a return to political violence. This lesson, moreover, is framed here against the background of the evolution of amnesties throughout the twentieth century, and in the context of international law. Crucially, then, this analysis of what is now a global reference point for comparative studies of amnesties, provides new insights into the complex relationship between democracy and the varying mechanisms of transitional justice.

By investigating Sri Lanka as a case study, this book examines whether democracy, compared to authoritarianism, is conducive to post-war reconciliation. The research, founded on primary as well as secondary data, concludes that political systems have little to do with the success or failure of post-war ethnic reconciliation. The Sri Lankan case indicated that post-war reconciliation is more contingent on the readiness of the former enemies to come together. Readiness stems from, for example, satisfaction in the way issues have been resolved, confidence in the other party's intentions, and the compulsion to coexist. If the level of satisfaction, confidence, and the compulsion to coexist are low, the readiness to reconcile will also be low. The end of the war had a profound impact on post-war governance and ethnic relations in Sri Lanka. Hence, the volume provides an in-depth analysis of the factors that led to the military victory of the Sri Lankan government over the Liberation Tigers of Tamil Eelam (LTTE) in 2009. The chapters delve into the nexus between governance and reconciliation under the first two post-war governments. Reconciliation did not materialize in this period. Instead, new fault-lines emerged as attacks on the Muslim community escalated drastically. This book provides a comprehensive analysis of the nature of relations between the Sinhalese and Muslims and the Tamils and Muslims, as well as the nature and causes of post-war anti-Muslim riots.

How are militarism and militarisation embodied and why is it important to study these concepts together? This volume highlights a lack of research into people's emotions, bodies and experiences in global politics, and brings these important dimensions to bear on how we study militarism and process of militarisation. This collection showcases innovative research that examines people's everyday lived experience and the multiple ways militarism is enshrined in our societies. This book examines the mobilization, role, and trajectory of women rescuers and perpetrators during the 1994 genocide in Rwanda. While much has been written about the victimization of women during the 1994 genocide in Rwanda, very little has been said about women who rescued targeted victims or perpetrated crimes against humanity. This book explores and analyzes the role played by women who exercised agency as rescuers and as perpetrators during the genocide in Rwanda. As women, they took actions and decisions within the context of a deeply entrenched patriarchal system that limited their choices. This work examines two diverging paths of women's agency during this period: to rescue from genocide or to perpetrate genocide. It seeks to answer three questions: First, how were certain Rwandan women mobilized to participate in genocide, and by whom? Second, what were the specific actions of women during this period of violence and upheaval? Finally, what were the trajectories of women rescuers and perpetrators after the genocide? Comparing and contrasting how women rescuers and perpetrators were mobilized, the actions they undertook, and their post-genocide trajectories, and concluding with a broader discussion of the long-term impact of ignoring these women, this book develops a more nuanced and holistic view of women's agency and the genocide in Rwanda. This book will be of much interest to students of gender studies, genocide studies, African politics and critical security studies.

This anthology examines and deconstructs what Israeli security looks like and how its various security identities have evolved both before the establishment of the state and in the years and decades since 1948. It casts light on how aspects of Israel's foreign relations have been shaped as much by internal politics as by external challenge. Further, not only does it answer the questions surrounding Israel's past, but examines carefully what type of country it has now become. The combination of rising Chinese power and longstanding territorial disputes has drawn increased attention and threats to the Asia-Pacific region. Five smaller powers contest Beijing's claims; Malaysia, the Philippines, Vietnam, Brunei and Indonesia, with the United States viewed as the most likely counterbalance to coercive behavior towards them. However, only one of these five states - the Philippines -has maintained a guarantee of protection through alliance with the US. This book examines the Revolutionary Armed Forces of Colombia (FARC) as a commercial insurgency through the network-complex paradigm of insurgency. Countering traditional perspectives of the group, it proposes new and comprehensive explanations for the FARC's presence in Latin America. Existing narratives have portrayed the FARC as a terrorist, narco-terrorist, or criminal organization - a narrative popularized by the government offensive conducted by the Colombian state during the last couple of decades. In contrast, this book goes beyond simplistic perspectives of the FARC and instead studies the group in relation to the network-complex paradigm of insurgency. It explains the organization as a 'commercial insurgency' with three dimensions - political, criminal, and military - and understands the Colombian insurgency not as a monolith, but as a system of individuals with diversified interests ranging from the highly indoctrinated to the profit-motivated. This examination allows for an analysis of some of the insurgency's most unexplored characteristics: an interest in urbanizing its actions and the increased 'invisibility' of combatants, the significance of its political institutions, and the construction of its transnational networks. The volume also discusses the future of FARC in post-conflict Colombia, not only within the country but as an actor in the region. The conflict in eastern Ukraine continues with little sign of a negotiated resolution. Crimea has been absorbed into the Russian Federation, and celebrates the third anniversary of its 'integration' in March 2017. The ongoing nature of the conflict contrasts with a lack of academic exploration of the issues surrounding it. To date, most analyses have focused on the geopolitical implications of the Ukrainian crisis, such as the impact on NATO-Russia relations, and foreign policy responses to the crisis from a variety of state and supranational actors including the EU and Russia. The role of sub-state and non-state actors, and implications for them, has been largely overlooked. This volume seeks to rectify this by examining a wide array of non-state and sub-state actors that have both played a role in the conflict in Ukraine and been indirectly impacted by it.

This book advances the claims of feminist international relations scholars that the social construction of masculinities is key to resolving the scourges of militarism, sexual violence and international insecurity. More than two decades of feminist research has charted the dynamic relationship between warfare and masculinity, but there has yet to be a detailed account of the role of masculinity in structuring the range of volatile civil conflicts which emerged in the Global South after the end of the Cold War. By bridging feminist scholarship on international relations with the scholarship of masculinities, Duriesmith advances both bodies of scholarship through detailed case study analysis. By challenging the concept of 'new war', he suggests that a new model for understanding the gendered dynamics of civil conflict is needed, and proposes that the power dynamics between groups of men based on age difference, ethnicity, location and class form an important and often overlooked causal component to these civil conflicts. Exploring the role of masculinities through two case studies, the civil war in Sierra Leone (1991-2002) and the Second Sudanese Civil War (1983-2005), this book will be of great interest to postgraduate students, practitioners and academics working in the fields of gender and security studies.

Justice in domestic courts is one of the most prominent aims of victims seeking to obtain accountability for human rights violations. It is, however, also one of the most difficult to achieve. In many Latin American countries, as well as elsewhere, activists have put human rights prosecutions forward as a fundamental means to end impunity, build democracy, strengthen the rule of law and address victims' rights. But there is still little knowledge about what actually happens when these judicial mechanisms are effectively put to work. Can prosecutions of mass human rights violations contribute to overcome the effects of state violence and impunity? Can trials enable meaningful reparative changes for victims in their local contexts? Analysing the human rights trials in Argentina established to prosecute those responsible for human rights violations during the military dictatorship, this book addresses how and why domestic prosecutions can operate as a means for reparation and contribute to dealing with the damage caused by crimes against humanity. Based on a series of interviews conducted with victims participating in these prosecutions, as well as with lawyers, prosecutors, judges and other relevant actors in five provinces of Argentina, this book will be of considerable interest to those studying and working in the interdisciplinary field of transitional justice and human rights. The PhD thesis on which this book was based was awarded with the 2016 Doctoral Studies Award of the Philipps University of Marburg in Germany.

Many conflicts throughout the world can be characterized as sovereignty conflicts in which two states claim exclusive sovereign rights for different reasons over the same piece of land. It is increasingly clear that the available remedies have been less than successful in many of these cases, and that a peaceful and definitive solution is needed. This book proposes a fair and just way of dealing with certain sovereignty conflicts. Drawing on the work of John Rawls in A Theory of Justice, this book considers how distributive justice theories can be in tune with the concept of sovereignty and explores the possibility of a solution for sovereignty conflicts based on Rawlsian methodology. Jorge E. Nunez explores a solution of egalitarian shared sovereignty, evaluating what sorts of institutions and arrangements could, and would, best realize shared sovereignty, and how it might be applied to territory, population, government, and law.

Taking Northern Ireland as its primary case study, this book applies the burgeoning literature in memory studies to the primary question of transitional justice: how shall societies and individuals reckon with a traumatic past? Joseph Robinson argues that without understanding how memory shapes, moulds, and frames narratives of the past in the minds of communities and individuals, theorists and practitioners may not be able to fully appreciate the complex, emotive realities of transitional political landscapes. Drawing on interviews with what the author terms "memory curators," coupled with a robust analysis of secondary literature from a range of transitional cases, the book analyses how the bodies of the dead, the injured, and the traumatised are written into - or written out of - transitional justice. The author argues that scholars cannot appreciate the dynamism of transitional memory-space unless they first engage with the often silenced or marginalised voices whose memories remain trapped behind the antagonistic politics of fear and division. Ultimately challenging the imperative of national reconciliation, the author argues for a politics of public memory that incubates at multiple nodes of social production and can facilitate a vibrant, democratic debate over the ways in which a traumatic past can or should be remembered.

Examining the thematic intersection of law, technology and violence, this book explores cyber attacks against states and current international law on the use of force. The theory of information ethics is used to critique the law's conception of violence and to develop an informational approach as an alternative way to think about cyber attacks. Cyber attacks against states constitute a new form of violence in the information age, and international law on the use of force is limited in its capacity to regulate them. This book draws on Luciano Floridi's theory of information ethics to critique the narrow conception of violence embodied in the law and to develop an alternative way to think about cyber attacks, violence, and the state. The author uses three case studies - the 2007 cyber attacks against Estonia, the Stuxnet incident involving Iran that was discovered in 2010, and the cyber attacks used as part of the Russian interference in the 2016 US presidential election - to demonstrate that an informational approach offers a means to reimagine the state as an entity and cyber attacks as a form of violence against it. This interdisciplinary approach will appeal to an international audience of scholars in international law, international relations, security studies, cyber security, and anyone interested in the issues surrounding emerging technologies.

Global and local contestations are not only gendered, they also raise important questions about agency and its practice and location in the twenty-first century. Silence and voice are being increasingly debated as sites of agency within feminist research on conflict and insecurity. Drawing on a wide range of feminist approaches, this volume examines the various ways that silence and voice have been contested in feminist research, and their impact on how agency is understood and performed, particularly in situations of conflict and insecurity. The collection makes an important and timely contribution to interdisciplinary feminist theorizing of silence, voice and agency in global politics. Interrogating the intellectual landscape of existing debates about agency, silence and voice in an increasingly unequal and conflict-ridden world, the contributors to this volume challenge the dominant narratives of agency based on voice or speech alone as a necessary precondition for understanding or negotiating agency or empowerment. Many of the authors have engaged in field research in both the Global South and North and bring in-depth and diverse gendered case studies to their analysis, focusing on the increasing importance of examining silence as well as voice for understanding gender and agency in an increasingly embattled and complicated world. The gender-differentiated and more severe impacts of armed conflict upon women and girls are well recognised by the international community, as demonstrated by UN Security Council Resolution (UNSCR) 1325 on Women, Peace and Security and subsequent resolutions. Similarly, the development community has identified gender-differentiated impacts upon women and girls as a result of the effects of climate change. Current research and analysis has reached no consensus as to any causal relationship between climate change and armed conflict, but certain studies suggest an indirect linkage between climate change effects such as food insecurity and armed conflict. Little research has been conducted on the possible compounding effects that armed conflict and climate change might have on at-risk population groups such as women and girls. Armed Conflict, Women and Climate Change explores the intersection of these three areas and allows the reader to better understand how military organisations across the world need to be sensitive to these relationships to be most effective in civilian-centric operations in situations of humanitarian relief, peacekeeping and even armed conflict. This book examines strategy and military doctrine from NATO, the UK, US and Australia, and explores key issues such as displacement, food and energy insecurity, and male out-migration as well as current efforts to incorporate gender considerations in military activities and operations. Analyzing both historical contexts and geographical locations, this volume explores the continuous reformation of state power and its potential in situations of violent conflict. The state, otherwise understood as an abstract and transcendent concept in many works on globalization in political philosophy, is instead located and analyzed here as an embedded part of lived reality. This relationship to the state is exposed as an integral factor to the formation of the social - whether in Africa, the Middle East, South America or the United States. Through the examination of these particular empirical settings of war or war-like situations, the book further argues for the continued importance of the state in shifting social and political circumstances. In doing so, the authors provide a critical contribution to debates within a broad spectrum of fields that are concerned with the future of the state, the nature of sovereignty, and globalization.

Palestinian Popular Struggle challenges conventional thinking about political action and organization. It offers an alternative to the seemingly failed tracks of armed struggle and diplomatic negotiations.
