From ancient to modern times, sexualised war violence against women was tolerated if not encouraged as a means of reward, propaganda, humiliation, and terror. This was and is in defiance of international laws that have criminalised acts of sexualised war violence since the 18th century. Ad hoc international tribunals have addressed especially war rape since the 15th century. The International Criminal Court (ICC), however, is the first independent, permanent, international criminal court that recognises not only war rape but also sexual slavery and other sexualised crimes as crimes against humanity, war crimes, and acts of genocide in its statute and supporting documents. This book explores how the ICC definitions of rape and forced marriage came about, and addresses the ongoing challenge of how to define war rape and forced marriage in times of armed conflict in a way that adequately reflects women's experiences, as well as the nature of the crimes. In addition to deepening the understanding of the ICC negotiations of war rape and forced marriage, and of the crimes themselves, this volume highlights relevant factors that need to be considered when criminalising acts of sexualised war violence under international law. This interdisciplinary book explores the Northern Ireland conflict through a human rights framework. The book examines the conflict from the creation of the Northern Ireland state in 1921 to 2014. This timeframe allows an analysis of how human rights impacted upon the conflict in its broadest understanding (i.e. the pre-violent conflict, the violent conflict and the post-violent conflict phases). Furthermore, it allows for a better understanding of how the various stages of the conflict impacted upon how human rights are understood in Northern Ireland today. The study's main findings are that: (i) human rights had a significant impact on the development of the conflict; (ii) human rights violations were both underlying causes and direct causes of the descent into violence; (iii) the conflict coloured the view of human rights held by the main political actors; and (iv) human rights continue to be partially understood through the prism of the conflict. More generally, this interdisciplinary work explores the relationship between law, politics and conflict. This book offers a comprehensive overview of the impact of 'strategic culture' on Israeli military operations against Hamas between 1987 and 2014. It has often been argued that Israeli policies and military operations against Hamas have proven tactically effective, but strategically disastrous, allowing the Islamic Resistance Movement to grow from a small spin-off of the Muslim Brotherhood into a powerful military and political actor in the Palestinian arena. This book argues, contrary to this opinion, that Israel was effective in its struggle against the Islamic Resistance Movement between 1987 and 2014, as the Jewish state ultimately managed to deny the majority of Hamas' strategic aims and to preserve a position of relative strength. By relying on a synthesis of primary sources, interviews, memoirs, scholarly and professional military studies and information gathered from the media, the study delivers a careful and comprehensive analysis of the conflict. It provides an historical outline of the development of the Israeli 'strategic culture' and analyzes its impact on the process of military adaptation during the First Intifada, the Oslo Peace Process, the al-Aqsa Intifada and the Gaza wars. Finally, the book illuminates how the Israeli strategic culture moulded a distinctive 'way of war' that, though marked by successes and failures, ultimately proved effective against Hamas. Examining how migrants appropriate mobility in the context of biometric border controls, this volume mobilises new analytics and empirics in the debates about the politics of migration and provides an analytically effective and politically significant tool for the study of contemporary migration. Drawing from the tension between the EU's attempt to achieve watertight border controls by means of biometric technologies, and migrants' persistence to move to and live in the EU, the volume pursues two interrelated objectives: first, it studies the encounters between migrants and the Visa Information System (VIS), one of the largest biometric databases in the world, from the perspective of mobility in order to investigate how migrants appropriate mobility via Schengen visa within and against this biometric border regime. This book investigates how drone warfare is deeply gendered and how this can be explored through the methodological framework of 'Haunting'. Utilising original interview data from British Reaper drone crews, the book analyses the way killing by drones complicates traditional understandings of masculinity and femininity in warfare. As their role does not include physical risk, drone crews have been critiqued for failing to meet the masculine requirements necessary to be considered 'warriors' and have been derided for feminising war. However, this book argues that drone warfare, and the experiences of the crews, exceeds the traditional masculine/feminine binary and suggests a new approach to explore this issue. The framework of Haunting presented here draws on the insights of Jacques Derrida, Avery Gordon, and others to highlight four key themes - complex personhood, in/(hyper)visibility, disturbed temporality and power - as frames through which the intersection of gender and drone warfare can be examined. This book explores the question of whether peacekeeping commanders can be held accountable for a failure to protect the civilian population in the mission area. This requires an assessment of whether peacekeeping commanders have an obligation to act against such serious crimes being committed under domestic and international law. The work uses the cases of the Dutch and Belgian peacekeeping commanders in Srebrenica and Kigali as examples, but it also places the analysis into the context of contemporary peacekeeping operations. It unfolds two main arguments. First, it provides a critical note to the contextual interpretation given to international law in relation to peacekeeping. It is argued that establishing a specific paradigm for peacekeeping operations with clear rules of interpretation and benchmark criteria would benefit peacekeeping and international law by making the contextual interpretation of international law redundant. Second, it is held that alternative options to the existing forms of criminal responsibility for military commanders should be considered, possibly focusing more clearly on failing to fulfil a norm of protection that is specific to peacekeeping and distinct from protective obligations under international human rights law and international humanitarian law.

Drawing on a rich body of multimethod field research, this book examines the ways in which Indonesian and Philippine religious actors have fostered conflict resolution and under what conditions these efforts have been met with success or limited success. This book investigates competing modes of thought about gender security and aims to understand the policy implications of personal-political imaginations. This book scrutinises how political actors in the Israeli parliament (the Knesset) have articulated the security-democracy nexus in their discourses. Security crises expose political leaders to an uncomfortable dilemma: guaranteeing the safety of citizens while at the same time preserving democratic principles, basic rights and liberties. In this respect, Israel represents an archetypical case. Defining itself as a democracy, the state of Israel has been in quasi-constant conflict with its neighbouring countries while facing terror attacks repeatedly. This situation has resulted in the upholding of the state of emergency since the establishment of the state in 1948 and in the enactment of security measures that are often in conflict with democratic values. The tension between security and democracy is not a new question: it has been at the centre of political thought from Rousseau and Locke to Lasswell and Dahl and stood at the core of political debates after 9/11 and the 2005 terror attacks in London. Many studies have questioned how political actors manage this tension or how they could - properly - balance security and democracy. Yet, in spite of the abundant literature on the issue, the manner in which political actors conceptualise and frame this tension has been rarely explored. Even less has been said on the effects of this conceptualisation on the democratic regime. Drawing on discourse theory and on an innovative narrative analysis, the book examines 40 debates held in the Knesset on security-oriented laws enacted in two different contexts: the period of relative calm preceding the first Palestinian intifada (1987) and the period following the eruption of the second intifada (2000). More specifically, three types of laws and discussions are examined: laws establishing a relation between freedom of expression and security; laws linking the category of 'the enemy' to democracy; and finally those connecting the right to family unification and residence of Palestinians with terrorism. Through a comparative analysis of the political actors' discourses in 1985 and between 2000 and 2011, the study demonstrates that two main narratives have constantly competed: on the one hand a marginal narrative anchored in basic rights and on the other a defensive democracy narrative, which has become dominant. The latter has legitimised the restriction of freedom of expression, freedom to participate in elections, freedom of movement or the right to citizenship. The book shows how the increasing dominance of the defensive democracy narrative has had a fundamental impact in reshaping the polity and the identity of Israel's democratic regime. The analysis ultimately opens the possibility to rethink the conventional approach of the security-democracy dilemma and to reflect on processes in other states, such as the United Kingdom or the United States during different security crises. Renegotiating the Nuclear Order offers a sociological approach to the nuclear order, and order defined by nuclear technology and nuclear weapons. The focus is on the need to renegotiate the nuclear order, given the conflict between deterrence and disarmament and the unbalanced distribution of rights and responsibilities between the nuclear and nonnuclear states. The study applies the concepts, a relevant social group, and a technological frame developed in the sociology of technology on the current competition between the Non-Proliferation Treaty and the Treaty on the Prohibition on Nuclear Weapons. The negotiations of the nuclear programs of North Korea and Iran form the empirical background. The policy challenges identified in the sociotechnical analysis are threefold. Firstly, there is the need to guarantee the credibility of the nuclear diplomacy in the gap between the "military" and the "peaceful". Secondly, during the past 50 years the rights of the non-nuclear states have been undermined, while the nuclear-weapon states have ignored their disarmament obligations. There is a need to renegotiate a new balance. Thirdly, the relationship between the two treaties has to be clarified. The proposal is to clearly separate the two into a comprehensive treaty on non-proliferation and to a verifiable treaty on prohibiting nuclear weapons. This book explores what political conditions must be established and what obstacles overcome for the fi ve offi cial Nuclear Weapon States (NWS)- China, France, Russia, the UK and US- to eliminate their nuclear weapons.
