As recently as five years ago mass incarceration was widely considered to be a central, permanent feature of the political and social landscape. The number of people in U.S. prisons is still without historic parallel anywhere in the world or in U.S. history. But in the last few years, the population has decreased, in some states by almost a third. A broad consensus is emerging to reduce prison rolls. Politicians have called for repealing the harshest sentencing laws of the war on drugs, abolishing mandatory minimums and closing correctional facilities. Does the decrease in the prison population herald the dismantling of mass incarceration? This book provides an answer. Drawing on original research from across New York State, the contributors argue that while massive decarceration is taking place, the outcome to date is not the one wished for by reformers, namely a more just system. While drug law reform is clearly upon us, for example, a moral panic about heroin addiction and phantom meth labs has recently reached a fever pitch. As the penitentiary population drops and prisons close, the number of people in jail has swelled. New intelligence-led policing, and the rise of a reentry industry together have led to more surveillance and less social justice. Together these developments lead to justice disinvestment as the state sheds direct responsibility for the criminal justice system to the private and non-profit sector, while it extends its reach through new forms of community-based supervision, surveillance and policing into poor neighborhoods and communities of color. Celebration may be premature, in other words. Having endowed a group that is already disproportionately poor and people of color with the stigma of criminality, the state has left the formerly incarcerated and their communities to their fate. The future we face appears to be neither emancipatory reform nor simply the continuation of past mass incarceration. The challenge of freedom, on a scale not seen since the Reconstruction, remains before us.
Originally published in 1974, Deviance and Social Control represents a collection of original papers first heard at the annual meeting of the British Sociological Association in 1971. They reveal how the American approach to deviance has been taken up by British sociologists, and revised and modified, and they explore possibilities of extending and strengthening the subject, for instance through comparative analysis or by examining issues which bear on deviant behaviour.
Over the past few decades, there has been a sharp increase in the number of elderly prisoners, and hence a rise in the number of prisoners dying in custody. In this book, Khechumyan questions whether respect for human dignity would justify releasing older and seriously ill prisoners. He also examines the normative justifications which could limit the administration of the imprisonment of the elderly and seriously ill. Khechumyan argues that factors such as a prisoner's age and health could alter the balance between the legitimate goals of punishment, rendering the continued imprisonment 'grossly disproportionate'. To address these issues, Articles 3 and 5 of the European Convention of Human Rights are extensively examined. Rethinking Black Motherhood and Drug Addictions: Counternarratives of Black Family Resilience offers a unique perspective on the complexities of being a Black mother addicted to crack, powder cocaine, heroin, and crank. Qualitative interviews provide rich narratives from five Black mothers challenging negative controlled images and stereotypes of Black motherhood and drug addiction. Using Black Feminist Thought, Critical Race Feminism, and Resilience as conceptual frameworks, this book confronts hegemonic constructions of Black mothers and their children within the context of drug addictions. Particular attention is focused on using the mothers' self-definitions of struggles and family resilience to dismantle the negative controlled images of the junkie and the crack ho' and her crack baby. The mothers in this book speak truth to their experiences with motherhood and addictions to some of the most powerful street drugs that explicitly defy the junkie, crack ho', and crack baby images. The book also addresses tensions existing within researcher-participant relationships and nuances unique to research with Black mothers in recovery. Conversations about rehabilitation and how to address the drugs-crime nexus have been dominated by academics and policymakers, without due recognition of the experience and knowledge of practitioners. Not enough is known about the cultures and conditions in which rehabilitation occurs. At the end of the twentieth century a step-change in thinking about the offending behaviour of women began to impact on policy-makers concerned with the treatment of female offenders. A growing number of nations, states and organisations both national and supra-national in nature began to acknowledge that existing criminal justice and especially penal practices had not been sufficiently attentive to women's needs and had discriminated against women as a result. The concept of 'gender-responsive justice' - an orientation to working with women and girls based around a consideration of the special needs of women as prisoners and their particular pathways to offending - has been developed as a result. This book explores the development of this concept, the theories which have informed it, policy arenas in which gender-responsive justice has been attempted and the practices of gender-responsive justice which have subsequently emerged. This book takes a global perspective as it outlines the different international and national arenas within which gender-responsive justice gained favour and considers what has been learned from this novel and feminist-inspired approach. Gender-responsive justice has not been without its critics, however, and this book also examines the different arguments which have been used to attack or critique the concept from varied perspectives. Despite broad scholarship documenting the compounding effects and self-reproducing character of incarceration, ways of conceptualising imprisonment and the post-prison experience have scarcely changed in over a century. Contemporary correctional thinking has congealed around notions of risk and management. This book aims to cast new light on men's experience of release from prison. Drawing on research conducted in Australia, it speaks to the challenges facing people leaving prison and seeking acceptance amongst the non-imprisoned around the world. Circles of Support and Accountability is a voluntary initiative that assists people with convictions for sexual offences to resettle in the community. People leaving prison with such convictions often have difficulties in resettling. They carry the burden of the conviction itself, which may be both stigmatising and isolating, and they are the subject of sex offender register requirements, parole and other supervisory conditions. Circles of Support and Accountability in the UK started over ten years ago and have slowly spread across the country. They work closely with the police and probation services but rely entirely on volunteers prepared to give up their time to work with people often otherwise shunned by communities. Circles offer support to the person concerned but also hold them accountable for their future behaviour. They aim to ensure there are 'no more victims'. This book is based on original research and provides a close-up picture of how these Circles of Support and Accountability work in practice. It brings together for the first time the voices of all the participants, from the offenders and the volunteers through to the Coordinators who link the volunteers to the professionals in the form of the police and probation services. The research was commissioned by Circles UK and funded by the Wates Foundation and the University of Leeds, School of Law.
These essays, first published in 1996, focus on class, race, and gender as organising and analytical concepts in criminology. For many years, their importance in studying how the world relates to crime and its control was minimized or ignored. This book seeks to understand the processes of reintegration of former Jihadist detainees, as well as the role that the police and other frontline professionals play in this process. Over the past few decades the number of people who have been detained under the suspicion of terrorist activities has grown significantly. This has resulted in an increased scholarly interest in the topic of prisons and terrorism. However, the main focus of academic research has been on the period of incarceration with researchers paying extensive attention to the conditions under which terrorists have been detained as well as to various processes of alienation and (violent) radicalisation that sometimes take root while in prison. Much less has been written about the period after their incarceration and the steps being taken to prepare them for that transition. This book seeks to fill this gap. It argues that sentencing or incarcerating terrorism suspects is not the end of the story, but just the beginning of the next phase: a process of reintegration, or the start of a new cycle of violence. This exploratory study outlines the factors during and after detention that contribute or hinder the reintegration of those who have been incarcerated for violent extremism and terrorism. The overriding aim of this work is to facilitate further research into the radicalisation and de-radicalisation of jihadist suspects. This book will be of much interest to students of terrorism and counter-terrorism, Islamist radicalisation, criminology and security studies in general.

The public perception is that juvenile crime is out-of- hand and that no one can do anything about it. Research, however, shows that a mere 8% of juvenile offenders arrested and sent to juvenile court commit more than half of all repeat juvenile crimes, including violence. The first special juvenile court was created in 1899. Since then,juvenile justice has had a chequered history, and is now more controversial than ever. Should our treatment of young offenders differ in its aims or principles from that of adult offenders? What role should ideas of punishment or retribution play? Should our aims be rehabilitative and educative rather than punitive?
