Diversion in youth justice is a subject of enduring interest. It concerns the processes by which decisions are made about whether or not to prosecute young offenders, and this book explores the continuing debates and historical developments which shape these processes. The treatment of young offenders is a contentious subject, and this book provides a comprehensive review of out of court decision-making in the context of wider arguments about how we should deal with the crimes of the young. This book follows a broadly historical structure, exploring the development of ideas and approaches to agency decision-making at the point of prosecution. This leads to the identification of a number of distinctive 'models' of diversion, reflecting both specific periods of time and particular philosophies of intervention with young people in trouble with the law. This book seeks to understand the processes of reintegration of former Jihadist detainees, as well as the role that the police and other frontline professionals play in this process. Over the past few decades the number of people who have been detained under the suspicion of terrorist activities has grown significantly. This has resulted in an increased scholarly interest in the topic of prisons and terrorism. However, the main focus of academic research has been on the period of incarceration with researchers paying extensive attention to the conditions under which terrorists have been detained as well as to various processes of alienation and (violent) radicalisation that sometimes take root while in prison. Much less has been written about the period after their incarceration and the steps being taken to prepare them for that transition. This book seeks to fill this gap. It argues that sentencing or incarcerating terrorism suspects is not the end of the story, but just the beginning of the next phase: a process of reintegration, or the start of a new cycle of violence. This exploratory study outlines the factors during and after detention that contribute or hinder the reintegration of those who have been incarcerated for violent extremism and terrorism. The overriding aim of this work is to facilitate further research into the radicalisation and de-radicalisation of jihadist suspects. Restorative justice (RJ) and restorative approaches (RAs) are becoming increasingly valued as a way of responding to a wide range of conflicts, including problem and offending behaviours. This title was first published in 2003. Adolescence is popularly understood as a transitional phase of turbulence and extremes. It is also often associated with 'trouble'. Criminal justice statistics, however, reveal that youth criminality remains a relatively rare phenomenon, less than one percent of the total adolescent population in any given year. This exceptional book is based upon a major Australian research programme to consider the key social factors impacting upon the lives of young people. A sample of 1,300 young people was divided into three major subgroups: a 'control' group, drawn from state secondary schools and closely approximating the general population; a chronically marginalized cohort representing a 'vulnerable group', and a group of offenders, most of whom were incarcerated at the time of the research. With its rich data source and highly integrated structure, the book makes a major contribution to our understanding of adolescent criminality and associated policy both in Australia and internationally.
This book aims to make the case for and provide some of the resources necessary to reimagine rehabilitation for twenty-first-century criminal justice. Outlining an approach to rehabilitation which takes into account wider democratic processes, political structures and mechanisms of resource allocation, the authors develop a new model of rehabilitation comprising four forms - personal, legal, social and moral. Personal rehabilitation concerns how individuals make their journeys away from offending and towards reintegration and how they can be supported to do so, whilst legal rehabilitation concerns the role of the criminal courts in the process of restricting and then restoring the rights and status of citizens. Moral rehabilitation is concerned with the ethical basis of the interactions between the individual who has offended and the people and organisations charged with providing rehabilitative services. Social rehabilitation explores the crucial contribution civil society can make to rehabilitation, exploring this through the lens of citizenship, community and social capital. Drawing on the conceptual insights offered in the late Stan Cohen's seminal work - Visions of Social Control - and specifically his insistence that modern social institutions can aspire to doing good and doing justice, the authors argue that these values can underpin a moral pragmatism in designing social interventions that must go beyond achieving simply instrumental ends. Over the past two decades, concern about adolescent sex offenders has grown at an astonishing pace, garnering heated coverage in the media and providing fodder for television shows like "Law & Order." Americans' reaction to such stories has prompted the unquestioned application to adolescents of harsh legal and clinical intervention strategies designed for serious adult offenders, with little attention being paid to the psychological maturity of the offender. Many strategies being used today to deal with juvenile sex offenders--and even to define what criteria to use in defining "juvenile sex offender"--do not have empirical support and, Frank C. DiCataldo cautions, may be doing more harm to children and society than good. The Perversion of Youth critiques the current system and its methods for treating and categorizing juveniles, and calls for a major reevaluation of how these cases should be managed in the future. Through an analysis of the history of the problem and an empirical review of the literature, including specific cases and their outcomes, DiCataldo demonstrates that current practices are based more on our collective fears and moral passions than on any supportive science or sound policy.
The 2008 UK government Youth Crime Action Plan emphasises prevention and early intervention in different aspects of work with young people who offend or are considered to be 'at risk' of offending. Much of this approach includes targeted work with families and work to reduce the numbers of young people entering the youth justice system. This book explores the journey of young people through a Secure Training Centre and, more generally, the criminal justice system in the UK. It examines the extent to which young people have been failed by the system at every stage of their lives, with incarceration used as a means of removing 'the problem' from society. To explore this process, the authors utilise an integrated theoretical framework to develop a new rehabilitative approach focused on developing positive outcomes for young people. The book deploys a social impact measurement methodology to evaluate the experience and outcomes of youth justice interventions at a Secure Training Centre. Such an approach provides a fresh perspective on the youth justice debate which has traditionally utilised outcome data to measure immediate impact relating to recidivism and is therefore not focused on the young person holistically. Using a social impact framework to evaluate youth justice, underpinned by an integrated theoretical framework, allows for assessment to be made which place the young person at the centre of evaluation.

Over the last decade, the reformed youth justice system has seen increases in the numbers of children and young people in custody, a sharp rise in indeterminate sentences and the continuing deaths of young prisoners. Originally published in 1941 and written in an attempt to dispute the popular assumption at the time that a 'bit of discipline' is what is needed for the correction of young men who show delinquent tendencies, this book is much more than that. Basically an account of a kind of voluntary Borstal Institution of which the author was head from 1936 to 1940, its interest on reissue in 1967 lay in the fact that it contained the germinal ideas of most of the day's newest methods in penal treatment, not just as ideas, but in practice. Here is the therapeutic community in embryo, here are the beginnings of group therapy, of inmate participation in treatment, of therapy through relationships. None of them are mentioned by name - the names had not been invented; but anyone who wanted to understand the trends in the treatment of delinquent and maladjusted people at the time would find it all here in simple untechnical English. The book is also an account of an enthralling experience, exciting and interesting in itself, apart from any social significance. Just before the camp started, Alec Paterson said to David Wills, 'Do you really think you can run a place of this kind without the use of punishment?' Wills said he didn't know, but looked forward to trying. Readers of this book may judge for themselves how far he succeeded. A particularly interesting feature of this edition is the account of the subsequent lives of the many boys who were at Hawkspur.
Originally published in 1974, Deviance and Social Control represents a collection of original papers first heard at the annual meeting of the British Sociological Association in 1971. Over the past few decades, there has been a sharp increase in the number of elderly prisoners, and hence a rise in the number of prisoners dying in custody. In this book, Khechumyan questions whether respect for human dignity would justify releasing older and seriously ill prisoners. He also examines the normative justifications which could limit the administration of the imprisonment of the elderly and seriously ill. Khechumyan argues that factors such as a prisoner's age and health could alter the balance between the legitimate goals of punishment, rendering the continued imprisonment 'grossly disproportionate'. To address these issues, Articles 3 and 5 of the European Convention of Human Rights are extensively examined.
