Ethical Issues in Forensic Psychiatry - Minimizing Harm (Hardcover): RL Sadoff Ethical Issues in Forensic Psychiatry - Minimizing Harm (Hardcover)
RL Sadoff
R1,807 R1,478 Discovery Miles 14 780 Save R329 (18%) Out of stock

Ethical medical practice and treatment in psychiatry are based on the concept of first do no harm. However, this cannot, and does not, apply to forensic cases where there is no doctor-patient relationship and the forensic psychiatrist may indeed cause harm to the examinee. In this book, Robert Sadoff analyzes the ethical issues affecting forensic psychiatric practice, especially those promulgated by the American Academy of Psychiatry and the Law. Within those guidelines, he looks at individual bias, vulnerability of the examinee, and potential harm to the mental health professional. The book discusses each of the procedures of the forensic expert separately with respect to minimizing harm. It has been written with an international audience in mind and features chapters reviewing the European and UK perspectives, by Emanuele Valenti and John Baird, respectively.

Robert Sadoff addresses the long-term harm that can be either avoided or minimized through careful planning and application of ethical principles. He is not advocating that the harm can be totally eliminated, because that is impossible in the adversarial system in which forensic psychiatrists work. However, there are means by which harm may be minimized if care is taken during the assessment, the report writing, and the testimony phase of the proceedings. The book develops the scope of forensic psychiatry from the standpoint of administrative, civil and criminal cases. It presents the practical issues involved in conducting forensic psychiatric assessments under various conditions plus special considerations, such as bias, minimizing harm, developing a therapeutic approach, and elaborating on various vulnerable individuals who are frequently examined in forensic cases. These include juveniles, mentally retarded, autistic, sexual assault victims, the elderly, the organically damaged, the psychotic, and mentally disabled prisoners. Immigrants are covered in a chapter by Solange Margery Bertoglia. The ethical issues in conducting forensic psychiatric examinations and presenting psychiatric testimony in court are examined and discussed. Cases illustrating the difficulties involved punctuate the presentation. The book closes with a fascinating account of the legal perspective by Donna Vanderpool.

In summary, this book illustrates the ethical and practical issues that affect forensic psychiatric practice. The question is not what we do, but how we do it, and which standards, ethical guidelines and personal values contribute to the total picture. Despite the fact that we cannot always adhere to the doctrine of "primum non nocere," we can minimize the harm caused inherently by the adversarial system in which we participate.

Praise for "Ethical Issues in Forensic Psychiatry"

"One of the founding giants of the forensic psychiatric field has written here far more than a "mere" ethics textbook. Instead, this compendium serves multiple purposes: it is a valuable primer on forensic techniques of examination and testimony, a model of best forensic practices, and an instruction on the most appropriately civilized way in which to conduct oneself as a forensic psychiatrist.

The success of these multiple accomplishments clearly derives from characteristics of the author. In both sage advice to practitioners and in many revealing case examples, Dr. Sadoff displays the tact, good manners and sensitivity of a consummate gentleman - a term not always associated with the hurly-burly of courtroom work. The book's primary focus on avoiding harm to all the parties involved in the work places it on the moral high ground of the legal system in which participating clinicians must find a place."

Expert Report Writing in Toxicology - Forensic, Scientific and Legal Aspects (Paperback): MD Coleman Expert Report Writing in Toxicology - Forensic, Scientific and Legal Aspects (Paperback)
MD Coleman
R1,087 Discovery Miles 10 870 Ships in 12 - 17 working days

Every year throughout the world, individuals health is damaged by their exposure to toxic chemicals at work. In most cases these problems will resolve, but many will sustain permanent damage. Whilst any justified claim for compensation requires medical and legal evidence a crucial and often controversial component of this process is the establishment of a causal link between the individual s condition and exposure to a specific chemical or substance. Causation, in terms of how a substance or substances led the claimant to his or her current plight, can be difficult to establish and the main purpose of this book, is to provide the aspiring expert report writer with a concise, practical guide that uses case histories to illuminate the process of establishing causation in occupational toxicity proceedings. In summary: * A practical, accessible guide to the preparation of balanced, scientifically sound expert reports in the context of occupational toxicology. * Focuses on the scientist s role in establishing a causal link between exposure to toxins and an individual s ill health. * Includes real-life case histories drawn from the Author s 15 years experience in this area to illustrate the principles involved. Expert Report Writing in Toxicology: Forensic, Scientific and Legal Aspects proves invaluable to scientists across a range of disciplines needing guidance as to what is expected of them in terms of the best use of their expertise and how to present their findings in a manner that is authoritative, balanced and informative.

Bolshevik Sexual Forensics - Diagnosing Disorder in the Clinic and Courtroom, 1917-1939 (Hardcover): Dan Healey Bolshevik Sexual Forensics - Diagnosing Disorder in the Clinic and Courtroom, 1917-1939 (Hardcover)
Dan Healey
R3,001 Discovery Miles 30 010 Ships in 12 - 17 working days

In an effort to modernize criminal and civil investigations, early Bolsheviks gave forensic doctors-most of whom had been trained under the tsarist regime-new authority over issues of sexuality. Revolutionaries believed that forensic medicine could provide scientific and objective solutions to sexual disorder in the new society. Bolshevik Sexual Forensics explores the institutional history of Russian and Soviet forensic medicine and examines the effects of its authority when confronting sexual disorder. Healey compares sex crime investigations from Petrograd and Sverdlovsk in the 1920s to the numerous publications by forensic doctors and psychiatrists of the prerevolutionary and early Soviet periods to illustrate the role that these specialists played. In addition, Healey presents a fascinating look at how doctors diagnosed and treated hermaphroditism, showing how Soviet physicians revolutionized the standard scientific view in these cases by taking into account individual desire. This study sheds light on unexplored radical and reactionary forces that shaped the Bolshevik "sexual revolution" as lawmakers defined new ways of seeing sexual crime and disorder. Forensic doctors struggled to interpret the replacement of the age of consent with a standard of "sexual maturity," a designation that made female sexuality a collective "resource," not part of an individual's personality. "Innocence," "experience," and virginity played a major role in the expertise doctors furnished in rape and abuse trials. Psychiatrists recoiled from the language of sexual psychology in their investigations of sex criminals. Yet in the clinic, Soviet physicians probed the desires of the two-sexed citizen, whose psychology served as the basis for a distinctly modern approach to the "erasure" of the hermaphrodite. Healey concludes that the vision of men and women as equals after a "sexual revolution" was undermined from the outset of the Soviet experiment. Law and medicine failed to protect women and girls from violence, and Soviet medicine's physiological and biological model of sexual citizenship erased the vision of sexual self-expression, especially for women. This groundbreaking study will appeal to Soviet historians and those interested in gender studies, sexuality, medicine, and forensics.

Marius Leander Huesmann
R2,157 Discovery Miles 21 570 Ships in 10 - 15 working days

Silent Witness - Forensic DNA Evidence in Criminal Investigations and Humanitarian Disasters (Paperback): Henry Erlich, Eric... Silent Witness - Forensic DNA Evidence in Criminal Investigations and Humanitarian Disasters (Paperback)
Henry Erlich, Eric Stover, Thomas J. White; Foreword by Scott Turow
R972 Discovery Miles 9 720 Ships in 9 - 15 working days

Since its introduction in the late 1980s, DNA analysis has revolutionized the forensic sciences: it has helped to convict the guilty, exonerate the wrongfully convicted, identify victims of mass atrocities, and reunite families whose members have been separated by war and repressive regimes. Yet, many of the scientific, legal, societal, and ethical concepts that underpin forensic DNA analysis remain poorly understood, and their application often controversial. Told by over twenty experts in genetics, law, and social science, Silent Witness relates the history and development of modern DNA forensics and its application in both the courtroom and humanitarian settings. Across three thematic sections, Silent Witness tracks the scientific advances in DNA analysis and how these developments have affected criminal and social justice, whether through the arrests of new suspects, as in the case of the Golden State Killer, or through the ability to identify victims of war, terrorism, and human rights abuses, as in the cases of the disappeared in Argentina and the former Yugoslavia and those who perished during the 9/11 attacks. By providing a critical inquiry into modern forensic DNA science, Silent Witness underscores the need to balance the benefits of using forensic genetics to solve crime with the democratic right to safeguard against privacy invasion and unwarranted government scrutiny, and raises the question of what it means to be an autonomous individual in a world where the most personal elements of one's identity are now publicly accessible.

Investigations in Sex Estimation: A Comparison of Morphological and Metrical Methods is a collective comparison of the many morphological and metric methods currently used on adult and juvenile human remains. This single comprehensive resource for sex estimation in skeletal material includes discussion on the evolution of sexual dimorphism in modern humans, how sexual dimorphism manifests itself in those bones, the growth development in juveniles and how sexual dimorphism can be measured in their bones. Data is presented which contradicts previously held postulates and some different uses of sex estimation methods are suggested, such as using the grading system to assess evolutionary change in skeletons or grouping juveniles into smaller groups by age to better estimate sex. New insights are offered for future research from the presentation of case studies on gender and a comparison of the sex differences between two African-American collections which suggests a correlation between occupation and evolutionary change. To achieve the objective, data on 294 adults from four diverse collections of known sex are obtained using a total of 67 morphological and metric methods. An additional 23 morphological and metric methods used on juveniles, aged 0 to 18, from two of the collections. The methods are specific to either the cranium, mandible, pelvis, humerus or femur. The compilation of assessment of sex provides definitive answers on which type of method, morphological or metric, is more accurate, which morphological and metric methods are the most accurate, and which bones are more reliable to estimate sex especially in the absence of a pelvis. Investigations in Sex Estimation is intended to be used in the field and the laboratory for the identification of sex in human remains and aims to provide a wealth of data for future research in sexual dimorphic studies.

A fascinating Jazz Age tale of chemistry and detection, poison and murder, "The Poisoner's Handbook" is a page-turning account of a forgotten era. In early twentieth-century New York, poisons offered an easy path to the perfect crime. Science had no place in the Tammany Hall-controlled coroner's office, and corruption ran rampant. However, with the appointment of chief medical examiner Charles Norris in 1918, the poison game changed forever. Together with toxicologist Alexander Gettler, the duo set the justice system on fire with their trailblazing scientific detective work, triumphing over seemingly unbeatable odds to become the pioneers of forensic chemistry and the gatekeepers of justice.
