Die Haftung des Tierarztes gewinnt zunehmend an Bedeutung. Die vorliegende Arbeit nimmt diese Entwicklung zum Anlass, die zivilrechtliche Verantwortlichkeit von Veterinaren grundlegend zu betrachten. Nach einem UEberblick uber die historische Entwicklung werden zunachst die Gemeinsamkeiten und Unterschiede zur Haftung des Humanmediziners analysiert. Anschliessend befasst sich die Arbeit mit den in Betracht kommenden Anspruchsgrundlagen, wobei auch die im Kontext der Kaufuntersuchung relevante Frage der Haftung gegenuber Dritten beleuchtet wird. Aufbauend darauf widmet sich die Untersuchung sodann den Pflichten und Haftungsgrunden wahrend der tierarztlichen Behandlung, der Aufklarung sowie der Durchfuhrung von Kaufuntersuchungen. Stets wird dabei die Rechtsprechung berucksichtigt und kritisch bewertet. Die Arbeit schliesst mit einer umfassenden Darstellung zivilprozessualer Fragen, welche fur die Durchsetzung von Haftungsanspruchen von entscheidender Bedeutung sind.

Die Anwendung von antibakteriell wirksamen Substanzen in der Veterinarmedizin erfolgt zum einen aus Grunden des Verbraucherschutzes, zum anderen zur Erhaltung der Tiergesundheit. Gleichzeitig fuhrt jeder Einsatz von Antibiotika zur Selektion von bereits bestehenden Resistenzen, auch wird das Entstehen neuer Resistenzmechanismen begunstigt.

Aus diesen Grunden mussen nachhaltig wirksame Managementmassnahmen ergriffen werden, um den Eintrag von resistenten Bakterien insbesondere durch Lebensmittel liefernden Tiere in die menschliche Nahrungskette moglichst gering zu halten bzw. zu vermeiden. Zur Beurteilung der aktuellen Resistenzsituation und entwicklung ist die Erhebung valider Empfindlichkeitsdaten fur tierpathogene Bakterien erforderlich. Das Bundesamt fur Verbraucherschutz und Lebensmittelsicherheit (BVL) erhebt diese Daten im Rahmen des Nationalen Resistenzmonitorings (GERM-Vet) seit 2001. Diese Daten ermoglichen es, koordinierende Massnahmen zu ergreifen und Entscheidungshilfen zur kalkulierten Therapie zu geben."

Born in rural Worcestershire in 1950, from an early age David Harwood learned about keeping animals before going on to study veterinary medicine at London's Royal Veterinary College.
