The international system is becoming increasingly legalized, with legal arguments and legal advisors playing an increasingly important part in the state policymaking process. This book examines potential synergies between the fields of Terrorism Studies and Peace and Conflict Studies. Studying Muslim fundamentalisms, this book compares key movements, examining their commonalities, differences, and intricate relations, as well as their achievements and failures. Critical Terrorism Studies emerged around 2007, in the context of the rapidly intensifying War on Terror. It was in this era that "terrorism" became a "growth industry" which generated a huge amount of academic research as well as social and political activity. Yet a yawning gap developed between the actual material threat posed by terrorists, and the level of investment and activity devoted to responding to this threat. Similarly, the quality of terrorism research was noticeably weak and lacking in methodological rigour. Critical Terrorism Studies set out to explore the exceptional treatment of political violence, to challenge the political manipulation of terrorism fears and increase in draconian anti-terrorism legislation, and to address some of the conceptual and methodological failings of terrorism research. In the 10 years since the journal Critical Studies on Terrorism was launched, that context and mission remains as important as ever. The Madrid train bombers, shoe-bomber Richard Reid, al-Qaeda in Iraq, and the 9/11 attacks-all were led by men radicalized behind bars. By their very nature, prisons are intended to induce transformative experiences among inmates, but today's prisons are hotbeds for personal transformation toward terrorist beliefs and actions due to the increasingly chaotic nature of prison life caused by mass incarceration. In The Spectacular Few, Mark Hamm demonstrates how prisoners use criminal cunning, collective resistance and nihilism to incite terrorism against Western targets. A former prison guard himself, Hamm knows the realities of day-to-day prison life and understands how prisoners socialize, especially the inner-workings and power of prison gangs-be they the Aryan Brotherhood or radical Islam. He shows that while Islam is mainly a positive influence in prison, certain forces within the prison Muslim movement are aligned with the efforts of al-Qaeda and its associates to inspire convicts in the United States and Europe to conduct terrorist attacks on their own. An ethnography of terrorism trials in Delhi, India, this book explores what modes of life are made possible in the everyday experience of the courtroom. Mayur Suresh shows how legal procedures and technicalities become the modes through which courtrooms are made habitable. Where India’s terror trials have come to be understood by way of the expansion of the security state and displays of Hindu nationalism, Suresh elaborates how they are experienced by defendants in a quite different way, through a minute engagement with legal technicalities. Amidst the grinding terror trials—which are replete with stories of torture, illegal detention and fabricated charges—defendants school themselves in legal procedures, became adept petition writers, build friendships with police officials, cultivate cautious faith in the courts and express a deep sense of betrayal when this trust is belied. Though seemingly mundane, legal technicalities are fraught and highly contested, and acquire urgent ethical qualities in the life of a trial: the file becomes a space in which the world can be made or unmade, the petition a way of imagining a future, and investigative and courtroom procedures enable the unexpected formation of close relationships between police and terror-accused. In attending to the ways in which legal technicalities are made to work in everyday interactions among lawyers, judges, accused terrorists, and police, Suresh shows how human expressiveness, creativity and vulnerability emerge through the law.

Pinpointing media strengths and weaknesses in shaping and in reporting on a major crisis in Africa, this ground-breaking work analyzes Savimbi as a cold war guerrilla, the role of different media segments in the dirty war in Angola, and the right-wing influence of the Reagan and Bush administrations into the 1990s. The resurrection of Savimbi, who represented a lost cause after his defeat in the Angolan civil war in 1976, but who was kept alive by South African support, was due to his adoption by the Reagan administration as an ally in the crusade against Third World governments supported by the Soviet Union. The study shows how the mainstream media tended to follow the administration's agenda and right-wing views in portraying Savimbi as an ally. Windrich also explains how the Bush administration and the media have continued to support Savimbi and his rebel movement.

Regulatory Counter-Terrorism explores an emerging terrain in which the global governance of terrorism is expanding. This book offers a theory and model of counterterrorism based on emancipation and non-violence. Critical Terrorism Studies (CTS) scholars have produced wide-ranging and rich critiques of terrorism-related research, as well as state counterterrorism policies and practices. This work aims to fill in a gap in the current literature by constructing an original and specifically CTS model of counterterrorism. The model outlines the basic assumptions, priorities, principles, strategies and tactics, measures and evaluation of counterterrorism. It challenges prevalent models of counterterrorism through a radical rethinking of the ontology, epistemology and the agenda of counterterrorism. The model aims to prevent future acts of terrorism by (1) re-conceptualising how we study and understand terrorism, and; (2) suggesting that our efforts to counter and prevent terrorism must commensurate with the goals we want to achieve. Essentially, this involves a commitment to emancipation, and a rejection of violence as a tool. The second part of the book is a case study of Norwegian counterterrorism which shows how the theory and model developed in the book can be used. This is the first substantial analysis of Norwegian counterterrorism in almost ten years, and produces encouraging findings which support the potential for non-violent solutions to terrorism. This book will be of particular interest to students of terrorism and counterterrorism, critical security studies, and international relations in general.

This edited volume offers a comparative and interdisciplinary analysis of interrogation and questioning in war and conflict in the twentieth century. This book uses Securitisation Theory to explore how Muslims have been constructed as a security issue in Africa after the 9/11 attacks in the United States. These attacks became the rationale for the US's Global War on Terror (GWOT). The centrality of Africa as an arena to execute the GWOT is the focus of this book. This book explores, particularly, how western-centred security discourses around Muslims has permeated South African security discourse in the post-apartheid period. It claims that the popular press and the local think-tank community were critical knowledge-sites that imported rather than interrogated debates which have underpinned policy-initiatives such as the GWOT. Such theorisation seems contrary to the original architects of securitisation theory who maintain that issues become security concerns when institutional voices declare these as such. However, this book confirms that non-institutional voices have securitised the African Muslims by equating them with terrorism. This book illustrates that such securitisation reproduces partisan knowledge that promote Western interests.

Despite numerous efforts since the 1920s, the international community has failed to define or criminalize 'terrorism' in international law. This book first explores the policy reasons for defining and criminalizing terrorism, before proposing the basic elements of an international definition. Terrorism should be defined and criminalized because it seriously undermines fundamental human rights, jeopardizes the State and peaceful politics, and may threaten international peace and security. Definition would also help to distinguish political from private violence, eliminating the overreach of the many 'sectoral' anti-terrorism treaties. A definition may also help to confine the scope of UN Security Council resolutions since 11 September 2001, which have encouraged States to pursue unilateral and excessive counter-terrorism measures. Defining terrorism as a discrete international crime normatively recognizes and protects vital international community values and interests, symbolically expresses community condemnation, and stigmatizes offenders. Any definition of terrorism must also accommodate reasonable claims to political violence, particularly against repressive governments, and this book examines the range of exceptions, justifications, excuses, defences and amnesties potentially available to terrorists, as well as purported exceptions such as self-determination struggles, 'State terrorism' and armed conflicts. While this book seeks to minimize recourse to violence, it recognises that international law should not become complicit in oppression by criminalizing legitimate forms of political resistance. In the absence of an international definition, the remainder of the book explores how the international community has responded to terrorism in international and 'regional' treaties, the United Nations system, and in customary law. The final part of the book explores the distinctive prohibitions and crime of 'terrorism' in armed conflict under international humanitarian law.
