When Slobodan Milosevic died in the United Nations Detention Unit in The Hague over four years after his trial had begun, many feared - and some hoped - that international criminal justice was experiencing some sort of death itself. Yet the Milosevic case, the first trial of a former head of state by a truly international criminal tribunal and one of the most complex and lengthy war crimes trials in history, stands for much in the development and the future of international criminal justice, both politically and legally. This book, written by the senior legal advisor working for the Trial Chamber, analyses the trial to determine what lessons can be learnt that will improve the fair and expeditious conduct of complex international criminal proceedings brought against former heads of state and senior political and military officials, and develops reforms for the future achievement of best practice in international criminal law.

Taking an interdisciplinary approach, this book raises new questions and provides different perspectives on the roles, responsibilities, ethics and protection of interpreters in war while investigating the substance and agents of Japanese war crimes and legal aspects of interpreters' taking part in war crimes. Informed by studies on interpreter ethics in conflict, historical studies of Japanese war crimes and legal discussion on individual liability in war crimes, Takeda provides a detailed description and analysis of the 39 interpreter defendants and interpreters as witnesses of war crimes at British military trials against the Japanese in the aftermath of the Pacific War, and tackles ethical and legal issues of various risks faced by interpreters in violent conflict. The book first discusses the backgrounds, recruitment and wartime activities of the accused interpreters at British military trials in addition to the charges they faced, the defence arguments and the verdicts they received at the trials, with attention to why so many of the accused were Taiwanese and foreign-born Japanese. Takeda provides a contextualized discussion, focusing on the Japanese military's specific linguistic needs in its occupied areas in Southeast Asia and the attributes of interpreters who could meet such needs. In the theoretical examination of the issues that emerge, the focus is placed on interpreters' proximity to danger, visibility and perceived authorship of speech, legal responsibility in war crimes and ethical issues in testifying as eyewitnesses of criminal acts in violent hostilities. Takeda critically examines prior literature on the roles of interpreters in conflict and ethical concerns such as interpreter neutrality and confidentiality, drawing on legal discussion of the ineffectiveness of the superior orders defence and modes of individual liability in war crimes. The book seeks to promote intersectoral discussion on how interpreters can be protected from exposure to manifestly unlawful acts such as torture.

As the world becomes ever more unequal, people become ever more 'disposable'. Today, governments systematically exclude sections of their populations from society through heavy-handed policing. But it doesn't always go to plan. William I. Robinson exposes the nature and dynamics of this out-of-control system, arguing for the urgency of creating a movement capable of overthrowing it. The global police state uses a variety of ingenious methods of control, including mass incarceration, police violence, US-led wars, the persecution of immigrants and refugees, and the repression of environmental activists. An estimated one million Armenians were killed in the dying days of the Ottoman Empire in 1915. During the two decades following entry into World War II, nearly 30 million men and women served in or worked for the United States military. Tens of thousands faced a general court-martial under the Articles of War, which prescribed either life in prison or death for crimes of murder, rape or desertion. Only 160 men were sentenced to death and executed-159 for murder or rape (or a combination of the two), and one for desertion. The manner of death was by firing squad or by hanging. These dishonored servicemen were buried in various locations around the world. Later, nearly all were moved to grave sites in military cemeteries, segregated from those who died honorably. This book tells the stories of the men, their crimes and their executions.

This book presents a review of historical and emerging legal issues that concern the interpretation of the international crime of genocide. The Polish legal expert Raphael Lemkin formulated the concept of genocide during the Nazi occupation of Europe, and it was then incorporated into the 1948 Convention on the Prevention and Punishment of the Crime of Genocide. This volume looks at the issues that are raised both by the existing international law definition of genocide and by the possible developments that continue to emerge under international criminal law. The authors consider how the concept of genocide might be used in different contexts, and see whether the definition in the 1948 convention may need some revision, also in the light of the original ideas that were expressed by Lemkin. Far from the image of an apolitical, "clean" Wehrmacht that persists in popular memory, German soldiers regularly cooperated with organizations like the SS in the abuse and murder of countless individuals during the Second World War. This in-depth study demonstrates that a key factor in the criminalization of the Wehrmacht was the intense political indoctrination imposed on its members. This book examines British responses to genocide and atrocity in the Ottoman Empire during the aftermath of World War I. The authors analyze British humanitarianism and humanitarian intervention through the advice and policies of the Foreign Office and British government in London and the actions of Foreign Officers in the field. British understandings of humanitarianism at the time revolved around three key elements: good government, atrocity, and the refugee crises; this ideology of humanitarianism, however, was challenged by disputed policies of post-war politics and goals regarding the Near East. This resulted in limited intervention methods available to those on the ground but did not necessarily result in the forfeiture of the belief in humanitarianism amongst the local British officials charged with upholding it. This study shows that the tension between altruism and political gain weakened British power in the region, influencing the continuation of violence and repression long after the date most perceive as the cessation of WWI. The book is primarily aimed at scholars and researchers within the field; it is a research monograph and will be of greatest interest to scholars of genocide, British history, and refugee studies, as well as for activists and practitioners.

Yet much less attention has been given to how these incidents persist in collective memory today.
