During World War II, Croatia became a fascist state under the control of the Ustasha Movement - allied with Nazi Germany and Fascist Italy. Here, Goran Miljan examines and analyzes for the first time the ideology, practices, and international connections of the Ustasha Youth organization. The Ustasha Youth was an all-embracing fascist youth organization, established in July 1941 by the `Independent State of Croatia' with the goal of reeducating young people in the model of an ideal `new' Croat. This youth organization attempted to set in motion an all-embracing, totalitarian national revolution which in reality consisted of specific interconnected, mutually dependent practices: prosecution, oppression, mass murder, and the Holocaust - all of which were officially legalized within a month of the regime's accession to power. To this end education, sport, manual work and camping took place in specially established Ustasha Youth Schools. In order to justify their radical policies of youth reeducation, the Ustasha Youth, besides emphasizing national character and the importance of cultural and national purity, also engaged in transnational activities and exchanges, especially with the Hlinkova mladez [Hlinka Youth] of the Slovak Republic. Both youth organizations were closely modelled after the youth organizations in Nazi Germany and Fascist Italy. This is a little studied part of the history of World War II and of Fascism, and will be essential reading for scholars of Central Europe and the Holocaust.

The 1994 Rwandan genocide against the Tutsi was the signature moral horror of the late 20th century. This book places the insurgent group Boko Haram, which has terrorised northeastern Nigeria through the last six years, in an historical and cultural context. It examines cultural changes in the lands south of Lake Chad through deep time, showing how these ancient processes can help us think about Boko Haram's activities in the present. The archaeological and documentary record for this area is unusually rich for sub-Saharan Africa, and allows us to understand Boko Haram within an historical narrative that stretches back directly five centuries, with cultural origins that stretch even deeper into the past. One important way to understand Boko Haram is as a frontier phenomenon, the most recent manifestation of processes of horrific violence, identity production and wealth creation that have been part of political relationships in this area of Central Africa through the last millennium. In striking ways, Boko Haram resembles the slave-raiders and warlords who figure in precolonial and colonial writings about the southern Lake Chad Basin. In modern times, these accounts are paralleled by the activities of smugglers, bandits (coupeurs de route, 'road cutters') and tax evaders, illegal actors who stand in complex relationships to the governments of modern African nation-states. The borderlands of these states are often places where the state refuses to exercise its full authority, because of the profits and opportunities that illegal and semi-legal activities afford, among others to state officials and bureaucrats. For local people, Boko Haram's actions are thus to a great extent understood in terms of slave-raids and borderlands. Those actions are not some mysterious, unprecedented eruption of violence and savagery: they can be understood within local contexts of politics and history. This book is written to counter exoticised portrayals of Boko Haram's activities, and of the region as a whole.
From videos of rights violations, to satellite images of environmental degradation, to eyewitness accounts disseminated on social media, human rights practitioners have access to more data today than ever before. To say that mobile technologies, social media, and increased connectivity are having a significant impact on human rights practice would be an understatement. Modern technology - and the enhanced access it provides to information about abuse - has the potential to revolutionise human rights reporting and documentation, as well as the pursuit of legal accountability. However, these new methods for information gathering and dissemination have also created significant challenges for investigators and researchers. For example, videos and photographs depicting alleged human rights violations or war crimes are often captured on the mobile phones of victims or political sympathisers. The capture and dissemination of content often happens haphazardly, and for a variety of motivations, including raising awareness of the plight of those who have been most affected, or for advocacy purposes with the goal of mobilising international public opinion. For this content to be of use to investigators it must be discovered, verified, and authenticated. Discovery, verification, and authentication have, therefore, become critical skills for human rights organisations and human rights lawyers. This book is the first to cover the history, ethics, methods, and best-practice associated with open source research. It is intended to equip the next generation of lawyers, journalists, sociologists, data scientists, other human rights activists, and researchers with the cutting-edge skills needed to work in an increasingly digitized, and information-saturated environment.
Evil is sometimes thought to be incomprehensible and abnormal, falling outside of familiar historical and human processes. And yet the twentieth century was replete with instances of cruelty on a massive scale, including systematic torture, murder, and enslavement of ordinary, innocent human beings. These overwhelming atrocities included genocide, totalitarianism, the Holocaust, and the Holodomor. This innovative study of memorial architecture investigates how design can translate memories of human loss into tangible structures, creating spaces for remembering. Using approaches from history, psychology, anthropology and sociology, Sabina Tanovic explores purposes behind creating contemporary memorials in a given location, their translation into architectural concepts, their materialisation in the face of social and political challenges, and their influence on the transmission of memory. This book is concerned with the commercial exploitation of armed conflict; it is about money, war, atrocities and economic actors, about the connections between them, and about responsibility. It aims to clarify the legal framework that defines these connections and gives rise to criminal or, in some instances, civil responsibility, referring both to mechanisms for international criminal justice, such as the International Criminal Court, and domestic systems. It considers which economic actors among individuals, businesses, governments and States should be held accountable and before which forum. Additionally, it addresses the question of how to recover illegally acquired profits and redirect them to benefit the victims of war. The chapters shine a critical light on the options provided by a network of laws to ensure that the 'great industrialists' of our time, who find economic opportunities in the war-ravaged lives of others, are unable to pursue those opportunities with impunity.
This important book considers whether the Special Court for Sierra Leone (SCSL), which was established jointly through an unprecedented bilateral treaty between the United Nations (UN) and Sierra Leone in 2002, has made jurisprudential contributions to the development of the nascent and still unsettled field of international criminal law. A leading authority on the application of international criminal justice in Africa, Charles Jalloh argues that the SCSL, as an innovative hybrid international penal tribunal, made useful jurisprudential additions on key legal questions concerning greatest responsibility jurisdiction, the war crime of child recruitment, forced marriage as a crime against humanity, amnesty, immunity and the relationship between truth commissions and criminal courts. The term "genocide"-"group killing"-which first appeared in Raphael Lemkin's 1944 book, Axis Rule in Occupied Europe, had by 1948 established itself in international law through the United Nations Convention on the Prevention and Punishment of the Crime of Genocide. Since then the charge of genocide has been both widely applied but also contested. In Genocide: The Act as Idea, Berel Lang examines and illuminates the concept of genocide, at once articulating difficulties in its definition and proposing solutions to them. In his analysis, Lang explores the relation of genocide to group identity, individual and corporate moral responsibility, the concept of individual and group intentions, and the concept of evil more generally. The idea of genocide, Lang argues, represents a notable advance in the history of political and ethical thought which proposed alternatives to it, like "crimes against humanity," fail to take into account.
When and how might the term genocide appropriately be ascribed to the experience of North American Indigenous nations under settler colonialism? Laurelyn Whitt and Alan W. Clarke contend that, if certain events which occurred during the colonization of North America were to take place today, they could be prosecuted as genocide. The legal methodology that the authors develop to establish this draws upon the definition of genocide as presented in the United Nations Genocide Convention and enhanced by subsequent decisions in international legal fora. Focusing on early British colonization, the authors apply this methodology to two historical cases: that of the Beothuk Nation from 1500-1830, and of the Powhatan Tsenacommacah from 1607-77. North American Genocides concludes with a critique of the Conventional account of genocide, suggesting how it might evolve beyond its limitations to embrace the role of cultural destruction in undermining the viability of human groups.

From the 1880s to the 1940s, an upsurge of explosive pogroms caused much pain and suffering across the eastern borderlands of Europe. When World War I began, Karnig Panian was only five years old, living among his fellow Armenians in the Anatolian village of Gurin. Four years later, American aid workers found him at an orphanage in Antoura, Lebanon. He was among nearly 1,000 Armenian and 400 Kurdish children who had been abandoned by the Turkish administrators, left to survive at the orphanage without adult care. This memoir offers the extraordinary story of what he endured in those years-as his people were deported from their Armenian community, as his family died in a refugee camp in the deserts of Syria, as he survived hunger and mistreatment in the orphanage. This book deals with literary representations of the genocide of the Tutsis in Rwanda. The focus is a transnational, polyphonic writing project entitled 'Rwanda: ecrire par devoir de memoire' (Rwanda: Writing by Duty of Memory), undertaken in 1998 by a group of nine African authors. This work emphasizes the Afropolitan cultural frame in which the texts were conceived and written. Instead of using Western and Eurocentric tropes, this volume looks at a so-called 'minority trauma': an African conflict situated in a collectivist society and written about by writers from African origin. This approach enables a more situated study, in which it becomes possible to draw out the local notions of ubuntu, oral testimonies, mourning traditions, healing and storytelling strategies, and the presence of the 'invisible'. As these texts are written in French and to date not all of them have been translated into English, most academic research has been done in French. This book thus assists in connecting English-speaking readers not only to a set of texts written in French with significant literary and cultural value, but also to francophone trauma studies research.
This book examines the 'war on terror' and radicalization from an ontological, non-state centric perspective. Since 9/11, criminology has developed in its study of terrorism, utilising alternative non-state centric frameworks to uncover and make visible state-initiated harm. Although progress has been achieved, criminology has continued to privilege the state, thereby failing to uncover forms of state crime and how such crimes facilitate radicalization and terrorism. Ahmed aims to rectify this gap by demonstrating how crimes of the state have contributed to the existence of Islamist-inspired terrorism and the emergence of global Jihadist organisations like Al-Qaeda and ISIS. The 'War on Terror' abandons the dominant socially-constructed discourse and application of the 'war on terror' and instead favours a grounded approach whereby actors, actions and consequences are analysed according to the risk they represent. Ahmed achieves this grounded approach through situating state practices in international human rights law and international humanitarian law. Through documenting the intersectionality of these practices with radicalization in the emergence of global Jihadist organisations, the book demonstrates how state crimes contribute to terrorism. Although the book sits at the intersections of critical criminology, state crime, international/transnational crime, it is relevant to all disciplines that are concerned with state crime, terrorism and radicalization.
Unlike the Holocaust, Rwanda, Cambodia, or Armenia, scant attention has been paid to the human tragedies analyzed in this book. From German Southwest Africa (now Namibia), Burundi, and eastern Congo to Tasmania, Tibet, and Kurdistan, from the mass killings of the Roms by the Nazis to the extermination of the Assyrians in Ottoman Turkey, the mind reels when confronted with the inhuman acts that have been consigned to oblivion. Forgotten Genocides: Oblivion, Denial, and Memory gathers eight essays about genocidal conflicts that are unremembered and, as a consequence, understudied. The contributors, scholars in political science, anthropology, history, and other fields, seek to restore these mass killings to the place they deserve in the public consciousness. Remembrance of long forgotten crimes is not the volume's only purpose-equally significant are the rich quarry of empirical data offered in each chapter, the theoretical insights provided, and the comparative perspectives suggested for the analysis of genocidal phenomena. While each genocide is unique in its circumstances and motives, the essays in this volume explain that deliberate concealment and manipulation of the facts by the perpetrators are more often the rule than the exception, and that memory often tends to distort the past and blame the victims while exonerating the killers. Although the cases discussed here are but a sample of a litany going back to biblical times, Forgotten Genocides offers an important examination of the diversity of contexts out of which repeatedly emerge the same hideous realities.
In the midst of the Second World War, the Allies acknowledged Germany's ongoing programme of extermination. In the Shadow of the Holocaust examines the struggle to attain post-war justice and prosecution. Focusing on Poland's engagement with the United Nations War Crimes Commission, it analyses the different ways that the Polish Government in Exile (based in London from 1940) agitated for an Allied response to German atrocities. Michael Fleming shows that jurists associated with the Government in Exile made significant contributions to legal debates on war crimes and, along with others, paid attention to German crimes against Jews. By exploring the relationship between the UNWCC and the Polish War Crimes Office under the authority of the Polish Government in Exile and later, from the summer of 1945, the Polish Government in Warsaw, Fleming provides a new lens through which to examine the early stages of the Cold War.
Established in Peru in 1570, the Holy Office of the Inquisition operated there until 1820, prosecuting, torturing, and sentencing alleged heretics. Ana Schaposchnik offers a deeply researched history of the Inquisition's tribunal in the capital city of Lima, with a focus on cases of crypto-Judaism-the secret adherence to Judaism while publicly professing Christianity. Delving into the records of the tribunal, Schaposchnik brings to light the experiences of individuals on both sides of the process. Some prisoners, she discovers, developed a limited degree of agency as they managed to stall trials or mitigate the most extreme punishments. Training her attention on the accusers, Schaposchnik uncovers the agendas of specific inquisitors in bringing the condemned from the dungeons to the 1639 Auto General de Fe ceremony of public penance and execution. Through this fine-grained study of the tribunal's participants, Schaposchnik finds that the Inquisition sought to discipline and shape culture not so much through frequency of trials or number of sentences as through the potency of individual examples.
